		<section display-inline="no-display-inline" id="H073CDBAAA5F844C1B93BBCF00A78426" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Recycling Investment Saves
			 Energy</short-title></quote> or the <quote><short-title>RISE Act</short-title></quote>.</text>
		</section><section id="HE5FDE9B421B64EEDBD4DD27283D330B5"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds the following:</text>
			<paragraph id="H17DA265B66D34918AAC663C5599DC8E2"><enum>(1)</enum><text>Recycling means
			 business in the United States, with more than 56,000 reuse and recycling
			 establishments that employ over 1,100,000 people, generating an annual payroll
			 of nearly $37,000,000,000, and grossing over $236,000,000,000 in annual
			 revenues. In 2005, recycling scrap materials accounted for $15,700,000,000 in
			 exports for the United States. On a per-ton basis, sorting and processing
			 recyclables alone sustain 10 times more jobs than landfilling or
			 incineration.</text>
			</paragraph><paragraph id="H4365057282904A64B15813561BD90000"><enum>(2)</enum><text>By reducing the
			 need to extract and process virgin raw materials into manufacturing feedstock,
			 reuse and recycling helps achieve significant energy savings. For
			 example:</text>
				<subparagraph id="H1E909E96ECC542DE8126CE907B42DCF1"><enum>(A)</enum><text>Taken together,
			 the amount of energy wasted from not recycling aluminum and steel cans, paper,
			 printed materials, glass, and plastic equals the annual output of 15 medium
			 sized power plants.</text>
				</subparagraph><subparagraph id="H6F5B4A7296A54C07B0B8EB86CF9B0E2"><enum>(B)</enum><text>The reuse of 500
			 steel drums per week yields 6 trillion Btu’s per year, which is enough energy
			 savings to power a city the size of Colorado Springs, Colorado, for 1
			 year.</text>
				</subparagraph></paragraph><paragraph id="H85C34109EFA3440093987616B047ECFD"><enum>(3)</enum><text>Unfortunately, the
			 United States recycling rate of many consumer commodities, including aluminum,
			 glass, and plastic, are stagnant or declining, and businesses that rely on
			 recycled feedstock are finding it difficult to obtain the quantity and quality
			 of recycled materials needed. Increasingly, United States manufacturing
			 facilities that rely on recycled feedstock are closing or forced to re-tool to
			 use virgin materials.</text>
			</paragraph><paragraph id="HACF379327DF54B7C8FE500228511C001"><enum>(4)</enum><text>The environmental
			 impacts from reuse and recycling are significant. Increased reuse and recycling
			 would produce significant environmental benefits, such as cleaner air, safer
			 water, and reduced production costs. For example:</text>
				<subparagraph id="H44DB377CC5464A7DA100EDA7FE7DBE7E"><enum>(A)</enum><text>Between 2 and 5
			 percent of the waste stream is reusable. Reuse prevents waste creation and
			 adverse impacts from disposal.</text>
				</subparagraph><subparagraph id="H55A629EA71574230A478F7F4A033B758"><enum>(B)</enum><text>On a per-ton
			 basis, recycling of: office paper prevents 60 pounds of air pollutants from
			 being released, saves 7,000 gallons of water, and 3.3 cubic yards of landfill
			 space; aluminum saves 10 cubic yards of landfill space; plastic saves 30 cubic
			 yards of landfill space; glass prevents 7.5 pounds of air pollutants from being
			 released and saves 2 cubic yards of landfill space; and steel saves 4 cubic
			 yards of landfill space.</text>
				</subparagraph><subparagraph id="H3195BBB57E1F4F478E3CC326079DF00"><enum>(C)</enum><text>The manufacture of
			 100 percent recycled paperboard products uses significantly less fossil fuel
			 than comparable products and is therefore a net reducer of greenhouse gases.
