		<section commented="no" id="H08862FBF0B9740D3ADE101EC5BB4C270" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Consumer Product and Food Safety
			 Information Act of 2008</short-title></quote>.</text>
		</section><section id="HCBC0D4F6AB294FC78400F76FBCC70084"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to establish a
			 simple, centralized, and comprehensive public information process to notify
			 American consumers about product recalls.</text>
		</section><section id="H905EE5A6AA364237AF3C1E1C00006069"><enum>3.</enum><header>Improved Public
			 Notice of Product Recalls and Product Safety Information</header>
			<subsection id="HDBD74BB33CEC4804A3E69BF481764427"><enum>(a)</enum><header>Public
			 information initiative</header>
				<paragraph id="H172EE8543F2C44B8B950E5F612FB7700"><enum>(1)</enum><header>In
			 general</header><text>The head of each enforcement agency shall design and
			 implement a public information plan to use agency and media resources to
			 provide information to the public concerning—</text>
					<subparagraph id="H19B41C92FA254E42A85F77F8CEF217B5"><enum>(A)</enum><text>the role of the
			 agency in ensuring product safety;</text>
					</subparagraph><subparagraph id="H7E691BC3C5504402AA552982E8F832F5"><enum>(B)</enum><text>steps consumers
			 can take to enhance their safety while using products under the jurisdiction of
			 the agency;</text>
					</subparagraph><subparagraph id="H0D5A213907F74333BF7C03C28E5810DF"><enum>(C)</enum><text>information about
			 product recalls concerning products under the jurisdiction of the agency;
			 and</text>
					</subparagraph><subparagraph id="HBF3110895F314A40A3387700C322A54"><enum>(D)</enum><text>additional
			 information that the agency head determines will enhance consumer
			 safety.</text>
					</subparagraph></paragraph><paragraph id="HBCBEBCAE61C34E29B3CF475309775225"><enum>(2)</enum><header>Components of
			 initiative</header><text display-inline="yes-display-inline">The plan under
			 paragraph (1) shall include procedures for developing and distributing the
			 following materials:</text>
					<subparagraph id="HE0DE947989DD42E8BCB0FD35CFC447B2"><enum>(A)</enum><text>Public service
			 announcements under subsection (d).</text>
					</subparagraph><subparagraph id="H381471B716B24C41BAF6E8401DABDA44"><enum>(B)</enum><text>Quarterly reports
			 under subsection (e).</text>
					</subparagraph><subparagraph id="HC0BE76208DF64C20B0436D7E7C417901"><enum>(C)</enum><text>Posters and other
			 materials under subsection (f).</text>
					</subparagraph><subparagraph id="HD98B3C30B68A4B5E914F0050F8F7D896"><enum>(D)</enum><text>Other appropriate
			 mechanisms for communicating product safety information to the public.</text>
					</subparagraph></paragraph></subsection><subsection id="H73D2FD921844484C87A0EAB182F595A1"><enum>(b)</enum><header>Clearinghouse</header>
				<paragraph id="H0E9436ECA8E443A9B9412369ED005C68"><enum>(1)</enum><header>In
			 general</header><text>The Commission shall establish a clearinghouse to collect
			 and distribute product recall and product safety information.</text>
				</paragraph><paragraph id="HBD959E72D2544AF38CDD54B900BF8685"><enum>(2)</enum><header>Contribution of
			 information</header><text display-inline="yes-display-inline">Before the end of
			 the 30-day period beginning on the date the materials listed under subsection
			 (a)(2) are made available to the public by an enforcement agency, the head of
			 each enforcement agency shall provide electronic copies of the materials to the
			 Commission for inclusion in the clearinghouse.</text>
				</paragraph><paragraph id="H88F811F5A0C34D9C0077EB006D2651F7"><enum>(3)</enum><header>Availability to
			 the public</header>
					<subparagraph id="HFAA9831071D94F70A9819500F5D9E100"><enum>(A)</enum><header>Physical
			 Location</header><text>Before the end of the 30-day period beginning on the
			 date the Commission receives the materials under paragraph (2), the Commission
			 shall make the materials available in a central location that is open to the
			 public.</text>
					</subparagraph><subparagraph id="HC2786923BBBF4B3BA23446B300DA2728"><enum>(B)</enum><header>Web
			 site</header><text display-inline="yes-display-inline">Before the end of the
			 14-day period beginning on the date the Commission receives the materials under
			 paragraph (2), the Commission shall make the materials available on the Web
