		<official-title>To reduce youth usage of tobacco products, to enhance
		  State efforts to eliminate retail sales of tobacco products to minors, and for
		  other purposes.</official-title>

		<section id="H1DC6FCE0ABBD46F68DBF25FD20AA27F6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Stop Adolescent Smoking Without
			 Excessive Bureaucracy Act of 2008</short-title></quote>.</text>
		</section><section id="HF0D21A25C21B48460003975622E700B1"><enum>2.</enum><header>Youth compliance
			 target and enforcement</header>
			<subsection id="H102320533D504499BFBC6180C92F9ED7"><enum>(a)</enum><header>Amendment</header><text display-inline="yes-display-inline">Section 1926 of the Public Health Service
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300x-26">42 U.S.C. 300x–26</external-xref>) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H03D76A80483C4AA39FF09E75E924E631" style="OLC">
					<section id="H15B1E30EFD104A28AEF6EA92EA68426E"><enum>1926.</enum><header>Strengthening
				State laws relating to tobacco product sales to individuals under the age of
				18</header>
						<subsection id="HD11CF3DF9305459892AC772650B0A4AE"><enum>(a)</enum><header>Relevant
				law</header>
							<paragraph id="H46F443F1578D460FA1575578B3DEE800"><enum>(1)</enum><header>In
				general</header><text>Subject to paragraph (2), for fiscal year 2010 and
				subsequent fiscal years, the Secretary may make a grant under section 1921 only
				if the State involved has in effect a law providing that—</text>
								<subparagraph id="H7E55E1CFB30147C7B38E9C983FF0EFCE"><enum>(A)</enum><text>it is unlawful for
				any manufacturer, retailer, or distributor of tobacco products to sell or
				distribute any such product to any individual under 18 years of age;</text>
								</subparagraph><subparagraph id="H99D0BE4580D44F59B641F6D601847217"><enum>(B)</enum><text>it is unlawful for
				an individual under 18 years of age—</text>
									<clause id="H4ABEE05F64E846E3AC3760A062E30371"><enum>(i)</enum><text>to
				purchase or attempt to purchase, or receive or attempt to receive, a tobacco
				product; or</text>
									</clause><clause id="HE1D9D32F9B8F47079646562D05CC7FB0"><enum>(ii)</enum><text>to possess or
				attempt to possess a tobacco product in a public place;</text>
									</clause></subparagraph><subparagraph id="HAF3FF54E7F55411AAB311479C50080A7"><enum>(C)</enum><text>a law enforcement
				agency, upon determining that an individual under 18 years of age allegedly
				purchased or received a tobacco product, or allegedly possessed a tobacco
				product in a public place, shall notify the individual’s parent or parents,
				custodian, or guardian (if the name and address of a parent, guardian, or
				custodian is reasonably ascertainable);</text>
								</subparagraph><subparagraph id="H722F48BA2B074D6393D0A5292C4019AB"><enum>(D)</enum><text display-inline="yes-display-inline">within 180 days after the effective date of
				such State law, any person engaged in the business of distributing tobacco
				products at retail shall implement a program—</text>
									<clause id="H2A76F9EB1DD74A659645E16F71009B86"><enum>(i)</enum><text>to
				notify each employee employed by that person who distributes tobacco products
				that State law prohibits the sale or distribution of tobacco products to any
				individual under 18 years of age and the purchase or receipt, or possession in
				a public place, of tobacco products by any such individual; and</text>
									</clause><clause id="H9D4001519C814C9FBBB4EE99816F9EC8"><enum>(ii)</enum><text>to ensure
				compliance with such law;</text>
									</clause></subparagraph><subparagraph id="H94554EE4439F4047AECBABCBDE60BD7F"><enum>(E)</enum><text>an employer shall
				not be in violation of the prohibition described in subparagraph (A) if such
				employer—</text>
									<clause id="HFA9409BCDBC041ECA349622B8EBF75BC"><enum>(i)</enum><text>relies upon proof
				of age that appeared on its face to be valid; or</text>
									</clause><clause commented="no" id="HED3EED2C5EF04F80B098C9ECCFE7D93D"><enum>(ii)</enum><text>implements a
				program in accordance with subparagraph (D); and</text>
