<official-title>To expand the eligibility of individuals to qualify for loan forgiveness for teachers in order to provide additional incentives for teachers currently employed or seeking employment in economically depressed rural areas, Territories, and Indian Reservations.</official-title>

<section section-type="section-one" id="H1E78462C7A4E44EFAA991349A2599FA0" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Teacher Recruitment Act of 2007</short-title></quote>.</text></section> 
<section id="HAF0F450FB37547B0930719D61E2C5D77"><enum>2.</enum><header>Expansion of teacher loan forgiveness programs</header> 
<subsection id="H2748FDF06E45482C9300A1A7B0EF6C9"><enum>(a)</enum><header>Guaranteed student loans</header><text>Part B of title IV of the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> is amended by—</text> 
<paragraph id="H6FEE23601ACD44019F3293243F22A3A7"><enum>(1)</enum><text>redesignating section 428K (<external-xref legal-doc="usc" parsable-cite="usc/20/1078-11">20 U.S.C. 1078–11</external-xref>) as section 428L; and</text></paragraph> 
<paragraph id="H916643553F724828B41EA2419C8E93D4"><enum>(2)</enum><text>by inserting after section 428J the following new section:</text>

<section id="HCEFA32231D474EA5B214D7A7A8B91E95"><enum>428K.</enum><header>Expanded loan forgiveness for teachers</header> 
<subsection id="HA09A0AC342FA4952A38ECE15A6F9E4F6"><enum>(a)</enum><header>Purpose</header><text>It is the purpose of this section to expand, subject to the availability of appropriations therefor, the eligibility of individuals to qualify for loan forgiveness for teachers beyond that available under section 428J, in order to provide additional incentives for such individuals to teach in economically disadvantaged or depressed and underserved rural areas.</text></subsection> 
<subsection id="H88DCAA3F19B444BE9677C12C06FC2C03"><enum>(b)</enum><header>Program authorized</header> 
<paragraph id="HBA92A1AAB16D488EAB00F6AB6B5C87C6"><enum>(1)</enum><header>In general</header><text>From the sums appropriated pursuant to subsection (i), the Secretary shall carry out a program, through the holder of the loan, of assuming the obligation to repay a qualified loan amount for a loan made under section 428 or 428H, in accordance with subsection (c), for any new borrower on or after October 1, 1998, who—</text> 
<subparagraph id="H14BB763F7DF048A5A15CCD17F6171146"><enum>(A)</enum><text>is employed as a full-time teacher in a public elementary or secondary school in an economically disadvantaged or depressed and underserved rural area;</text></subparagraph> 
<subparagraph id="H1B7EAEEC50F44A2085615700DBD33DA"><enum>(B)</enum><text>has a State certification (which may include certification obtained through alternative means) or a State license to teach, and has not failed to comply with State or local accountability standards; and</text></subparagraph> 
<subparagraph id="HAC0AEF0A04F746E1BA52EB92E908E0F"><enum>(C)</enum><text>is not in default on a loan for which the borrower seeks forgiveness.</text></subparagraph></paragraph> 
<paragraph id="HE9511312662B4CB89C3E81383C7E827C"><enum>(2)</enum><header>Selection of recipients</header><text>The Secretary shall by regulation establish a formula that ensures fairness and equality for applicants in the selection of borrowers for loan repayment under this section, based on the amount available pursuant to subsection (i).</text></paragraph></subsection> 
<subsection id="H8F5C98EFFE9D4CA4823384E33011E170"><enum>(c)</enum><header>Qualified loans amount</header> 
<paragraph id="HB7E91AFB214D4D70BF57ED9EAA97541"><enum>(1)</enum><header>In general</header><text>The Secretary shall repay not more than the percentage specified in paragraph (2) of the loan obligation on a loan made under section 428 or 428H that is outstanding after the completion of each complete school year of teaching described in subsection (b)(1). No borrower may receive a reduction of loan obligations under both this section and section 460.</text></paragraph> 
<paragraph id="H827DD034A4504795938676D2E59D7D95"><enum>(2)</enum><header>Percentage eligible</header><text>The percent of the loan obligation which the Secretary shall repay under paragraph (1) of this subsection is 15 percent for the first or second year of such service, 20 percent for the third or fourth year of such service, and 30 percent for the fifth year of such service.</text></paragraph> 
<paragraph id="H80AE9A9700BC4F84BD0083C29DD72459"><enum>(3)</enum><header>Treatment of consolidation loans</header><text>A loan amount for a loan made under section 428C may be a qualified loan amount for the purposes of this subsection only to the extent that such loan amount was used to repay a Federal Direct Stafford Loan, a Federal Direct Unsubsidized Stafford Loan, or a loan made under section 428 or 428H for a borrower who meets the requirements of subsection (b), as determined in accordance with regulations prescribed by the Secretary.</text></paragraph> 