			 site established under subsection (c).</text>
					</subparagraph></paragraph><paragraph id="HBCED69D974C04D328ECC1FC6DB910963"><enum>(4)</enum><header>Distribution of
			 Materials</header>
					<subparagraph id="H2479D5FEB3444CBB8B7C285B249C8E71"><enum>(A)</enum><header>Distribution to
			 Government Entities</header>
						<clause id="HCF049D320507479197FE480000388773"><enum>(i)</enum><header>In
			 general</header><text>The Commission shall distribute the materials in the
			 clearinghouse to an entity listed in clause (ii) for distribution in accordance
			 with that clause, if the Commission determines that the materials are related
			 to the persons served by that entity.</text>
						</clause><clause id="H8E651B6BBD4448D1AD562DFC2DF3A0AA"><enum>(ii)</enum><header>Entities;
			 further distribution</header><text>The entities referred to in subparagraph (A)
			 are the following:</text>
							<subclause id="H8956AE9061F043398243E93EFE844255"><enum>(I)</enum><text display-inline="yes-display-inline">The Federal Citizen Information Center of
			 the General Services Administration.</text>
							</subclause><subclause display-inline="no-display-inline" id="H8FB20F7139504DEEBF9001C26D2E6293"><enum>(II)</enum><text display-inline="yes-display-inline">The Federal Trade Commission, which may
			 provide the materials to the public as appropriate.</text>
							</subclause><subclause id="H2638688CFD204312B2E8A6F20467DCBD"><enum>(III)</enum><text>The Department
			 of Education, which, as determined appropriate by the Secretary of Education,
			 may provide the materials—</text>
								<item id="H5B8117A54F884B7BB4BC58F8B8735C48"><enum>(aa)</enum><text>to
			 public schools; and</text>
								</item><item id="H48AB56A5E176440486E64C23B02731CA"><enum>(bb)</enum><text>to
			 the public through the Department of Education Web site.</text>
								</item></subclause><subclause id="H290D9791E24B4DD5ADCC60457DE28087"><enum>(IV)</enum><text>The Government
			 Printing Office, which, as determined appropriate by the Director of the
			 Government Printing Office, may distribute the materials to the Federal
			 depository libraries.</text>
							</subclause><subclause id="H5338BEAFE2004C09B6EE0451DC492311"><enum>(V)</enum><text>State and local
			 government officials, including the head of a State department of health or its
			 equivalent.</text>
							</subclause></clause></subparagraph><subparagraph id="H85CD94F78F0A41C1AC4BD6D1474995E4"><enum>(B)</enum><header>Distribution to
			 the Public</header><text display-inline="yes-display-inline">The Commission
			 shall make available to the public, upon request and without charge, copies
			 of—</text>
						<clause id="HD4C95C689A534C13B3EFF7446CCF0000"><enum>(i)</enum><text>the
			 quarterly reports under section (a)(2)(B); and</text>
						</clause><clause id="H79AA6A0060924212B3832200D8647D4"><enum>(ii)</enum><text>any
			 other materials collected for the clearinghouse that the Commission determines
			 is appropriate for direct distribution to members of the public.</text>
						</clause></subparagraph></paragraph><paragraph id="H04DA7A489411476AAEC1DC1A34F44DA"><enum>(5)</enum><header>Toll-Free
			 number</header>
					<subparagraph id="H4D9C2FE2A7E241819E547396D400FF65"><enum>(A)</enum><header>In
			 General</header><text>The Commission shall establish a toll-free telephone
			 number to—</text>
						<clause id="H10570A7125E14B3E9BEBF773AB4E7546"><enum>(i)</enum><text>provide
			 information about—</text>
							<subclause id="H5118083A037E43E8B8C2D509988827F"><enum>(I)</enum><text>product recalls and
			 product safety; and</text>
							</subclause><subclause id="H56F9433F176F4CE990E96800E2267DFC"><enum>(II)</enum><text>materials
			 available under paragraph (4)(B); and</text>
							</subclause></clause><clause id="H488C8E784A47421397E69037ABDFBFC"><enum>(ii)</enum><text>to
			 allow individuals to request such materials.</text>
						</clause></subparagraph><subparagraph id="H695CC8A6821D41E9949B1BA5E0AD38E3"><enum>(B)</enum><header>Accessibility</header><text>The
			 toll-free telephone number shall make information available—</text>
						<clause id="H4C6C07C109D841A2894F5B002EBAE58E"><enum>(i)</enum><text>to
			 the hearing impaired and the visually impaired; and</text>
						</clause><clause id="H75C76C3F60C04AF400033D4C211F36FA"><enum>(ii)</enum><text>in
			 English, Spanish, French, Japanese, Chinese, Vietnamese, Korean, and
