		<official-title>To amend the Detainee Treatment Act of 2005 and title 18,
		  United States Code, to include waterboarding in the definition of cruel,
		  inhuman, or degrading treatment or punishment and in the definition of torture,

			 definition of cruel, inhuman, or degrading treatment or punishment and in
			 definition of torture</header>
			<subsection id="HF46F6A36133B49F2B483B998FA686574"><enum>(a)</enum><header>Cruel, inhuman,
			 or degrading treatment or punishment</header><text display-inline="yes-display-inline">Section 1003(d) of the Detainee Treatment
			 Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000dd">42 U.S.C. 2000dd</external-xref>; <external-xref legal-doc="public-law" parsable-cite="pl/109/148">Public Law 109–148</external-xref>) and section 1403(d) of the
			 Detainee Treatment Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000dd">42 U.S.C. 2000dd</external-xref>; <external-xref legal-doc="public-law" parsable-cite="pl/109/163">Public Law 109–163</external-xref>) are each
			 amended by inserting after <quote>1984</quote> the following: <quote>, and
			 includes waterboarding, which includes any form of physical treatment that
			 simulates drowning or gives the individual who is subjected to it the sensation
			 of drowning</quote>.</text>
			</subsection><subsection id="H912BB100E9A74DD8B70116E122020602"><enum>(b)</enum><header>Torture</header><text>Section
			 2340(1) of title 18, United States Code, is amended by inserting before the
			 semicolon at the end the following: <quote>and includes the technique known as
			 <quote>waterboarding</quote>, which includes any form of physical treatment
			 that simulates drowning or gives the individual who is subjected to it the
			 sensation of drowning</quote>.</text>
			</subsection></section><section id="HF7F7D60645754569BC32A89B00B94817"><enum>2.</enum><header>Treatment of
			 individuals in custody of Central Intelligence Agency</header><text display-inline="no-display-inline">Section 1003(a) of the Detainee Treatment
			 Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000dd">42 U.S.C. 2000dd</external-xref>; <external-xref legal-doc="public-law" parsable-cite="pl/109/148">Public Law 109–148</external-xref>) and section 1403(a) of the
			 Detainee Treatment Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000dd">42 U.S.C. 2000dd</external-xref>; <external-xref legal-doc="public-law" parsable-cite="pl/109/163">Public Law 109–163</external-xref>) are each
			 amended by inserting after <quote>Government,</quote> the following:
			 <quote>including any individual in the custody or under the physical control of
			 the Central Intelligence Agency,</quote>.</text>
