		<legis-type>A BILL</legis-type>
		<official-title>To permit nonjudicial employees of the District of
		  Columbia courts, employees transferred to the Pretrial Services, Parole, Adult
		  Probation, and Offender Supervision Trustee, and employees of the District of
		  Columbia Public Defender Service to have periods of service performed prior to
		  the enactment of the Balanced Budget Act of 1997 included as part of the years
		  of service used to determine the time at which such employees are eligible to
		  retire under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/84">chapter 84</external-xref> of title 5, United States Code, and for other
		  purposes.</official-title>

		<section display-inline="no-display-inline" id="HD0D7873C36504F55BAB48DB57D003B8E" section-type="section-one"><enum>1.</enum><header>Short Title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>District of Columbia Court, Offender
			 Supervision, Parole, and Public Defender Employees Equity Act of
			 2008</short-title></quote>.</text>
		</section><section id="H19A5EFE20EAC468AB300F29D9C77CBC6"><enum>2.</enum><header>Retirement Credit
			 For Service of Certain Employees Transferred From District of Columbia Service
			 to Federal Service</header>
			<subsection id="H9953949731B746F69374CD1F00F630F1"><enum>(a)</enum><header>In
			 General</header><text>Any individual serving as an employee or Member (as those
			 terms are defined by <external-xref legal-doc="usc" parsable-cite="usc/5/8401">section 8401</external-xref> of title 5, United States Code) on or after
			 the date of enactment of this Act who performed qualifying District of Columbia
			 service shall be entitled to have such service included in calculating the
			 individual’s creditable service under <external-xref legal-doc="usc" parsable-cite="usc/5/8411">section 8411</external-xref> of title 5, United States
			 Code, but only for purposes of the following provisions of such title:</text>
				<paragraph id="H893B4C65527D4F1000A6AC3F4328AF29"><enum>(1)</enum><text>Section 8410
			 (relating to eligibility for annuity).</text>
				</paragraph><paragraph id="HB1DCCCB016854C49BAE500B3A2DCC3B1"><enum>(2)</enum><text>Section 8412
			 (relating to immediate retirement).</text>
				</paragraph><paragraph id="H87840431E3DD417DB48300A81D91BDF6"><enum>(3)</enum><text>Section 8413
			 (relating to deferred retirement).</text>
				</paragraph><paragraph id="HD080B37541564C18B400854F86DABAB9"><enum>(4)</enum><text>Section 8414
			 (relating to early retirement).</text>
				</paragraph><paragraph id="H5436ED19FA3A408FA517C61E7DC7CE7D"><enum>(5)</enum><text>Subchapter IV of
			 chapter 84 (relating to survivor annuities).</text>
				</paragraph><paragraph id="HA3368DB33AAC467B81A52213BDD3E19"><enum>(6)</enum><text>Subchapter V of
			 chapter 84 (relating to disability benefits).</text>
				</paragraph></subsection><subsection display-inline="no-display-inline" id="H8977B62AEB5C4A76B1C7F59BD609DE4"><enum>(b)</enum><header>Service Not
			 Included in Computing Amount of Any Annuity</header><text>Qualifying District
			 of Columbia service shall not be taken into account for purposes of computing
			 the amount of any benefit payable out of the Civil Service Retirement and
			 Disability Fund.</text>
			</subsection></section><section id="HD39DA3F9B7B24960A8981217597DC055"><enum>3.</enum><header>Qualifying
			 District of Columbia Service Defined</header><text display-inline="no-display-inline">In this Act, <quote>qualifying District of
			 Columbia service</quote> means any of the following:</text>
			<paragraph id="H71B0BEC5112A43718D9996C1EF27D33E"><enum>(1)</enum><text>Service performed
			 by an individual as a nonjudicial employee of the District of Columbia
			 courts—</text>
				<subparagraph id="H87E2B2613BC84E5C8F4F8D8E89A090DC"><enum>(A)</enum><text>which was
			 performed prior to the effective date of the amendments made by section
			 11246(b) of the Balanced Budget Act of 1997; and</text>
				</subparagraph><subparagraph id="H2F67D1932912488DB900D8CD6CD96153"><enum>(B)</enum><text>for which the
			 individual did not ever receive credit under the provisions of subchapter III
			 of chapter 83 or <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/84">chapter 84</external-xref> of title 5, United States Code (other than by
			 virtue of section 8331(1)(iv) of such title).</text>
				</subparagraph></paragraph><paragraph id="H32CC1C13F044476E835083DA561B03F"><enum>(2)</enum><text>Service performed
			 by an individual as an employee of an entity of the District of Columbia
			 government whose functions were transferred to the Pretrial Services, Parole,
			 Adult Supervision, and Offender Supervision Trustee under section 11232 of the
			 Balanced Budget Act of 1997—</text>
				<subparagraph id="H05D2C0EBCC9342609DFCE0F725954F19"><enum>(A)</enum><text>which was
			 performed prior to the effective date of the individual’s coverage as an
			 employee of the Federal Government under section 11232(f) of such Act;
			 and</text>
				</subparagraph><subparagraph id="H886B42704B0A478480B70093BB48E72B"><enum>(B)</enum><text display-inline="yes-display-inline">for which the individual did not ever
			 receive credit under the provisions of subchapter III of chapter 83 or chapter
			 84 of title 5, United States Code (other than by virtue of section 8331(1)(iv)
			 of such title).</text>
				</subparagraph></paragraph><paragraph id="H6909AFB077904D7D9B14DC85249EECA9"><enum>(3)</enum><text>Service performed
			 by an individual as an employee of the District of Columbia Public Defender
			 Service—</text>
				<subparagraph id="H587518EA3EA7479CA0247381EA391143"><enum>(A)</enum><text>which was
			 performed prior to the effective date of the amendments made by section 7(e) of
			 the District of Columbia Courts and Justice Technical Corrections Act of 1998;
			 and</text>
				</subparagraph><subparagraph id="HCBE84B0B18374288B6DBD1EF46B0145D"><enum>(B)</enum><text display-inline="yes-display-inline">for which the individual did not ever
			 receive credit under the provisions of subchapter III of chapter 83 or chapter
			 84 of title 5, United States Code (other than by virtue of section 8331(1)(iv)
			 of such title).</text>
				</subparagraph></paragraph><paragraph id="H7358D4EB6E8B49CBA4D96383FD663B43"><enum>(4)</enum><text>In the case of an
			 individual who was appointed to a position in the Federal Government under the
			 priority consideration program established by the Bureau of Prisons under
			 section 11203 of the Balanced Budget Act of 1997, service performed by the
			 individual as an employee of the District of Columbia Department of
			 Corrections—</text>
				<subparagraph id="H160E687121A549EC90ED0610758276F5"><enum>(A)</enum><text>which was
			 performed prior to the effective date of the individual’s coverage as an
			 employee of the Federal Government; and</text>
				</subparagraph><subparagraph id="H4F8510396B6645BAAD45EAD0D81C1758"><enum>(B)</enum><text>for which the
			 individual did not ever receive credit under the provisions of subchapter III
			 of chapter 83 or <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/84">chapter 84</external-xref> of title 5, United States Code (other than by
			 virtue of section 8331(1)(iv) of such title).</text>
				</subparagraph></paragraph></section><section id="H761BDA23B3AF4029884B5CD441100019"><enum>4.</enum><header>Certification of
			 Service</header><text display-inline="no-display-inline">The Office of
			 Personnel Management shall accept the certification of the appropriate
			 personnel official of the government of the District of Columbia concerning
			 whether an individual performed qualifying District of Columbia service and the
			 length of the period of such service the individual performed.</text>