			 And, for every 100 tons of recycled paperboard produced, 105 tons of material
			 is prevented from going to the landfill, thus reducing landfill gases.</text>
				</subparagraph></paragraph><paragraph id="H10DE2EE7E2634EA49048D24209EEEB3"><enum>(5)</enum><text>A
			 national investment in the reuse and recycling industries is needed to preserve
			 and expand America’s reuse and recycling infrastructure.</text>
			</paragraph></section><section id="H7CFC0218F6FD4165A40593617D1FC36"><enum>3.</enum><header>Special
			 depreciation allowance for certain reuse and recycling property</header>
			<subsection id="H36ACBE52E840400CBB12BCC5E4B43D00"><enum>(a)</enum><header>In
			 general</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/168">Section 168</external-xref> of the Internal Revenue Code of 1986
			 (relating to accelerated cost recovery system) is amended by adding at the end
			 the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H0726EE3252754091ABE6617E1482D049" style="OLC">
					<subsection id="H1F6C1B7D399B4EE884EC38989FC1C625"><enum>(l)</enum><header>Special
				allowance for certain reuse and recycling property</header>
						<paragraph id="HB24CF2971BAE4F9085F9D5368943CBBD"><enum>(1)</enum><header>In
				general</header><text>In the case of any qualified reuse and recycling
				property—</text>
							<subparagraph id="H0A59DECA0733461595EB69F03510B0"><enum>(A)</enum><text>the depreciation
				deduction provided by section 167(a) for the taxable year in which such
				property is placed in service shall include an allowance equal to 50 percent of
				the adjusted basis of the qualified reuse and recycling property, and</text>
							</subparagraph><subparagraph id="H78923AE21D4E405AB18116DF4DDE5250"><enum>(B)</enum><text>the adjusted basis
				of the qualified reuse and recycling property shall be reduced by the amount of
				such deduction before computing the amount otherwise allowable as a
				depreciation deduction under this chapter for such taxable year and any
				subsequent taxable year.</text>
							</subparagraph></paragraph><paragraph id="H18498047F348478EA2D74B40A21CE8F0"><enum>(2)</enum><header>Qualified reuse
				and recycling property</header><text>For purposes of this subsection—</text>
							<subparagraph id="H02A1B181BAA0430CB53F92876CD95CD9"><enum>(A)</enum><header>In
				general</header><text>The term <term>qualified reuse and recycling
				property</term> means any reuse and recycling property—</text>
								<clause id="HEFE862407EF846C788B055C857094C08"><enum>(i)</enum><text>to
				which this section applies,</text>
								</clause><clause id="H1C73B6AB828A474AAA683EFA00CC4134"><enum>(ii)</enum><text>which has a
				useful life of at least 5 years,</text>
								</clause><clause id="H729F3FD06EDC4A1E88F857C57FDB744C"><enum>(iii)</enum><text>the original use
				of which commences with the taxpayer after December 31, 2006, and</text>
								</clause><clause id="HBA0F939B390F4EA398AAC62F6B1FD2D5"><enum>(iv)</enum><text>which is—</text>
									<subclause id="H8F393D803F12417CBF791CDEBCBFC27"><enum>(I)</enum><text>acquired by
				purchase (as defined in section 179(d)(2)) by the taxpayer after December 31,
				2006, but only if no written binding contract for the acquisition was in effect
				before January 1, 2007, or</text>
									</subclause><subclause id="H10B7FA13CAA8414DAA37D402C99D5EB"><enum>(II)</enum><text>acquired by the
				taxpayer pursuant to a written binding contract which was entered into after
				December 31, 2006.</text>
									</subclause></clause></subparagraph><subparagraph id="H1AA762E756B84247A87B9783F4F34C70"><enum>(B)</enum><header>Exceptions</header>
								<clause id="H226A7122157745C8B666EC889FF3BB91"><enum>(i)</enum><header>Alternative
				depreciation property</header><text>The term <term>qualified reuse and
				recycling property</term> shall not include any property to which the
				alternative depreciation system under subsection (g) applies, determined
