<section id="H9A462B191D5242009E4B75045F5019A7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>United States-Republic of Korea Defense Cooperation Improvement Act of 2008</short-title></quote>. </text> </section> 
<section id="HEA567F3EB5C94452AEB9AA80B617CB48"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following findings:</text> 
<paragraph id="HF4E5E3FF10CF433EAC97055165A2E7A0"><enum>(1)</enum><text>Close and continuing cooperation in defense between the United States and the Republic of Korea continues to be in the national security interest of the United States.</text></paragraph> 
<paragraph id="H3C7645A6479042178B3782D6F7C14CA0"><enum>(2)</enum><text>The Republic of Korea was designated a Major Non-NATO Ally in 1987, the first such designation.</text></paragraph> 
<paragraph id="HD63634DB886B463DBFCD00C9A1E1AE00"><enum>(3)</enum><text>The Republic of Korea has been a major purchaser of United States defense articles and services through the Foreign Military Sales (FMS) program, totaling $6,900,000,000 in deliveries over the last 10 years.</text></paragraph> 
<paragraph id="HF45560D3163148EFBCDF28FC86A60200"><enum>(4)</enum><text>Purchases of United States defense articles, services, and major defense equipment facilitate and increase the interoperability of Republic of Korea military forces with United States military forces.</text></paragraph> 
<paragraph id="HDF05C9D7E3E0459EA8CA5B35801B16D8"><enum>(5)</enum><text>Congress has previously enacted important, special defense cooperation arrangements for the Republic of Korea, as in the Act entitled <quote>An Act to authorize the transfer of items in the War Reserves Stockpile for Allies, Korea</quote>, approved December 30, 2005 (<external-xref legal-doc="public-law" parsable-cite="pl/109/159">Public Law 109–159</external-xref>), which authorized the President, notwithstanding section 514 of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2321h">22 U.S.C. 2321h</external-xref>), to transfer to the Republic of Korea certain defense items to be included in a war reserve stockpile for that country.</text></paragraph> 
<paragraph id="H06CE2E48C8E34D5C8B3771824EE8B650"><enum>(6)</enum><text>Such actions by Congress and sales to the Republic of Korea enhance defense ties with that country and ensure favorable consideration by the Government of the Republic of Korea when it considers acquisitions of certain weapons systems.</text></paragraph> 
<paragraph id="H25203216FF064F44B800F627DB32FEAE"><enum>(7)</enum><text>Enhanced support for defense cooperation with the Republic of Korea is important to the national security of the United States, including through creation of a status in law for the Republic of Korea similar to the countries in the North Atlantic Treaty Organization, Japan, Australia, and New Zealand, with respect to consideration by Congress of foreign military sales to the Republic of Korea.</text></paragraph></section> 
<section id="HC9E59B5C13D84CD29FC342AE009E2762"><enum>3.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that expeditious consideration of certifications of letters of offer to sell defense articles, defense services, design and construction services, and major defense equipment to the Republic of Korea under section 36(b) of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2776">22 U.S.C. 2776(b)</external-xref>) is fully consistent with United States security and foreign policy interests and the objectives of world peace and security.</text></section> 
<section id="H5B5713110A504024B6FDFD00C289313C"><enum>4.</enum><header>Amendments to Arms Export Control Act</header><text display-inline="no-display-inline">The Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2751">22 U.S.C. 2751 et seq.</external-xref>) is amended—</text> 
<paragraph id="H0C709A26EBDB4E41BF394EB548F88E4F"><enum>(1)</enum><text>in section 3 (<external-xref legal-doc="usc" parsable-cite="usc/22/2753">22 U.S.C. 2753</external-xref>)—</text> 
<subparagraph id="H0BA0F4B6F65941FCBE3C2578B9582003"><enum>(A)</enum><text>in subsection (b)(2), by inserting <quote>the Government of the Republic of Korea,</quote> before <quote>the Government of Australia</quote>; and</text></subparagraph> 
<subparagraph id="HF85B32FE8D834137AE1F159B4DBF3735"><enum>(B)</enum><text>in subsection (d)—</text> 
<clause id="HB01E5A773FFB4DC68640B4902CA337FB"><enum>(i)</enum><text>in paragraph (2)(B), by inserting <quote>the Republic of Korea,</quote> before <quote>Japan</quote>;</text></clause> 
<clause id="HCBA0C38518514B08AE9099EB23F67910"><enum>(ii)</enum><text>in paragraph (3)(A)(i), by inserting <quote>the Republic of Korea,</quote> before <quote>Australia</quote>; and</text></clause>

<paragraph id="H96A6FE6598944EBCB681645C92BF007B"><enum>(2)</enum><text>in section 21 (<external-xref legal-doc="usc" parsable-cite="usc/22/2761">22 U.S.C. 2761</external-xref>)—</text> 
<subparagraph id="HFD8DB2B3C2CC4143950785F7D2E751C"><enum>(A)</enum><text>in subsection (e)(2)(A), by inserting <quote>the Republic of Korea,</quote> before <quote>Japan</quote>; and</text></subparagraph> 
<subparagraph id="H008917C060244D0586001FCEE4B79FE0"><enum>(B)</enum><text>in subsection (h)—</text> 
<clause id="H113D2E03DCC4457E89F9290910E7B3FB"><enum>(i)</enum><text>in paragraph (1)(A), by inserting <quote>the Republic of Korea,</quote> before <quote>Australia</quote>; and</text></clause> 
<clause id="H397EC3598C314A0FA4121E4EF5A5F2F8"><enum>(ii)</enum><text>in paragraph (2), by striking <quote>or to any member government of that Organization if that Organization or member government</quote> and inserting <quote>, to any member government of that Organization, or to the Governments of the Republic of Korea, Australia, New Zealand, Japan, or Israel if that Organization, member government, or the Governments of the Republic of Korea, Australia, New Zealand, Japan, or Israel</quote>;</text></clause></subparagraph></paragraph>