									</clause></subparagraph><subparagraph display-inline="no-display-inline" id="HC15EA0839BCD464A912E6806E6B6071"><enum>(F)</enum><text>an individual who
				violates the prohibition described in subparagraph (B) may be liable for a
				civil monetary penalty and may be required to perform community service.</text>
								</subparagraph></paragraph><paragraph id="H6F3F518C79CC43D88040834763D28942"><enum>(2)</enum><header>Delayed
				applicability for certain states</header><text>In the case of a State whose
				legislature does not convene a regular session in fiscal year 2010, and in the
				case of a State whose legislature does not convene a regular session in fiscal
				year 2011, the requirement described in paragraph (1) as a condition of a
				receipt of a grant under section 1921 shall apply only for fiscal year 2012 and
				subsequent fiscal years.</text>
							</paragraph></subsection><subsection id="HFBE9DE965A8E4A878083A083C1238BA"><enum>(b)</enum><header>State goals for
				noncompliance</header><text>Beginning with respect to the first applicable
				fiscal year, a funding agreement for a grant under section 1921 is that the
				State involved has established goals for reducing the rate of retailer
				violations of the law described in subsection (a), as determined through
				annual, random, unannounced inspections described in subsection (c)(2)(A), so
				that the rate of such violations relative to the number of inspections does not
				exceed the following:</text>
							<paragraph id="HC64F2A0D6E24446299BF9FD20053DE5C"><enum>(1)</enum><text>20 percent during
				fiscal year 2010.</text>
							</paragraph><paragraph id="H5F9549E242404219B9EC13AC18E01910"><enum>(2)</enum><text>19 percent during
				fiscal year 2011.</text>
							</paragraph><paragraph id="HB0D4DA11FAB44F6FB4BC1FD687ADA71C"><enum>(3)</enum><text>18 percent during
				fiscal year 2012.</text>
							</paragraph><paragraph id="HB70F63D78F6A4C488CC20028F6E100A0"><enum>(4)</enum><text>17 percent during
				fiscal year 2013.</text>
							</paragraph><paragraph id="H17023CC693DC47049FA5AE5F7B3FCEF7"><enum>(5)</enum><text>16 percent during
				fiscal year 2014.</text>
							</paragraph><paragraph id="H59953CFA943B45BF9925FBF2471E99CD"><enum>(6)</enum><text>15 percent during
				fiscal year 2015.</text>
							</paragraph><paragraph id="H4BDADE1F153745558BDB5061285473A6"><enum>(7)</enum><text>14 percent during
				fiscal year 2016.</text>
							</paragraph><paragraph id="H9A6052CB2D75477F9E5D6431CBF89B10"><enum>(8)</enum><text>13 percent during
				fiscal year 2017.</text>
							</paragraph><paragraph id="H2658C282740B4C54BC52CAA43B253C6"><enum>(9)</enum><text>12 percent during
				fiscal year 2018.</text>
							</paragraph><paragraph id="H8DB58E3B932148EF8E4B983B098E6251"><enum>(10)</enum><text>11 percent during
				fiscal year 2019.</text>
							</paragraph><paragraph id="H413CD363E3434D1393005DFA8E6ECDDF"><enum>(11)</enum><text>10 percent during
				fiscal year 2020 and each subsequent year.</text>
							</paragraph></subsection><subsection id="HFC59916474094C5988BDB8709EB6D271"><enum>(c)</enum><header>Enforcement</header>
							<paragraph id="H6B14AE0DBBED443388000855F4A954D0"><enum>(1)</enum><header>In
				general</header><text>A funding agreement for a grant under section 1921 is
				that the State involved will enforce the law described in subsection (a) in a
				manner that can reasonably be expected to achieve the goals established
				pursuant to subsection (b) and reduce the extent to which tobacco products are
				available to individuals under 18 years of age.</text>
							</paragraph><paragraph id="HEBC7051048554B8EBFDF776D51699D39"><enum>(2)</enum><header>Activities and
				reports regarding enforcement</header><text>A funding agreement for a grant
				under section 1921 is that the State involved will—</text>
								<subparagraph id="H8E685484C7C145C2B3F52DC3A71722C3"><enum>(A)</enum><text>annually conduct
				random, unannounced inspections to ensure compliance with the law described in
				subsection (a); and</text>
								</subparagraph><subparagraph id="H8F947E2A5816425498037272FFF9C8CB"><enum>(B)</enum><text display-inline="yes-display-inline">annually submit to the Secretary a report
				describing—</text>
