		<section display-inline="no-display-inline" id="H8C570D3F7C4446589B0565D8F47F10C3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Nino's
			 Act</short-title></quote>.</text>
		</section><section id="H630E7279B8EC48D4A8ACF00C7A6D577"><enum>2.</enum><header>Medicaid coverage
			 of drugs prescribed for research study child participants</header>
			<subsection id="H4EB4CA0B7545439297A83D3C623F009C"><enum>(a)</enum><header>Mandatory
			 coverage if State provides drug coverage</header>
				<paragraph id="H2F3F86E6F402430094A65E45DB417460"><enum>(1)</enum><header>State plan
			 requirement</header><text>Section 1902(a) of the Social Security Act (42 U.S.C.
			 1396a(a)) is amended—</text>
					<subparagraph id="H8E1985CDE34041DE885828153B05E0E5"><enum>(A)</enum><text>in paragraph (69),
			 by striking <quote>and</quote> at the end;</text>
					</subparagraph><subparagraph id="H2CF587761ADB491DAFFFC428781698BB"><enum>(B)</enum><text>in paragraph (70),
			 by striking the period at the end and inserting <quote>; and</quote>;
			 and</text>
					</subparagraph><subparagraph id="HF7BDDCBBA2DB4331A1759941A919C6F0"><enum>(C)</enum><text>by inserting after
			 paragraph (70) the following new paragraph:</text>
						<quoted-block display-inline="no-display-inline" id="H035486BC0FCB40F98D7DED8DB2BCC2B" style="OLC">
							<paragraph id="HAF61F4848DF746BA9B543121B5C076F7"><enum>(71)</enum><text>in the case of a
				State plan that provides medical assistance for prescribed drugs under section
				1905(a)(12), provide for such medical assistance to include coverage for any
				drug, biological product, or insulin prescribed for a child (including any such
				drug, product, or insulin that is self-administered) who—</text>
								<subparagraph id="HDDF13212B6C64848B42C3D57366D7D62"><enum>(A)</enum><text>is eligible for
				medical assistance under the State plan (including a child who is eligible only
				on the basis of paragraph (10)(A)(i)(VIII));</text>
								</subparagraph><subparagraph id="H15CE6A9AD1EE47D89B36B86E491D4E2"><enum>(B)</enum><text>is a current or
				former participant in a research study conducted or funded (in whole or in
				part) by the National Institutes of Health; and</text>
								</subparagraph><subparagraph id="HF3B94B9DE3AE4B5DABC781B49BE5DE56"><enum>(C)</enum><text>satisfies the
				requirements of subparagraphs (B), (C), and (D) of subsection
				(dd)(1).</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H2207A7EBDC3B4E3EB3C7898006003103"><enum>(2)</enum><header>Mandatory
			 coverage of drugs of research study child participants who are not otherwise
			 eligible for Medicaid if the State offers drug coverage</header>
					<subparagraph id="H51C9DF38E69B49288091CA8F92ECC6DF"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section
			 1902(a)(10)(A)(i) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396b">42 U.S.C. 1396b(a)(10)(A)(i)</external-xref>) is
			 amended—</text>
						<clause id="HF49740945327437BA82D37A6DEEC1486"><enum>(i)</enum><text>in
			 subclause (VI), by striking <quote>or</quote> at the end;</text>
						</clause><clause id="HE3FC84CEA7274E8C92AE7600F6758146"><enum>(ii)</enum><text>in
			 subclause (VII), by adding <quote>or</quote> at the end; and</text>
						</clause><clause id="HAC33EDFF083B4F7C98317119BAB5FBC7"><enum>(iii)</enum><text>by
			 adding at the end the following new subclause:</text>
							<quoted-block display-inline="no-display-inline" id="H3016C0F79BE54F8D9C9E52D6923BBA7F" style="OLC">
								<subclause id="HACAC5678FCF44D5CBC0003FE6B576900"><enum>(VIII)</enum><text>who are
				research study child participants described in subsection (dd)(1), but only if
				the medical assistance made available by the State includes prescribed drugs
				under section
				1905(a)(12),</text>
								</subclause><after-quoted-block>.</after-quoted-block></quoted-block>
						</clause></subparagraph><subparagraph id="H64765235D70540B28F061E28FB4C2EB4"><enum>(B)</enum><header>Group
			 described</header><text>Section 1902 of the Social Security Act (42 U.S.C.
