<enum>I</enum><header>Administration and
Management of Capitol Visitor Center</header>
<subtitle id="H32A763AC054F48D2884D00BE9B20D638"><enum>A</enum><header>Description of
Facility</header>
<section display-inline="no-display-inline" id="H0C6026DFDCD249E3A409251682BBC63E" section-type="subsequent-section"><enum>101.</enum><header>Description and
Purposes of Capitol visitor center</header>
<subsection id="H012379CFF19546D1A6FFD4AAA8C4281"><enum>(a)</enum><header>Treatment as Part
of Capitol</header><text>In this Act, the <quote>Capitol Visitor Center</quote>
is the facility authorized for construction under the heading <quote>Capitol
Visitor Center</quote> under chapter 5 of title II of division B of the Omnibus
Consolidated and Emergency Supplemental Appropriations Act, 1999 (Public Law
105–277; 112 Stat. 2681–569), and such facility shall be considered to be part
of the United States Capitol for all provisions of law in accordance with this
Act.</text>
</subsection><subsection id="H7C84E6EF284B4260805DCB236DA8E9AF"><enum>(b)</enum><header>Purposes of the
facility</header><text>In accordance with the provisions of this Act, the
Capitol Visitor Center shall be used to—</text>
<paragraph id="H61F805E616154C0D927B2FB28C598BBF"><enum>(1)</enum><text>provide enhanced
security for persons working in or visiting the United States Capitol;
and</text>
</paragraph><paragraph id="H5B0606E2DDFA45E48C12543517385C03"><enum>(2)</enum><text>improve the
visitor experience by providing a structure that will afford improved visitor
orientation and enhance the educational experience of those who have come to
learn about Congress and the Capitol.</text>
</paragraph></subsection><subsection display-inline="no-display-inline" id="HB8BF826D835B42AA8971D0F2E48ADD5"><enum>(c)</enum><header>Conforming
Amendment Relating to Visitor Center Space in the Capitol</header><text>Section
301 of the National Visitor Center Facilities Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/2/2165">2 U.S.C. 2165</external-xref>) is
repealed.</text>
</subsection></section><section id="H94682B11549E4A52B025B1D078E9ABEF"><enum>102.</enum><header>Oversight of
Committees</header><text display-inline="no-display-inline">The Committee on
Rules and Administration of the Senate and the Committee on House
Administration of the House of Representatives (hereafter in this Act referred
to as the <quote>supervising Committees</quote>) shall exercise policy review
and oversight over the Capitol Visitor Center.</text>
</section><section display-inline="no-display-inline" id="H05E48301C21B4C2BB1F8FFC5B125B8E" section-type="subsequent-section"><enum>103.</enum><header>Special Rule for
Certain Spaces in the Capitol Visitor Center</header>
<subsection id="HD9032210B6B64955BDCAD4B71B8CFC3E"><enum>(a)</enum><header>Senate and House
of Representatives Expansion Space</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this
Act, the Senate and House of Representatives expansion space described as
<quote>unassigned space</quote> under the heading <quote>Architect of the
Capitol, Capitol Visitor Center</quote> in the Legislative Branch
Appropriations Act, 2002 (<external-xref legal-doc="public-law" parsable-cite="pl/107/68">Public Law 107–68</external-xref>; 115 Stat. 588)—</text>
<paragraph id="HFBF7A668290B4223970000C73D1DEDDD"><enum>(1)</enum><text>shall not be
treated as part of the Capitol Visitor Center for purposes of this Act;
and</text>
</paragraph><paragraph id="H2EEFFC0FAD584CC695A696F90A79E3E"><enum>(2)</enum><text>shall be treated
for purposes of law (including rules of the House of Representatives and
Senate)—</text>
<subparagraph id="H4C9A56157C7B4D78B926B18D44BEA005"><enum>(A)</enum><text>in the case of
space assigned for the use of the Senate, as part of the Senate wing of the
Capitol and subject to the authority and control of the Committee on Rules and
Administration of the Senate, or</text>
