		<official-title>To direct the Administrator of the Small Business
		  Administration to conduct a demonstration program to raise awareness about
		  telework among small business employers, and to encourage such employers to
		  offer telework options to employees, and for other purposes.</official-title>

		<section display-inline="no-display-inline" id="HE9A20D7E76BE4C1A9C318F4502BCF97" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Small Business Telework Promotion
			 Act</short-title></quote>.</text>
		</section><section id="HAC8DC1C0647C438CBFCA607F5827B0F4"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds that—</text>
			<paragraph id="HFFC2EA5943F24D218C22FD3D95E630CD"><enum>(1)</enum><text>Federal, State,
			 and local governments spend billions of dollars annually on the Nation’s
			 transportation needs;</text>
			</paragraph><paragraph id="H6738956539BE493C956400AF44676BE8"><enum>(2)</enum><text>congestion on the
			 Nation’s roads costs lost work time and increased fuel consumption;</text>
			</paragraph><paragraph id="HD7E11CFA32514DEA0095D59FB2005094"><enum>(3)</enum><text>on average,
			 on-road vehicles contribute 34 percent of nitrogen oxides emissions;</text>
			</paragraph><paragraph id="H53C07B6687214C99B93566586C4114AC"><enum>(4)</enum><text>it is estimated
			 that staying at home to work requires 3 times less energy consumption than
			 commuting to work;</text>
			</paragraph><paragraph id="HB6775E520EB140D89801986EFD726E27"><enum>(5)</enum><text display-inline="yes-display-inline">the average travel time to work is 25
			 minutes each way;</text>
			</paragraph><paragraph id="HCF2BD40DAE184727987589947155F977"><enum>(6)</enum><text>telework reduces
			 the volume of peak commuter traffic, thereby reducing traffic congestion and
			 air pollution;</text>
			</paragraph><paragraph id="HBD5678A3DDBB47FCAA4EA6B7FA7D6796"><enum>(7)</enum><text>the Nation’s
			 communities can benefit from telework, which gives workers more time to spend
			 at home with their families;</text>
			</paragraph><paragraph id="H582DA0C8650A4C4A902137EA221F00CC"><enum>(8)</enum><text>it is in the
			 national interest to raise awareness within the small business community of
			 telework options for employees;</text>
			</paragraph><paragraph id="H59B05C7CC27D46199E00D61BB1B6FF87"><enum>(9)</enum><text>the small business
			 community can benefit from offering telework options to employees because such
			 options make it easier for small employers to retain valued employees and
			 employees with irreplaceable institutional memory;</text>
			</paragraph><paragraph id="HDF21D8D4C49D43C9A422A5AFAAD47306"><enum>(10)</enum><text>companies with
			 telework programs have found that telework can boost employee productivity 5
			 percent to 20 percent, thereby saving businesses valuable resources and
			 time;</text>
			</paragraph><paragraph id="H6DE51828E40B4677A4C0B8EA6000F13"><enum>(11)</enum><text>individuals with
			 disabilities, including service-disabled veterans, who own or are employed by
			 small businesses could benefit from telework to their workplaces;</text>
			</paragraph><paragraph id="H5CD835D1A8FF4C34B4C5F471A41BE4B"><enum>(12)</enum><text>telework has the
			 potential to provide more employment opportunities in rural communities;
			 and</text>
			</paragraph><paragraph id="H90A6089975D043DE8DDBA478D436AA5F"><enum>(13)</enum><text>telework is seen
			 as a valuable tool in disaster preparedness and business continuity.</text>
			</paragraph></section><section id="H5FD3004195D24D6CA36485D1977477BF"><enum>3.</enum><header>Small business
			 demonstration program</header>
			<subsection id="H64F3EF085BB54C27922BF9DC82B8A026"><enum>(a)</enum><header>In
			 general</header><text>The Administrator of the Small Business Administration
			 shall carry out a competitive grant program under this section to raise
