		<official-title>To amend title 5, United States Code, to provide for a
		  lump-sum payment for certain Federal employees who retire with a substantial
		  amount of unused sick leave for which they would not otherwise receive any
		  compensation or benefit, and for other purposes.</official-title>

		<section id="H45374658AC09492997EE6F23ECDAEF2C" section-type="section-one"><enum>1.</enum><header>Payment for certain unused
			 sick leave</header>
			<subsection id="HE19CD4BBD837464CA73E3CB36E774298"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Chapter 55 of title
			 5, United States Code, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HAA3525B5D1324732B3DEE2FDCACD092D" style="USC">
					<subchapter id="HDE3C4B578A2C4A2984E4E2C255644DA8"><enum>X</enum><header>Payment for
				certain unused sick leave</header>
						<section id="HB4B558F864EF4666951F01FD6EBAE8DE"><enum>5597a.</enum><header>Definitions</header><text display-inline="no-display-inline">For purposes of this subchapter—</text>
							<paragraph id="H2C2BE8877AA040B995920037411B207B"><enum>(1)</enum><text>the term
				<term>covered retirement system</term> means the Federal Employees’ Retirement
				System and the Foreign Service Pension System; and</text>
							</paragraph><paragraph id="H0F1D02556B5E45BA95B431F7F2BC3F8B"><enum>(2)</enum><text>the term
				<term>employee</term> means an employee as defined by section 2105 and an
				officer or employee of the United States Postal Service or of the Postal
				Regulatory Commission, but does not include a Congressional employee as defined
				by section 2107.</text>
							</paragraph></section><section id="HA0B32CEBCC1F4B86ADE9126D2C26ABF8"><enum>5597b.</enum><header>Lump-sum
				payment for certain unused sick leave</header>
							<subsection id="H457F5AD43AF04A3F86EF4CF4DF01241"><enum>(a)</enum><header>In
				general</header><text>Any qualified employee who is separated from the service
				or is transferred to a position which is not subject to a covered retirement
				system shall be eligible to receive a lump-sum payment under this
				section.</text>
							</subsection><subsection id="H3D610FC9A532402D93E0C799D2905E41"><enum>(b)</enum><header>Qualified
				employee</header><text>For purposes of this section, the term <term>qualified
				employee</term> means an employee who, immediately before such employee’s
				separation or transfer (as described in subsection (a))—</text>
								<paragraph id="H93318A64BBDF4B5382ACC82B109C990"><enum>(1)</enum><text>is subject to a
				covered retirement system; and</text>
								</paragraph><paragraph id="H051A32999307444E8BCC4167D29E51C3"><enum>(2)</enum><text>satisfies the age
				and service requirements for immediate or early retirement under such
				system.</text>
								</paragraph></subsection><subsection id="H6B8E62B1A2F8420AA4B59DF0B8D3BE4"><enum>(c)</enum><header>Amount
				payable</header>
								<paragraph id="H3AD45F0FE66140BB87E89C2022F40049"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">A lump-sum payment
				under this section shall be equal to the amount of basic pay (including
				locality pay) the employee would have received, for such employee’s period of
				compensable sick leave, if such employee had remained in the service or not
				transferred until the end of such period.</text>
								</paragraph><paragraph id="H0209E315D92E488DAF5FBDD3ED56E38"><enum>(2)</enum><header>Period of
				compensable sick leave</header><text display-inline="yes-display-inline">For
				purposes of this section, the term <term>period of compensable sick
				leave</term> means a period equal in duration to 15 percent of the amount
				(rounded to the nearest whole number of hours) by which the total number of
				hours of accumulated and current accrued sick leave standing to the employee’s
				credit (as of the time of separation or transfer) under a formal leave system,
				exceeds 500 hours.</text>
								</paragraph><paragraph id="H2AEE4881205543299E84CF04B9009B5F"><enum>(3)</enum><header>Limitations</header><text>In
				no event shall—</text>
									<subparagraph id="HD639BB26670C495C948D4724015C0930"><enum>(A)</enum><text>any payment under
				this section exceed $10,000; or</text>
									</subparagraph><subparagraph id="H92DC83046D42435FAE07F9290164864B"><enum>(B)</enum><text>any hours of sick
				leave be taken into account under paragraph (2)(A) which are creditable in the
				computation of any other compensation or benefit provided for under any other
