<legis-type>A BILL</legis-type> 
<official-title>To protect the second amendment rights of individuals to carry firearms and ammunition in units of the National Park System and the National Wildlife Refuge System and to require that hunting activities be a land use in all management plans for Federal land to the extent that such use is not clearly incompatible with the purposes for which the Federal land is managed.</official-title>

<section id="H588DB90320A34F2E8FA3CDA770217139" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting the Second Amendment and Hunting Rights on Federal Lands Act of 2008</short-title></quote>. </text> </section> 
<section id="HA01D3A15459341E28D12595BD360007F"><enum>2.</enum><header>Possessing or carrying firearms and ammunition in units of the National Park System and the National Wildlife Refuge System</header> 
<subsection id="H981EE3906403434EACBCA42428604D3"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds the following:</text> 
<paragraph id="HDED0D851F94145EFB719934113E128C"><enum>(1)</enum><text>The second amendment to the Constitution of the United States provides that <quote>the right of the people to keep and bear Arms, shall not be infringed</quote>.</text></paragraph> 
<paragraph id="H5B0B8F53DC004BFF99D3F75A3659B5F"><enum>(2)</enum><text>People in the United States use firearms over 2,000,000 times a year for self-defense.</text></paragraph> 
<paragraph id="HBA4D6B24E0D0453F91F1F648D98A000"><enum>(3)</enum><text>States that have enacted legislation expanding the rights of residents to use firearms for self-defense have witnessed a decrease in firearm-related crime.</text></paragraph> 
<paragraph id="H55893909761742D1009BCC340770183C"><enum>(4)</enum><text display-inline="yes-display-inline">As of the date of enactment of this Act, Federal regulations generally prohibit persons from possessing firearms in units of the National Park System and the National Wildlife Refuge System.</text> </paragraph> 
<paragraph id="HA2DBAC8975B84F23934B7C8E64D5FC2C"><enum>(5)</enum><text display-inline="yes-display-inline">The regulations described in paragraph (4) often prevent an individual complying with Federal and State laws from exercising such individual’s second amendment rights while in units of the National Park System or the National Wildlife Refuge System.</text></paragraph> 
<paragraph id="HEDD47781AD4A4D2DA3764567B9A9F1F1"><enum>(6)</enum><text>Laws relating to the transportation and possession of firearms in units of the National Park System and the National Wildlife Refuge System are often different than the laws of the State such units of the National Park System or the National Wildlife Refuge System are located in, entrapping otherwise law-abiding gun owners while in units of the National Park System and the National Wildlife Refuge System. </text></paragraph> 
<paragraph id="HBEE911A25BCF4844004094FCB75E8F72"><enum>(7)</enum><text>Federal law should clarify that the second amendment rights of an individual in a unit of the National Park System or the National Wildlife Refuge System will not be infringed.</text></paragraph></subsection> 
<subsection id="H963050B3F6F54E95BF297ED9BF545153"><enum>(b)</enum><header>Protecting the right of an individual To keep and bear firearms and ammunition in units of the national park system and the national wildlife refuge system</header><text display-inline="yes-display-inline">No Federal regulation shall restrict any individual from possessing or carrying a firearm or ammunition if that restriction is based in whole or in part upon the fact that the individual is in a unit of the National Park System or the National Wildlife Refuge System.</text> </subsection></section> 
<section id="H5D6ADCA03553471385B3FEEC39DB15E"><enum>3.</enum><header>Hunting on Federal Land</header> 
<subsection id="HEBF9B68B2ED744F6A7619697ADEFDC00"><enum>(a)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purpose of this section is to require that hunting activities be a land use in all management plans for Federal land to the extent that such use is not clearly incompatible with the purposes for which the Federal land is managed.</text></subsection> 
<subsection id="HC1FC53885E6049878F3EF7E7922D7DA3"><enum>(b)</enum><header>Hunting allowed unless incompatible</header><text display-inline="yes-display-inline">When developing or considering approval of a management plan (or any amendment to such a management plan) for any Federal land, the head of the agency with jurisdiction over such Federal land shall ensure that hunting activities are allowed as a use of such land to the extent that such use is not clearly incompatible with the purposes for which the Federal land is managed. </text></subsection> 
<subsection id="HCDEECD3B46A843EFB98D347824D715CE" commented="no"><enum>(c)</enum><header>Publication of reasons for not allowing hunting</header><text display-inline="yes-display-inline">If hunting activities are not allowed or are restricted on Federal land, the head of the agency with jurisdiction over such Federal land shall include in the management plan for that Federal land the specific reason that hunting activities are not allowed or are restricted. Allowing contract or quota thinning of wildlife shall not constitute allowing unrestricted hunting. For the purposes of this subsection, a fee charged by any entity related to hunting activities on Federal land under the jurisdiction of the Secretary that is in excess of that needed to recoup costs of management of the Federal land shall be deemed to be a restriction on hunting.</text></subsection> 
<subsection id="HACCD8593AE8E4CE79006AD4D60E91E00"><enum>(d)</enum><header>Fees</header><text display-inline="yes-display-inline">Fees charged related to hunting activities on Federal land shall be—</text> 
<paragraph id="HDA2A62B7C67348D2A80248DC9307AB7C"><enum>(1)</enum><text>retained by the head of the agency with jurisdiction over such Federal land to offset costs directly related to management of hunting on the Federal land upon which hunting activities related to the fee are conducted; and</text></paragraph> 
<paragraph id="HBD6E839CA2614C6889F3F615431CF667"><enum>(2)</enum><text display-inline="yes-display-inline">limited to what the Secretary reasonably estimates to be necessary to offset costs directly related to management of hunting on the Federal land upon which hunting activities related to the fee are conducted.</text></paragraph></subsection> 
<subsection id="H3E6704A841314CF6B87C62AB164D1D82"><enum>(e)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this Act:</text> 
<paragraph id="H9E2F418BDDEF4472855BD06CCF1CA44"><enum>(1)</enum><header>Hunting</header><text>The term <term>hunting</term> includes hunting, trapping, netting, and fishing. </text></paragraph> 
<paragraph id="H1C1C7DE92F734FD09B4D2528857DA6A8"><enum>(2)</enum><header>Management plan</header><text>The term <term>management plan</term> shall include a management plan, management contract, or other comprehensive plan for the management or use of Federal land.</text></paragraph></subsection> 
<subsection id="H616D8DE31DEA4261A49EEDB54FB2CE" commented="no"><enum>(f)</enum><header>Applicability</header><text>This section shall apply to all management plans developed, approved, or amended after the date of the enactment of this section.</text> </subsection></section>
