		<official-title display="yes">To ensure national security while promoting
		  foreign investment and the creation and maintenance of jobs, to reform the
		  process by which such investments are examined for any effect they may have on
		  national security, to establish the Committee on Foreign Investment in the
		  United States, and for other purposes.</official-title>

		<section display-inline="no-display-inline" id="H329781AD32A44F3FAB8ED1E5FC1380B1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>National Security Foreign Investment
			 Reform and Strengthened Transparency Act of 2007</short-title></quote>.</text>
		</section><section id="H2F6FBA14061247ECBAA0EA1C60B53346"><enum>2.</enum><header>
			 United States security improvement amendments; clarification of review and
			 investigation process</header><text display-inline="no-display-inline">Section
			 721 of the Defense Production Act of 1950 (50 U.S.C. App.
			 2170) is amended by striking subsections (a) and (b) and
			 inserting the following new subsections:</text>
			<quoted-block display-inline="no-display-inline" id="H21DC5484BFB343CF8961008FC8CF074C" style="OLC">
				<subsection id="H8C6393DEC4BD4423A55476C1E3B80638"><enum>(a)</enum><header>Definitions</header><text>For
				purposes of this section, the following definitions shall apply:</text>
					<paragraph id="HB965DCEB4DF249A4A5FB21BFA05D61EC"><enum>(1)</enum><header>Committee</header><text display-inline="yes-display-inline">The term <term>Committee</term> means the
				Committee on Foreign Investment in the United States.</text>
					</paragraph><paragraph commented="no" id="H7E9735F2624A43DB8F17400021F48E9F"><enum>(2)</enum><header>Control</header><text display-inline="yes-display-inline">The term <term>control</term> has the
				meaning given to such term in regulations which the Committee shall
				prescribe.</text>
					</paragraph><paragraph id="H89C46C61F1B94726993BC679BD51E1F0"><enum>(3)</enum><header>Covered
				transaction</header><text display-inline="yes-display-inline">The term
				<term>covered transaction</term> means any merger, acquisition, or takeover by
				or with any foreign person which could result in foreign control of any person
				engaged in interstate commerce in the United States.</text>
					</paragraph><paragraph id="H04DB1701E8B3443A881166FE396C7C53"><enum>(4)</enum><header>Foreign
				government-controlled transaction</header><text>The term <term>foreign
				government-controlled transaction</term> means any covered transaction that
				could result in the control of any person engaged in interstate commerce in the
				United States by a foreign government or an entity controlled by or acting on
				behalf of a foreign government.</text>
					</paragraph><paragraph commented="no" id="HC61E244B2B9A4CA999A178D04969887E"><enum>(5)</enum><header>Clarification</header><text display-inline="yes-display-inline">The term <term>national security</term>
				shall be construed so as to include those issues relating to <quote>homeland
				security</quote>, including its application to critical infrastructure.</text>
					</paragraph></subsection><subsection id="HB4FE8CE426EE498595802DAABFEA5B8E"><enum>(b)</enum><header>National
				security reviews and investigations</header>
					<paragraph id="HEFDC7D2D69824AA0A3ED3524DB1BE510"><enum>(1)</enum><header>National
				security reviews</header>
						<subparagraph id="HB0B8FE38F95D47199BA8EA6690C52B55"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">Upon receiving
				written notification under subparagraph (C) of any covered transaction, or on a
				motion made under subparagraph (D) with respect to any covered transaction, the
				President, acting through the Committee, shall review the covered transaction
				to determine the effects of the transaction on the national security of the
				United States.</text>
						</subparagraph><subparagraph id="HC3213C5EF506450B9437B1A921C99E4"><enum>(B)</enum><header>Control by
				foreign government</header><text display-inline="yes-display-inline">If the
				Committee determines that the covered transaction is a foreign
				government-controlled transaction, the Committee shall conduct an investigation
				of the transaction under paragraph (2).</text>
						</subparagraph><subparagraph id="H3CB1ADB32B7946E79EF5992BE112D586"><enum>(C)</enum><header>Written
				notice</header>
							<clause id="H868F0D6363F44C689261B7FF99AC00D6"><enum>(i)</enum><header>In
				general</header><text>Any party to any covered transaction may initiate a
				review of the transaction under this paragraph by submitting a written notice
				of the transaction to the Chairperson of the Committee.</text>
							</clause><clause commented="no" id="H017F3582958549B995ADE9516415AD31"><enum>(ii)</enum><header>Withdrawal of
				notice</header><text display-inline="yes-display-inline">No covered transaction
				for which a notice was submitted under clause (i) may be withdrawn from review
				unless—</text>
								<subclause id="H896900343C39483092506985CD74683"><enum>(I)</enum><text>a written request
				for such withdrawal is submitted by any party to the transaction; and</text>
								</subclause><subclause id="H453AEB28397D479EB4C1AB4115D5DC84"><enum>(II)</enum><text>the request is
				approved in writing by the Chairperson, in consultation with the Vice
				Chairpersons, of the Committee.</text>
								</subclause></clause><clause commented="no" id="H7455B632BCE0408D96D592EC0019CA5"><enum>(iii)</enum><header>Continuing
				discussions</header><text display-inline="yes-display-inline">The approval of a
				withdrawal request under clause (ii) shall not be construed as precluding any
				party to the covered transaction from continuing informal discussions with the
				Committee or any Committee member regarding possible resubmission for review
				pursuant to this paragraph.</text>
							</clause></subparagraph><subparagraph display-inline="no-display-inline" id="H2EEA56498D134289A7232E002587F007"><enum>(D)</enum><header>Unilateral
				initiation of review</header><text>Subject to subparagraph (F), the President,
				the Committee, or any member acting on behalf of the Committee may move to
				initiate a review under subparagraph (A) of—</text>
							<clause id="H2B81E70EE27C4A8A904652FD4B236433"><enum>(i)</enum><text display-inline="yes-display-inline">any covered transaction;</text>
							</clause><clause id="H61AA770F04324561989581A2B8EDCEB5"><enum>(ii)</enum><text display-inline="yes-display-inline">any covered transaction that has previously
				been reviewed or investigated under this section, if any party to the
				transaction submitted false or misleading material information to the Committee
				in connection with the review or investigation or omitted material information,
				including material documents, from information submitted to the Committee;
				or</text>
							</clause><clause id="HAB4FA95CB0EA46488DD70132BBD21CCC"><enum>(iii)</enum><text display-inline="yes-display-inline">any covered transaction that has previously
				been reviewed or investigated under this section, if any party to the
				transaction or the entity resulting from consummation of the transaction
				intentionally materially breaches a mitigation agreement or condition described
				in subsection (l)(1)(A), and—</text>