</subparagraph><subparagraph id="H667E8B1805B94615B7FEFA8C546DB664"><enum>(B)</enum><text>in the case of
space assigned for the use of the House, as part of the House of
Representatives wing of the Capitol and subject to the authority and control of
the Speaker.</text>
</subparagraph></paragraph></subsection><subsection id="H87E9B7FFC8964782904C6452F7BB0898"><enum>(b)</enum><header>Treatment of
Congressional Auditorium and Related Adjacent Areas</header>
<paragraph id="H4F612E33731E4B7E8F59236D2E20B296"><enum>(1)</enum><header>In
general</header><text>Notwithstanding any other provision of this Act, the
space in the Capitol Visitor Center known as the Congressional Auditorium,
together with each of the areas referred to in paragraph (2), shall be assigned
for Congressional use by the Chief Executive Officer for Visitor Services under
guidelines established by the supervising Committees.</text>
</paragraph><paragraph id="HCC502076BB5343C19865E9299B3E7C15"><enum>(2)</enum><header>Areas
described</header><text>The areas referred to in this paragraph are as follows,
as identified and designated by the Architect of the Capitol on October 1,
2007:</text>
<subparagraph id="H8E5A32C716784DF0AE38E7D25F49F18F"><enum>(A)</enum><text display-inline="yes-display-inline">The North Congressional Meeting Room
(CVC268) and the South Congressional Meeting Room (CVC217).</text>
</subparagraph><subparagraph id="HDC9192BE0679485EB850B12BAE4F069D"><enum>(B)</enum><text display-inline="yes-display-inline">The North Pre-function Area (CVC268CR) and
the South Pre-function Area (CVC217CR).</text>
</subparagraph><subparagraph id="HE7E9D8D14BF54AAD9EB848797E137962"><enum>(C)</enum><text>Lobbies CVC215 and
CVC 212.</text>
</subparagraph><subparagraph id="H2A1A25F1DA164E2EBBA051D0FE33A49C"><enum>(D)</enum><text display-inline="yes-display-inline">The North Cloak Room (CVC210) and the South
Cloak Room (CVC208).</text>

</subparagraph></paragraph></subsection></section></subtitle><subtitle id="H60F9985D8E2F405980F571ED3944A0AC"><enum>B</enum><header>Office of the
Capitol Visitor Center; Chief Executive Officer for Visitor Services</header>
<section id="HD7F3434CD6144D5B8232659B00700087"><enum>111.</enum><header>Establishment</header><text display-inline="no-display-inline">There is established within the Office of
the Architect of the Capitol the Office of the Capitol Visitor Center (in this
Act referred to as the <quote>Office</quote>), to be headed by the Chief
Executive Officer for Visitor Services (in this Act referred to as the
<quote>Chief Executive Officer</quote>).</text>
</section><section id="H00E1E0FC3C8A46EA8443C3942605AEE"><enum>112.</enum><header>Appointment and
Supervision of Chief Executive Officer for Visitor Services</header>
<subsection id="H71E6E1E9B8C74035B7AD3E1D38E316F0"><enum>(a)</enum><header>Appointment</header><text>The
Chief Executive Officer shall be appointed by the Architect of the
Capitol.</text>
</subsection><subsection id="H126646F8F52D493B9806B1C3EDAF5BC6"><enum>(b)</enum><header>Supervision and
Oversight</header><text>The Chief Executive Officer shall report directly to
the Architect of the Capitol and shall be subject to policy review and
oversight by the supervising Committees.</text>
</subsection><subsection id="H1484B5867239443881F06450DF560065"><enum>(c)</enum><header>Removal</header><text>Upon
removal of the Chief Executive Officer, the Architect of the Capitol shall
immediately notify the supervising Committees and the Committees on
Appropriations of the House of Representatives and Senate, stating the reasons
for the removal.</text>
</subsection><subsection id="H89A42A18E74D47C3B6C6405FEDFE5488"><enum>(d)</enum><header>Compensation</header><text>The
Chief Executive Officer shall be paid at an annual rate of pay equal to the
annual rate of pay of the Deputy Architect of the Capitol and Chief Operating
Officer of the Office of the Architect of the Capitol.</text>