									<clause id="H11B3F12AF9B94643A64CAB30AEB7778"><enum>(i)</enum><text>the
				activities carried out by the State to enforce such law during the fiscal year
				preceding the fiscal year for which the State is seeking the grant;</text>
									</clause><clause id="H1E6E290B4179499CBBCD457E29F7AAAF"><enum>(ii)</enum><text>the extent of
				success the State has achieved in meeting the goals established pursuant to
				subsection (b) and in reducing the availability of tobacco products to
				individuals under 18 years of age; and</text>
									</clause><clause id="H43DC31C929944414A7CBB8B0095D8B34"><enum>(iii)</enum><text>the strategies
				to be utilized by the State for enforcing such law during the fiscal year for
				which the grant is sought.</text>
									</clause></subparagraph></paragraph><paragraph id="HABEDB83568E34A799913BF76E59707D"><enum>(3)</enum><header>Use of
				individuals under 18 years of age in inspections</header><text>A funding
				agreement for a grant under section 1921 is that the State may engage an
				individual under 18 years of age to test compliance with the law described in
				subsection (a) only if—</text>
								<subparagraph id="H63F23DD2937442DAACE96775932E3480"><enum>(A)</enum><text>the testing is
				conducted with the written consent of a parent or legal guardian of such
				individual; and</text>
								</subparagraph><subparagraph id="HA329E3426F254E758CD31500425F9864"><enum>(B)</enum><text>such individual
				acts under the direct supervision of the State during a random, unannounced
				inspection.</text>
								</subparagraph></paragraph></subsection><subsection id="H7583DA45BE28457B86C4E4EE8EFF24F"><enum>(d)</enum><header>Use of State
				settlement proceeds</header><text>A funding agreement for a grant under section
				1921 is that the State involved certifies to the Secretary that, with respect
				to the calendar year preceding the year in which the State is applying for such
				a grant, the State expended more than 10 percent of the funds paid to the State
				for such calendar year as part of the comprehensive settlement of November 1998
				(as referred to in section 1903(d)(3)(B)(i) of the Social Security Act) on
				health programs, tobacco control and cessation activities, or economic
				development for tobacco regions.</text>
						</subsection><subsection id="H9B29510C2E4040C3B2361F705495EDA8"><enum>(e)</enum><header>Noncompliance of
				state</header>
							<paragraph id="HF076034F15AD4F9D94BC243CF38D10CE"><enum>(1)</enum><header>Determination by
				Secretary</header><text>Before making a grant under section 1921 to a State for
				any fiscal year, the Secretary shall make a determination of whether the State
				has maintained compliance with subsections (a), (b), (c), and (d).</text>
							</paragraph><paragraph id="H4CA260A150DF4DA1B4C4F3739E007248"><enum>(2)</enum><header>Reduction of
				allotment</header><text display-inline="yes-display-inline">Beginning with
				respect to the first applicable fiscal year, if, after notice to the State and
				an opportunity for a hearing, the Secretary determines that the State is not in
				compliance with any of subsections (a), (b), or (c), the Secretary shall reduce
				the amount of the allotment under section 1921 for the State for the fiscal
				year involved by an amount equal to—</text>
								<subparagraph id="HD0CB0881DC2E4B1FAE95B9974B36F9CC"><enum>(A)</enum><text>in the case of
				fiscal year 2010, 10 percent of the amount determined under section 1933 for
				the State for the fiscal year;</text>
								</subparagraph><subparagraph id="H78B599FA1D7D404290B1B1885064B98"><enum>(B)</enum><text>in the case of
				fiscal year 2011, 20 percent of the amount determined under section 1933 for
				the State for the fiscal year;</text>
								</subparagraph><subparagraph id="H6EA41F844D18419BAF58B3BD1EC34DC7"><enum>(C)</enum><text>in the case of
				fiscal year 2012, 30 percent of the amount determined under section 1933 for
				the State for the fiscal year; and</text>
								</subparagraph><subparagraph id="HE3E5EC4EF79F400F93008C4769800600"><enum>(D)</enum><text>in the case of
				fiscal year 2013 or any subsequent fiscal year, 40 percent of the amount
