			 securities by Federal credit unions</header><text display-inline="no-display-inline">Section 107 of the
			 <act-name parsable-cite="FCUA">Federal Credit Union Act</act-name> (12 U.S.C.
			 1757) is amended—</text>
			<paragraph id="H862729E5B5224BBB86BC4B616715FF7E"><enum>(1)</enum><text>by striking
			 <quote>A Federal credit union</quote> and inserting <quote>(a)
			 <header-in-text level="subsection" style="OLC">In general</header-in-text>.—A
			 Federal credit union</quote>; and</text>
			</paragraph><paragraph id="H1E6C4136ACB14F029708F968BA48A563"><enum>(2)</enum><text>by adding at the
			 end the following new subsection:</text>
				<quoted-block id="H0BC86CFC6B8047398BA2B4085070A25E">
					<subsection id="HADC82DDAC2404D48A9F0F86340965C6"><enum>(b)</enum><header>Investment for
				the credit union’s own account</header>
						<paragraph id="H3E8AAE3FD8C04F028939CE4393F7002C"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">In addition to the
				investments authorized in subsection (a), a Federal credit union may purchase
				and hold for its own account such investment securities of investment grade as
				the Board may authorize by regulation, subject to such limitations and
				restrictions as the Board may prescribe in the regulations.</text>
						</paragraph><paragraph id="H0665B0EC76A94E19AC096FF54C0049CE"><enum>(2)</enum><header>Percentage
				limitations</header>
							<subparagraph id="HE961D54DBE9C4A46991B85CFFC9716E1"><enum>(A)</enum><header>Single
				obligor</header><text>In no event may the total amount of investment securities
				of any single obligor or maker held by a Federal credit union for the credit
				union’s own account exceed at any time an amount equal to 10 percent of the net
				worth of the credit union.</text>
							</subparagraph><subparagraph id="H02D0CF0625E2456A92F9EBE4900B58E"><enum>(B)</enum><header>Aggregate
				investments</header><text>In no event may the aggregate amount of investment
				securities held by a Federal credit union for the credit union’s own account
				exceed at any time an amount equal to 10 percent of the assets of the credit
				union.</text>
							</subparagraph></paragraph><paragraph id="H1819E2E74EAA4697B79942022C486566"><enum>(3)</enum><header>Investment
				security defined</header>
							<subparagraph id="H3390DD58B5A84CEB997658F5E8161425"><enum>(A)</enum><header>In
				general</header><text>For purposes of this subsection, the term
				<term>investment security</term> means marketable obligations evidencing the
				indebtedness of any person in the form of bonds, notes, or debentures and other
				instruments commonly referred to as investment securities.</text>
							</subparagraph><subparagraph id="HE32400EA4DCE4781B7728858EAF93BD1"><enum>(B)</enum><header>Further
				definition by Board</header><text>The Board may further define the term
				<term>investment security</term>.</text>
							</subparagraph></paragraph><paragraph id="HF82003CD82F84586824C25045FD4B6A0"><enum>(4)</enum><header>Investment grade
				defined</header><text>The term <term>investment grade</term> means with respect
				to an investment security purchased by a credit union for its own account, an
				investment security that at the time of such purchase is rated in one of the 4
				highest rating categories by at least 1 nationally recognized statistical
				rating organization.</text>
						</paragraph><paragraph id="HCA2159497B2347B78BA4FBF41C559DD9"><enum>(5)</enum><header>Clarification of
				prohibition on stock ownership</header><text>No provision of this subsection
				shall be construed as authorizing a Federal credit union to purchase shares of
				stock of any corporation for the credit union’s own account, except as
				otherwise permitted by
				law.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H7BB49BAA5B934BDDA481D888678F198F"><enum>3.</enum><header>Increase in
			 investment limit in credit union service organizations</header><text display-inline="no-display-inline">Section 107(a)(7)(I) of the
			 <act-name parsable-cite="FCUA">Federal Credit Union Act</act-name> (12 U.S.C.
			 1757(7)(I)) (as so redesignated by section 2(1)) is amended by striking
			 <quote>up to 1 per centum of the total paid</quote> and inserting <quote>up to
			 3 percent of the total paid</quote>.</text>
		</section><section display-inline="no-display-inline" id="HAC001A526BF8470FB659142ED3158487" section-type="subsequent-section"><enum>4.</enum><header>Member business loan
			 exclusion for loans to nonprofit religious organizations</header><text display-inline="no-display-inline">Section 107A(a) of the
			 <act-name parsable-cite="FCUA">Federal Credit Union Act</act-name> (12 U.S.C.
