		  for transparency in the relationship between physicians and manufacturers of
		  drugs, devices, or medical supplies for which payment is made under Medicare,
		  Medicaid, or SCHIP, and for other purposes.</official-title>

		<section id="HC405E1F3DF104EBEA048118E002904CE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Physician Payments Sunshine Act of
			 2008</short-title></quote>.</text>
		</section><section id="HC4E26CC9C38D41958E1CAF757260BFBA"><enum>2.</enum><header>Quarterly
			 transparency reports from manufacturers of covered drugs, devices, or medical
			 supplies under Medicare, Medicaid, or SCHIP</header><text display-inline="no-display-inline">Part A of title XI of the Social Security
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1301">42 U.S.C. 1301 et seq.</external-xref>) is amended by inserting after section 1128F the
			 following new section:</text>
			<quoted-block display-inline="no-display-inline" id="HCCB74A8A7E844013A8B800B600B9CF8" style="OLC">
				<section id="HF4B6D060DA9845B299616362CD4ECABA"><enum>1128G.</enum><header>Quarterly
				transparency reports from manufacturers of covered drugs, devices, or medical
				supplies under Medicare, Medicaid, or SCHIP</header>
					<subsection id="H69BB435DF9BF4E8A962200BE6B692552"><enum>(a)</enum><header>Reporting of
				payments or other transfer of value</header><text>On January 1, 2009, and the
				first day of each fiscal year quarter beginning thereafter, each manufacturer
				of a covered drug, device, or medical supply who provides a payment or other
				transfer of value, directly, indirectly, or through an agent, subsidiary, or
				other third party, to a physician; to an entity that a physician is employed
				by, has tenure with, or has a significant ownership interest in; or to a
				covered organization in which a physician has a significant professional
				membership interest, shall submit to the Secretary, in such electronic form as
				the Secretary shall require, the following:</text>
						<paragraph id="HD95B532353544007971B96D63ED31413"><enum>(1)</enum><text>The name
				of—</text>
							<subparagraph id="HB254709F802F49BCA450C2D610E64118"><enum>(A)</enum><text>the
				physician;</text>
							</subparagraph><subparagraph id="H4FF4F93EDE0C471EA45B00CB1CE89FF"><enum>(B)</enum><text>if a payment or
				other transfer of value was provided to an entity that the physician is
				employed by, has tenure with, or has a significant ownership interest in, the
				name of the entity; and</text>
							</subparagraph><subparagraph id="H25D701D548FF4DC78E601042B941D82F"><enum>(C)</enum><text>if a payment or
				other transfer of value was provided to an organization so specified in which
				the physician has such a significant professional membership interest, the name
				of the organization.</text>
							</subparagraph></paragraph><paragraph id="H37DD4AC26A7840F882DD430039332B5C"><enum>(2)</enum><text>The address
				of—</text>
							<subparagraph id="H93CC12133F254CB7963D96414B2B2B6B"><enum>(A)</enum><text>the physician’s
				office;</text>
							</subparagraph><subparagraph id="HF8B0524F5474443D859F07860706A7A9"><enum>(B)</enum><text>in the case of an
				entity required to be named under paragraph (1)(B), the primary place of
				business or headquarters for the entity; and</text>
							</subparagraph><subparagraph id="H4D30A160874A40AD9101495700933FA3"><enum>(C)</enum><text>in the case of an
				organization required to be named under paragraph (1)(C), the primary place of
				business or headquarters of the organization.</text>
							</subparagraph></paragraph><paragraph id="HD6928D9C22C342B78F38D9077C58528B"><enum>(3)</enum><text>The facility with
				which the physician is affiliated, if any.</text>
						</paragraph><paragraph id="H9BEE5DCB4417418D96837C2C81016E62"><enum>(4)</enum><text>The value of the
				payment or other transfer of value.</text>
						</paragraph><paragraph id="H1462176D4F9146D485918FE17C8C3D90"><enum>(5)</enum><text>The date on which
				the payment or other transfer of value was provided.</text>
						</paragraph><paragraph id="HDD0E833F1EF046CA9BFC60D9EF6DC424"><enum>(6)</enum><text>A description of
				the nature of the payment or other transfer of value, indicated (as appropriate
				for all that apply) as—</text>
							<subparagraph id="H96710BBD7A0C4043A8AB8E344D1B1D2F"><enum>(A)</enum><text>compensation;</text>
							</subparagraph><subparagraph id="H223D9C7F47594BC0A859472326E5EEDD"><enum>(B)</enum><text>food,