</subsection><subsection id="HEB4A8B3F25194CF900F4E361E2B43DB6"><enum>(e)</enum><header>Transition for
Current Chief Executive Officer for Visitor Services</header>
<paragraph id="H20C5F00479604CFA9E82160018EA8CF"><enum>(1)</enum><header>Appointment</header><text display-inline="yes-display-inline">The individual who serves as the Chief
Executive Officer for Visitor Services under section 6701 of the U.S. Troop
Readiness, Veterans’ Care, Katrina Recovery, and Iraq Accountability
Appropriation Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/2/1806">2 U.S.C. 1806</external-xref>) as of the date of the enactment of
this Act shall be the first Chief Executive Officer for Visitor Services
appointed by the Architect under this section.</text>
</paragraph><paragraph id="HCB24403D14624CA585FBD46796464876"><enum>(2)</enum><header>Conforming
amendment</header><text>Section 6701 of the U.S. Troop Readiness, Veterans’
Care, Katrina Recovery, and Iraq Accountability Appropriation Act of 2007 (2
U.S.C. 1806) is repealed.</text>
</paragraph></subsection></section><section id="HDF067D406388472C9647DF0074FF314B"><enum>113.</enum><header>General Duties
of Chief Executive Officer</header>
<subsection display-inline="no-display-inline" id="H49B009F7DDAF44FDB08FA425D2539702"><enum>(a)</enum><header>Administration
of Facilities, Services, and Activities</header>
<paragraph id="H9EBB97D926F04B0A8FE32E9755F100D4"><enum>(1)</enum><header>In
general</header><text>Except to the extent otherwise provided in this Act, the
Chief Executive Officer shall be responsible for—</text>
<subparagraph id="HCE061645AA5244468445ADC79CEAF4B"><enum>(A)</enum><text>the operation,
management, and budget preparation and execution of the Capitol Visitor Center,
including all long term planning and day-today operational services and
activities provided within the Capitol Visitor Center; and</text>
</subparagraph><subparagraph id="H068CFD7263BB4E2486B2AA8BCB4D3DEF"><enum>(B)</enum><text>in accordance with
subtitle A of title III, the management of guided tours of the interior of the
United States Capitol.</text>
</subparagraph></paragraph><paragraph id="H8713A681B52E47EE9080C03703AF40B1"><enum>(2)</enum><header>Independent
budget submission</header>
<subparagraph id="H6214CE2C45C74CF5810032004C694B6C"><enum>(A)</enum><header>In
general</header><text>The proposed budget for the Office for a fiscal year
shall be prepared by the Chief Executive Officer, and shall be included without
revision in the proposed budget for the year for the Office of the Architect of
the Capitol (as submitted by the Architect of the Capitol to the
President).</text>
</subparagraph><subparagraph id="H43ED3AFEDD884F80AC10374E07765431"><enum>(B)</enum><header>Exclusion of
costs of general maintenance and repair of Visitor Center</header><text>In
preparing the proposed budget for the Office under subparagraph (A), the Chief
Executive Officer shall exclude costs attributable to the activities and
services described in section 115(b) (relating to continuing jurisdiction of
the Architect of the Capitol for the care and superintendence of the Capitol
Visitor Center).</text>
</subparagraph></paragraph></subsection><subsection id="HEC62FB59AEF04E4F8856539D38C3A3CA"><enum>(b)</enum><header>Personnel and
Other Administrative Provisions</header>
<paragraph id="H13D83A3CE54B475580FEF343C0D4BEE9"><enum>(1)</enum><header>Personnel,
disbursements, and contracts</header><text>In carrying out this Act, the Chief
Executive Officer shall have the authority—</text>
<subparagraph id="HD665866B2F9C4E6A929B2F7417D1DAE1"><enum>(A)</enum><text>to appoint, hire,
and fix the compensation of such personnel as may be necessary for operations
of the Office, except that no employee may be paid at an annual rate in excess
of the maximum rate payable for level 15 of the General Schedule unless
otherwise authorized by law;</text>
</subparagraph><subparagraph id="H03D337BBDFC2497BA44700F237C5B3C"><enum>(B)</enum><text>to disburse funds