			 1757a(a)) is amended by inserting <quote>, excluding loans made to nonprofit
			 religious organizations,</quote> after <quote>total amount of such
			 loans</quote>.</text>
		</section><section id="H21334A38E90F4F70823B8951D94CF67"><enum>5.</enum><header>Authority of NCUA
			 to establish longer maturities for certain credit union loans</header><text display-inline="no-display-inline">Section 107(a)(5) of the
			 <act-name parsable-cite="FCUA">Federal Credit Union Act</act-name> (12 U.S.C.
			 1757(5)) (as so redesignated by section 2(1)) is amended in the matter
			 preceding subparagraph (A), by striking <quote>except as otherwise provided
			 herein</quote> and inserting <quote>or any longer maturity as the Board may
			 allow, in regulations, except as otherwise provided in this Act</quote>.</text>
		</section><section id="H180B20F4DBAE47D6807882FC61E33330"><enum>6.</enum><header>Providing the
			 National Credit Union Administration with greater flexibility in responding to
			 market conditions</header><text display-inline="no-display-inline">Section
			 107(a)(5)(A)(vi)(I) of the <act-name parsable-cite="FCUA">Federal Credit Union
			 Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/12/1757">12 U.S.C. 1757(5)(A)(vi)(I)</external-xref>) (as so redesignated by section
			 2(1)) is amended by striking <quote>six-month period and that prevailing
			 interest rate levels</quote> and inserting <quote>6-month period or that
			 prevailing interest rate levels</quote>.</text>
		</section><section id="HB4C14FB4890943CFAC9F66C0C347E11F"><enum>7.</enum><header>Conversions of
			 certain credit unions to a community charter</header><text display-inline="no-display-inline">Section 109(g) of the
			 <act-name parsable-cite="FCUA">Federal Credit Union Act</act-name> (12 U.S.C.
			 1759(g)) is amended by inserting after paragraph (2) the following new
			 paragraph:</text>
			<quoted-block act-name="Federal" id="H956CFF1DF95A4DCBB1699BE07916DB2D">
				<paragraph id="H9C28906D55864E269CBED5BC2546E714"><enum>(3)</enum><header>Criteria for
				continued membership of certain member groups in community charter
				conversions</header><text display-inline="yes-display-inline">In the case of a
				voluntary conversion of a common-bond credit union described in paragraph (1)
				or (2) of subsection (b) into a community credit union described in subsection
				(b)(3), the Board shall prescribe, by regulation, the criteria under which the
				Board may determine that a member group or other portion of a credit union’s
				existing membership, that is located outside the well-defined local community,
				neighborhood, or rural district that shall constitute the community charter,
				can be satisfactorily served by the credit union and remain within the
				community credit union’s field of
				membership.</text>
				</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H47E5CA2A029342BA998D97CC82027653"><enum>8.</enum><header>Credit union
			 participation in the SBA section 504 program</header><text display-inline="no-display-inline">Section 107(a)(5)(A)(iii) of the Federal
			 Credit Union Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1757">12 U.S.C. 1757(5)(A)(iii)</external-xref>) (as so redesignated by section
			 2(1)) is amended by inserting <quote>, and applicable regulations,</quote>
			 after <quote>specified in the law</quote>.</text>
		</section><section id="H06396D363D7E4B6286BC84D10305F858"><enum>9.</enum><header>Amendments
			 relating to credit union service to underserved areas</header>
			<subsection id="H29E5ACFC96DF442C95C3236B4309F4D9"><enum>(a)</enum><header>In
			 general</header><text>Paragraph (2) of section 109(c) of the Federal Credit
			 Union Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1759">12 U.S.C. 1759(c)(2)</external-xref>) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H58FC9A4411C84350A807751F1EB74F1D" style="OLC">
					<paragraph id="HCA86E1204F2043189BAAE52802EB5138"><enum>(2)</enum><header>Exception for
				underserved areas</header>
						<subparagraph id="H24B7146D501C4E8096A2CD3EAAAB9B8"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">Notwithstanding
				subsection (b), the Board may approve an application by a Federal credit union
				to allow the membership of such credit union to include any person or
				organization whose principal residence or place of business is located within a
				local community, neighborhood, or rural district if—</text>
							<clause id="H40099092C86C415D8F0053DFECC1470"><enum>(i)</enum><text display-inline="yes-display-inline">the Board determines—</text>
								<subclause id="HF3164B46B82547C5AE325042C482EA8F"><enum>(I)</enum><text>at any time after
				August 7, 1998, that all of the local community, neighborhood, or rural
				district taken into account for purposes of this paragraph is an underserved
				area (as defined in section 101(10)); and</text>
								</subclause><subclause id="H08EF0C50844B4A10B893F37B4BA19063"><enum>(II)</enum><text>at the time of
				such approval, that the credit union is well capitalized or adequately