				entertainment, or gifts;</text>
							</subparagraph><subparagraph id="HE027B4C41B654DCBAFC1CFB9C847AF89"><enum>(C)</enum><text>trips or
				travel;</text>
							</subparagraph><subparagraph id="H60717D7A082C41A5951264D04FD6C065"><enum>(D)</enum><text>a product or other
				item provided for less than market value;</text>
							</subparagraph><subparagraph id="HA3FA3A2462A649EEA50054837D606146"><enum>(E)</enum><text>participation in a
				medical conference, continuing medical education, other educational or
				informational program or seminar, or funded research (such as lab-based,
				epidemiology, or health services research) that is not a clinical trial;
				provision of materials related to such a conference, educational or
				informational program or seminar, or research; or remuneration for promoting or
				participating in such a conference, educational or informational program or
				seminar, or research;</text>
							</subparagraph><subparagraph id="H78ACC9668A3E4EA3AD5128C0910242DC"><enum>(F)</enum><text>product rebates or
				discounts;</text>
							</subparagraph><subparagraph id="H4CFEBC9834BC4CDF943686B805AA14E9"><enum>(G)</enum><text>consulting fees or
				honoraria;</text>
							</subparagraph><subparagraph id="H75C71B45B8D94DF60050C6FEBA6B5F8D"><enum>(H)</enum><text>dividend, profit
				distribution, stock or stock option grant, or any ownership or investment
				interest held by a physician in a manufacturer (excluding a dividend or other
				profit distribution from, or ownership or investment interest in, a publicly
				traded security and mutual fund (as described in section 1877(c)); or</text>
							</subparagraph><subparagraph id="HFEC3FF0270EC46670000E99EAE505F00"><enum>(I)</enum><text>any other economic
				benefit, as defined by the Secretary.</text>
							</subparagraph></paragraph><paragraph id="HD0B375A9D4064C37906278FB6FC2BF19"><enum>(7)</enum><text>The purpose of the
				expenditure according to categories specified by the Secretary, such as
				consulting, education, royalty, and research.</text>
						</paragraph></subsection><subsection id="HFF644EF94B92497096E89DA19FB48B55"><enum>(b)</enum><header>Annual summary
				report</header><text>Each manufacturer of a covered drug, device, or medical
				supply that is required to submit information under subsection (a) during a
				year shall submit a report to the Secretary not later than December 31 of the
				year that summarizes, in such electronic form as the Secretary shall specify,
				each submission of information under subsection (a) made by the manufacturer
				during the year. The summary report shall include the aggregate amount of all
				transfers of anything of value that is less than $25, including any
				compensation, gift, honorarium, speaking fee, consulting fee, travel, discount,
				cash rebate, or services.</text>
					</subsection><subsection id="H017B1D5EEA364D33B8B46D9220B7B092"><enum>(c)</enum><header>Reporting date
				for applicable clinical trials</header>
						<paragraph id="H0BE7BB3CECFB4BA29EE34DA01331BBE9"><enum>(1)</enum><header>In
				general</header><text>Notwithstanding subsection (a), a payment or other
				transfer of value made for the general funding of a clinical trial described in
				paragraph (2) shall be disclosed in the first quarterly report after the date
				clinical trial information for such trial is required to be posted under
				section 402(j)(2)(D) of the Public Health Service Act.</text>
						</paragraph><paragraph id="H36ECC228F85740819BCDCDBBFB791260"><enum>(2)</enum><header>Clinical
				trial</header><text>A clinical trial described in this paragraph is an
				applicable clinical trial for which clinical trial information is required to
				be submitted under section 402(j)(2)(C) of the Public Health Service
				Act.</text>
						</paragraph></subsection><subsection id="H0AC8A502598C4E8CB7F5006D422C004F"><enum>(d)</enum><header>Penalty for
				noncompliance</header><text>Any manufacturer of a covered drug, device, or
				medical supply that knowingly fails to submit information required under
				subsection (a) or (b) in accordance with regulations promulgated to carry out
				such subsection, shall be subject to a civil money penalty of not less than
				$10,000, but not more than $100,000, for each such failure. Such penalty shall
				be imposed and collected in the same manner as civil money penalties under
				subsection (a) of section 1128A are imposed and collected under that
				section.</text>