								<subclause id="HBA59CC59BBCD43B798BBB5B0F0837612"><enum>(I)</enum><text display-inline="yes-display-inline">such breach is certified by the lead
				department or agency monitoring and enforcing such agreement or condition as an
				intentional material breach; and</text>
								</subclause><subclause id="H8A1F96E75DA54D60B25545FB987E54BB"><enum>(II)</enum><text>such department
				or agency certifies that there is no other remedy or enforcement tool available
				to address such breach.</text>
								</subclause></clause></subparagraph><subparagraph id="H8EA4AAE0CBC94F90844C39C07C0029CD"><enum>(E)</enum><header>Timing</header><text>Any
				review under this paragraph shall be completed before the end of the 30-day
				period beginning on the date of the receipt of written notice under
				subparagraph (C) by the Chairperson of the Committee, or the date of the
				initiation of the review in accordance with a motion under subparagraph
				(D).</text>
						</subparagraph><subparagraph id="H42DDB042D7734E8CA06485BDEC008E00"><enum>(F)</enum><header>Limit on
				delegation of certain authority</header><text display-inline="yes-display-inline">The authority of the Committee or any
				member of the Committee to initiate a review under subparagraph (D) may not be
				delegated to any person other than the Deputy Secretary or an appropriate Under
				Secretary of the department or agency represented on the committee or by such
				member (or by a person holding an equivalent position to a Deputy Secretary or
				Under Secretary).</text>
						</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="HE43DA2004BA1409DB8A5D882749F8C33"><enum>(2)</enum><header>National
				security investigations</header>
						<subparagraph id="H02579F2233434159B504D36FC827E29E"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">In each case in
				which—</text>
							<clause id="H0863EA77F23441339C48A8DAC2BB1528"><enum>(i)</enum><text>a
				review of a covered transaction under paragraph (1) results in a determination
				that—</text>
								<subclause id="H47EC4249343C44A491A803DD85E20C3"><enum>(I)</enum><text display-inline="yes-display-inline">the transaction threatens to impair the
				national security of the United States and that threat has not been mitigated
				during or prior to the review of a covered transaction under paragraph (1);
				or</text>
								</subclause><subclause id="HC7785BBEC5EC42EEA0F45EFC5B0C74"><enum>(II)</enum><text>the transaction is
				a foreign government-controlled transaction;</text>
								</subclause></clause><clause commented="no" id="HC517CD5F09A04514BD25B149A4506711"><enum>(ii)</enum><text display-inline="yes-display-inline">a roll call vote pursuant to paragraph
				(3)(A) in connection with a review under paragraph (1) of any covered
				transaction results in at least 1 vote by a Committee member against approving
				the transaction; or</text>
							</clause><clause commented="no" id="H63CD32F844EF4C6B81D80036FEEB63F8"><enum>(iii)</enum><text display-inline="yes-display-inline">the Director of National Intelligence
				identifies particularly complex intelligence concerns that could threaten to
				impair the national security of the United States and Committee members were
				not able to develop and agree upon measures to mitigate satisfactorily those
				threats during the initial review period under paragraph (1),</text>
							</clause><continuation-text continuation-text-level="subparagraph">the
				President, acting through the Committee, shall immediately conduct an
				investigation of the effects of the transaction on the national security of the
				United States and take any necessary actions in connection with the transaction
				to protect the national security of the United States.</continuation-text></subparagraph><subparagraph display-inline="no-display-inline" id="HBCAB68BBC1C4454C8DF92793E3002150"><enum>(B)</enum><header>Timing</header>
							<clause id="H115BADADE31C44C0B8006EE610762BF4"><enum>(i)</enum><header>In
				general</header><text>Any investigation under subparagraph (A) shall be
				completed before the end of the 45-day period beginning on the date of the
				investigation commenced.</text>
							</clause><clause id="HF20018F34EAE42FF878BD6546DBC6893"><enum>(ii)</enum><header>Extensions of
				time</header><text>The period established under subparagraph (B) for any
				investigation of a covered transaction may be extended with respect to any
				particular investigation by the President or by a rollcall vote of at least 2/3
				of the members of the Committee involved in the investigation by the amount of
				time specified by the President or the Committee at the time of the extension,
				not to exceed 45 days, as necessary to collect and fully evaluate information
				relating to—</text>
								<subclause id="HEE8503AD6C964A98ACD00ECC462E035"><enum>(I)</enum><text>the covered
				transaction or parties to the transaction; and</text>
								</subclause><subclause id="H8918CEF6A12741BCBC8E46C327946074"><enum>(II)</enum><text>any effect of the
				transaction that could threaten to impair the national security of the United
				States.</text>
								</subclause></clause></subparagraph><subparagraph commented="no" id="H7E6AB83D34794AEEA226CDE45828188B"><enum>(C)</enum><header>Exception</header><text display-inline="yes-display-inline">Notwithstanding subparagraph (A)(i)(II), an
				investigation of a foreign government-controlled transaction shall not be
				required under this paragraph if the Secretary of the Treasury, the Secretary
				of Homeland Security, and the Secretary of Commerce determine, on the basis of
				the review of the transaction under paragraph (1), that the transaction will
				not affect the national security of the United States and no agreement or
				condition is required, with respect to the transaction, to mitigate any threat
				to the national security (and such authority of each such Secretary may not be
				delegated to any person other than the Deputy Secretary of the Treasury, of
				Homeland Security, or of Commerce, respectively).</text>
						</subparagraph></paragraph><paragraph id="H25432CFC76F240A782408CF49D42C945"><enum>(3)</enum><header>Approval of
				chairperson and vice chairpersons required</header>
						<subparagraph id="H0ABA94F12305452FA62F91DFE4A2EE67"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">A review or
				investigation under this subsection of a covered transaction shall not be
				treated as final or complete until the results of such review or investigation
				are approved by a majority of the members of the Committee in a roll call vote
				and signed by the Secretary of the Treasury, the Secretary of Homeland
				Security, and the Secretary of Commerce (and such authority of each such
				Secretary may not be delegated to any person other than the Deputy Secretary or
				an appropriate Under Secretary of the Treasury, of Homeland Security, or of
				Commerce, respectively).</text>
						</subparagraph><subparagraph display-inline="no-display-inline" id="HF9AEDF1497DF473A83E2CC65BDCDD3AB"><enum>(B)</enum><header>Additional
				action required in certain cases</header><text display-inline="yes-display-inline">In the case of any roll call vote pursuant