			 awareness about telework among small business employers and to encourage such
			 employers to offer telework options to employees.</text>
			</subsection><subsection id="HE3CDBCFCB4DA4F238ECAA46B80C2EDE8"><enum>(b)</enum><header>Special outreach
			 to individuals with disabilities</header><text>In carrying out the program, the
			 Administrator shall make special efforts to conduct outreach to—</text>
				<paragraph id="H4176788528194676BF4CDB7F11D9F39"><enum>(1)</enum><text>businesses owned by
			 or employing individuals with disabilities, and service-disabled veterans in
			 particular;</text>
				</paragraph><paragraph id="HF944E84D058F481C974B9F85FB6C8FDB"><enum>(2)</enum><text>Federal, State,
			 and local agencies having knowledge and expertise in assisting individuals with
			 disabilities or service-disabled veterans; and</text>
				</paragraph><paragraph id="H1A13FDB934234F91A33F591462AC178"><enum>(3)</enum><text>any group or
			 organization, the primary purpose of which is to aid individuals with
			 disabilities or service-disabled veterans.</text>
				</paragraph></subsection><subsection id="H3E9089865ECF47859BE55D2C3BB9DD9D"><enum>(c)</enum><header>Permissible
			 activities</header><text>Funds received under a grant may be used only
			 to—</text>
				<paragraph id="H99B41862320740D4AC30BCDCBEAFA7E2"><enum>(1)</enum><text>produce
			 educational materials and conduct presentations designed to raise awareness in
			 the small business community of the benefits and the ease of telework;</text>
				</paragraph><paragraph id="HF376382535C24ED788A8096163078B5F"><enum>(2)</enum><text>conduct
			 outreach—</text>
					<subparagraph id="H66DEAAF079714D7EA52C1687373C3594"><enum>(A)</enum><text>to small business
			 concerns that are considering offering telework options; and</text>
					</subparagraph><subparagraph id="HE88E770B20E4483C88D88B72C94CB9AD"><enum>(B)</enum><text>to entities
			 described in subsection (b); and</text>
					</subparagraph></paragraph><paragraph id="H5F53F71ACAA44EF78B95BBE7B682282C"><enum>(3)</enum><text>acquire telework
			 technologies and equipment to be used for demonstration purposes.</text>
				</paragraph></subsection><subsection id="H1803A40305564B289D1710722D3502EB"><enum>(d)</enum><header>Report to
			 congress</header><text>Not later than the end of fiscal year 2009, the
			 Administrator shall transmit to the Committee on Small Business of the House of
			 Representatives and the Committee on Small Business and Entrepreneurship of the
			 Senate a report containing the results of an evaluation of the program and any
			 recommendations as to whether the program, with or without modification, should
			 be extended.</text>
			</subsection><subsection id="HC74AA394597F4E569CA93678F0593493"><enum>(e)</enum><header>Definitions</header><text>In
			 this section—</text>
				<paragraph id="HE6CD08572FE24B1BB488740091F40085"><enum>(1)</enum><text>the term
			 <term>disability</term> has the same meaning as in section 3 of the Americans
			 with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12102">42 U.S.C. 12102</external-xref>); and</text>
				</paragraph><paragraph id="H3A859A018A454E3CA2D79F6D1E876831"><enum>(2)</enum><text>the term
			 <term>telework</term> means the performance of any portion of work functions by
			 an employee outside the normal place of business under circumstances which
			 reduce or eliminate the need to commute.</text>
				</paragraph></subsection><subsection id="H38EFBCC6E2DB427BA26860A2481072BB"><enum>(f)</enum><header>Termination</header><text>The
			 authority to carry out the program under this section shall terminate at the
			 end of fiscal year 2009.</text>
			</subsection><subsection id="H7ABC2AF47F8C4DE69CA0FDFC92E8146E"><enum>(g)</enum><header>Authorization of
			 appropriations</header><text>There is authorized to be appropriated to the
			 Small Business Administration $5,000,000 to carry out this section.</text>