					</subsection><subsection id="H67598025775641650078D9C59B8FA5B9"><enum>(e)</enum><header>Public
				availability</header><text>Not later than June 1, 2009, the Secretary shall
				establish procedures to ensure that the information reported under subsection
				(a) and the summary reports submitted under subsection (b) are readily
				accessible to the public through an Internet website that is easily searchable,
				downloadable, and understandable.</text>
					</subsection><subsection id="H88371B77BE4B47A7B83560EFF1A3FA1D"><enum>(f)</enum><header>Report to
				congress</header><text>Not later than April 1 of each year beginning with 2010,
				the Secretary shall submit to Congress a report that includes the
				following:</text>
						<paragraph id="H96AFB7E403384958925F96ECEABE244"><enum>(1)</enum><text>The information
				submitted under subsections (a) and (b) during the preceding year, aggregated
				for each manufacturer of a covered drug, device, or medical supply that
				submitted such information during such year.</text>
						</paragraph><paragraph id="HC0655AD7547B441C9835A2938DFEC19C"><enum>(2)</enum><text>A description of
				any enforcement actions taken to carry out this section, including any
				penalties imposed under subsection (d), during the preceding year.</text>
						</paragraph></subsection><subsection id="H7C799FB0B4024BDC00B164992B465E8C"><enum>(g)</enum><header>Definitions</header><text>In
				this section:</text>
						<paragraph id="H94085C4695AA49FC8FB538006216532F"><enum>(1)</enum><header>Covered drug,
				device, or medical supply</header><text>The term <term>covered drug, device, or
				medical supply</term> means any drug, biological product, device, or medical
				supply for which payment is available under title XVIII or a State plan under
				title XIX or XXI (or a waiver of such a plan).</text>
						</paragraph><paragraph id="H37E71C5BCEB340E2BC3EF3E7CAB0721B"><enum>(2)</enum><header>Covered
				organization</header><text>The term <quote>covered organization</quote> means
				an organization that is involved in health care financing, organization, or
				delivery.</text>
						</paragraph><paragraph id="HD153CCCDC88B4997B0B852D5C6D3C408"><enum>(3)</enum><header>Manufacturer of
				a covered drug, device, or medical supply</header><text>The term
				<term>manufacturer of a covered drug, device, or medical supply</term> means
				any entity—</text>
							<subparagraph id="H5E8A7B1DB5A649A59D7191914DC6E83E"><enum>(A)</enum><text display-inline="yes-display-inline">with annual gross revenues that exceed
				$1,000,000; and</text>
							</subparagraph><subparagraph id="HFED1E7D86C1F48338900D4AA109B1868"><enum>(B)</enum><text>which is engaged
				in the production, preparation, propagation, compounding, conversion, or
				processing of a covered drug, device, or medical supply.</text>
							</subparagraph></paragraph><paragraph id="H8D4607F45BFD4FD6A116C44530BD8539"><enum>(4)</enum><header>Payment or other
				transfer of value</header>
							<subparagraph id="HF427AEAD3A2A4875944660FEC575B580"><enum>(A)</enum><header>In
				general</header><text>The term <term>payment or other transfer of value</term>
				means a transfer of anything of value that exceeds $25, and includes any
				compensation, gift, honorarium, speaking fee, consulting fee, travel, discount,
				cash rebate, services, or dividend, profit distribution, stock or stock option
				grant, or any ownership or investment interest held by a physician in a
				manufacturer (excluding a dividend or other profit distribution from, or
				ownership or investment interest in, a publicly traded security or mutual fund
				(as described in section 1877(c)).</text>
							</subparagraph><subparagraph id="HD1F2F23124994BBC984D2E5631BA72EA"><enum>(B)</enum><header>Exclusions</header><text>Such
				term does not include the following:</text>
								<clause id="H06B7EFA68E2B4146A7376EDAB3D8D0E0"><enum>(i)</enum><text>Product samples
				that are intended for patients.</text>
								</clause><clause id="H6AF3982CA8314BF89349AD7E00B1D08"><enum>(ii)</enum><text>A
				payment or other transfer of value made for the general funding of a clinical
				trial, other than an applicable clinical trial for which clinical trial
				information is required to be submitted under section 402(j)(2)(C) of the
				Public Health Service Act.</text>
								</clause><clause id="H97FA6246247B438A82A563E47F381362"><enum>(iii)</enum><text>A transfer of
