		<section id="H20A7442AE0114A57AED3C0C6C047C1D7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>National Sea Grant College Program
			 Amendments Act of 2008</short-title></quote>.</text>
		</section><section id="HA34894405CA542908D776E81E6013408"><enum>2.</enum><header>References</header><text display-inline="no-display-inline">Except as otherwise expressly provided
			 therein, whenever in this Act an amendment or repeal is expressed in terms of
			 an amendment to, or repeal of, a section or other provision, the reference
			 shall be considered to be made to a section or other provision of the National
			 Sea Grant College Program Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1121">33 U.S.C. 1121 et seq.</external-xref>).</text>
		</section><section id="H97AA0CC381C944B39B25A398318432B"><enum>3.</enum><header>Findings and
			 purpose</header>
			<subsection id="H1125AEBCD07546FD8EE759A6DCA9D9C0"><enum>(a)</enum><header>Findings</header><text>Section
			 202(a) (<external-xref legal-doc="usc" parsable-cite="usc/33/1121">33 U.S.C. 1121(a)</external-xref>) is amended—</text>
				<paragraph id="H3B89ADC23910426FB73433D8B6698693"><enum>(1)</enum><text>by amending
			 paragraph (1)(D) to read as follows:</text>
					<quoted-block id="H43F58C2875A34B4A873246752301D98D" style="OLC">
						<subparagraph id="H3907B5E738AB4F60959EAE78CF46009F"><enum>(D)</enum><text>encourage the
				development of preparation, forecast, analysis, mitigation, response, and
				recovery systems for coastal
				hazards;</text>
						</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HDB14BE47C4B94521B796B1E811A49D04"><enum>(2)</enum><text>in paragraph (2)
			 by striking <quote>program of research, education,</quote> and inserting
			 <quote>program of integrated research, education, extension, </quote>;
			 and</text>
				</paragraph><paragraph id="H7A6F53950B224D4FB526166B38DE33EE"><enum>(3)</enum><text>by striking
			 paragraph (6) and inserting the following:</text>
					<quoted-block id="HFB7A2648CF354BD5A535E26B9EDA1BE0" style="OLC">
						<paragraph id="H2FE9D5A75C4043A99C179FC8AC009427"><enum>(6)</enum><text>The National Ocean
				Research Priorities Plan and Implementation Strategy issued by the National
				Science and Technology Council’s Joint Subcommittee on Ocean Science and
				Technology on January 26, 2007, identifies research priorities for compelling
				areas of interaction between society and the ocean, and calls for the
				engagement of a broad array of ocean science sectors (government, academia,
				industry, and non-government entities) to address the areas of greatest
				research need and opportunity.</text>
						</paragraph><paragraph id="HBDBD0FC38A2E44009FAE674E5BA42481"><enum>(7)</enum><text>The National
				Oceanic and Atmospheric Administration, through the national sea grant college
				program, offers the most suitable locus and means for such commitment and
				engagement through the promotion of activities that will result in greater such
				understanding, assessment, development, utilization, and conservation. The most
				cost-effective way to promote such activities is through continued and
				increased Federal support of the establishment, development, and operation of
				programs and projects by sea grant colleges, sea grant institutes, and other
				institutions, including strong collaborations between Administration scientists
				and research and outreach personnel at academic
				institutions.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H0E420E0CE33B4C87BAD1F4A3CC002319"><enum>(b)</enum><header>Purpose</header><text>Section
			 202(c) (<external-xref legal-doc="usc" parsable-cite="usc/33/1121">33 U.S.C. 1121(c)</external-xref>) is amended by striking <quote>to promote research,
			 education, training, and advisory service activities</quote> and inserting
			 <quote>to promote integrated research, education, training, and extension
			 activities</quote>.</text>
			</subsection></section><section id="HCAA932FD23B1484B85D657C373BAA653"><enum>4.</enum><header>Definitions</header>
			<subsection id="H23C610A100174A988B1EEA44B210F75D"><enum>(a)</enum><header>Amendments</header><text display-inline="yes-display-inline">Section 203 (<external-xref legal-doc="usc" parsable-cite="usc/33/1122">33 U.S.C. 1122</external-xref>) is
			 amended—</text>
				<paragraph id="H0294DC90FA0E42D1BBE13C4BE4111568"><enum>(1)</enum><text>in paragraph (11)
			 by striking <quote>advisory services</quote> and inserting <quote>extension
			 services</quote>;</text>
				</paragraph><paragraph commented="no" id="HD3F3ECC504E34357B7C625EC00D9E85E"><enum>(2)</enum><text>in each of
			 paragraphs (12) and (13) by striking <quote>(<external-xref legal-doc="usc" parsable-cite="usc/33/1126">33 U.S.C. 1126</external-xref>)</quote>;
			 and</text>
				</paragraph><paragraph id="H8A43B1DE200547AD99EB488CED32FC00"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block id="H01DD79E098F24C908FFDB1566FCD300" style="OLC">
						<paragraph id="H19505711D89C487F9FB17D5C00A5E937"><enum>(17)</enum><text>The term
				<quote>regional research and information plan</quote> means a plan developed by
				one or more sea grant colleges or sea grant institutes that identifies regional
				priorities to implement the National Ocean Research Priorities Plan and
				Implementation Strategy.</text>
						</paragraph><paragraph commented="no" id="HBC8EB46F26774892A5F720B4006241F"><enum>(18)</enum><text>The term
				<quote>National Ocean Research Priorities Plan and Implementation
				Strategy</quote> means such plan and strategy issued by the National Science
				and Technology Council’s Joint Subcommittee on Ocean Science and Technology on
				January 26,
				2007.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H62A03E331D14401A80AA1E167785FF64"><enum>(b)</enum><header>Repeal</header><text display-inline="yes-display-inline">Section 307 of the Flower Garden National
			 Marine Sanctuary Act (<external-xref legal-doc="public-law" parsable-cite="pl/102/251">Public Law 102–251</external-xref>; 106 Stat. 66) is repealed.</text>
			</subsection></section><section id="H681A6687FD8946ED81E1239E66CC3F6B"><enum>5.</enum><header>National sea
			 grant college program, generally</header>
			<subsection id="H867E8BECA70845D4A78928F619D0BD1B"><enum>(a)</enum><header>Program
			 elements</header><text>Section 204(b) (<external-xref legal-doc="usc" parsable-cite="usc/33/1123">33 U.S.C. 1123(b)</external-xref>) is amended—</text>
				<paragraph id="HA71E488CEE4341D5BDB53664E9006FF2"><enum>(1)</enum><text>by amending in
			 paragraph (1) to read as follows:</text>
					<quoted-block id="H07B021179DA444FEBC00E88FDD00B7F4" style="OLC">
						<paragraph id="H35B4793F72664EE588968F288050B961"><enum>(1)</enum><text>sea grant programs
				that comprise a national sea grant college program network, including
				international projects conducted within such programs and regional and national
				projects conducted among such programs;</text>
						</paragraph><after-quoted-block>;
				</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H3C561E5B01594B01B22566E78EDCB558"><enum>(2)</enum><text>by amending
			 paragraph (2) to read as follows:</text>