			 Tagalog.</text>
						</clause></subparagraph><subparagraph id="H55BE6E1D49F64BAEA326C63BE00CA35"><enum>(C)</enum><header>Form of
			 Distribution</header><text display-inline="yes-display-inline">The Commission
			 shall distribute materials in an electronic form unless the Commission
			 determines that a hard copy is appropriate.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" id="H1D82293C898B4F48A87ED8E993375B17"><enum>(c)</enum><header>Comprehensive
			 Product Recall Web site</header>
				<paragraph commented="no" id="H3E22A3D173074117958600424F9EA28C"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Commission shall
			 establish a public Web site to provide information to the public about product
			 recalls.</text>
				</paragraph><paragraph commented="no" id="H58167DCE38FB4CD99DF8B363EBAB2"><enum>(2)</enum><header>Contents</header>
					<subparagraph commented="no" id="HB9AE99F374B44CE78B265F69E79258C9"><enum>(A)</enum><header>Required
			 Information</header><text>The Commission shall include on the Web site—</text>
						<clause id="HF18BF44A7BF44BBC9600848442C9511D"><enum>(i)</enum><text>information on
			 product recalls, including information on whether each product recall was
			 initiated by a Federal agency or by another entity;</text>
						</clause><clause id="H40E19A50386942149BB835F4574411EA"><enum>(ii)</enum><text>electronic
			 versions of the quarterly reports under subsection (e);</text>
						</clause><clause id="H1A31E7E365FD4BEFBE9397DC9D4765E7"><enum>(iii)</enum><text>access to other
			 information available in the clearinghouse established by the Commission under
			 subsection (b); and</text>
						</clause><clause id="H82FDDD5B729446538B8EFEBFD36D00B1"><enum>(iv)</enum><text>a
			 search function that allows users to use a single search to find product
			 recalls concerning products under the jurisdiction of multiple enforcement
			 agencies.</text>
						</clause></subparagraph><subparagraph commented="no" id="HDB805E18267A41CB8415ED9600B86539"><enum>(B)</enum><header>Optional
			 Information</header><text display-inline="yes-display-inline">The Commission
			 may include on the Web site—</text>
						<clause id="H2D1C1F2A1289430EB446338613C00C7"><enum>(i)</enum><text>additional
			 information concerning product recalls, including press releases and links to
			 other Web sites providing information about product recalls;</text>
						</clause><clause commented="no" id="H97C63E1F2C6F4DEFA36621303E204D00"><enum>(ii)</enum><text display-inline="yes-display-inline">information for consumers on product
			 licensing, certification, and labeling, including links to other Web sites
			 containing such information; and</text>
						</clause><clause id="HCC185B53C7A446D99FD62B89FC356D23"><enum>(iii)</enum><text>additional
			 information on product safety for consumers, including links to other Web sites
			 containing such information.</text>
						</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6EFC8279AD8C4F2D94B3434B31C535D1"><enum>(3)</enum><header>Deadline</header><text>The
			 Commission shall make the Web site available to the public not later than 30
			 days after the date of enactment of this Act.</text>
				</paragraph><paragraph commented="no" id="H98FC4819F46149DC0049C5BEE53B4933"><enum>(4)</enum><header>Updates</header><text>The
			 Commission shall update the information on the Web site before the end of the
			 14-day period beginning on the date that new information listed in paragraph
			 (2)(A) is submitted to the clearinghouse established under subsection
			 (b).</text>
				</paragraph><paragraph commented="no" id="H2CC4D095DF36414C87A27EC395CBC3"><enum>(5)</enum><header>Links</header><text>The
			 head of each enforcement agency, each relevant department, the Federal Trade
			 Commission, and the Department of Education shall prominently display a link to
			 the Web site established under paragraph (1) on the public Web site of such
			 agency or department, respectively.</text>
				</paragraph></subsection><subsection commented="no" id="H5999116151E046E1868777291208253B"><enum>(d)</enum><header>Public Service
			 Announcements</header>
				<paragraph commented="no" id="HD0AD30879E22422AA5A96700C50B02B"><enum>(1)</enum><header>In
			 General</header><text>The head of each enforcement agency shall issue national
			 public service announcements via newspaper, radio, television, and the Internet