				anything of value to a physician when the physician is a patient and not acting
				in his or her professional capacity.</text>
								</clause><clause id="HDCA0D5D87B85446C99CCCB071C427DB7"><enum>(iv)</enum><text display-inline="yes-display-inline">Compensation paid by a manufacturer of a
				covered drug, device, or medical supply to a physician who is directly employed
				by and works solely for such manufacturer.</text>
								</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4E629005350743489D2D1E91DE68C96D"><enum>(5)</enum><header display-inline="yes-display-inline">Physician</header><text display-inline="yes-display-inline">The term <term>physician</term> has the
				meaning given that term in section 1861(r).</text>
						</paragraph><paragraph id="H7B4CBC2A26954EE2B9D08100C53FD687"><enum>(6)</enum><header>Significant
				professional membership interest</header><text>The term <quote>significant
				professional membership interest</quote> means, with respect to a physician and
				a covered organization, the physician is a voluntary paying member of such
				organization or the physician receives professional certification through such
				organization.</text>
						</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H7325D26DE0B1419D87FF67B18FA15C39"><enum>3.</enum><header>Limitation on tax
			 deductions for advertising by certain manufacturers of drugs, devices, or
			 medical supplies</header>
			<subsection id="H7BBAB8BC767F4F9A97699FBF0215B2F0"><enum>(a)</enum><header>In
			 general</header><text>Part IX of subchapter B of chapter 1 of subtitle A of the
			 Internal Revenue Code of 1986 (relating to items not deductible) is amended by
			 adding at the end the following:</text>
				<quoted-block id="H3DEED495E5634EAB86A7C739B1232FF4" style="OLC">
					<section id="HBD8E1BAF6DB24260B8BA17096E26F545"><enum>280I.</enum><header>Limitation on
				tax deductions for advertising by certain manufacturers of drugs, devices, or
				medical supplies</header>
						<subsection id="H9C943D0EEA094357A963A2E46A804AA"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">No deduction shall be
				allowed under this chapter for any taxable year for any expenditure relating to
				the advertising, promoting, or marketing (in any medium) of any covered drug,
				device, or medical supply manufactured by the taxpayer if, during the taxable
				year, a penalty is imposed on the taxpayer under section 1128G(d) of the Social
				Security Act (relating to quarterly transparency reports from manufacturers of
				covered drugs, devices, or medical supplies under Medicare, Medicaid, or
				SCHIP).</text>
						</subsection><subsection id="H9C97A9F7888244D9A234C46BE2CEBBC4"><enum>(b)</enum><header>Definitions and
				special rules</header><text>For purposes of this section—</text>
							<paragraph id="H4CEAD35CC5A3487F8175EB5CE1100758"><enum>(1)</enum><header>Covered drug,
				device, or medical supply</header><text display-inline="yes-display-inline">The
				term <quote>Covered drug, device, or medical supply</quote> has the meaning
				given such term by section 1128G(g) of the Social Security Act.</text>
							</paragraph><paragraph id="HA5875072939F44449B14951FE7776273"><enum>(2)</enum><header>Aggregation
				rules</header><text>All members of the same controlled group of corporations
				(within the meaning of section 52(a)) and all persons under common control
				(within the meaning of section 52(b)) shall be treated as 1
				person.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H432B3FA0990C4D378F5038FAC6007735"><enum>(b)</enum><header>Conforming
			 amendment</header><text>The table of sections for such part IX is amended by
			 adding after the item relating to section 280H the following:</text>
				<quoted-block display-inline="no-display-inline" id="HB41EED2168644ADC888624FD830003FC" style="OLC">
					<toc container-level="quoted-block-container" idref="H3DEED495E5634EAB86A7C739B1232FF4" lowest-bolded-level="division-lowest-bolded" lowest-level="section" quoted-block="no-quoted-block" regeneration="yes-regeneration">
						<toc-entry idref="HBD8E1BAF6DB24260B8BA17096E26F545" level="section">Sec. 280I. Limitation on tax deductions for advertising by
				certain manufacturers of drugs, devices, or medical
				supplies.</toc-entry>
					</toc>

			</subsection><subsection id="H2CDD0E3B80424E80958900C71D283F3D"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to taxable
			 years beginning ending after the date of the enactment of this Act.</text>
