<official-title display="yes">To amend the Runaway and Homeless Youth Act to authorize appropriations, and for other purposes.</official-title>

<section id="HC5E2FC2D0DCF4231A20598EFEAA8C1EA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Reconnecting Homeless Youth Act of 2008</short-title></quote>.</text></section> 
<section id="H1FD42CEE08FE4220ACF73E656E92E9D1"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Section 302 of the Runaway and Homeless Youth Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5701">42 U.S.C. 5701</external-xref>) is amended—</text> 
<paragraph id="H2B216C47424847DC836828C8878768A6"><enum>(1)</enum><text>by redesignating paragraphs (3), (4), and (5) as paragraphs (4), (5), and (6), respectively, and</text></paragraph> 
<paragraph id="H6922F88073474ECEAF4CE6B602892716"><enum>(2)</enum><text>inserting after paragraph (2) the following:</text> 
<quoted-block style="OLC" id="HE76A7BDCD0BB4F62B048D51D12E3A000" display-inline="no-display-inline"> 
<paragraph id="HE5170B331A3843A296CD2B758F48ADC0"><enum>(3)</enum><text>services to such young people should be developed and provided using a positive youth development approach that ensures the young person a sense of—</text> 
<subparagraph id="H6A4E73A6BFE14964B785CCE1B6F8BF8B"><enum>(A)</enum><text>safety and structure;</text></subparagraph> 
<subparagraph id="H8BF3955CA7FE441A9DEEC8FBF10086C5"><enum>(B)</enum><text>belonging and membership;</text></subparagraph> 
<subparagraph id="H251B6A5E02044F2FBFE65673A232B4BF"><enum>(C)</enum><text>self-worth and social contribution;</text></subparagraph> 
<subparagraph id="H7EA379227B404B05AE2B46753F1D796D"><enum>(D)</enum><text>independence and control over one’s life; and</text></subparagraph> 
<subparagraph id="HDFFE7A481BAE47E687D627AB26F455D5"><enum>(E)</enum><text>closeness in interpersonal relationships;</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H9675FF97587C483F84979D3C145B8EDE"><enum>3.</enum><header>Grants for centers and services</header><text display-inline="no-display-inline">Section 311 of the Runaway and Homeless Youth Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5711">42 U.S.C. 5711</external-xref>) is amended—</text> 
<paragraph id="H94961F8ADA2B4C09BC4DEEE4E5AA5C00"><enum>(1)</enum><text>in subsection (a)(2)(B)(i) by inserting before the semicolon the following:</text> 
<quoted-block style="OLC" id="H00BAD5A55F8242BC9F5D65B29BEB01CA" display-inline="no-display-inline"> 
<quoted-block-continuation-text quoted-block-continuation-text-level="clause">provided for a continuous period not to exceed 15 days, except that such shelter may be provided for a continuous period not to exceed 21 days if the State where the center is located has an applicable State or local law or regulation that permits a length of stay in excess of such 15 days in compliance with licensure requirements for child and youth serving facilities</quoted-block-continuation-text><after-quoted-block>,</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HBF8937AF3A1E450FA743C1DB33633612"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b)—</text> 
<subparagraph id="HAAB3D6CED6354A37A9AD3F221256AA98"><enum>(A)</enum><text>in paragraph (2)—</text> 
<clause id="H794200C76B4949D99809AEF67F2BD7B6"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>The</quote> and inserting <quote>(A) Except as provided in subparagraph (B) and to the extent that sufficient funds are available, the</quote>, </text></clause> 
<clause id="H792A0D0589324E0DBEB7008FA307E8E3"><enum>(ii)</enum><text>by striking <quote>$100,000</quote> and inserting <quote>$150,000</quote>,</text></clause> 
<clause id="HF6DB277D422A4D2E89EB3C00DE3E4805"><enum>(iii)</enum><text>by striking <quote>$45,000</quote> and inserting <quote>$70,000</quote>, and</text></clause> 
<clause id="H88EA277B39D44488BCA0E2379C965B51"><enum>(iv)</enum><text>by adding at the end the following: </text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="H373C3B8D53464BAE8F87DBE74768FF8B"> 
<subparagraph id="HF65EB3097C2046C9AB310076436254F3" indent="up1"><enum>(B) </enum><text display-inline="yes-display-inline">For fiscal years 2009 and 2010, the amount allotted under paragraph (1) with respect to a State for a fiscal year shall be not less than the amount alotted with respect to such State for fiscal year 2008.</text></subparagraph><after-quoted-block>,</after-quoted-block></quoted-block></clause> </subparagraph> 