			 that contain—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="HBFFC7B02E7CC41CFB600D354A9B22D8"><enum>(A)</enum><text>information
			 on—</text>
						<clause id="HD47C40D5FAC64114A449B80095A318C5"><enum>(i)</enum><text>the
			 role of the agency in product safety;</text>
						</clause><clause commented="no" id="H88FCD0F52F404A55A11E77F121EC1FC4"><enum>(ii)</enum><text>the types of
			 products regulated by the agency;</text>
						</clause><clause commented="no" id="HB0CBA698E75B4858AEE2F7B99B00CB05"><enum>(iii)</enum><text>the availability
			 and location of print, Internet, and other resources on recent product recalls,
			 including information on the Web site established under subsection (c);</text>
						</clause><clause commented="no" id="H0FB3A0D8457941C2A2FB22374805102"><enum>(iv)</enum><text>the role of the
			 consumer in—</text>
							<subclause id="H30CC1AE706E04964A38676F22E32EECC"><enum>(I)</enum><text>evaluating the
			 safety of a product prior to purchasing such product;</text>
							</subclause><subclause id="HCE23E0A01E2D45E79F9640B78855F170"><enum>(II)</enum><text>using a product
			 in a safe manner; and</text>
							</subclause><subclause id="H4650420265F2420B80EE8785FB8465A9"><enum>(III)</enum><text>participating in
			 a product recall;</text>
							</subclause></clause></subparagraph><subparagraph commented="no" id="H44A1A8C5350F4E6192B059D466028090"><enum>(B)</enum><text>contact
			 information for consumers seeking information about product safety; and</text>
					</subparagraph><subparagraph commented="no" id="H56009AD88AB346E9BE40E55697CE3166"><enum>(C)</enum><text>other information
			 that the head of the agency considers relevant to informing consumers about
			 product recalls and product safety.</text>
					</subparagraph></paragraph><paragraph id="H104B63B715D94A6F00C52F96ABE401F1"><enum>(2)</enum><header>Required
			 information for a public service announcement describing a
			 recall</header><text>If a public service announcement made under paragraph (1)
			 includes information about a specific product recall, that announcement must
			 state whether the product recall was initiated by a Federal agency or by a
			 private entity.</text>
				</paragraph><paragraph commented="no" id="H9935129017A3473F939FD1A2BC1FD922"><enum>(3)</enum><header>Frequency</header><text>The
			 head of each enforcement agency shall issue the announcements required under
			 paragraph (1) at least—</text>
					<subparagraph commented="no" id="H9FFD71AA5C1744B700E8EEA23EC44F1"><enum>(A)</enum><text display-inline="yes-display-inline">not later than the end of the 30-day period
			 beginning on the date of issuance by the agency of each quarterly report under
			 subsection (e); and</text>
					</subparagraph><subparagraph commented="no" id="HB2900C940EFA42A2828B6846FBE2E3B"><enum>(B)</enum><text display-inline="yes-display-inline">within—</text>
						<clause commented="no" id="H2BF2F3B4ACF94C3FAA9C81D8B3596F64"><enum>(i)</enum><text>the 7-day period
			 ending on each Federal holiday; and</text>
						</clause><clause commented="no" id="H1AEE99DCDE8A45D6A4116B30ECFD3604"><enum>(ii)</enum><text>the 7-day period
			 beginning on each Federal holiday.</text>
						</clause></subparagraph></paragraph></subsection><subsection commented="no" id="H8B74577A5B334EA2B721A0CAF3F107FA"><enum>(e)</enum><header>Quarterly
			 Report</header>
				<paragraph commented="no" id="HDE9D50E423DB4DB0A4667EAED8DF77CD"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than 30
			 days after the end of each fiscal year quarter, the head of each enforcement
			 agency shall issue in accordance with this subsection a report that lists all
			 products that—</text>
					<subparagraph commented="no" id="H66BD17A0CDF143C69F6B69057C9DBFD9"><enum>(A)</enum><text>were subject to a
			 product recall in the previous quarter; and</text>
					</subparagraph><subparagraph id="H77055549506A4BD09F81B3FFAD1E7FCD"><enum>(B)</enum><text>are within the
			 administrative jurisdiction of the agency.</text>
					</subparagraph></paragraph><paragraph commented="no" id="H4FBF3B3AF5BA4C3D99117723658466A6"><enum>(2)</enum><header>Contents</header>
					<subparagraph commented="no" id="H14CD85CE95104F1D88C1B683F89E5855"><enum>(A)</enum><header>General
			 Information</header><text>The report shall contain the address of the Web site
			 established under subsection (c).</text>