<paragraph id="HF34AB194FB7444A2A535FAC78806BB4D"><enum>(4)</enum><header>Treatment of years of service for continuing education loans</header><text>For purposes of paragraph (2), the year of service is determined on the basis of the academic year that the borrower began the service as a full-time teacher, except that in the case of a borrower who incurs a loan obligation for continuing education expenses while teaching, the year of service is determined on the basis of the academic year following the academic year for which the loan obligation was incurred.</text></paragraph></subsection> 
<subsection id="HCED8B12B0AA642638B3253873470D9A5"><enum>(d)</enum><header>Regulations</header><text>The Secretary is authorized to issue such regulations as may be necessary to carry out the provisions of this section.</text></subsection> 
<subsection id="HDD7D4B720FA24F8EB4A8239925551B82"><enum>(e)</enum><header>Construction</header><text>Nothing in this section shall be construed to authorize any refunding of any repayment of a loan.</text></subsection> 
<subsection id="H86211AE9DF3147969300EDC20240005"><enum>(f)</enum><header>List</header><text>If the list of schools in which a teacher may perform service pursuant to subsection (b)(1)(A) is not available before May 1 of any year, the Secretary may use the list for the year preceding the year for which the determination is made to make such service determination.</text></subsection> 
<subsection id="HFD269D9AF21241ECB5A1E2B3C5A38321"><enum>(g)</enum><header>Additional eligibility provisions</header> 
<paragraph id="H466FDE860B164F8E9FA5CAEC162000A6"><enum>(1)</enum><header>Continued eligibility</header><text>Any teacher who performs service in a school that—</text> 
<subparagraph id="H2A7EF8A8CC584974BCC4FFC3CA77F746"><enum>(A)</enum><text>meets the requirements of subsection (b)(1)(A) in any year during such service; and</text></subparagraph> 
<subparagraph id="H744833EFDF694B6CBFB34D4FC83F6EA1"><enum>(B)</enum><text>in a subsequent year fails to meet the requirements of such subsection,</text></subparagraph><continuation-text continuation-text-level="paragraph">may continue to teach in such school and shall be eligible for loan forgiveness pursuant to subsection (b).</continuation-text></paragraph> 
<paragraph id="HB193048109CF4A0F832D2E184D43929C"><enum>(2)</enum><header>Prevention of double benefits</header><text>No borrower may, for the same service, receive a benefit under both this section and subtitle D of title I of the National and Community Service Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12571">42 U.S.C. 12571 et seq.</external-xref>).</text></paragraph></subsection> 
<subsection id="HE55E53268196485C87FEA4A25B6C79D0"><enum>(h)</enum><header>Definition</header><text>For purposes of this section:</text> 
<paragraph id="H4D1F215D784944CC9941C2622B4C2422"><enum>(1)</enum><header>Area</header><text>The term <term>economically disadvantaged or depressed and underserved rural area</term> means any of the following areas in any State:</text> 
<subparagraph id="HE9EF5F1A47C745F8BADD25E5A5E38917"><enum>(A)</enum><text>A rural area that has a chronically high rate of unemployment.</text></subparagraph> 
<subparagraph id="H4FF2701E570C4564BF6DF3E60233484"><enum>(B)</enum><text>A rural area in which at least 30 percent of the households have household incomes of less than $15,000, as determined on the basis of the most recent decennial census.</text></subparagraph> 
<subparagraph id="H62CE052E4723477F862438E355B6F1C0"><enum>(C)</enum><text>An Indian reservation.</text></subparagraph> 
<subparagraph id="H55537E7F2B904E439F6EEFAD86830099"><enum>(D)</enum><text>Any other rural area that, as determined by regulations, has a significant shortage of educational and employment opportunities.</text></subparagraph></paragraph> 
<paragraph id="H394788B170BD462CB7EB7DFFDB9E9F72"><enum>(2)</enum><header>Indian reservation</header><text>The term <term>Indian reservation</term> includes Indian reservations, public domain Indian allotments, former Indian reservations in Oklahoma, and land held by incorporated Native Alaskan groups, regional corporations, and village corporations under the provisions of the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1601">43 U.S.C. 1601 et seq.</external-xref>).</text></paragraph> 
<paragraph id="HDA43B500F6724C419DC75D9F574FAD03"><enum>(3)</enum><header>Year</header><text>The term <term>year</term>, where applied to service as a teacher, means an academic year as defined by the Secretary.</text></paragraph></subsection> 
