		<official-title>To require new coal-fired electric generating units to
		  use state-of-the-art control technology to capture and permanently sequester
		  carbon dioxide emissions, and for other purposes.</official-title>

		<section id="H6A96063B4A194E03A83375541BE21C45" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Moratorium on Uncontrolled Power
			 Plants Act of 2008.</short-title></quote></text>
		</section><section id="H2F342803635045858E38B8B400C900A5"><enum>2.</enum><header>Moratorium</header>
			<subsection id="H7788B804ADD645E4A920CF3D8DE8A8CB"><enum>(a)</enum><header>CO2
			 sequestration required</header><text>Effective upon the date of enactment of
			 this Act, no permitting authority shall issue a permit for a proposed new
			 coal-fired electric generating unit under the Clean Air Act, unless the permit
			 requires the unit to use state-of-the-art control technology to capture and
			 permanently sequester carbon dioxide emissions from such unit.</text>
			</subsection><subsection id="HC163F69053DC4627A0A69FC82C74E976"><enum>(b)</enum><header>Duration of
			 moratorium</header><text>This moratorium shall apply until such time as a
			 comprehensive program to reduce emissions of greenhouse gases is in
			 effect.</text>
			</subsection></section><section id="H57BCFB60ABDF4049B51C6362D23FF7EC"><enum>3.</enum><header>Greenhouse gas
			 emission allowances</header>
			<subsection id="H1F4511801F0E4AEC00EEA6102890ACD8"><enum>(a)</enum><header>Allowances</header><text display-inline="yes-display-inline">No new coal-fired electric generating unit
			 that—</text>
				<paragraph id="H11BC5DDBB7334771A4A1E528FA05986"><enum>(1)</enum><text>commences
			 construction after the date of introduction of this Act; and</text>
				</paragraph><paragraph id="H1B27D84003E54C5F9992A37D933E295F"><enum>(2)</enum><text>does not install
			 and operate state-of-the-art control technology to control carbon dioxide
			 emissions from such unit;</text>
				</paragraph><continuation-text continuation-text-level="subsection">shall
			 receive greenhouse gas emission allowances free of charge or at any price less
			 than the market price under any future program to address global warming
			 adopted by Congress or the Environmental Protection Agency.</continuation-text></subsection><subsection id="HF056227E37A24C4EBBEB1B760359BE8E"><enum>(b)</enum><header>Other
			 sources</header><text>Nothing shall be implied from this section with respect
			 to the potential allocation of allowances to any source not barred from
			 receiving allowances by the previous sentence.</text>
			</subsection></section><section id="H2ED375991643465584B428C72080882"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">For the purposes of this Act:</text>
			<paragraph id="HBA6B173D71E7487E8825BC2FC3215DC2"><enum>(1)</enum><header>Administrator</header><text>The
			 term <quote>Administrator</quote> means the Administrator of the Environmental
			 Protection Agency.</text>
			</paragraph><paragraph id="HF14FB92AC3AB45D0BDFCE4ED2FF3A787"><enum>(2)</enum><header>Coal-fired
			 electric generating unit</header><text display-inline="yes-display-inline">The
			 term <quote>Coal-fired electric generating unit </quote> means an electric
			 utility unit that uses coal, petroleum coke, coal refuse, or a synthetic gas
			 derived from coal either exclusively, in any combination together, or in any
			 combination with other fuels in any amount.</text>
			</paragraph><paragraph id="HB34B1F64960F4459BF9B11B9F521C931"><enum>(3)</enum><header>Comprehensive
			 program</header><text display-inline="yes-display-inline">The term
			 <quote>Comprehensive program</quote> means a program adopted by Congress or the
			 Environmental Protection Agency that requires immediate and significant
			 reductions in greenhouse gas emissions across the U.S. economy and increases
			 the reductions over time to reduce U.S. greenhouse gas emissions to 80 percent
			 below 1990 levels by 2050.</text>
			</paragraph><paragraph id="H9038C06957B54C2BBFE550C4FC54BCD"><enum>(4)</enum><header>Greenhouse
			 gas</header><text>The term <quote>greenhouse gas</quote> means—</text>
				<subparagraph id="H51378BA09DA64CCBA26E4237A00A573"><enum>(A)</enum><text>carbon
			 dioxide;</text>
				</subparagraph><subparagraph id="HEC03F93F13F543F29C007DC357EE88D6"><enum>(B)</enum><text>methane;</text>
				</subparagraph><subparagraph id="H6B0B960F62A047ED81F7EC093264936"><enum>(C)</enum><text>nitrous
			 oxide;</text>
				</subparagraph><subparagraph id="H771EEA33E929479D97B0DF7D9834FDE"><enum>(D)</enum><text>hydrofluorocarbons;</text>
				</subparagraph><subparagraph id="H7DD4EF26708140A99FBAF001EF7FC878"><enum>(E)</enum><text>perfluorocarbons;</text>
				</subparagraph><subparagraph id="HE700E7A3C97840EEB4AF53641B20BABC"><enum>(F)</enum><text>sulfur
			 hexafluoride; or</text>
				</subparagraph><subparagraph id="HC0A261EF8A144D64BD95B9BA8D2CA9C5"><enum>(G)</enum><text>any other
			 anthropogenically-emitted gas that the Administrator, after notice and comment,
			 determines contributes to global warming to a non-negligible degree.</text>
				</subparagraph></paragraph><paragraph id="H5909EE830A2F42C187C7FA2300CD1B25"><enum>(5)</enum><header>State-of-the-art
			 control technology</header><text>The term <quote>state-of-the-art control
			 technology</quote> means technology that captures not less than 85 percent of
			 the total carbon dioxide produced by the unit on an annual average basis and
			 permanently sequesters that carbon dioxide in a geological formation approved
			 by the Administrator in a manner that prevents its later release into the
			 atmosphere.</text>