					</subparagraph><subparagraph commented="no" id="H67E1DC5A0E5441A889B869A716D08748"><enum>(B)</enum><header>Specific Product
			 Information</header><text>The report shall contain the following information
			 for each product listed in such report:</text>
						<clause commented="no" id="HB91B0E0280314E018625287F6BD673B2"><enum>(i)</enum><text>The product
			 name.</text>
						</clause><clause commented="no" id="H8FA2F7BDAC3D40F796CCACA55DF2EEDE"><enum>(ii)</enum><text>A photograph of
			 the product.</text>
						</clause><clause commented="no" id="HA0D6217797B948528F313F4CF50000CC"><enum>(iii)</enum><text>A clear and
			 concise description of the product.</text>
						</clause><clause commented="no" id="HA0EFFE7CC6024587A09F611CF4D66331"><enum>(iv)</enum><text>The reason for
			 the product recall.</text>
						</clause><clause id="HB7A3CE1ED81E4A77BAF91333C7C96300"><enum>(v)</enum><text>Whether the
			 product recall was initiated by a Federal agency or by a private entity.</text>
						</clause><clause commented="no" id="H53EE8BF41D574758006559D8761B242F"><enum>(vi)</enum><text>A description of
			 the steps a consumer should take to respond to the product recall,
			 including—</text>
							<subclause commented="no" id="H377BC2EF4D8E413084714DC65037D3A7"><enum>(I)</enum><text>returning the
			 product to the manufacturer;</text>
							</subclause><subclause commented="no" id="HD8337B088DD941D700E2B886994A531"><enum>(II)</enum><text>replacing a part;
			 or</text>
							</subclause><subclause commented="no" id="H844E5A5BB5BE4DFD8365588DCAD2A4C7"><enum>(III)</enum><text>other
			 appropriate action.</text>
							</subclause></clause><clause commented="no" id="H3F7A6FA6BC36428F8E13A1ACB7010047"><enum>(vii)</enum><text>The contact
			 information for the manufacturer, including the manufacturer’s—</text>
							<subclause commented="no" id="H10FC08AFAF344FEB9976E8E8A538B89D"><enum>(I)</enum><text>name;</text>
							</subclause><subclause commented="no" id="H3F7D47EE24EE4B889C5CD77D3D000050"><enum>(II)</enum><text>postal
			 address;</text>
							</subclause><subclause commented="no" id="HC5F32D60F7964AA4A4FABC70D3E21968"><enum>(III)</enum><text>telephone
			 number, including any telephone number dedicated to the product recall;
			 and</text>
							</subclause><subclause commented="no" id="HE7D452DE27154991925679557D3FA6E0"><enum>(IV)</enum><text>Web site,
			 including any Web site dedicated to the product recall.</text>
							</subclause></clause><clause commented="no" id="H82EB9ED42D7D4DB3ADD6C6FDA18500E1"><enum>(viii)</enum><text display-inline="yes-display-inline">The contact information for the
			 distributor, including the distributor’s—</text>
							<subclause commented="no" id="H0A74D01029594E8B82C9281E1D8DE63D"><enum>(I)</enum><text display-inline="yes-display-inline">name;</text>
							</subclause><subclause commented="no" id="H5253B85D1DC94F34994BB66F319453EC"><enum>(II)</enum><text display-inline="yes-display-inline">postal address;</text>
							</subclause><subclause commented="no" id="HDB4F7092281947CAACB9A2F5A78B509C"><enum>(III)</enum><text display-inline="yes-display-inline">telephone number, including any telephone
			 number dedicated to the product recall; and</text>
							</subclause><subclause commented="no" id="H82271F8F074D4E769061F66FDFCCEAF6"><enum>(IV)</enum><text display-inline="yes-display-inline">Web site, including any Web site dedicated
			 to the product recall.</text>
							</subclause></clause><clause commented="no" id="H46573E281040477E94C20061ECD4E0C2"><enum>(ix)</enum><text>The date that the
			 product first became available to consumers in the United States.</text>
						</clause><clause commented="no" id="HF916B6ED449B4A6B807F846105F8D729"><enum>(x)</enum><text>The date that the
			 product recall was issued.</text>
						</clause><clause commented="no" id="H1A5263324A8E40DFBCA02CDEB39EF329"><enum>(xi)</enum><text>The location of
			 additional information about the product recall, including—</text>
							<subclause commented="no" id="HD8457CBFF6854C47BB314FD4430234BD"><enum>(I)</enum><text>the telephone
			 number of each hotline dedicated to the product recall that was established by
			 the enforcement agency, the manufacturer, or a third party; and</text>
							</subclause><subclause commented="no" id="HC82FC863201A4E55857497EB79B98E95"><enum>(II)</enum><text display-inline="yes-display-inline">the address of each Web site providing