				to subparagraph (A) in connection with an investigation under paragraph (2) of
				any foreign government-controlled transaction in which there is at least 1 vote
				by a Committee member against approving the transaction, the investigation
				shall not be treated as final or complete until the findings and report
				resulting from such investigation are signed by the President (in addition to
				the Chairperson and the Vice Chairpersons of the Committee under subparagraph
				(A)).</text>
						</subparagraph><subparagraph id="HA81F24F147B24C14874BA802521F52CD"><enum>(C)</enum><header>Presidential
				action required in certain cases</header><text display-inline="yes-display-inline">In the case of any covered transaction in
				which any party to the transaction is—</text>
							<clause id="H44A71D4675034B44941200F5D8E89560"><enum>(i)</enum><text>a
				person of a country the government of which the Secretary of State has
				determined, for purposes of section 6(j) of the Export Administration Act of
				1979 (as continued in effect pursuant to the International Emergency Economic
				Powers Act), section 40 of the Arms Export Control Act, section 620A of the
				Foreign Assistance Act of 1961, or other provision of law, is a government that
				has repeatedly provided support for acts of international terrorism;</text>
							</clause><clause id="H17E7A0E301054A21B5F7D836EDFAA8B5"><enum>(ii)</enum><text display-inline="yes-display-inline">a government described in clause (i);
				or</text>
							</clause><clause id="H8F43ADEB09634FF4AE835555026825D5"><enum>(iii)</enum><text>person
				controlled, directly or indirectly, by any such government,</text>
							</clause><continuation-text continuation-text-level="subparagraph">a
				review or investigation under this subsection of such covered transaction shall
				not be treated as final or complete until the results of such review or
				investigation are approved and signed by the President.</continuation-text></subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H6F85F5BA0BE0424DB68357E5AC943DC"><enum>(4)</enum><header>Analysis by
				Director of National Intelligence</header>
						<subparagraph id="HB59F0CE32155470CAFFDF1E5BF5F6FD1"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Director of
				National Intelligence shall expeditiously carry out a thorough analysis of any
				threat to the national security of the United States of any covered
				transaction, including making requests for information to the Director of the
				Office of Foreign Assets Control within the Department of the Treasury and the
				Director of the Financial Crimes Enforcement Network. The Director of National
				Intelligence also shall seek and incorporate the views of all affected or
				appropriate intelligence agencies.</text>
						</subparagraph><subparagraph display-inline="no-display-inline" id="HCB0F239988EF43688BF32D60DA7A07E"><enum>(B)</enum><header>Timing</header><text display-inline="yes-display-inline">The Director of National Intelligence shall
				be provided adequate time to complete the analysis required under subparagraph
				(A), including any instance described in paragraph (2)(A)(iii).</text>
						</subparagraph><subparagraph id="HA94456CA9D6E4B05A2A2FAE137E5DB55"><enum>(C)</enum><header>Independent role
				of director</header><text display-inline="yes-display-inline">The Director of
				National Intelligence shall not be a member of the Committee and shall serve no
				policy role with the Committee other than to provide analysis under
				subparagraph (A) in connection with a covered transaction.</text>
						</subparagraph></paragraph><paragraph id="H8B9C3C4FFB6F4C16AD3C3E77EC2BCAA1"><enum>(5)</enum><header>Submission of
				additional information</header><text>No provision of this subsection shall be
				construed as prohibiting any party to a covered transaction from submitting
				additional information concerning the transaction, including any proposed
				restructuring of the transaction or any modifications to any agreements in
				connection with the transaction, while any review or investigation of the
				transaction is on-going.</text>
					</paragraph><paragraph id="HF890210DF22A4A4C92AEFDB7E5DB99DE"><enum>(6)</enum><header>Regulations</header><text>Regulations
				prescribed under this section shall include standard procedures for—</text>
						<subparagraph id="H55A497A6209A47A6BE32CFA2C6FCB1EF"><enum>(A)</enum><text>submitting any
				notice of a proposed or pending covered transaction to the Committee;</text>
						</subparagraph><subparagraph id="H644D175319DA4949ADE200EE03C26367"><enum>(B)</enum><text display-inline="yes-display-inline">submitting a request to withdraw a proposed
				or pending covered transaction from review; and</text>
						</subparagraph><subparagraph id="HCB1965DE217841E995233DFF6CFB8E4C"><enum>(C)</enum><text display-inline="yes-display-inline">resubmitting a notice of proposed or
				pending covered transaction that was previously withdrawn from
				review.</text>
						</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section display-inline="no-display-inline" id="H6B91361C8121457588ECA5905ECAC500"><enum>3.</enum><header>Statutory
			 establishment of the Committee on Foreign Investment in the United
			 States</header>
			<subsection id="HDEAA88EC9B3B4D599E4856111923A66F"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 721 of the
			 Defense Production Act of 1950 (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/50/2170">50 U.S.C. App. 2170</external-xref>) is
			 amended by striking subsection (k) and inserting the following new
			 subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H33B10149112F4B84B6622ECE2F83662E" style="OLC">
					<subsection id="H11351C53AB2444178EABE0D5C3DA0817"><enum>(k)</enum><header>Committee on
				foreign investment in the United States</header>
						<paragraph id="H40CFA0F05B104D01A0E89F6CFCD10000"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Committee on Foreign Investment in the
				United States established pursuant to Executive Order No. 11858 shall be a
				multi-agency committee to carry out this section and such other assignments as
				the President may designate.</text>
						</paragraph><paragraph commented="no" id="HFC2F83DA08524D2AAB703877D5FBBAF"><enum>(2)</enum><header>Membership</header><text>The
				Committee shall be comprised of the following members or the designee of any
				such member:</text>
							<subparagraph commented="no" id="HA226E0F7BA0840FAA18140D5DE10853D"><enum>(A)</enum><text>The Secretary of
				the Treasury.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2CC249EA5EDB4D71B6B499A4FA217DFF"><enum>(B)</enum><text>The Secretary of
				Homeland Security.</text>
							</subparagraph><subparagraph commented="no" id="H87891281541342E1A6C5A9AEF9514021"><enum>(C)</enum><text>The Secretary of
				Commerce.</text>
							</subparagraph><subparagraph commented="no" id="HF0CDEEA5196545B0ACFE401E94C68C75"><enum>(D)</enum><text>The Secretary of
				Defense.</text>
							</subparagraph><subparagraph commented="no" id="HB1B2A64334FE44528151BDE8513C6F4"><enum>(E)</enum><text>The Secretary of
				State.</text>
							</subparagraph><subparagraph commented="no" id="H25EB61F722B747AC81DB2C5BF397F038"><enum>(F)</enum><text>The Attorney