			 1396a) is amended by adding at the end the following new subsection:</text>
						<quoted-block display-inline="no-display-inline" id="HB3CABFB5335043CFB821D667E5BA6133" style="OLC">
							<subsection id="H157472F7BC204F518795891C573991E5"><enum>(dd)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H95D17448792E486EA7F81D86C5CC6E29"><enum>(1)</enum><text>Research study child
				participants described in this subsection are individuals who—</text>
									<subparagraph id="H892233F6C4234843009B45009BC6F54B" indent="up1"><enum>(A)</enum><text>are not otherwise eligible for medical
				assistance under the State plan;</text>
									</subparagraph><subparagraph id="HD5E6498739E64F858986C09000800483" indent="up1"><enum>(B)</enum><text>have not attained age 19;</text>
									</subparagraph><subparagraph id="H7A650962A1804F65AAF602BAD456DF2E" indent="up1"><enum>(C)</enum><text>have been certified by a physician
				participating in a research study conducted or funded (in whole or in part) by
				the National Institutes of Health to be current or former participants in such
				trial or study who have a specific disease or condition that—</text>
										<clause id="HCAA13881E84749B8BAFD166EABCD6409"><enum>(i)</enum><text>is or has been successfully treated
				under such trial or study with a prescribed use of a drug, biological product,
				or insulin that is not approved under the Federal Food, Drug, and Cosmetic Act;
				and</text>
										</clause><clause id="HBC482DCBCB154AC881604BBA4202C744"><enum>(ii)</enum><text>is likely to continue to be
				successfully treated with such drug, product, or insulin; and</text>
										</clause></subparagraph><subparagraph id="H9AA972ADD178487590E3BB5E72F732D6" indent="up1"><enum>(D)</enum><text>do not have other health coverage for
				such drug, product, or insulin.</text>
									</subparagraph></paragraph><paragraph id="H12A350914B3A4AD6979D07550729C9CF" indent="up1"><enum>(2)</enum><text>A State shall redetermine not less
				than every 2 years the eligibility of an individual for medical assistance who
				is eligible solely on the basis of subsection (a)(10)(A)(i)(VIII).</text>
								</paragraph><paragraph id="HDD255E93A8F640D88D49C1D0FA5CBEAC" indent="up1"><enum>(3)</enum><text>For purposes of this subsection and
				paragraphs (10)(A)(i)(VIII) and (71) of subsection (a), the term <term>research
				study</term> means a clinical study, including an observational (or natural
				history) study, or a clinical trial, to test an experimental
				therapy.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="HEC673FAB95584D2DBDB865E6BF45095D"><enum>(C)</enum><header>Medical
			 assistance limited to coverage of the research or observational trial drugs,
			 biological product, or insulin</header><text>Section 1902(a)(10) of the Social
			 Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)(10)</external-xref>) is amended in the matter following
			 subparagraph (G)—</text>
						<clause id="H05A90067953548A6AB4BACFC8C0E6BA"><enum>(i)</enum><text>by
			 striking <quote>and (XIV)</quote> and inserting <quote>(XIV)</quote>;
			 and</text>
						</clause><clause id="H364DE9E9DEBC4F5D912CC78C92249F42"><enum>(ii)</enum><text>by
			 inserting <quote>, and (XV) the medical assistance made available to a research
			 study child participant described in subsection (dd)(1) who is eligible for
			 medical assistance solely on the basis of subparagraph (A)(10)(i)(VIII) shall
			 be limited to medical assistance for a drug, biological product, or insulin
			 that is prescribed for the participant as a result of participation in such
			 trial or study (including any such drug, product, or insulin that is
			 self-administered)</quote> before the semicolon.</text>
						</clause></subparagraph><subparagraph id="HCCE8C4DDF60D4A9B8CCFEA9E1457855D"><enum>(D)</enum><header>Conforming
			 amendment</header><text>Section 1903(f)(4) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396b">42 U.S.C. 1396b</external-xref>)(f)(4))
			 is amended in the matter preceding subparagraph (A) by inserting
			 <quote>1902(a)(10)(A)(i)(VIII),</quote> after
			 <quote>1902(a)(10)(A)(i)(VII),</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="HF37BBE62255248FDAF613804E642677C"><enum>(b)</enum><header>Presumptive
			 eligibility</header><text>Section 1920B of the Social Security Act (42 U.S.C.