			 information concerning the product recall that was established by the agency,
			 the manufacturer, or a third party.</text>
							</subclause></clause></subparagraph></paragraph><paragraph commented="no" id="H9F4806E389E244F39E80AD5C93C5223B"><enum>(3)</enum><header>Distribution</header>
					<subparagraph commented="no" id="H351A06DC844F4B2985DBAF809077B752"><enum>(A)</enum><header>Online
			 availability</header><text>The head of each enforcement agency shall make each
			 quarterly report it issues under this subsection available on the Web site of
			 such agency. If a department has jurisdiction over such agency, the head of the
			 department shall include a link to such report on the public Web site of that
			 department.</text>
					</subparagraph><subparagraph commented="no" id="H1AA8D1A2C38B4DE199213E299CF68BFE"><enum>(B)</enum><header>Congress</header><text>The
			 head of the enforcement agency shall submit each quarterly report to
			 Congress.</text>
					</subparagraph></paragraph><paragraph id="H9DE117CF86074EB39D10D8C600776DA7"><enum>(4)</enum><header>Notice</header>
					<subparagraph commented="no" id="HB15173BA166A45A9B26284DB43F2C69"><enum>(A)</enum><header>Press
			 Release</header><text display-inline="yes-display-inline">Not later than the
			 end of the 30-day period beginning on the date of issuance of the quarterly
			 report under paragraph (1), the head of each enforcement agency shall issue a
			 press release. Such press release shall announce the availability of such
			 report, including information on where members of the public can access the
			 report.</text>
					</subparagraph><subparagraph id="HF08BCAEBC79E4F7C8C89E258F72B020"><enum>(B)</enum><header>Federal
			 Register</header><text>Not later than the end of the 30-day period beginning on
			 the date of issuance of the quarterly report under paragraph (1), the head of
			 the enforcement agency shall publish in the Federal Register a notice of the
			 availability of the quarterly report.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" id="H658F5BE8ADD14606821F2EBEDE3C0124"><enum>(f)</enum><header>Posters and
			 other Materials in Public Places</header>
				<paragraph id="H92238AEB9D1B4C70907DBB00A5EDB2EC"><enum>(1)</enum><header>Posters
			 Describing Significant Product Recalls</header>
					<subparagraph id="H12CBAFEBB32C4FB28EAF390031F27D17"><enum>(A)</enum><header>In
			 general</header><text>If a significant product recall of a product under the
			 jurisdiction of an enforcement agency occurs, the head of such agency shall
			 print and distribute a poster containing information describing such
			 recall.</text>
					</subparagraph><subparagraph id="HC58939F513494C85885FDA6CD377053C"><enum>(B)</enum><header>Contents</header><text>The
			 poster shall include—</text>
						<clause id="H9886DEE52F1648F7BE4B231F1602DC16"><enum>(i)</enum><text>information on
			 whether the product recall was initiated by a Federal agency or by a private
			 entity; and</text>
						</clause><clause id="HC0A9F9793C12450C89B93242DD3DC37"><enum>(ii)</enum><text>information on how
			 to find additional information about product recalls.</text>
						</clause></subparagraph><subparagraph id="H475B144D329249268461C0011643AFFB"><enum>(C)</enum><header>Distribution</header><text display-inline="yes-display-inline">The posters under subparagraph (A) shall be
			 distributed to businesses and other members of the public upon request, at no
			 charge.</text>
					</subparagraph><subparagraph id="H270871F17D5E4FF782C8C3D1521C4B00"><enum>(D)</enum><header>Deadline</header><text>The
			 head of the enforcement agency shall print and distribute the poster under
			 subparagraph (A) before the end of the 30-day period beginning on the date the
			 product recall was issued.</text>
					</subparagraph></paragraph><paragraph id="HE9098A0B62EA4660BDA96F3C743491DF"><enum>(2)</enum><header>Posters
			 Describing Agency Role in product Safety</header>
					<subparagraph id="HAAE98B101B174B08834C00B4A8CD23B0"><enum>(A)</enum><header>In
			 general</header><text>The head of each enforcement agency shall—</text>
						<clause id="H1D027E2A68CF4B7482DEA93803929227"><enum>(i)</enum><text display-inline="yes-display-inline">before the end of the 30-day period
			 beginning on the date of enactment of this Act, issue posters and other printed