				General.</text>
							</subparagraph><subparagraph commented="no" id="HCFAA7BB929EE4BB186687F25389BE100"><enum>(G)</enum><text>The Secretary of
				Energy.</text>
							</subparagraph><subparagraph commented="no" id="HB5C9B3901F3841E6AF866691D0C91291"><enum>(H)</enum><text>The Chairman of
				the Council of Economic Advisors.</text>
							</subparagraph><subparagraph commented="no" id="H46937435E6934C4B9302F9BB04592473"><enum>(I)</enum><text>The United States
				Trade Representative.</text>
							</subparagraph><subparagraph commented="no" id="HED6E45BCC19E4081B1E0CA74EB12BF3C"><enum>(J)</enum><text>The Director of
				the Office of Management and Budget.</text>
							</subparagraph><subparagraph commented="no" id="H6466A0ED4BD44C039F32AF0021AC19BF"><enum>(K)</enum><text>The Director of
				the National Economic Council.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC63B86122BB84F0781163F32DAEDCDA"><enum>(L)</enum><text>The Director of the
				Office of Science and Technology Policy.</text>
							</subparagraph><subparagraph id="HA4A002FB8B8C42B487AB99F99018930"><enum>(M)</enum><text display-inline="yes-display-inline">The President’s Assistant for National
				Security Affairs.</text>
							</subparagraph><subparagraph commented="no" id="H4703C6CE3F474536BB1F0012D2531BD5"><enum>(N)</enum><text>Any other designee
				of the President from the Executive Office of the President.</text>
							</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="HE818698E9D0D47AD00D69D539FDF90EC"><enum>(3)</enum><header>Chairperson;
				vice chairpersons</header><text display-inline="yes-display-inline">The
				Secretary of the Treasury shall be the Chairperson of the Committee. The
				Secretary of Homeland Security and the Secretary of Commerce shall be the Vice
				Chairpersons of the Committee.</text>
						</paragraph><paragraph id="HDA8764A26C514D449D36A79719867E5B"><enum>(4)</enum><header>Other
				members</header><text display-inline="yes-display-inline">Subject to subsection
				(b)(4)(B), the Chairperson of the Committee shall involve the heads of such
				other Federal departments, agencies, and independent establishments in any
				review or investigation under subsection (b) as the Chairperson, after
				consulting with the Vice Chairpersons, determines to be appropriate on the
				basis of the facts and circumstances of the transaction under investigation (or
				the designee of any such department or agency head).</text>
						</paragraph><paragraph id="H9FA961F7E69648768E9233FC9DB15556"><enum>(5)</enum><header>Meetings</header><text display-inline="yes-display-inline">The Committee shall meet upon the direction
				of the President or upon the call of the Chairperson of the Committee without
				regard to section
				552b of title 5, United States Code (if otherwise
				applicable).</text>
						</paragraph><paragraph id="HB74B221D9F214299AA145120C4BE8115"><enum>(6)</enum><header>Collection of
				evidence</header><text>Subject to subsection (c), the Committee may, for the
				purpose of carrying out this section—</text>
							<subparagraph id="HE78A4CB106294B46B363EC73CCCF462B"><enum>(A)</enum><text>sit and act at
				such times and places, take such testimony, receive such evidence, administer
				such oaths; and</text>
							</subparagraph><subparagraph id="H4647AFE801E548F89F48E49DA6346BBB"><enum>(B)</enum><text>require the
				attendance and testimony of such witnesses and the production of such books,
				records, correspondence, memoranda, papers, and documents as the Chairperson of
				the Committee may determine advisable.</text>
							</subparagraph></paragraph><paragraph id="HF6F32D851B6D425B9BA450EE28CA00FC"><enum>(7)</enum><header>Authorization of
				appropriations</header><text>There are authorized to be appropriated to the
				Secretary of the Treasury for each of fiscal years 2008, 2009, 2010, and 2011
				expressly and solely for the operations of the Committee that are conducted by
				the Secretary, the sum of
				$10,000,000.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H2BC2E18C16484B439198DBDB4E60A15B"><enum>(b)</enum><header>Technical and
			 conforming amendment</header><text>The first sentence of section 721(c) of the
			 Defense Production Act of 1950 (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/50/2170">50 U.S.C. App. 2170(c)</external-xref>) is
			 amended—</text>
				<paragraph id="HB9FDF648977B4608AFB751DA5770ACF2"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>material filed
			 with</quote> and inserting <quote>material, including proprietary business
			 information, filed with, or testimony presented to,</quote>; and</text>
				</paragraph><paragraph id="HEDB38EC814234D4EBD2BFFA6E8E768A7"><enum>(2)</enum><text>by striking
			 <quote>or documentary material</quote> the second place such term appears and
			 inserting <quote>, documentary material, or testimony</quote>.</text>
				</paragraph></subsection></section><section id="HF77118C4F9DF482C914BAEC606C8CB4E"><enum>4.</enum><header>Additional
			 factors required to be considered</header><text display-inline="no-display-inline">Section 721(f) of the Defense Production Act
			 of 1950 (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/50/2170">50 U.S.C. App. 2170(f)</external-xref>) is
			 amended—</text>
			<paragraph id="H40F7B44D74D54C2C9D00D6683F52B8BC"><enum>(1)</enum><text>in the matter
			 preceding paragraph (1)—</text>
				<subparagraph commented="no" id="H6F76CFB37766460CB79FBE531BBFE12C"><enum>(A)</enum><text>by striking
			 <quote>may</quote> and inserting <quote>shall</quote>; and</text>
				</subparagraph><subparagraph id="H2289F46649434BC800BD38E9B3EF269"><enum>(B)</enum><text>by striking

					<paragraph id="H8C9AF4723A60484AB500240057343D4B"><enum>(6)</enum><text display-inline="yes-display-inline">whether the covered transaction has a
				security-related impact on critical infrastructure in the United States;</text>
					</paragraph><paragraph display-inline="no-display-inline" id="HA48455DC22F54093B249C4611EE3C6B"><enum>(7)</enum><text display-inline="yes-display-inline">the potential effects of the covered
				transaction on the efforts of the United States to curtail human smuggling (and
				such term, for purposes of this paragraph, means any act constituting a
				violation of section 274(a) of the Immigration and Nationality Act) and to
				curtail drug smuggling with regard to any country which is not described in
				paragraphs (1) and (2) of section 1003(a) of the Controlled Substances Import
				and Export Act;</text>
					</paragraph><paragraph id="H6173A4F4FE994C4AB832753FC100B91E"><enum>(8)</enum><text display-inline="yes-display-inline">whether the covered transaction is a
				foreign government-controlled transaction; and</text>
					</paragraph><paragraph id="H426F025890B244998F2D052143B81C36"><enum>(9)</enum><text>such other factors
				as the President or the President’s designee may determine to be appropriate,
				generally or in connection with a specific review or
				investigation.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H6FBE2B1E6E274EDD8C63D2DB9D017B13"><enum>5.</enum><header>Nonwaiver of
			 sovereign immunity</header><text display-inline="no-display-inline">Section
			 721(d) of the Defense Production Act of 1950 (50 U.S.C. App.