<subparagraph id="H33E9B574E8384E8CA6DE9B8FB08B112"><enum>(B)</enum><text>by redesignating paragraph (3) as paragraph (4), and</text></subparagraph> 
<subparagraph id="H6E200679D2754B9A8850BDD260A45790"><enum>(C)</enum><text>by inserting after paragraph (2) the following:</text> 
<quoted-block style="OLC" id="HCB22B0C720834FD99E0328FF75557B8C" display-inline="no-display-inline"> 
<paragraph id="H9CD11388F38B4400B8B9593129C47D26"><enum>(3)</enum><text display-inline="yes-display-inline">Whenever the Secretary determines that any part of the amount allotted under paragraph (1) with respect to a State will not be obligated before the end of the fiscal year, the Secretary shall reallot such part under paragraph (1) with respect to the remaining States for obligation for such fiscal year.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section> 
<section id="H9397F854409B4356AFBF6D26FD3F85DA"><enum>4.</enum><header>Basic center grant program eligibility</header><text display-inline="no-display-inline">Section 312(b) of the Runaway and Homeless Youth Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5712">42 U.S.C. 5712(b)</external-xref>) is amended—</text> 
<paragraph id="HD1341E41F6894361A1B74775F196CE00"><enum>(1)</enum><text>in paragraph (11) by striking <quote>and</quote> at the end,</text></paragraph> 
<paragraph id="H712A6D9E55B7498A8000FD788C5800ED"><enum>(2)</enum><text>in paragraph (12) by striking the period at the end and inserting <quote>; and</quote>, and</text></paragraph> 
<paragraph id="H3E490F2203324146B7F97DAAB7C15990"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following: </text> 
<quoted-block style="OLC" id="H7D253BB1646A47C5A927A708FE5111FC" display-inline="no-display-inline"> 
<paragraph id="H49699F0C2FB14E6B8FE41CF6DB159447"><enum>(13)</enum><text display-inline="yes-display-inline">shall develop an adequate emergency preparedness and management plan.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HE4D2BCE142D84D8AA5A8F504B300F2AC"><enum>5.</enum><header>Transitional living grant program eligibility</header><text display-inline="no-display-inline">Section 322(a) of the Runaway and Homeless Youth Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2714-2">42 U.S.C. 2714-2(a)</external-xref>) is amended—</text> 
<paragraph id="H5D11783AD0964DFC876600AC6F6B1288"><enum>(1)</enum><text>in paragraph (1)—</text> 
<subparagraph id="HF7AFD92904EC469EB657F6F65D9C55"><enum>(A)</enum><text>by striking <quote>indirectly</quote> the 1st place it appears and inserting <quote>by contract</quote>, and </text></subparagraph> 
<subparagraph id="H75C784FB3C1B4268BE3B581D002983DD"><enum>(B)</enum><text>by striking <quote>and services</quote> and inserting <quote>, and to provide, directly or indirectly, services</quote>,</text></subparagraph></paragraph> 
<paragraph id="H623232827627436CB26C5DB4C7313621"><enum>(2)</enum><text>in paragraph (2)—</text> 
<subparagraph id="H2C5DEB58E7F844309C5EA1D3F6FABDD2"><enum>(A)</enum><text>by striking <quote>except that a youth</quote> and inserting the following: </text>

<subparagraph id="H161F4F97A70A40EEB561761E52175270"><enum>(B)</enum><text>by inserting <quote>such youth may</quote> after <quote>program,</quote>, and</text></subparagraph> 
<subparagraph id="HFB70C6C958104D249371D84825EDAC"><enum>(C)</enum><text>by striking <quote>period;</quote> and inserting the following: </text> 
<quoted-block style="OLC" id="HB217B7668F9045F899B57DAFBD256071" display-inline="no-display-inline"> 
<quoted-block-continuation-text quoted-block-continuation-text-level="clause">period; and</quoted-block-continuation-text> 
<clause id="H06E44D25AE9F41A0B8DC00FDBF764220"><enum>(ii)</enum><text display-inline="yes-display-inline">a program that is located in a State that has an applicable State or local law or regulation that permits a length of stay in excess of such 540-day period in compliance with licensure requirements for child and youth serving facilities, a youth may remain in such program throughout a continuous period not to exceed 635 days;</text></clause><after-quoted-block>,</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H9C1812D48AD94F03A1AB2EBCF249EDD0"><enum>(3)</enum><text>in paragraph (14) by striking <quote>and</quote> at the end,</text></paragraph> 