				capitalized (as defined in section 216(c)(1)); and</text>
								</subclause></clause><clause id="H3B73849488494C22B9A789647D5600BC"><enum>(ii)</enum><text display-inline="yes-display-inline">before the end of the 24-month period
				beginning on the date of such approval, the credit union has established and
				maintains an office or facility in the local community, neighborhood, or rural
				district at which credit union services are available.</text>
							</clause></subparagraph><subparagraph id="HD54284C1E4E94A5793B0047DDDAF12BD"><enum>(B)</enum><header>Termination of
				approval</header><text>Any failure of a Federal credit union to meet the
				requirement of clause (ii) of subparagraph (A) by the end of the 24-month
				period referred to in such clause shall constitute a termination, as a matter
				of law, of any approval of an application under this paragraph by the Board
				with respect to the membership of such credit union.</text>
						</subparagraph><subparagraph id="H3499F2CDF26249A5AE95CFA33FB27435"><enum>(C)</enum><header>Annual credit
				union reporting requirement</header><text display-inline="yes-display-inline">Any Federal credit union which has an
				application approved under this paragraph shall submit an annual report to the
				Administration on the number of members of the credit union who are members by
				reason of such application and the number of offices or facilities maintained
				by the credit union in the local community, neighborhood, or rural district
				taken into account by the Board in approving such application.</text>
						</subparagraph><subparagraph id="H3455C2A0FFCE45B1BE29BCD5AB1B5240"><enum>(D)</enum><header>Publication by
				administration</header><text>The Administration shall publish annually a report
				containing—</text>
							<clause id="HE2168DB4E0C24C7D9DCF19A38FFECA96"><enum>(i)</enum><text>a
				list of all the applications approved under this paragraph prior to the
				publication of the report;</text>
							</clause><clause id="H466576E21FBE4F56B600E53606EB1B56"><enum>(ii)</enum><text>the number and
				locations of the underserved areas taken into account in approving such
				applications; and</text>
							</clause><clause id="HC4DC9EBB3FF44FB782026EFF0926D8B4"><enum>(iii)</enum><text>the total number
				of members of credit unions who are members by reason of the approval of such
				applications.</text>
							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H474341D5EB3247318587BA62857902BA"><enum>(b)</enum><header>Underserved area
			 defined</header><text>Section 101 of the Federal Credit Union Act (12 U.S.C.
			 1752) is amended—</text>
				<paragraph id="H3C77C81172B24F0E848586B380F4E182"><enum>(1)</enum><text>by striking
			 <quote>and</quote> at the end of paragraph (8);</text>
				</paragraph><paragraph id="H1F98CA5B366240AE91A291DC5190455D"><enum>(2)</enum><text>by striking the
			 period at the end of paragraph (9) and inserting <quote>; and</quote>;
			 and</text>
				</paragraph><paragraph id="H850BCE2487F84AF7A48524FC4D10F5D9"><enum>(3)</enum><text>by adding at the
			 end the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="H7FB1E3B04B0E445DB5DE86A298B66790" style="OLC">
						<paragraph id="HC6731165969945C3B5611C77E5A8BFD"><enum>(10)</enum><text display-inline="yes-display-inline">the term <quote>underserved area</quote>
				means a geographic area consisting of a single census tract or a group of
				census tracts, each of which meets the criteria for—</text>
							<subparagraph id="HB2999E72F0724231A400BAAB001D16FE"><enum>(A)</enum><text display-inline="yes-display-inline">a low income community, as defined in
				<external-xref legal-doc="usc" parsable-cite="usc/26/45D">section 45D(e)</external-xref> of the Internal Revenue Code of 1986; or</text>
							</subparagraph><subparagraph id="H17B8CD966D2F4E0D94542D37581E94C0"><enum>(B)</enum><text display-inline="yes-display-inline">an investment area, as defined and
				designated under section 103(16) of the Community Development Banking and
				Financial Institutions Act of
				1994.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="HC9521D72CB2F46BFB5FE89AB15552F00"><enum>10.</enum><header>Short-term
			 payday loan alternatives within field of membership</header><text display-inline="no-display-inline">Section 107(a)(12)(B) of the Federal Credit
			 Union Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1757">12 U.S.C. 1757(12)(B)</external-xref>) (as so redesignated by section 2(1)) is
			 amended by inserting <quote>and provide short-term loans as an alternative to
			 payday loans</quote> after <quote>domestic electronic fund transfers</quote>.</text>
		</section><section id="H5516F0242BE84EBC009D925DF0FDAC72"><enum>11.</enum><header>Credit union
			 governance</header>
			<subsection id="HC2F31717206A4DD2A42E5899681C725D"><enum>(a)</enum><header>Expulsion of
			 members for just cause</header><text display-inline="yes-display-inline">Subsection (b) of section 118 of the
			 <act-name parsable-cite="FCUA">Federal Credit Union Act</act-name> (12 U.S.C.