<subsection id="HAB499AC30DFC481BBD3377664E31217E"><enum>(i)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section such sums as may be necessary for fiscal year 2008 and each of the 5 succeeding fiscal years.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H5FE7748CC8A4445AA5BD2DA27006C888"><enum>(b)</enum><header>Direct student loans</header><text>Part D of title IV of the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> is amended by inserting after section 460 the following new section:</text>

<section id="HB5A8ED8E0D584C3EA216905C4BAE22C2"><enum>460A.</enum><header>Expanded loan forgiveness for teachers</header> 
<subsection id="HA657E36CCEB64C18B881204119F800D3"><enum>(a)</enum><header>Purpose</header><text>It is the purpose of this section to expand, subject to the availability of appropriations therefor, the eligibility of individuals to qualify for loan forgiveness for teachers beyond that available under section 460, in order to provide additional incentives for such individuals to teach in economically disadvantaged or depressed and underserved rural areas.</text></subsection> 
<subsection id="H13E7AA53B17940D1833519BDC0FDE009"><enum>(b)</enum><header>Program authorized</header> 
<paragraph id="H7C3D221ABFE145C5B053BA153772C520"><enum>(1)</enum><header>In general</header><text>From the sums appropriated pursuant to subsection (i), the Secretary shall carry out canceling the obligation to repay a qualified loan amount in accordance with subsection (c) for Federal Direct Stafford Loans and Federal Direct Unsubsidized Stafford Loans made under this part for any new borrower on or after October 1, 1998, but who—</text> 
<subparagraph id="H252E08B2B666416EAA7626926300D480"><enum>(A)</enum><text>is employed as a full-time teacher in a public elementary or secondary school in an economically disadvantaged or depressed and underserved rural area;</text></subparagraph> 
<subparagraph id="H6F56DD101C8547A500FC1D158D447B85"><enum>(B)</enum><text>has a State certification (which may include certification obtained through alternative means) or a State license to teach, and has not failed to comply with State or local accountability standards; and</text></subparagraph> 
<subparagraph id="HCC950B6AF2364E1C005513E0FCDBA3A6"><enum>(C)</enum><text>is not in default on a loan for which the borrower seeks forgiveness.</text></subparagraph></paragraph> 
<paragraph id="H850F8799CC144009AE37E2861E2410AF"><enum>(2)</enum><header>Selection of recipients</header><text>The Secretary shall by regulation establish a formula that ensures fairness and equality for applicants in the selection of borrowers for loan repayment under this section, based on the amount available pursuant to subsection (i).</text></paragraph></subsection> 
<subsection id="HBA2B92990CAE4B0DB366C7BC86FEC2BA"><enum>(c)</enum><header>Qualified loans amount</header> 
<paragraph id="H731166F35F9F4546B95963C5E3346B08"><enum>(1)</enum><header>In general</header><text>The Secretary shall cancel not more than the percentage specified in paragraph (2) of the loan obligation on a loan made under this part that is outstanding after the completion of each complete school year of teaching described in subsection (b)(1). No borrower may receive a reduction of loan obligations under both this section and section 428J.</text></paragraph> 
<paragraph id="H0F453C0A7F234CF09556BB80F45EB311"><enum>(2)</enum><header>Percentage eligible</header><text>The percent of the loan obligation which the Secretary shall repay under paragraph (1) of this subsection is 15 percent for the first or second year of such service, 20 percent for the third or fourth year of such service, and 30 percent for the fifth year of such service.</text></paragraph> 
<paragraph id="H5E98DAA27A3C4A559C2F48C6CB6D345"><enum>(3)</enum><header>Treatment of consolidation loans</header><text>A loan amount for a Federal Direct Consolidation Loan may be a qualified loan amount for the purposes of this subsection only to the extent that such loan amount was used to repay a Federal Direct Stafford Loan, a Federal Direct Unsubsidized Stafford Loan, or a loan made under section 428 or 428H for a borrower who meets the requirements of subsection (b), as determined in accordance with regulations prescribed by the Secretary.</text></paragraph>

<paragraph id="H79F72D5FC45147DF8CE8D3FE8ED73247"><enum>(1)</enum><header>Continued eligibility</header><text>Any teacher who performs service in a school that—</text> 
<subparagraph id="HC276B6D3F8B64C7BA974BD1B58143DCE"><enum>(A)</enum><text>meets the requirements of subsection (b)(1)(A) in any year during such service; and</text></subparagraph> 
<subparagraph id="H35D0822D3E514887B3B1F35CFE27DBD"><enum>(B)</enum><text>in a subsequent year fails to meet the requirements of such subsection,</text></subparagraph><continuation-text continuation-text-level="paragraph">may continue to teach in such school and shall be eligible for loan forgiveness pursuant to subsection (b).</continuation-text></paragraph>