<paragraph id="HF7108190E487488C922C181C53B400E2"><enum>(4)</enum><text>in paragraph (15) by striking the period at the end and inserting <quote>; and</quote>, and</text></paragraph> 
<paragraph id="H4DC10A4F31E948D3A1858B7BE68C001C"><enum>(5)</enum><text display-inline="yes-display-inline">by adding at the end the following: </text>

<section id="HDD59001F43004159002F8726EBB90286"><enum>6.</enum><header>Research, evaluation, demonstration, and service projects</header><text display-inline="no-display-inline">Section 343 of the Runaway and Homeless Youth Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5714-23">42 U.S.C. 5714-23</external-xref>)) is amended—</text> 
<paragraph id="H8D42FBD37E3340B59F2044A2CE4EBD66" commented="no"><enum>(1)</enum><text>in subsection (b)—</text> 
<subparagraph id="H1D72BDF748D84F69AE59BADCEDEB3E24" commented="no"><enum>(A)</enum><text>in the matter preceding paragraph (1)—</text>

<subparagraph id="H84CF9182ABFB4BB19D12DBD458CE78F" commented="no"><enum>(D)</enum><text>by adding at the end the following: </text>

<paragraph id="HBA1A63DCEE964D8BB8423F6B1FDEC05E" commented="no"><enum>(10)</enum><text display-inline="yes-display-inline">programs, including innovative programs, that assist youth in obtaining and maintaining safe and stable housing, and may include programs with supportive services that continue after program completion.</text></paragraph><after-quoted-block>, and</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H0D79A2557D4C48B4AB792E8C0718207F"><enum>(2)</enum><text display-inline="yes-display-inline">by amending subsection (c) to read as follows: </text> 
<quoted-block style="OLC" id="H5F764B29538841F6ADAEBFC093ECF4A9" display-inline="no-display-inline"> 
<subsection id="HBC8DF4DF53BF4EE094EC4800CE065660"><enum>(c)</enum><text>In selecting among applicants for grants under subsection (a), the Secretary shall—</text> 
<paragraph id="H3620842D31594570BDC900E801F6E01D"><enum>(1)</enum><text>give priority to applicants who have experience working with runaway youth or homeless youth; and</text></paragraph> 
<paragraph id="H6FFE508EEE1F4952BCFB899CFEE51925"><enum>(2)</enum><text>ensure that the applicants selected—</text> 
<subparagraph id="H6D20824CBDCE434D858CFAAD0F6F3EA"><enum>(A)</enum><text>are geographically representative of different regions of the United States; and</text></subparagraph> 
<subparagraph id="HFD04D94A277B476986C1A6A7E3BD1DC"><enum>(B)</enum><text>carry out projects that serve diverse populations of runaway or homeless youth.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H3A4803E2154D4DA59EA94369C4991CCA"><enum>7.</enum><header>Estimate of incidence and prevalence of youth homelessness</header><text display-inline="no-display-inline">Part D of the Runaway and Homeless Youth Act (42 U.S.C. 5714-21–5714-24) is amended by adding at the end the following: </text> 
<quoted-block style="OLC" id="H5E704F703FD4451C876300EBCD6C462D" display-inline="no-display-inline"> 
<section id="HC978EBD992C643CF8E1DFEDECC6FAEA2"><enum>345.</enum><header>Periodic estimate of incidence and prevalence of youth homelessness</header> 
<subsection id="H077010C28E854E9EBFFFFF916D255822"><enum>(a)</enum><header>Periodic estimate</header><text>Not later than 2 years after the effective date of this section, and at 5-year intervals thereafter, the Secretary, in coordination with the United States Interagency Council on Homelessness, shall prepare and submit to the Committee on Education and Labor of the House of Representatives and the Committee on Judiciary of the Senate, and make public, a report—</text> 
<paragraph id="HEBA02BE94BDB459A9EBAE5D16B6100F8"><enum>(1)</enum><text>by using the best quantitative and qualitative social science research method available, containing an estimate of the incidence and prevalence of runaway and homeless individuals who are less than 26 years of age and not less than 13 years of age; and</text></paragraph> 
<paragraph id="H97DD1BD0909A4F85B737C03BB2103BEA"><enum>(2)</enum><text>that includes with such estimate an assessment of the characteristics of such individuals.</text></paragraph></subsection> 