			 1396r–1b) is amended—</text>
				<paragraph id="H6AA07B6F611D42498F18FCCCE12B7489"><enum>(1)</enum><text>in the section
			 heading, by inserting <quote><header-in-text level="section" style="traditional">or research study child
			 participants</header-in-text></quote> after <quote><header-in-text level="section" style="traditional">patients</header-in-text></quote>;</text>
				</paragraph><paragraph id="H7D70C1E86A9C4F7BB029AE77ABE4E461"><enum>(2)</enum><text>in subsection (a),
			 by inserting <quote>or a child who is eligible for medical assistance under the
			 State plan (including a child who is eligible only on the basis of section
			 1902(a)(10)(A)(i)(VIII) but subject to the limitation on medical assistance for
			 such a child under clause (XV) of the matter following section 1902(a)(10)(G)),
			 is a current or former participant in a research study conducted or funded (in
			 whole or in part) by the National Institutes of Health, and satisfies the
			 requirements of subparagraphs (B), (C), and (D) of section 1902(dd)(1)</quote>
			 after <quote>patients)</quote>;</text>
				</paragraph><paragraph id="H757D39B17A3F4EB5A97D3784716CF2A0"><enum>(3)</enum><text>in subsection
			 (b)(1)(A), by inserting <quote>or subsection (a)</quote> after
			 <quote>1902(aa)</quote>; and</text>
				</paragraph><paragraph id="H6F1ED37523B14754A3138BD59409E80"><enum>(4)</enum><text>in
			 subsection (d), in the flush language following paragraph (2), by striking
			 <quote>for purposes of clause (4) of the first sentence of section
			 1905(b)</quote> and inserting <quote>for purposes of the first sentence of
			 section 1905(b) (and, in the case of medical assistance furnished to an
			 individual described in section 1902(aa), for purposes of clause (4) of such
			 sentence)</quote>.</text>
				</paragraph></subsection><subsection id="H2464EED620F84FD1B5E88664C100A471"><enum>(c)</enum><header>Notice of
			 medicaid coverage for research study child participants</header>
				<paragraph id="H6BCDDF102A6044A98233F2CDC3AD175D"><enum>(1)</enum><header>In
			 general</header><text>Not later than 90 days after the date of enactment of
			 this Act, the Secretary of Health and Human Services, in consultation with the
			 Director of the Institutes of Health and State Medicaid Directors,
			 shall—</text>
					<subparagraph id="H5FFEABB87B8B4C5885B343005C31EA45"><enum>(A)</enum><text>develop a written
			 notice for child participants in research studies (as defined in section
			 1902(dd)(3) of the Social Security Act, as added by subsection (a)(2)(B))
			 conducted or funded (in whole or in part) by the National Institutes of Health
			 who are likely to eligible for medical assistance for a drug, biological
			 product, or insulin prescribed for such participants as a result of
			 participation in such a study (including any such drug, product, or insulin
			 that is self-administered) in accordance with paragraph (10)(A)(i)(VIII) or
			 (71) of section 1902(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)</external-xref>) (as
			 added by subsection (a)), of the availability of such assistance; and</text>
					</subparagraph><subparagraph id="H7A78713F3AB243A5ABFAD1AB62027B6F"><enum>(B)</enum><text>establish
			 procedures for making such notice available to the child participants through
			 physicians participating in such research studies or such other means as the
			 Secretary determines appropriate.</text>
					</subparagraph></paragraph><paragraph id="H4129D1BC64C84DA68510F08DCE1508F"><enum>(2)</enum><header>Authorization of
			 appropriations</header><text>There is authorized to be appropriated for fiscal
			 year 2008 and each fiscal year thereafter such sums as may be necessary to
			 carry out this subsection.</text>
				</paragraph></subsection><subsection id="H96546A005FEE4FCCA6F5C3BF6A4B5B8"><enum>(d)</enum><header>Effective
			 date</header><text>The amendments made by this section apply to medical
			 assistance for items and services furnished on or after the date of enactment
			 of this Act, without regard to whether final regulations to carry out such
			 amendments have been promulgated.</text>