				statute.</text>
									</subparagraph></paragraph></subsection><subsection id="H7E400A75FF384DD98651E0FCC300AA3"><enum>(d)</enum><header>Conditions for
				and effect of receiving a payment</header><text>A payment under this
				section—</text>
								<paragraph id="H4DCEE91325AB4EB6BD01928400A65CDE"><enum>(1)</enum><text display-inline="yes-display-inline">shall be payable by the agency from which
				the employee was separated or transferred, but only upon application made in
				accordance with applicable regulations under section 5597c;</text>
								</paragraph><paragraph id="HBF8B07C81863454A8DF3005DB14DF6DE"><enum>(2)</enum><text>terminates all
				rights of the employee with respect to the hours of leave described in
				subsection (c)(2)(A) (and not excluded by subsection (c)(3)(B)); and</text>
								</paragraph><paragraph id="H44D4CD86F75F48E9BC0757888C013661"><enum>(3)</enum><text>terminates any
				right of the employee to receive any other payment under this section,
				including with respect to any sick leave subsequently accruing.</text>
								</paragraph></subsection><subsection id="H2AFB0A11E15C4AC69FFE7488D46DF3DC"><enum>(e)</enum><header>Application by a
				survivor</header><text>An application under this section may also be made by
				any person who, by virtue of subchapter VIII, is entitled to receive any
				payment which (but for subsection (d)(1)) would otherwise be due a deceased
				employee under this section.</text>
							</subsection><subsection id="H731100ADF69E4E55B214A0BDC162BFFF"><enum>(f)</enum><header>Additional
				rules</header><text display-inline="yes-display-inline">A lump-sum payment
				under this section shall be considered pay for taxation purposes only. The
				period of compensable sick leave used in calculating any such payment shall not
				be extended due to any holiday occurring after the employee’s separation or
				transfer.</text>
							</subsection></section><section id="H8A88B62E9B5D4D2B985E00FCF5DF24E"><enum>5597c.</enum><header>Regulations</header><text display-inline="no-display-inline">Any regulations necessary for the
				administration of this subchapter shall be prescribed by the appropriate
				authority. For purposes of the preceding sentence, the <quote>appropriate
				authority</quote> is—</text>
							<paragraph id="HA6EB0F16A8E149C1940054E9EC1C3300"><enum>(1)</enum><text>if the separation
				or transfer is from a position in the executive branch, the Director of the
				Office of Personnel Management;</text>
							</paragraph><paragraph id="H5A54431809FB47E2ADF2E820664C5697"><enum>(2)</enum><text>if the separation
				or transfer is from a position in the judicial branch, the Director of the
				Administrative Office of the United States Courts; and</text>
							</paragraph><paragraph id="HCFF84E363A394B3C95C1394EA99D00B2"><enum>(3)</enum><text>if the separation
				or transfer is from a position in the legislative branch, the head of the
				office, agency, or other establishment from which such separation or transfer
				occurs.</text>
							</paragraph></section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HB629F268A3054B45AFEE7403DC5C3340"><enum>(b)</enum><header>Settlement of
			 accounts</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/5581">Section 5581(2)</external-xref> of title 5, United States Code, is
			 amended—</text>
				<paragraph id="HBAC699E37BC94D0EB807A0ACAC7BF050"><enum>(1)</enum><text>by redesignating
			 subparagraph (I) as subparagraph (J);</text>
				</paragraph><paragraph id="H99964E3291124D109B8B9614E5191C94"><enum>(2)</enum><text>in subparagraph
			 (H), by striking <quote>and</quote> after the semicolon; and</text>
				</paragraph><paragraph id="H7DCAEB3A74DC4C7D9BB43BD58042E656"><enum>(3)</enum><text>by inserting after
			 subparagraph (H) the following:</text>
					<quoted-block display-inline="no-display-inline" id="H0FC8EC79F1B143A0932BB6DB9AF14BC" style="USC">
						<subparagraph id="H23975BA219A24EE7ACD0588F685E1006"><enum>(I)</enum><text display-inline="yes-display-inline">payment for compensable sick leave under
				section 5597b;
				and</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H2A65C188DF414E9E9E391B183D7FDDD7"><enum>(c)</enum><header>Clerical
			 amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/55">chapter 55</external-xref> of title 5, United States
			 Code, is amended by adding at the end the following:</text>