<subsection id="HDEC1F128A0DD4CBE9097A119024DF94"><enum>(b)</enum><header>Content</header><text>The report required by subsection (a) shall include—</text> 
<paragraph id="H6C668CC2D24B468A937865BDE0CEE60"><enum>(1)</enum><text>the results of conducting a survey of, and direct interviews with, a representative sample of runaway and homeless individuals who are less than 26 years of age and not less than 13 years of age, to determine past and current—</text> 
<subparagraph id="H94281F093E6C4954B8E0B3746646F6FB"><enum>(A)</enum><text>socioeconomic characteristics of such individuals;</text></subparagraph> 
<subparagraph id="HCF51426DE7CB430580FDF249EB80097"><enum>(B)</enum><text>barriers to such individuals obtaining—</text> 
<clause id="HBA948CC237EC40D485EE417521430073"><enum>(i)</enum><text>safe, quality, and affordable housing;</text></clause> 
<clause id="H67584FC594F4432B979200C14311D79F"><enum>(ii)</enum><text>comprehensive and affordable health insurance and health services; and</text></clause> 
<clause id="H3583A8FA96CF413CA65014880775F93C"><enum>(iii)</enum><text>incomes, public benefits, supportive services, and connections to caring adults; and</text></clause></subparagraph> 
<subparagraph id="H3D4BE33A1BE5403886102F1100090241"><enum>(C)</enum><text>such other information that the Secretary determines, in consultation with States, units of local government, and national nongovernmental organizations concerned with homelessness, may be useful.</text></subparagraph></paragraph></subsection> 
<subsection id="H2C7F8C645A284B3C8F5CBEC9D85EFD43"><enum>(c)</enum><header>Implementation</header><text>If the Secretary enters into any contract with a non-Federal entity for purposes of carrying out subsection (a), such entity shall be a nongovernmental organization, or an individual, determined by the Secretary to have appropriate expertise in quantitative and qualitative social science research.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H4D8B8075B31B407E97B90000BF2D935D"><enum>8.</enum><header>Sexual abuse prevention program</header><text display-inline="no-display-inline">Section 351(b) of the Runaway and Homeless Youth Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5714-41">42 U.S.C. 5714–41(b)</external-xref>) is amended by inserting <quote>public and</quote> after <quote>priority to</quote>. </text></section> 
<section id="HB5D1F124F47C48BC86EA4FF41E029E7B"><enum>9.</enum><header>National homeless youth awareness campaign</header><text display-inline="no-display-inline">The Runaway and Homeless Youth Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5701">42 U.S.C. 5701 et seq.</external-xref>) is amended—</text> 
<paragraph id="HC6700012D0B0483A8031006BBDC5DD08"><enum>(1)</enum><text>by redesignating part F as part G, and</text></paragraph> 
<paragraph id="H1513F1B6393B4CE5B8A3E67AB00FE2B"><enum>(2)</enum><text>by inserting after part E the following:</text> 
<quoted-block style="OLC" id="HE51B5D3185DF4833A3FCFC6F6049CF2D" display-inline="no-display-inline"> 
<part id="HC7BFE207BCE34C4BA4E5466C359C8D27"><enum>F</enum><header>National Homeless Youth Awareness Campaign</header> 
<section id="HC9256CCAEE2B4036A9D392FACFC2DBCD"><enum>361.</enum><header>National homeless youth awareness campaign</header> 
<subsection id="HC266BC05DEFD4EF4B44EBED3E3AB66B1"><enum>(a)</enum><header>In general</header><text>The Secretary shall, directly or through grants or contracts, conduct a national homeless youth awareness campaign (referred to in this section as the <quote>national awareness campaign</quote>) in accordance with this section for purposes of—</text> 
<paragraph id="HAAAE4EA839304AF9A979A39E872D5985"><enum>(1)</enum><text>increasing awareness of individuals of all ages, socioeconomic backgrounds, and geographic locations, of the issues facing runway and homeless youth, the resources available for these youth, and the tools available for the prevention of youth runaway and homeless situations; and</text></paragraph> 
<paragraph id="H088E317AF2B245A4A8F95952D4D58E70"><enum>(2)</enum><text>encouraging parents, guardians, educators, health care professionals, social service professionals, law enforcement officials, and other community members to seek to prevent runaway youth and youth homelessness by assisting youth in averting or resolving runaway and homeless situations.</text></paragraph></subsection> 