			 materials that provide information on the role of the agency in product recalls
			 and product safety; and</text>
						</clause><clause id="HBA01F54C330246458FA552BF144BEB00"><enum>(ii)</enum><text>revise such
			 materials as appropriate.</text>
						</clause></subparagraph><subparagraph id="HEFE8CF14E4344F29B4AF007E62D804C7"><enum>(B)</enum><header>Distribution</header><text display-inline="yes-display-inline">The posters and other materials issued
			 under subparagraph (A) shall be distributed to businesses and other members of
			 the public upon request, at no charge.</text>
					</subparagraph></paragraph></subsection><subsection id="H892C3D660B094FEB0077C862ECB7966"><enum>(g)</enum><header>Notice of Private
			 Product Recalls</header><text display-inline="yes-display-inline">Any
			 manufacturer or distributor of a product who voluntarily initiates a product
			 recall for that product as a result of safety concerns shall provide notice of
			 such recall to the enforcement agency with the authority to regulate the safety
			 of that product, before the end of the 10-day period beginning on the date that
			 the manufacturer issues the product recall.</text>
			</subsection><subsection commented="no" id="H90488E67723248B79B85B4BB10308853"><enum>(h)</enum><header>Report to
			 Congress</header><text display-inline="yes-display-inline">Not later than the
			 end of the 30-day period beginning on the date of enactment of this Act, the
			 head of each enforcement agency shall submit a report to Congress containing
			 information on—</text>
				<paragraph commented="no" id="H233FA8B6A05D4344004C43D1A394B759"><enum>(1)</enum><text>the method by
			 which information on product recalls is collected and is retained by the
			 agency;</text>
				</paragraph><paragraph commented="no" id="H092DDF19D9954F5BB43CBBCA856006B"><enum>(2)</enum><text>a list of all
			 product recalls concerning products under the jurisdiction of the agency during
			 the 1-year period preceding the enactment of this section;</text>
				</paragraph><paragraph commented="no" id="HC65129EF138F44A4B57C993E0671098D"><enum>(3)</enum><text>the current
			 practices of the agency for distributing information about product recalls to
			 the public, including practices for providing information about the product
			 recall—</text>
					<subparagraph commented="no" id="H18E51B3A9E4F4C9300D6507460B44E94"><enum>(A)</enum><text>on the
			 Internet;</text>
					</subparagraph><subparagraph commented="no" id="HAA08BC52C0044CE3AD2DA841A615B813"><enum>(B)</enum><text>to the press;
			 and</text>
					</subparagraph><subparagraph commented="no" id="H2F75C8D37E41482291898FE9FA9F04C0"><enum>(C)</enum><text>to public
			 libraries;</text>
					</subparagraph></paragraph><paragraph commented="no" id="H8F1C6FF9ED8E4F9C869DE487C22287ED"><enum>(4)</enum><text>the progress that
			 the agency has made in developing the public information plan required under
			 subsection (a); and</text>
				</paragraph><paragraph commented="no" id="H5D3CBD74D4624DE789856F009DBEA4AA"><enum>(5)</enum><text>a budget analysis
			 detailing how the agency will use the amounts appropriated to it for purposes
			 of this section.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HA86E95D9D330419493533C4E6975FB8C"><enum>(i)</enum><header>Authorization of
			 appropriations</header><text display-inline="yes-display-inline">There are
			 authorized to be appropriated to carry out this section, in addition to any
			 other amounts otherwise authorized to be appropriated to provide the public
			 with information about product recalls and product safety—</text>
				<paragraph commented="no" id="HAE89DDE51E16481B00C0FCDB4BCB4FF7"><enum>(1)</enum><text display-inline="yes-display-inline">to the Commission, $5,000,000 for fiscal
			 year 2009 and $2,000,000 for each fiscal year thereafter; and</text>
				</paragraph><paragraph commented="no" id="HA04548FA4E85472DA500FC864DCB73CA"><enum>(2)</enum><text>to the head of
			 each enforcement agency, other than the Commission, $1,000,000 for fiscal year
			 2009 and each fiscal year thereafter.</text>
				</paragraph></subsection><subsection id="H247663FAA8BD4AA5B19909B07ED74770"><enum>(j)</enum><header>Application of
			 Deadlines</header><text>Each deadline established in this section for action by
			 an enforcement agency or a manufacturer or distributor of a product applies
			 only to the extent that the enforcement agency, manufacturer, or distributor