			 1764(b)) is amended to read as follows:</text>
				<quoted-block act-name="Federal" id="H61C54617D2C743A19BB53B2E00CAF84C">
					<subsection id="H1E2FBF506A74453282FDB5F919EEAD46"><enum>(b)</enum><header>Policy and
				actions of boards of directors of Federal credit unions</header>
						<paragraph id="H8F1261AAC1AC4932BC8B9D2742B39C3D"><enum>(1)</enum><header>Expulsion of
				members for nonparticipation or for just cause</header><text>The board of
				directors of a Federal credit union may, by majority vote of a quorum of
				directors, adopt and enforce a policy with respect to expulsion from
				membership, by a majority vote of such board of directors, based on just cause,
				including disruption of credit union operations, or on nonparticipation by a
				member in the affairs of the credit union.</text>
						</paragraph><paragraph id="H80DCFA0978424A108FEC906474CFFF25"><enum>(2)</enum><header>Written notice
				of policy to members</header><text>If a policy described in paragraph (1) is
				adopted, written notice of the policy as adopted and the effective date of such
				policy shall be provided to—</text>
							<subparagraph id="HF2BD7A34090C4C548F6822EBB575BA01"><enum>(A)</enum><text>each existing
				member of the credit union not less than 30 days prior to the effective date of
				such policy; and</text>
							</subparagraph><subparagraph id="H9C8CF72D579B49A5B5DDFB16DE76900"><enum>(B)</enum><text>each new member
				prior to or upon applying for
				membership.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HDCDB958F242842CDBE117DA700DB4191"><enum>(b)</enum><header>Term limits
			 authorized for Board members of Federal credit unions</header><text>Section
			 111(a) of the <act-name parsable-cite="FCUA">Federal Credit Union
			 Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/12/1761">12 U.S.C. 1761(a)</external-xref>) is amended by adding at the end the
			 following new sentence: <quote>The bylaws of a Federal credit union may limit
			 the number of consecutive terms any person may serve on the board of directors
			 of such credit union.</quote>.</text>
			</subsection></section><section id="HB532DF1233F1420D9837D352FC19350"><enum>12.</enum><header>Encouraging small
			 business development in underserved urban and rural communities</header><text display-inline="no-display-inline">Section 107A(c)(1)(B) of the Federal Credit
			 Union Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1757a">12 U.S.C. 1757a(c)(1)(B)</external-xref>) is amended—</text>
			<paragraph id="HECA2CBB8D8C345139718E341422EAD63"><enum>(1)</enum><text>by striking
			 <quote>or</quote> after the semicolon at the end of clause (iv);</text>
			</paragraph><paragraph id="H38B199498D9D4EBBA500CBC94D77FD5"><enum>(2)</enum><text>by
			 redesignating clause (v) as clause (vi); and</text>
			</paragraph><paragraph id="H164325719EFF4199AE9F30D327893D03"><enum>(3)</enum><text>by inserting after
			 clause (iv) the following new clause:</text>
				<quoted-block display-inline="no-display-inline" id="HFF1EDB9A56914E28AE71F51DF06BB6EF" style="OLC">
					<clause id="HB03B49DE0CCC4C98883663C71011058F"><enum>(v)</enum><text display-inline="yes-display-inline">that is made to a member, the proceeds of
				which are to be used for commercial, corporate, business, farm or agricultural
				purposes in an underserved area if such extension of credit—</text>
						<subclause id="H7D967F73FDA941728B6FA5BAA83058E"><enum>(I)</enum><text display-inline="yes-display-inline">is made to a person or organization whose
				principal residence or place of business is located within an underserved area
				(as defined in section 101(10)) served by the credit union; or</text>
						</subclause><subclause id="HB8BBA4B0938D4DE7919BFD404841C597"><enum>(II)</enum><text display-inline="yes-display-inline">is secured by real property located within,
				or is intended to operate as part of a business located within, such
				underserved area;
				or</text>
						</subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section display-inline="no-display-inline" id="HBA2EBCF387DC4790930058B3D2007BD9" section-type="subsequent-section"><enum>13.</enum><header>Exemption from
			 pre-merger notification requirement of the <act-name parsable-cite="CLAY">Clayton Act</act-name></header><text display-inline="no-display-inline">Section 7A(c)(7) of the
			 <act-name parsable-cite="CLAY">Clayton Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/18a">15 U.S.C. 18a(c)(7)</external-xref>) is
			 amended by inserting <quote>section 205(b)(3) of the
			 <act-name parsable-cite="FCUA">Federal Credit Union Act</act-name> (12 U.S.C.