<subsection id="HF70CD40538F940E0A621B4A33672B295"><enum>(b)</enum><header>Use of funds</header><text>Funds made available to carry out this section for the national awareness campaign may be used only for the following:</text> 
<paragraph id="HB6A120E9E01D4AB7A23F69AA8D00917E"><enum>(1)</enum><text>The dissemination of educational information and materials through various media, including television, radio, the Internet and related technologies, and emerging technologies.</text></paragraph> 
<paragraph id="H53EF23CBD8CE4EA699E4C26D3D0374EF"><enum>(2)</enum><text>Partnerships, including outreach activities, with national organizations concerned with youth homelessness, community-based youth service organizations (including faith-based organizations), and government organizations related to the national awareness campaign.</text></paragraph> 
<paragraph id="H8FB38D022664403684323288C0BE4B88" commented="no"><enum>(3)</enum><text>In accordance with applicable laws and regulations, the development and placement of public service announcements in telecommunications media, including the Internet and related technologies and emerging technologies, that educate the public on the issues facing runaway and homeless youth (or youth considering running away) and on the opportunities that adults have to assist such youth.</text></paragraph> 
<paragraph id="H4881842CA62145C6B2F5F9D9C8FEAC1"><enum>(4)</enum><text>Evaluation of the effectiveness of the national awareness campaign.</text></paragraph> </subsection> 
<subsection id="H06E893FBB55F498AA6A059ED5CBA25A6"><enum>(c)</enum><header>Prohibitions</header><text>None of the funds made available under subsection (b) may be obligated or expended for any of the following:</text> 
<paragraph id="H3C2D32D2DC0F428BB3C049616566DA92"><enum>(1)</enum><text>To supplant pro bono public service time donated by national or local broadcasting networks, advertising agencies, production companies, or other pro bono work for the national awareness campaign.</text></paragraph> 
<paragraph id="H09B5F542F2D148709EF81B87A870458B"><enum>(2)</enum><text>For partisan political purposes, or express advocacy in support of or to defeat any clearly identified candidate, clearly identified ballot initiative, or clearly identified legislative or regulatory proposal.</text></paragraph> 
<paragraph id="H72DE555237C04AD299A023C28B5B85D0"><enum>(3)</enum><text>To fund advertising that features any elected officials, persons seeking elected office, cabinet level officials, or other Federal employees employed in positions in schedule C of part 213 of title 5 of the Code of Federal Regulations (January 1, 2008), as amended from time to time.</text></paragraph> 
<paragraph id="H9CA5E8CD70314D7F8B6364CF34C99486"><enum>(4)</enum><text>To fund advertising that does not contain a primary message intended to educate the public on the issues facing runaway and homeless youth (or youth considering running away) or on the opportunities for adults to help such youth.</text></paragraph> 
<paragraph id="H7D67D1FFFA6E4DE0BB0605C0E5905F6F" commented="no"><enum>(5)</enum><text>To fund advertising that solicits contributions to support the national awareness campaign.</text></paragraph></subsection> 
<subsection id="HFA3C07E74ACD4FCB8E065FCAD06C04CA"><enum>(d)</enum><header>Financial and performance accountability</header><text>The Secretary shall perform—</text> 
<paragraph id="H49524031185048168974FA7627BB02E6"><enum>(1)</enum><text>audits and reviews of costs of the national awareness campaign pursuant to section 304C of the Federal Property and Administrative Services Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/41/254d">41 U.S.C. 254d</external-xref>); and</text></paragraph> 
<paragraph id="H37BA564F6DDD46C7A8C767F94076FE"><enum>(2)</enum><text>an audit to determine whether the costs of the national awareness campaign are allowable under section 306 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/41/256">41 U.S.C. 256</external-xref>).</text></paragraph></subsection> 
<subsection id="H80D1B74CE23B4ED5B5BB4F9F8D2EB47"><enum>(e)</enum><header>Report</header><text>The Secretary shall include in each report submitted under section 382 a summary of the national awareness campaign that describes—</text> 