			 2170(d)) is amended by adding at the end the following new
			 sentence: <quote>The United States shall not be held liable for any losses or
			 other expenses incurred by any party to a covered transaction as a result of
			 actions taken under this section after a covered transaction has been
			 consummated if the party did not submit a written notice of the transaction to
			 the Chairperson of the Committee under subsection (b)(1)(C) or did not wait
			 until the completion of any review or investigation under subsection (b), or
			 the end of the 15-day period referred to in this subsection, before
			 consummating the transaction.</quote>.</text>
		</section><section id="H3D7D4BBD18164991B4DC0871A3AEA9FC"><enum>6.</enum><header>Mitigation,
			 tracking, and post-consummation monitoring and enforcement</header><text display-inline="no-display-inline">Section 721 of the Defense Production Act of
			 1950 (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/50/2170">50 U.S.C. App. 2170</external-xref>) is
			 amended by inserting after subsection (k) (as amended by section 3 of this Act)
			 the following new subsection:</text>
			<quoted-block display-inline="no-display-inline" id="H74853FF545884FE1ACAFCB3E2EBC657E" style="OLC">
				<subsection id="H7931643F83284AA194539D2EB84FA4CE"><enum>(l)</enum><header>Mitigation,
				tracking, and postconsummation monitoring and enforcement</header>
					<paragraph id="HF6979244E56545359FF1D1B0009E51CF"><enum>(1)</enum><header>Mitigation</header>
						<subparagraph id="H36E016CDEAF145A6820406DF9E7701CC"><enum>(A)</enum><header>In
				general</header><text>The Committee or any agency designated by the Chairperson
				and Vice Chairpersons may, on behalf of the Committee, negotiate, enter into or
				impose, and enforce any agreement or condition with any party to a covered
				transaction in order to mitigate any threat to the national security of the
				United States that arises as a result of the transaction.</text>
						</subparagraph><subparagraph id="HEB88ED83E9004E7194B539C5D880C982"><enum>(B)</enum><header>Risk-based
				analysis required</header><text display-inline="yes-display-inline">Any
				agreement entered into or condition imposed under subparagraph (A) shall be
				based on a risk-based analysis, conducted by the Committee, of the threat to
				national security of the covered transaction.</text>
						</subparagraph></paragraph><paragraph id="HBB167E4E077A4AF6A600C839923416C9"><enum>(2)</enum><header>Tracking
				authority for withdrawn notices</header>
						<subparagraph id="H37F63D18EF8B4F3A923F77C2884EA6DB"><enum>(A)</enum><header>In
				general</header><text>If any written notice of a covered transaction that was
				submitted to the Committee under this section is withdrawn before any review or
				investigation by the Committee under subsection (b) is completed, the Committee
				shall establish, as appropriate—</text>
							<clause id="HA362BFB177E448E3B607D49F7480A3D8"><enum>(i)</enum><text>interim
				protections to address specific concerns with such transaction that have been
				raised in connection with any such review or investigation pending any
				resubmission of any written notice under this section with respect to such
				transaction and further action by the President under this section;</text>
							</clause><clause id="H2D678D41BC1D48CB8F123F824B3FBCF0"><enum>(ii)</enum><text>specific
				timeframes for resubmitting any such written notice; and</text>
							</clause><clause id="H300F689C7A8248AFB3EE7277EC291E24"><enum>(iii)</enum><text>a process for
				tracking any actions that may be taken by any party to the transaction, in
				connection with the transaction, before the notice referred to in clause (ii)
				is resubmitted.</text>
							</clause></subparagraph><subparagraph id="H9A62E7D2C1B3498FBC9500C1C9129446"><enum>(B)</enum><header>Designation of
				agency</header><text display-inline="yes-display-inline">The Committee may
				designate 1 or more appropriate Federal departments or agencies, other than any
				entity of the intelligence community (as defined in the National Security Act
				of 1947), as a lead agency to carry out, on behalf of the Committee, the
				requirements of subparagraph (A) with respect to any covered transaction that
				is subject to such subparagraph.</text>
						</subparagraph></paragraph><paragraph id="HD36F7B41B7174B11881D836E2B223582"><enum>(3)</enum><header>Negotiation,
				modification, monitoring, and enforcement</header>
						<subparagraph id="HAC03C73F7E404C778760587B53FE311D"><enum>(A)</enum><header>Designation of
				agency</header><text>The Committee shall designate 1 or more Federal
				departments or agencies as the lead agency to negotiate, modify, monitor, and
				enforce, on behalf of the Committee, any agreement entered into or condition
				imposed under paragraph (1) with respect to a covered transaction based on the
				expertise with and knowledge of the issues related to such transaction on the
				part of the designated department or agency.</text>
						</subparagraph><subparagraph id="H7FC23416274E476998697B00511F6248"><enum>(B)</enum><header>Reporting by
				designated agency</header>
							<clause id="H3C0A5BFC94044B1295C958BD41B11BAB"><enum>(i)</enum><header>Implementation
				reports</header><text>Each Federal department or agency designated by the
				Committee as a lead agency under subparagraph (A) in connection with any
				agreement entered into or condition imposed under paragraph (1) with respect to
				a covered transaction shall—</text>
								<subclause id="H636D39B618A64A39A297EFE76466E46"><enum>(I)</enum><text display-inline="yes-display-inline">report, as appropriate but not less than
				once in each 6-month period, to the Chairperson and Vice Chairpersons of the
				Committee on the implementation of such agreement or condition; and</text>
								</subclause><subclause id="H7F5FBA90ABE240439481C0237DBB0492"><enum>(II)</enum><text display-inline="yes-display-inline">require, as appropriate, any party to the
				covered transaction to report to the head of such department or agency (or the
				designee of such department or agency head) on the implementation or any
				material change in circumstances.</text>
								</subclause></clause><clause id="H7BCB907D342445ECB338A5000B2FDC6"><enum>(ii)</enum><header>Modification
				reports</header><text display-inline="yes-display-inline">Any Federal
				department or agency designated by the Committee as a lead agency under
				subparagraph (A) in connection with any agreement entered into or condition
				imposed with respect to a covered transaction shall—</text>
								<subclause id="HAACA04EECA5D493EA09625BE122BD641"><enum>(I)</enum><text>provide periodic
				reports to the Chairperson and Vice Chairpersons of the Committee on any
				modification to any such agreement or condition imposed with respect to the
				transaction; and</text>
								</subclause><subclause id="HB65196C69D584BBCA05BDE0063C34539"><enum>(II)</enum><text>ensure that any