				without regard to paragraph (7) of subsection (g) (relating to election to have
				system apply).</text>
								</clause><clause id="H047B221953E6482FA18932DDFCCD1997"><enum>(ii)</enum><header>Election
				out</header><text>If a taxpayer makes an election under this clause with
				respect to any class of property for any taxable year, this subsection shall
				not apply to all property in such class placed in service during such taxable
				year.</text>
								</clause></subparagraph><subparagraph id="H9D7F14CD3431499C96D79D00EAE3B23D"><enum>(C)</enum><header>Special rule for
				self-constructed property</header><text>In the case of a taxpayer
				manufacturing, constructing, or producing property for the taxpayer's own use,
				the requirements of clause (iv) of subparagraph (A) shall be treated as met if
				the taxpayer begins manufacturing, constructing, or producing the property
				after December 31, 2006.</text>
							</subparagraph><subparagraph id="HEE4E048E49AD426FA81F57272035B0BC"><enum>(D)</enum><header>Deduction
				allowed in computing minimum tax</header><text>For purposes of determining
				alternative minimum taxable income under section 55, the deduction under
				subsection (a) for qualified reuse and recycling property shall be determined
				under this section without regard to any adjustment under section 56.</text>
							</subparagraph></paragraph><paragraph id="HA3D4B769AF5B46B6A466475B4CC8232F"><enum>(3)</enum><header>Definitions</header><text>For
				purposes of this subsection—</text>
							<subparagraph id="HDBBFD1072B7C4F42BF56163EC72F49E"><enum>(A)</enum><header>Reuse and
				recycling property</header>
								<clause id="HBBCE51041C554E6EBFF5480061C4FF4"><enum>(i)</enum><header>In
				general</header><text>The term <term>reuse and recycling property</term> means
				any machinery and equipment (not including buildings or real estate), along
				with all appurtenances thereto, including software necessary to operate such
				equipment, which is used exclusively to collect, distribute, or recycle
				qualified reuse and recyclable materials.</text>
								</clause><clause id="H0E1846E86164438DB9EBFFA6F3DF5013"><enum>(ii)</enum><header>Exclusion</header><text>Such
				term does not include—</text>
									<subclause id="H46BD54FAA9C7437CB01546621655B000"><enum>(I)</enum><text>rolling stock or
				other equipment used to transport reuse and recyclable materials, and</text>
									</subclause><subclause id="HD814E8C7C0644FFD80749FB0EEE3FD0"><enum>(II)</enum><text>equipment used to
				produce new products or commodities from recycled products.</text>
									</subclause></clause></subparagraph><subparagraph id="H45C6861BB97A4722B446EE1D75A67F62"><enum>(B)</enum><header>Qualified reuse
				and recyclable materials</header>
								<clause id="H4646324823514A498BA0CCF232B24BD3"><enum>(i)</enum><header>In
				general</header><text>The term <term>qualified reuse and recyclable
				materials</term> means scrap plastic, scrap glass, scrap textiles, scrap
				rubber, scrap packaging, recovered fiber, scrap ferrous and nonferrous metals,
				or electronic scrap generated by an individual or business.</text>
								</clause><clause id="HDB1A5528DF8B44979CA43616783C6BAF"><enum>(ii)</enum><header>Electronic
				scrap</header><text>For purposes of clause (i), the term <term>electronic
				scrap</term> means—</text>
									<subclause id="H38ACB1D581EF42C3B300836E41AAF302"><enum>(I)</enum><text>any cathode ray
				tube, flat panel screen, or similar video display device with a screen size
				greater than 4 inches measured diagonally, or</text>
									</subclause><subclause id="HDCEDA70D346B40169C22854E86005F17"><enum>(II)</enum><text>any central
				processing
				unit.</text>
									</subclause></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H57EF5EE8B77C42B89E54A27E04A7B890"><enum>(b)</enum><header>Effective
			 date</header><text>The amendment made by this section shall apply to property
			 placed in service after December 31, 2006.</text>