						<paragraph id="H85A2079A1C55478E95174296CC528DD7"><enum>(2)</enum><text>administration of
				the national sea grant college program and this title by the national sea grant
				office and the Administration;</text>

				</paragraph><paragraph id="H5A2ECFF89E1F484797906B5985F57579"><enum>(3)</enum><text>by amending
			 paragraph (4) to read as follows:</text>

						<paragraph id="H052C2562DD394829A521E9AE87219E00"><enum>(4)</enum><text>any regional or
				national strategic investments in fields relating to ocean, coastal, and Great
				Lakes resources developed in consultation with the board and with the approval
				of the sea grant colleges and the sea grant
				institutes.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H5C7C9886DFDE409CAE68A87384B83962"><enum>(b)</enum><header>Technical
			 correction</header><text>Section 204(c)(1) (<external-xref legal-doc="usc" parsable-cite="usc/33/1123">33 U.S.C. 1123(c)(1)</external-xref>) is amended by
			 striking <quote>Within 6 months of the date of enactment of the National Sea
			 Grant College Program Reauthorization Act of 1998, the</quote> and inserting
			 <quote>The</quote>.</text>
			</subsection><subsection id="H4D5CBBEE7979449882FEDD4C15A7F332"><enum>(c)</enum><header>Functions of
			 Director of National Sea Grant College Program</header><text>Section 204(d) (33
			 U.S.C. 1123(d)) is amended—</text>
				<paragraph id="H4BEAEDA63F4547D2A96782133539A7A3"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (2)(A), by striking
			 <quote>long range</quote>;</text>
				</paragraph><paragraph id="H588DBA86F4674AB0AC54DDEB1CE224"><enum>(2)</enum><text>in
			 paragraph (3)(A)—</text>
					<subparagraph id="H18C97284641A47668416F600604827B3"><enum>(A)</enum><text>by striking
			 <quote>(A)(i) evaluate</quote> and inserting <quote>(A) evaluate and