				significant modification to any such agreement or condition is reported to the
				Director of National Intelligence and to any other Federal department or agency
				that may have a material interest in such modification.</text>
								</subclause></clause><clause display-inline="no-display-inline" id="HEA8A194AAB7D4528A399F99E1FCECFA"><enum>(iii)</enum><header>Compliance</header><text>The
				Committee shall develop and agree upon methods for evaluating compliance with
				any agreement entered into or condition imposed with respect to a covered
				transaction that will allow the Committee to adequately assure compliance
				without—</text>
								<subclause id="H130D89D2883B4A3380B74FE0B169A6A0"><enum>(I)</enum><text display-inline="yes-display-inline">unnecessarily diverting Committee resources
				from assessing any new covered transaction for which a written notice has been
				filed pursuant to subsection (b)(1)(C), and if necessary reaching a mitigation
				agreement with or imposing a condition on a party to such covered transaction
				or any covered transaction for which a review has been reopened for any reason;
				or</text>
								</subclause><subclause id="H785FECA4B0BF4F7A8614096D34423347"><enum>(II)</enum><text display-inline="yes-display-inline">placing unnecessary burdens on a party to a
				covered
				transaction.</text>
								</subclause></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H771DC0022E34497B9CE42964B38E01D"><enum>7.</enum><header>Increased
			 oversight by the congress</header>
			<subsection id="HBC09AF29338A40079E8D881C0000FFAE"><enum>(a)</enum><header>Report on
			 actions</header><text display-inline="yes-display-inline">Section 721(g) of the
			 Defense Production Act of 1950 (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/50/2170">50 U.S.C. App. 2170</external-xref>) is
			 amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="HC48F3BDF8118482900542BA0331DB0E9" style="OLC">
					<subsection id="H94059B92483B432CB77BE3C0B9C8CD15"><enum>(g)</enum><header>Reports to the
				congress</header>
						<paragraph id="H42ED75D436F4429F87457306C7703203"><enum>(1)</enum><header>Reports on
				completed committee investigations</header>
							<subparagraph id="H1A7C14B2845C4487A8B742E84113A6DD"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">Not later than 5 days
				after the completion of a Committee investigation of a covered transaction
				under subsection (b)(2), or, if the President indicates an intent to take any
				action authorized under subsection (d) with respect to the transaction, after
				the end of 15-day period referred to in subsection (d), the Chairperson or a
				Vice Chairperson of the Committee shall submit a written report on the findings
				or actions of the Committee with respect to such investigation, the
				determination of whether or not to take action under subsection (d), an
				explanation of the findings under subsection (e), and the factors considered
				under subsection (f), with respect to such transaction, to—</text>
								<clause id="HD9FAACFC87DF4CCFA368C83F50A405BD"><enum>(i)</enum><text>the Majority
				Leader and the Minority Leader of the Senate;</text>
								</clause><clause id="H42013305C7C3413DA21872005D0801A7"><enum>(ii)</enum><text>the Speaker and
				the Minority Leader of the House of Representatives;</text>
								</clause><clause id="H21E67C036FD2417AABF17BA37E8DBE97"><enum>(iii)</enum><text display-inline="yes-display-inline">the chairman and ranking member of each
				committee of the House of Representatives and the Senate with jurisdiction over
				any aspect of the covered transaction and its possible effects on national
				security, including, at a minimum, the Committee on Foreign Affairs, the
				Committee on Financial Services, and the Committee on Energy and Commerce of
				the House of Representatives; and</text>
								</clause><clause id="H6B610285C121451EBD558FC1FBC1B15E"><enum>(iv)</enum><text>Senators
				representing States and Members of Congress representing congressional
				districts that would be significantly affected by the covered
				transaction.</text>
								</clause></subparagraph><subparagraph id="H51BD4BDE70794F90ABCFB735FDC476EF"><enum>(B)</enum><header>Notice and
				briefing requirement</header><text display-inline="yes-display-inline">If a
				written request for a briefing on a covered transaction, or on compliance with
				a mitigation agreement or condition imposed with respect to such transaction,
				is submitted to the Committee by any Senator or Member of Congress who receives
				a report on the transaction under subparagraph (A), the Chairperson or a Vice
				Chairperson (or such other person as the Chairperson or a Vice Chairperson may
				designate) shall provide 1 classified briefing to each House of the Congress
				from which any such briefing request originates in a secure facility of
				appropriate size and location that shall be open only to the Majority Leader
				and the Minority Leader of the Senate, the Speaker and the Minority Leader of
				the House of Representatives, (as the case may be) the chairman and ranking
				member of each committee of the House of Representatives or the Senate (as the
				case may be) with jurisdiction over any aspect of the covered transaction and
				its possible effects on national security, including, at a minimum, the
				Committee on Foreign Affairs, the Committee on Financial Services, and the
				Committee on Energy and Commerce of the House of Representatives, and
				appropriate staff members who have security clearance.</text>
							</subparagraph></paragraph><paragraph id="HC9C8CCD206974E119CB2D34318058066"><enum>(2)</enum><header>Application of
				other provision</header>
							<subparagraph id="H775E2A05E98D4EDF8D09CB1657E81890"><enum>(A)</enum><header>In
				general</header><text>The disclosure of information under this subsection shall
				be consistent with the requirements of subsection (c). Members of Congress and
				staff of either House or any committee of the Congress shall be subject to the
				same limitations on disclosure of information as are applicable under such
				subsection.</text>
							</subparagraph><subparagraph id="HBB7F9CB9B353415E80E18E00C0F1F2F"><enum>(B)</enum><header>Proprietary
				information</header><text display-inline="yes-display-inline">Proprietary
				information which can be associated with a particular party to a covered
				transaction shall be furnished in accordance with subparagraph (A) only to a
				committee of the Congress and only when the committee provides assurances of
				confidentiality, unless such party otherwise consents in writing to such
				disclosure.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HE667AF7364C94E158ED367C11EDB6828"><enum>(b)</enum><header>Annual
			 report</header><text display-inline="yes-display-inline">Section 721 of the