				determined under section 1933 for the State for the fiscal year.</text>
								</subparagraph></paragraph><paragraph id="HB535649A2E4F4F80BD87765993A62932"><enum>(3)</enum><header>Additional
				reduction</header><text>Beginning with respect to the first applicable fiscal
				year, if the Secretary determines under paragraph (1) that the State is not in
				compliance with any of subsections (a), (b), or (c), and is not in compliance
				with subsection (d), the Secretary may reduce the amount of the allotment under
				section 1921 for the State for the fiscal year involved by an amount equal to
				10 percent of the amount determined under section 1933 for the State for such
				fiscal year. Such reduction shall be in addition to the reduction under
				paragraph (2).</text>
							</paragraph></subsection><subsection id="H0EB7356EF6D34F5699976E83FD2B1592"><enum>(f)</enum><header>Assistance in
				implementing programs</header><text>In order to assist States in establishing
				and implementing State laws described in subsection (a), the Secretary
				shall—</text>
							<paragraph id="H1473578CE7D34FD991A9EBBB001886D8"><enum>(1)</enum><text>develop not later
				than January 1, 2009, and subsequently revise as appropriate, model legislative
				language; and</text>
							</paragraph><paragraph id="H56FA0E59AAF2495291645900FBA88998"><enum>(2)</enum><text>provide technical
				assistance and guidance in developing, enacting, and implementing such laws and
				in setting goals pursuant to subsection (b).</text>
							</paragraph></subsection><subsection id="HA2461B97D62F4833A4198FB49BB59B9F"><enum>(g)</enum><header>Definition</header><text>In
				this section, the term <term>first applicable fiscal year</term> means—</text>
							<paragraph id="H2203B2F53BC147D600648DE3CC001577"><enum>(1)</enum><text>fiscal year 2012,
				in the case of any State described in subsection (a)(2); and</text>
							</paragraph><paragraph id="HE2442A96EEC14476A9316E20A0588F23"><enum>(2)</enum><text>fiscal year 2010,
				in the case of any other
				State.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H67F79A488E594440BF3B0859B8BA923E"><enum>(b)</enum><header>Effective
			 date</header>
				<paragraph id="H5DCE6879EFB84317B700195085449C86"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The amendment made by
			 subsection (a) shall apply with respect to the first applicable fiscal year and
			 each subsequent fiscal year. The provisions of section 1926 of the Public
			 Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300x-26">42 U.S.C. 300x–26</external-xref>), as in effect on the day before the date
			 of the enactment of this Act, shall apply with respect to fiscal years
			 preceding the first applicable fiscal year.</text>
				</paragraph><paragraph id="H1320BC03CC784C3B84AED6914D2346D2"><enum>(2)</enum><header>Definition</header><text>In
			 this subsection, the term <quote>first applicable fiscal year</quote> has the
			 meaning given such term in subsection (g) of section 1926 of the Public Health
			 Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300x-26">42 U.S.C. 300x–26</external-xref>), as amended by subsection (a) of this
			 section.</text>
				</paragraph></subsection></section><section id="H4F255446B0F54ECC831C001BC5BB0051"><enum>3.</enum><header>Public disclosure
			 of ingredients</header><text display-inline="no-display-inline">Section 7 of
			 the Federal Cigarette Labeling and Advertising Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1335a">15 U.S.C. 1335a</external-xref>) is
			 amended—</text>
			<paragraph id="H26B7E7B841894BD7BE830080B9992377"><enum>(1)</enum><text>in subsection (a),
			 by striking <quote>the company which uses the ingredients or</quote>;
			 and</text>
			</paragraph><paragraph id="HBD37D6710178496385EC3C9B5D6BE2EC"><enum>(2)</enum><text>by amending
			 subsection (b)(2) to read as follows:</text>
				<quoted-block id="H27B798485CBD406281E6B62E83D8CFA" style="OLC">
					<paragraph id="HE58F3A902573467A86004B4F6F00E5F6" indent="up1"><enum>(2)</enum><text>The Secretary shall make any
				information provided under this section accessible to the public on the
				Internet not later than 48 hours after receipt by the