			 can comply with the deadline and reasonably fulfil its obligations under other
			 Federal statutes.</text>
			</subsection><subsection id="H8D8BB16BC5F748389C69BF669E746E"><enum>(k)</enum><header>Definitions</header><text>For
			 purposes of this section, the following definitions apply:</text>
				<paragraph id="H3C641AADD106435EA885F4BF4BAD756B"><enum>(1)</enum><header>Commission</header><text display-inline="yes-display-inline">The term <term>Commission</term> means the
			 Consumer Product Safety Commission.</text>
				</paragraph><paragraph id="HE84196A180864DFF858DD8FA248555CB"><enum>(2)</enum><header>Consumer</header><text display-inline="yes-display-inline">The term <term>consumer</term> means, with
			 respect to a product, an individual who uses the product primarily for personal
			 purposes.</text>
				</paragraph><paragraph id="H16BFB966B7364F9E8BB94CC1AD1150D8"><enum>(3)</enum><header>Enforcement
			 agency</header><text>The term <term>enforcement agency</term> means any Federal
			 agency, including any independent agency and any independent regulatory agency,
			 having authority granted by Federal statute to regulate product safety.</text>
				</paragraph><paragraph id="HC6ACCA90194B40CF83AB16D89EF8591D"><enum>(4)</enum><header>Product</header><text display-inline="yes-display-inline">The term <term>product</term> means any
			 article, or component part thereof, including food, produced or
			 distributed—</text>
					<subparagraph id="H8F8ABA19A16043678EF0EC53E92B009C"><enum>(A)</enum><text>for sale to a
			 consumer for use in or around a permanent or temporary household or residence,
			 a school, in recreation, or otherwise; or</text>
					</subparagraph><subparagraph id="H92D409DF51F34BCC8F04235E928B6FD2"><enum>(B)</enum><text>for the personal
			 use, consumption, or enjoyment of a consumer in or around a permanent or
			 temporary household or residence, a school, in recreation, or otherwise.</text>
					</subparagraph></paragraph><paragraph id="H105BDFCA51014BA9A671365E85C200C9"><enum>(5)</enum><header>Product
			 Recall</header><text display-inline="yes-display-inline">The term <term>product
			 recall</term>—</text>
					<subparagraph id="H965D7A41A5904D4484659FDF0178B947"><enum>(A)</enum><text>means a recall of
			 a product issued to protect the safety of consumers; and</text>
					</subparagraph><subparagraph id="H60DBE38A915D48C48E08A84197898E4D"><enum>(B)</enum><text display-inline="yes-display-inline">includes—</text>
						<clause id="H6E28FC7337B446E59E00698661F28F3E"><enum>(i)</enum><text display-inline="yes-display-inline">a corrective action related to a consumer
			 product subject to an order under section 12 or 15 of the Consumer Product
			 Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2061">15 U.S.C. 2061</external-xref>, 2064);</text>
						</clause><clause id="H524C658351FB48FE960019228E81D2DB"><enum>(ii)</enum><text>the
			 designation of a product as a banned hazardous substance under the Federal
			 Hazardous Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1261">15 U.S.C. 1261 et seq.</external-xref>);</text>
						</clause><clause id="H3E7B242C20B14A2EA51398709343D7DC"><enum>(iii)</enum><text>a
			 voluntary corrective action related to a consumer product taken by the
			 manufacturer, in consultation with the Commission, of which action the
			 Commission has notified the public and that would have been subject to a
			 mandatory corrective action under the Consumer Product Safety Act (15 U.S.C.
			 2051 et seq.) or another Act enforced by the Commission if voluntary action had
			 not been taken by the manufacturer; and</text>
						</clause><clause id="HEA3884659EBC47B4BA9CE7A011AFEEA"><enum>(iv)</enum><text display-inline="yes-display-inline">a corrective action related to any motor
			 vehicle or replacement equipment that contains a defect related to motor
			 vehicle safety or that does not comply with applicable motor vehicle safety
			 standards and is subject to a notification order under section 30118(b) of
			 title 49, United States Code, or a remedy under section 30120 of such
			 title.</text>
						</clause></subparagraph></paragraph><paragraph id="H6CF92D72DD7E4CE59F6215E288A6002D"><enum>(6)</enum><header>Relevant
			 department</header><text>The term <term>relevant department</term> means any
			 executive department that includes an enforcement agency.</text>