			 Defense Production Act of 1950 (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/50/2170">50 U.S.C. App. 2170</external-xref>) is
			 amended by inserting after subsection (l) (as added by section 6 of this Act)
			 the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="HD94F674560494541AAFC156900E3CB7" style="OLC">
					<subsection id="HCEDB3138B93B4ADBA29FD568EA730097"><enum>(m)</enum><header>Annual report to
				the congress</header>
						<paragraph id="H5ADEDEB1B60E46D08C074C3DC7F2F7D"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Chairperson of
				the Committee shall transmit a report to the chairman and ranking member of
				each committee of the House of Representatives and the Senate with jurisdiction
				over any aspect of the report, including, at a minimum, the Committee on
				Foreign Affairs, the Committee on Financial Services, and the Committee on
				Energy and Commerce of the House of Representatives, before July 31 of each
				year on all the reviews and investigations of covered transactions completed
				under subsection (b) during the 12-month period covered by the report.</text>
						</paragraph><paragraph id="H75E170AB29E3421C93AA6CBDEE6BDCC5"><enum>(2)</enum><header>Contents of
				report relating to covered transactions</header><text display-inline="yes-display-inline">The report under paragraph (1) shall
				contain the following information with respect to each covered
				transaction:</text>
							<subparagraph id="HA9F7B1FE9A1C4C1A87A884445DA65D8E"><enum>(A)</enum><text display-inline="yes-display-inline">A list of all notices filed and all reviews
				or investigations completed during the period with basic information on each
				party to the transaction, the nature of the business activities or products of
				all pertinent persons, along with information about the status of the review or
				investigation, information on any withdrawal from the process, any rollcall
				votes by the Committee under this section, any extension of time for any
				investigation, and any presidential decision or action under this
				section.</text>
							</subparagraph><subparagraph id="H46C548C778F44100AA3FC29346813643"><enum>(B)</enum><text display-inline="yes-display-inline">Specific, cumulative, and, as appropriate,
				trend information on the numbers of filings, investigations, withdrawals, and
				presidential decisions or actions under this section.</text>
							</subparagraph><subparagraph id="H99D00FD130DA468E992400EA75F87D00"><enum>(C)</enum><text display-inline="yes-display-inline">Cumulative and, as appropriate, trend
				information on the business sectors involved in the filings which have been
				made, and the countries from which the investments have originated.</text>
							</subparagraph><subparagraph id="H2A2A50744FFA4E9DB6D92E3F7E772B00"><enum>(D)</enum><text>Information on
				whether companies that withdrew notices to the Committee in accordance with
				subsection (b)(1)(C)(ii) have later re-filed such notices, or, alternatively,
				abandoned the transaction.</text>
							</subparagraph><subparagraph id="HA7AEBDA0246045B68400F55F1BF0A1A2"><enum>(E)</enum><text display-inline="yes-display-inline">The types of security arrangements and
				conditions the Committee has used to mitigate national security concerns about
				a transaction, including a discussion of the methods the Committee and any lead
				departments or agencies designated under subsection (l) are using to determine
				compliance with such arrangements or conditions.</text>
							</subparagraph><subparagraph id="H4C1A58A700C947CFAB15B404FFC7E736"><enum>(F)</enum><text display-inline="yes-display-inline">A detailed discussion of all perceived
				adverse effects of covered transactions on the national security or critical
				infrastructure of the United States that the Committee will take into account
				in its deliberations during the period before delivery of the next such report,
				to the extent possible.</text>
							</subparagraph></paragraph><paragraph id="HE14648E85248496280D564CDC71600CD"><enum>(3)</enum><header>Contents of
				report relating to critical technologies</header>
							<subparagraph id="H779F09E367D74C8891E600EA395B5E21"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">In order to assist
				the Congress in its oversight responsibilities with respect to this section,
				the President and such agencies as the President shall designate shall include
				in the annual report submitted under paragraph (1) the following:</text>
								<clause id="H3B1428EA79CF4511B0C110F5A77B237C"><enum>(i)</enum><text>An
				evaluation of whether there is credible evidence of a coordinated strategy by 1
				or more countries or companies to acquire United States companies involved in
				research, development, or production of critical technologies for which the
				United States is a leading producer.</text>
								</clause><clause id="HAB1DD9F7EBAE4CADACBA973001878C1"><enum>(ii)</enum><text>An
				evaluation of whether there are industrial espionage activities directed or
				directly assisted by foreign governments against private United States
				companies aimed at obtaining commercial secrets related to critical
				technologies.</text>
								</clause></subparagraph><subparagraph id="H44C541D343464AC191A0BB7679AE07D2"><enum>(B)</enum><header>Critical
				technologies defined</header><text display-inline="yes-display-inline">For
				purposes of this paragraph, the term <term>critical technologies</term> means
				technologies identified under title VI of the National Science and Technology
				Policy, Organization, and Priorities Act of 1976 or other critical technology,
				critical components, or critical technology items essential to national defense
				or national security identified pursuant to this section.</text>
							</subparagraph><subparagraph id="HDDA622A6D64445B2846DD9AD8D4E5782"><enum>(C)</enum><header>Release of
				unclassified study</header><text display-inline="yes-display-inline">That
				portion of the annual report under paragraph (1) that is required by this
				paragraph may be classified. An unclassified version of that portion of the
				report shall be made available to the
				public.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection display-inline="no-display-inline" id="HE2ED28D0B97047B5A025D1E6949EDEA7"><enum>(c)</enum><header>Study and
			 report</header>
				<paragraph id="H38A6B3CBA0A2471182BAF9C4EDC14E37"><enum>(1)</enum><header>Study
			 required</header><text display-inline="yes-display-inline">Before the end of
			 the 120-day period beginning on the date of the enactment of this Act and
			 annually thereafter, the Secretary of the Treasury, in consultation with the
			 Secretary of State and the Secretary of Commerce, shall conduct a study on
			 investments in the United States, especially investments in critical
			 infrastructure and industries affecting national security, by—</text>
					<subparagraph id="HAEEAA776E8DE472581B8B793270161C3"><enum>(A)</enum><text display-inline="yes-display-inline">foreign governments, entities controlled by
