		  national parks.</official-title>

		<section id="HD69B09F200CA4CF49FB348AF4E5764CB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Protecting Americans from Violent
			 Crime Act of 2008</short-title></quote>.</text>
		</section><section id="HBC3E608741BD4E03864F1581AEABA600"><enum>2.</enum><header>Congressional
			 findings</header><text display-inline="no-display-inline">Congress finds the
			 following:</text>
			<paragraph id="HF0573DAE49284CA89C47AC72A1184E86"><enum>(1)</enum><text>The Second
			 Amendment to the Constitution provides that <quote>the right of the people to
			 keep and bear Arms, shall not be infringed</quote>;</text>
			</paragraph><paragraph id="H9767E813F73647DE896814006C654C90"><enum>(2)</enum><text>Section 2.4(a)(1)
			 of title 36, Code of Federal Regulations, provides that <quote>except as
			 otherwise provided in this section and parts 7 (special regulations) and 13
			 (Alaska regulations), the following are prohibited: (i) Possessing a weapon,
			 trap or net (ii) Carrying a weapon, trap or net (iii) Using a weapon, trap or
			 net</quote>;</text>
			</paragraph><paragraph id="H9BAAB8311F024CFB82D57BEDA396B97"><enum>(3)</enum><text>Section 27.42 of
			 title 50, Code of Federal Regulations, provides that, except in special
			 circumstances, citizens of the United States may not <quote>possess, use, or
			 transport firearms on national wildlife refuges</quote> of the United States
			 Fish and Wildlife Service;</text>
			</paragraph><paragraph id="HC1C8719C69F74D60A086148B0518307F"><enum>(4)</enum><text>The regulations
			 described in paragraphs (2) and (3) prevent individuals complying with Federal
			 and State laws from exercising the second amendment rights of the individuals
			 while at units of—</text>
				<subparagraph id="H9C5EA3E629E7477C8FAE954EAA5782C"><enum>(A)</enum><text>the National Park
			 System; and</text>
				</subparagraph><subparagraph id="H8500BC92D5EE4CB0A5D7FCA3369EAD99"><enum>(B)</enum><text>the National
			 Wildlife Refuge System;</text>
				</subparagraph></paragraph><paragraph id="HA12F03DED36949F2A6BE1DC2561BE74B"><enum>(5)</enum><text display-inline="yes-display-inline">The existence of different laws relating to
			 the transportation and possession of firearms at different units of the
			 National Park System and the National Wildlife Refuge System entraps
			 law-abiding gun owners while at units of the National Park System and the
			 National Wildlife Refuge System; and</text>
			</paragraph><paragraph id="H06C95CDF0F134F299D81F13944F90042"><enum>(6)</enum><text display-inline="yes-display-inline">The Federal laws should make it clear that
			 the second amendment rights of an individual at a unit of the National Park
			 System or the National Wildlife Refuge System should not be infringed.</text>
			</paragraph></section><section id="H16B7B1826E9041C4B481DB00776F4F45"><enum>3.</enum><header>Protecting the
			 right of individuals to bear arms in units of the National Park System and the
			 National Wildlife Refuge System</header>
			<subsection id="H72B70411A482474A83C4F77D3757BDD"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Except as provided in
			 <external-xref legal-doc="usc" parsable-cite="usc/18/930">section 930</external-xref> of title 18, United States Code, the Secretary of the Interior
			 shall not promulgate or enforce any regulation that prohibits an individual
			 from possessing, transporting, or carrying a firearm (including an assembled or
			 functional firearm) in any unit of the National Park System or the National
			 Wildlife Refuge System if—</text>
				<paragraph id="H79618A0B239C49F4BD4723EE00BF79E"><enum>(1)</enum><text>the individual is
			 not otherwise prohibited by law from possessing, transporting, or carrying the
			 firearm; and</text>
				</paragraph><paragraph id="H6F50FDFB839A4B87A4A06C2600D15CAE"><enum>(2)</enum><text display-inline="yes-display-inline">the possession, transportation, or carrying
			 of the firearm is in compliance with the law governing possession,
			 transportation, or carrying of firearms in parks of the State in which the unit
			 of the National Park System or the National Wildlife Refuge System is
			 located.</text>
				</paragraph></subsection><subsection id="H71F2E4AE6BCB48EEBD7EF6FA3EE43570"><enum>(b)</enum><header>Rule of
			 construction</header><text>Nothing in this Act shall be construed to
			 authorize—</text>
				<paragraph id="H05F48FFAB7714728AF884D92EC55F29"><enum>(1)</enum><text>the taking of
			 wildlife or fish, except as authorized by the Secretary; or</text>
				</paragraph><paragraph id="H959861AC15024F078B8D110065ECBD00"><enum>(2)</enum><text>the discharge of
			 firearms without legal justification or excuse, except as authorized by the
			 Secretary.</text>
				</paragraph></subsection><subsection id="H78C5CB5A16AF4F03B10019640636AA9B"><enum>(c)</enum><header>Definition</header><text display-inline="yes-display-inline">For purposes of this Act, the term
			 <quote>firearm</quote> shall have the meaning given to it in section 921(a)(3)
			 of title 18, United States Code.</text>