			 clauses (ii) through (iv) as clauses (iii) through (v), respectively, and by
			 inserting after clause (i) the following:</text>

			 striking <quote>encourage</quote> and inserting <quote>ensuring</quote>.</text>
					</subparagraph></paragraph></subsection></section><section id="HC7882B2DA235462E9E45161CFAB392AC"><enum>6.</enum><header>Program or
			 project grants and contracts</header>
			<subsection id="HD26FBA6FAA274D70001454623D92A79"><enum>(a)</enum><header>Exemption from
			 limitation on cost share</header><text>Section 205(a) (<external-xref legal-doc="usc" parsable-cite="usc/33/1124">33 U.S.C. 1124(a)</external-xref>) is
			 amended in the matter following paragraph (2), by striking <quote>section
			 204(c)(4)(F)</quote> and inserting <quote>section 204(d) or that are
			 appropriated under section 208(b)</quote>.</text>
			</subsection><subsection id="H9E54CCD30E174814BE86B384A07D2BB"><enum>(b)</enum><header>Special grants;
			 maximum amount</header><text>Section 205(b) (<external-xref legal-doc="usc" parsable-cite="usc/33/1124">33 U.S.C. 1124(b)</external-xref>) is amended by
			 striking the matter following paragraph (3) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="H135933A4CF654D1C9D77E7122444C816" style="OLC">
					<quoted-block-continuation-text quoted-block-continuation-text-level="subsection">The total
				amount that may be provided for grants under this subsection during any fiscal
				year shall not exceed an amount equal to 5 percent of the total funds
				appropriated for such year under section

			</subsection></section><section id="HFB026424D2A94975A96DB7B465178833"><enum>7.</enum><header>Extension
			 services by sea grant colleges and sea grant institutes</header><text display-inline="no-display-inline">Section 207(a) (<external-xref legal-doc="usc" parsable-cite="usc/33/1126">33 U.S.C. 1126(a)</external-xref>) is
			 amended in each of paragraphs (2)(B) and (3)(B) by striking <quote>advisory
			 services</quote> and inserting <quote>extension services</quote>.</text>
		</section><section id="HD023F40BCB1E45768DDE98B78DDE6928"><enum>8.</enum><header>Technical
			 correction relating to fellowships</header><text display-inline="no-display-inline">Section 208(a) (<external-xref legal-doc="usc" parsable-cite="usc/33/1127">33 U.S.C. 1127(a)</external-xref>) is
			 amended by striking <quote>Not later than 1 year after the date of the
			 enactment of the National Sea Grant College Program Act Amendments of 2002, and
			 every 2 years thereafter,</quote> and inserting <quote>Every 2
			 years,</quote>.</text>
		</section><section id="H4F045B120B9D45669580DD84F700A2DA"><enum>9.</enum><header>National Sea
			 Grant Advisory Board</header>
			<subsection id="H0F69C3AD83594B4A0000E91314DEF6A8"><enum>(a)</enum><header>Redesignation of
			 sea grant review panel as board</header>
				<paragraph id="H6E3FB0AACA884B59B19708B2A5592351"><enum>(1)</enum><header>Redesignation</header><text>The
			 sea grant review panel established by section 209 of the National Sea Grant
			 College Program Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1128">33 U.S.C. 1128</external-xref>), as in effect before the date of the
			 enactment of this Act, is redesignated as the National Sea Grant Advisory
			 Board.</text>
				</paragraph><paragraph id="HC4856D41841343B094829271E430278B"><enum>(2)</enum><header>Membership not
			 affected</header><text>An individual serving as a member of the sea grant
			 review panel immediately before the enactment of this Act may continue to serve
			 as a member of the National Sea Grant Advisory Board until the expiration of
			 such member's term under section 209(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1128">33 U.S.C. 1128(c)</external-xref>.</text>
				</paragraph><paragraph id="H51122D2017EE45FAAEB4CD648CDFD0C6"><enum>(3)</enum><header>References</header><text>Any
			 reference in a law, map, regulation, document, paper, or other record of the
			 United States to such sea grant review panel is deemed to be a reference to the
			 National Sea Grant Advisory Board.</text>
				</paragraph><paragraph id="H2FB0B2527A4644FBAF801560291B44F5"><enum>(4)</enum><header>Conforming
			 amendments</header>
					<subparagraph id="HF733E682490E42F19575D71D0321C9D3"><enum>(A)</enum><header>In
			 general</header><text>Section 209 (<external-xref legal-doc="usc" parsable-cite="usc/33/1128">33 U.S.C. 1128</external-xref>) is amended by striking so
			 much as precedes subsection (b) and inserting the following:</text>

