<official-title>To amend the Fair Credit Reporting Act to prohibit certain discriminatory uses of consumer reports and consumer information in connection with certain personal lines of insurance, and for other purposes.</official-title>

<section id="H2D358A50E9A94B1F98806BE21B78288F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Nondiscriminatory Use of Consumer Reports and Consumer Information Act of 2008</short-title></quote>.</text></section> 
<section id="HE73703B678204CBAA93DB304AD4457D" display-inline="no-display-inline"><enum>2.</enum><header>Use of consumer reports and consumer information in a discriminatory manner prohibited</header> 
<subsection id="HEE14CE2111104197BF852498004505FC"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 604 of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681b">15 U.S.C. 1681b</external-xref>) is amended—</text> 
<paragraph id="HE217A58A669A484400FF63B291864625"><enum>(1)</enum><text>in subsection (a), by striking <quote>Subject to subsection (c)</quote> and inserting <quote>Subject to subsections (c) and (h)</quote>; and</text></paragraph> 
<paragraph id="HA7D18E60D56743EB83513594F1006C4D"><enum>(2)</enum><text>in subsection (c)(1), by striking <quote>A consumer reporting agency</quote> and inserting <quote>Subject to subsection (h), a consumer reporting agency</quote>.</text></paragraph></subsection> 
<subsection id="H2E0B91B71F48448CB36F92CC8738AA3B"><enum>(b)</enum><header>Prohibition on certain discriminatory uses of consumer reports and consumer information in connection with insurance</header><text>Section 604 of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681b">15 U.S.C. 1681b</external-xref>) is amended by adding at the end the following new subsection:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="H6A22F8DBADD348FCA39D7B3072E75DE7"> 
<subsection id="H5D69813E2C6C4B89B6C2C59846660050"><enum>(h)</enum><header>Prohibition on certain discriminatory uses of consumer reports and consumer information in connection with insurance</header> 
<paragraph id="H0B054C8208854738AB11E90591F46FFF"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">No consumer reporting agency may furnish a consumer report or consumer information with respect to any consumer to any person for use in making any decision to underwrite or rate any personal lines of insurance, and no person shall use or obtain a consumer report or consumer information with respect to any consumer in connection with the underwriting or rating of any personal line of insurance, for which the Commission determines, including any finding or determination made in any study for which a report is submitted to the Congress, that any such use of the consumer report or the consumer information—</text> 
<subparagraph id="HAEF1DDF0ACDD47A58EFCF332B3E99C06"><enum>(A)</enum><text>results in racial or ethnic discrimination; or</text></subparagraph> 
<subparagraph id="H3148CE976E5E46A8AF3B26BB0320F11"><enum>(B)</enum><text display-inline="yes-display-inline">represents a proxy or proxy effect for race or ethnicity.</text></subparagraph></paragraph> 
<paragraph id="H10823B979B444A420023C232B27EB9DD"><enum>(2)</enum><header>Insurance information not included</header><text display-inline="yes-display-inline">Information derived from the following data bases shall not be treated as a consumer report or consumer information for purposes of paragraph (1):</text> 
<subparagraph id="HD6C21886FD6B4F6300E72D00631B96E"><enum>(A)</enum><text display-inline="yes-display-inline">Databases that contain information on property loss data regarding personal lines of insurance, such as the Comprehensive Loss Underwriting Exchange (CLUE) and Automobile-Property Loss Underwriting System (A–PLUS).</text></subparagraph> 
<subparagraph id="H3059D35B244E4D60A074D2CD4028A8E7"><enum>(B)</enum><text display-inline="yes-display-inline">Databases that contain information on driver history, such as accidents or moving violations, typically maintained at State departments of motor vehicles.</text></subparagraph> 
<subparagraph id="H81E8546620904E0B9130A165A45986D4"><enum>(C)</enum><text display-inline="yes-display-inline">Databases that contain information on a consumer’s medical history, to the extent such access and use for purposes described in paragraph (1) is consistent with the requirements of section 604(g).</text></subparagraph></paragraph> 
<paragraph id="H88C33F769FB6464386F5F725821B8D7"><enum>(3)</enum><header>Effect on state laws</header><text display-inline="yes-display-inline">Notwithstanding section 625(b)(3)(C), no provision of this section shall be construed as limiting or superseding the application of any State laws or regulations that restrict or prohibit the use of consumer reports or consumer information in the underwriting or rating of any personal lines of insurance.</text> </paragraph> 
<paragraph id="H78EC9FACAD504384868B903D7D5FC28D"><enum>(4)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this subsection, the following definitions shall apply:</text> 
<subparagraph id="H29F0F6E661D04F84877E28086EA80238"><enum>(A)</enum><header>Consumer information</header><text display-inline="yes-display-inline">The term <quote>consumer information</quote> means any information from the file on any consumer at a consumer reporting agency, or any product derived from any such information.</text> </subparagraph> 
<subparagraph id="HA2EDEBF8B064401B913BFA46B76317D2"><enum>(B)</enum><header>Personal line of insurance</header><text display-inline="yes-display-inline">The term <quote>personal line of insurance</quote> means any personal automobile or homeowners line of insurance, as defined in the Uniform Property and Casualty Product Coding Matrix established and maintained by the National Association of Insurance Commissioners (or any successor to such document).</text></subparagraph> 
<subparagraph id="HB6E2CFAE7BA048A78C6C35D9B23264EA"><enum>(C)</enum><header>Proxy for race or ethnicity</header><text display-inline="yes-display-inline">The term <quote>proxy for race or ethnicity</quote> means a substitute or stand-in for race or ethnicity, either by design or in effect, without regard to the extent of the effect.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection></section>