<paragraph id="H484A74D44C004BC4BFDAD1E70033FFE2" commented="no"><enum>(1)</enum><text>the activities undertaken by the national awareness campaign;</text></paragraph> 
<paragraph id="H2B5C0BE6A8554B7AABBB3411A891DF09"><enum>(2)</enum><text>steps taken to ensure that the national awareness campaign operates in an effective and efficient manner consistent with the overall strategy and focus of the national awareness campaign; and</text></paragraph> 
<paragraph id="H714FB6693F494B138516F03CAF004734"><enum>(3)</enum><text>each grant made to, or contract entered into with, a particular corporation, partnership, or individual working on the national awareness campaign.</text></paragraph></subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HC055EB87DC084AF0BF15972F5F5D6D25"><enum>10.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 387 of the Runaway and Homeless Youth Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5732a">42 U.S.C. 5732a</external-xref>) is amended—</text> 
<paragraph id="H66BAB364D04949E4A9165CC5E42CF8BA"><enum>(1)</enum><text>in paragraph (3)(A)—</text> 
<subparagraph id="H0CD8EB278BD94506814FC82BB83693C6"><enum>(A)</enum><text>in clause (i)—</text> 
<clause id="H6978A6A4BD4C477A87CA67E5A701135"><enum>(i)</enum><text>by striking <quote>not more than</quote> each place it appears and inserting <quote>less than</quote>, and</text></clause> 
<clause id="HD2FE70501D464DE396A68400807E4600"><enum>(ii)</enum><text>by inserting after <quote>age</quote> the last place it appears the following:</text> 
<quoted-block style="OLC" id="HD185919974FA4FA6843DC574EE01FC83" display-inline="no-display-inline"> 
<quoted-block-continuation-text quoted-block-continuation-text-level="clause">, or until attaining a higher maximum age if the State where the center is located has an applicable State or local law or regulation that permits such higher maximum age in compliance with licensure requirements for child and youth serving facilities</quoted-block-continuation-text><after-quoted-block>, and</after-quoted-block></quoted-block></clause></subparagraph> 
<subparagraph id="H46003FBDE2DC47C58B9FDA3EFE745012"><enum>(B)</enum><text>in clause (ii) by striking <quote>age;</quote> and inserting the following:</text> 
<quoted-block style="OLC" id="H71252505D1E54A6BAEACD0391BC149CB" display-inline="no-display-inline"> 
<quoted-block-continuation-text quoted-block-continuation-text-level="clause">age and either—</quoted-block-continuation-text> 
<subclause id="H4617E0259B484659906207DC073CA420" changed="deleted"><enum>(I)</enum><text>less than 22 years of age; or</text></subclause> 
<subclause id="H50AED19F05C94FF685BBCEAD6494244B"><enum>(II)</enum><text display-inline="yes-display-inline">an age exceeding 22 years of age as of the expiration of the maximum period of stay permitted under section 322(a)(2)(ii) if such individual commences such stay before attaining 22 years of age; </text></subclause><after-quoted-block>, and</after-quoted-block></quoted-block></subparagraph> </paragraph> 
<paragraph id="H0261F6B3879F435100E93159BFF9E7FD"><enum>(2)</enum><text>by redesignating paragraphs (4) through (7) as paragraphs (5) through (8), respectively.</text></paragraph> </section> 
<section id="HB60C8A9E1A5749A981F44B675C9DF0A0"><enum>11.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">Section 388(a) of the Runaway and Homeless Youth Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5751">42 U.S.C. 5751(a)</external-xref>) is amended—</text>

<section id="H5D0E9DE012D2468DA5ACB8477801CA7D"><enum>12.</enum><header>Performance standards</header><text display-inline="no-display-inline">The Runaway and Homeless Youth Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5701">42 U.S.C. 5701 et seq.</external-xref>) is amended by adding at the end the following: </text>

<section id="H5C5F66DE58924F7282FA3D0019C9E327"><enum>390.</enum><header>Performance standards</header> 
<subsection id="H787E09393FF242F7B826E0076C1D2F00"><enum>(a)</enum><header>Establishment of performance standards</header><text>Not later than 1 year after the effective date of this section, the Secretary shall establish by rule performance standards applicable to public and nonprofit private entities and agencies that receive grants under sections 311, 321, and 351.</text></subsection> 