			 or acting on behalf of a foreign government, or persons of foreign countries
			 which comply with any boycott of Israel; or</text>
					</subparagraph><subparagraph id="H723F26B1EE744663B3763565D9437888"><enum>(B)</enum><text display-inline="yes-display-inline">foreign governments, entities controlled by
			 or acting on behalf of a foreign government, or persons of foreign countries
			 which do not ban organizations designated by the Secretary of State as foreign
			 terrorist organizations.</text>
					</subparagraph></paragraph><paragraph id="HCEE9111453394274B008ADF267BC009C"><enum>(2)</enum><header>Report</header><text display-inline="yes-display-inline">Before the end of the 30-day period
			 beginning upon completion of each study under paragraph (1) or in the next
			 annual report under section 721(m) of the Defense Production Act of 1950 (as
			 added by subsection (b)), the Secretary of the Treasury shall submit a report
			 to the Congress, for transmittal to all appropriate committees of the Senate
			 and the House of Representatives, containing the findings and conclusions of
			 the Secretary with respect to the study described in paragraph (1), together
			 with an analysis of the effects of such investment on the national security of
			 the United States and on any efforts to address those effects.</text>
				</paragraph></subsection><subsection display-inline="no-display-inline" id="HC5133222A23842F896BE197BF55638F8"><enum>(d)</enum><header>Investigation by
			 inspector general</header>
				<paragraph id="H541D705EA4DC42B19FD566F00E42EEA"><enum>(1)</enum><header>In
			 general</header><text>The Inspector General of the Department of the Treasury
			 shall conduct an independent investigation to determine all of the facts and
			 circumstances concerning each failure of the Department of the Treasury to make
			 any report to the Congress that was required under section 721(k) of the
			 Defense Production Act of 1950 (as in effect before the date of the enactment
			 of this Act).</text>
				</paragraph><paragraph id="HBC925E64864C441C8EF2EE7E78001EDB"><enum>(2)</enum><header>Report to the
			 congress</header><text>Before the end of the 270-day period beginning on the
			 date of the enactment of this Act, the Inspector General of the Department of
			 the Treasury shall submit a report to the chairman and ranking member of each
			 committee of the House of Representatives and the Senate with jurisdiction over
			 any aspect of the report, including, at a minimum, the Committee on Foreign
			 Affairs, the Committee on Financial Services, and the Committee on Energy and
			 Commerce of the House of Representatives, on the investigation under paragraph
			 (1) containing the findings and conclusions of the Inspector General.</text>
				</paragraph></subsection></section><section id="H26D90BA0D5E949B9B08DCD3BB6AAFE86"><enum>8.</enum><header>Certification of
			 notices and assurances</header><text display-inline="no-display-inline">Section
			 721 of the Defense Production Act of 1950 (50 U.S.C. App.
			 2170) is amended by inserting after subsection (m) (as added by
			 section 7(b) of this Act) the following new subsection:</text>
			<quoted-block display-inline="no-display-inline" id="H8BD89649423D4B8FBD368660F9BE7E9" style="OLC">
				<subsection id="H5CAC6802E5FC43EB9DAF9E4F47DC025"><enum>(n)</enum><header>Certification of
				notices and assurances</header><text display-inline="yes-display-inline">Each
				notice required to be submitted, by a party to a covered transaction, to the
				President or the President's designee under this section and regulations
				prescribed under such section, and any information submitted by any such party
				in connection with any action for which a report is required pursuant to
				paragraph (3)(B)(ii) of subsection (l) with respect to the implementation of
				any mitigation agreement or condition described in paragraph (1)(A) of such
				subsection, or any material change in circumstances, shall be accompanied by a
				written statement by the chief executive officer or the designee of the person
				required to submit such notice or information certifying that, to the best of
				the person’s knowledge and belief—</text>
					<paragraph id="H3DD01A9B6A56418A853E4F3C6155FD69"><enum>(1)</enum><text display-inline="yes-display-inline">the notice or information submitted fully
				complies with the requirements of this section or such regulation, agreement,
				or condition; and</text>
					</paragraph><paragraph id="H0059725682FF42488E39F2642593A5A2"><enum>(2)</enum><text display-inline="yes-display-inline">the notice or information is accurate and
				complete in all material
				respects.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H42905BC0D33D472BB65FDEA0880079A2"><enum>9.</enum><header>Regulations</header><text display-inline="no-display-inline">Section 721(h) of the Defense Production Act
			 of 1950 (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/50/2170">50 U.S.C. App. 2170(h)</external-xref>) is
			 amended to read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="H68F11770A1E843448CCEA4DDA8105C00" style="OLC">
				<subsection id="H7AA2339A102140DF989162AC01BFCAD"><enum>(h)</enum><header>Regulations</header><text>The
				President shall direct the issuance of regulations to carry out this section.
				Such regulations shall, to the extent possible, minimize paperwork burdens and
				shall to the extent possible coordinate reporting requirements under this
				section with reporting requirements under any other provision of Federal
				law.</text>
				</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H969F76A510814A59B7D883DF034D7EA5"><enum>10.</enum><header>Effect on other
			 law</header><text display-inline="no-display-inline">Section 721(i) of the
			 Defense Production Act of 1950 (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/50/2170">50 U.S.C. App. 2170(i)</external-xref>) is
			 amended to read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="HD7C89A1349C345B886862743C5F70436" style="OLC">
				<subsection id="H90D4975BE9614450AD679F2959C135EF"><enum>(i)</enum><header>Effect on other
				law</header><text display-inline="yes-display-inline">No provision of this
				section shall be construed as altering or affecting any other authority,
				process, regulation, investigation, enforcement measure, or review provided by
				or established under any other provision of Federal law, including the
				International Emergency Economic Powers Act, or any other authority of the
				President or the Congress under the Constitution of the United
				States.</text>
				</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H0476AA2AE09A4E54AC3B0539105D96B1"><enum>11.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">The amendments made by
			 this Act shall apply after the end of the 90-day period beginning on the date
			 of the enactment of this Act.</text>