						</clause></subparagraph></paragraph></subsection><subsection id="H575F5F04073A472B9B4395D893A4CB"><enum>(b)</enum><header>Duties</header><text>Section
			 209(b) (<external-xref legal-doc="usc" parsable-cite="usc/33/1128">33 U.S.C. 1128(b)</external-xref>) is amended to read as follows:</text>

					<subsection id="H49992C60D5644E140037FDA3C5B7D177"><enum>(b)</enum><header>Duties</header>
						<paragraph id="HB12AA363578B445C924CE7F7E29227EA"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Board shall
				advise the Secretary and the Director concerning—</text>
							<subparagraph id="H0F1B2C89DCC14693B8C1BDA0D6B9EBE"><enum>(A)</enum><text>strategies for
				utilizing the sea grant college program to address the Nation's highest
				priorities regarding the understanding, assessment, development, utilization,
				and conservation of ocean, coastal, and Great Lakes resources;</text>
							</subparagraph><subparagraph id="HE28B230795B84A9D922DAC696D2299F7"><enum>(B)</enum><text>the designation of
				sea grant colleges and sea grant institutes; and</text>
							</subparagraph><subparagraph id="H25BBE2679436422F8FB84375D94BB961"><enum>(C)</enum><text>such other matters
				as the Secretary refers to the Board for review and advice.</text>
							</subparagraph></paragraph><paragraph id="HE4DA4A897B1640F89E4CB76FB4E3ED2C"><enum>(2)</enum><header>Biennial
				report</header><text>The Board shall report to the Congress every two years on
				the state of the national sea grant college program. The Board shall indicate
				in each such report the progress made toward meeting the priorities identified
				in the strategic plan in effect under section 204(c). The Secretary shall make
				available to the Board such information, personnel, and administrative services
				and assistance as it may reasonably require to carry out its duties under this
				title.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HBB35BC7BD6B84241A1BD6B1472410700"><enum>(c)</enum><header>Extension of
			 term</header><text display-inline="yes-display-inline">Section 209(c)(3) (33
			 U.S.C. 1128(c)) is amended by striking the second sentence and inserting the
			 following: <quote>The Director may extend the term of office of a voting member
			 of the Board once by up to 1 year.</quote>.</text>
			</subsection><subsection id="H658D7DACF1F742EF00A933285105996"><enum>(d)</enum><header>Establishment of
			 subcommittees</header><text>Section 204(c) (<external-xref legal-doc="usc" parsable-cite="usc/33/1123">33 U.S.C. 1123(c)</external-xref>) is amended by
			 adding at the end the following:</text>
				<quoted-block id="H8C7DA5BEB2F145B3BA664DF463D46B81" style="OLC">
					<paragraph id="H46CBF9130C0247C1920017EF99B06D26" indent="up1"><enum>(8)</enum><text>The Board may establish such
				subcommittees as are reasonably necessary to carry out its duties under
				subsection (b). Such subcommittees may include individuals who are not Board
				members.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="HCBAB2B4C4154490C894CB156354C366"><enum>10.</enum><header>Authorization of
			 appropriations</header>
			<subsection id="H1BD38BAABAA941CE00E44D2900F9E533"><enum>(a)</enum><header>Authorization</header><text>Section
			 212(a) (<external-xref legal-doc="usc" parsable-cite="usc/33/1131">33 U.S.C. 1131(a)</external-xref>) is amended to read as follows:</text>
				<quoted-block id="H9FC6263C310C4FC7AE00C0A300E513F5" style="OLC">
					<subsection id="HE0FBEFB41F424982AF05E35E6C20FA53"><enum>(a)</enum><header>Authorization</header><text display-inline="yes-display-inline">There are authorized to be appropriated to
				the Secretary to carry out this title—</text>
						<paragraph id="HB985381CA3BF49BD85221BB27CA4CC4F"><enum>(1)</enum><text>$66,000,000 for
				fiscal year 2009;</text>
						</paragraph><paragraph id="HD4C0D1F135FB4B01BE00682DEA538BD4"><enum>(2)</enum><text>$72,800,000 for
				fiscal year 2010;</text>