<subsection id="H48BE01B206244C48BDBA5BAE0460FC6C"><enum>(b)</enum><header>Implementation of performance standards</header><text>The Secretary shall integrate performance standards established under subsection (a) into the Secretary’s processes for grant-making, monitoring, and evaluation for programs under sections 311, 321, and 351.</text></subsection> 
<subsection id="H2F722155AF7E458BB7EE2FD8E301F328"><enum>(c)</enum><header>Consultation</header><text>The Secretary shall consult with representatives of public and private entities and agencies that receive grants under this title, statewide and regional nonprofit organizations (and combinations of such organizations) that receive grants under this title, and national nonprofit organizations concerned with youth homelessness in developing the performance standards required by subsection (a).</text></subsection> 
<subsection id="HB45E736BCA5843E1B3D01B20F0C17DA"><enum>(d)</enum><header>Public comment</header><text>The Secretary shall provide an opportunity for public comment concerning the establishment of the performance standards required by subsection (a) before issuing rules to establish such standards, and shall maintain an official record of such public comment.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H6DCE72FBDCC541EE8BE2334C820039C9"><enum>13.</enum><header>GAO study and report</header> 
<subsection id="H3FBF781C5E164B0896009648FAD65252"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">The Comptroller General shall conduct a study of, and make findings and recommendations relating to, the process for making grants under parts A, B, and E of the Runaway and Homeless Youth Act, with respect to—</text> 
<paragraph id="H4A30784555BA4866AAA386A47EFBD2E"><enum>(1)</enum><text>the written responses made by the Secretary of Health and Human Services to (and any other methods for communicating with) grant applicants who are do not receive a grant under part A, B, or E of such Act, to determine if the information provided in such responses to such applicants is conveyed clearly,</text></paragraph> 
<paragraph id="H3169C10E8B3C441BA26FFAFAACAAB723"><enum>(2)</enum><text>the structure of the grant application and associated documents (including announcements that grants are available under such parts), to determine if such application is structured so that the applicant has a clear understanding of what is required in each provision to successfully complete the application, including a clear explanation of terminology required to be used by the applicant throughout the document,</text></paragraph> 
<paragraph id="H48A0D1A3807E4A6400E470C7FD57D2F1"><enum>(3)</enum><text>the peer review process (if any) used to review grant applications (including the selection of peer reviewers) and the oversight of the peer review process by employees of the Department of Health and Human Services, as well as the extent to which such employees make funding determinations based on the comments and scores of the individuals who perform peer reviews,</text></paragraph> 
<paragraph id="HD9F884F7B1BB4C5E89A2981B4F42A558"><enum>(4)</enum><text>the typical time frame and the process used by such employees, including employee responsibilities, for responding to applicants and the efforts taken to communicate with applicants when there is a delay of decisions on applications or when funds to carry out this title are not appropriated before the beginning of the then current fiscal year, and </text></paragraph> 
<paragraph id="H1B3BCF481376401AB4C834CFEEF3AD67" commented="no"><enum>(5)</enum><text>the plans for and implementation of, where practicable, the new training and technical assistance programs and their effect on the grant application process.</text></paragraph></subsection> 
<subsection id="H012D0B5564D14614B0C27935A600AE00"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Comptroller General shall submit a report to the Committee on Education and Labor of the House of Representatives and the Committee on Judiciary of the Senate, containing a summary of the results of the study conducted under subsection (a), together with the findings and recommendations made by the Comptroller General based on such results.</text></subsection></section>