as may be necessary and available for the needs of the Office (consistent with
the requirements of section 213 in the case of amounts in the Capitol Visitor
Center Revolving Fund); and</text>
</subparagraph><subparagraph id="HE8DF52CE6F07445283021F5EBD8991C"><enum>(C)</enum><text>to designate an
employee of the Office to serve as contracting officer for the Office, subject
to subsection (c).</text>
</subparagraph></paragraph><paragraph id="H4CDBAE3022984C11BFD38F002F5055C0"><enum>(2)</enum><header>Temporary
assignment of personnel</header><text>The Chief Executive Officer shall
temporarily assign personnel of the Office based on a request from the Capitol
Police Board to assist the United States Capitol Police by providing ushering
and informational services, and other services not directly involving law
enforcement, in connection with—</text>
<subparagraph id="HE2E0FEC31E5C484990D5177C5F687D57"><enum>(A)</enum><text>the inauguration
of the President and Vice President of the United States;</text>
</subparagraph><subparagraph id="HEE2D41CF2F9C41FE8751273C86ABE8D0"><enum>(B)</enum><text>the official
reception of representatives of foreign nations and other persons by the Senate
or House of Representatives; or</text>
</subparagraph><subparagraph id="H0A59EC94BA434AABAC7BB592EFAB62ED"><enum>(C)</enum><text>other special or
ceremonial occasions in the United States Capitol or on the United States
Capitol Grounds that require the presence of additional Government
personnel.</text>
</subparagraph></paragraph><paragraph id="HFC1DFDA67D894196A6EA46D8B26779AB"><enum>(3)</enum><header>Agreements with
the office of the architect of the capitol, with other legislative branch
agencies, and with offices of the senate and house of
representatives</header><text>Subject to the approval of the supervising
Committees, the Chief Executive Officer may place orders and enter into
agreements with the Office of the Architect of the Capitol, with other
legislative branch agencies, and with any office or other entity of the Senate
or House of Representatives for procuring goods and providing financial and
administrative services on behalf of the Office, or to otherwise assist the
Chief Executive Officer in the administration and management of the Capitol
Visitor Center.</text>
</paragraph></subsection><subsection id="HFC0C4DE71A414C83AFF2C4299538FFE9"><enum>(c)</enum><header>Requiring
Approval of Certain Contracts</header><text>The Chief Executive Officer may not
enter into a contract for which the amount involved exceeds $250,000 without
the prior approval of the supervising Committees.</text>
</subsection><subsection id="H51FE069567F64493B07931996E1883F8"><enum>(d)</enum><header>Semiannual
Reports</header><text>The Chief Executive Officer shall submit a report to the
supervising Committees not later than 45 days following the close of each
semiannual period ending on June 30 or December 31 of each year on the
financial and operational status during the period of each function under the
jurisdiction of the Chief Executive Officer. Each such report shall include
financial statements and a description or explanation of current operations,
the implementation of new policies and procedures, and future plans for each
function.</text>
</subsection></section><section id="H29F5A055525648CEAEBB7B45215F365E"><enum>114.</enum><header>Acceptance of
Gifts and Volunteer Services</header>
<subsection id="HDA11D6397EA544C483AA48AA845E8BF3"><enum>(a)</enum><header>Acceptance of
gifts</header>
<paragraph id="HC4A73DCC23D74018BAEE23161202E765"><enum>(1)</enum><header>Authority to
accept and use gifts</header><text>The Chief Executive Officer, with the
approval of the supervising Committees, is authorized to receive, accept, and
hold unrestricted gifts of money on behalf of the Capitol Visitor Center, and
to use the gifts for the benefit of the Capitol Visitor Center</text>
</paragraph><paragraph id="H1DB189EAC0D04014AC1F93401E848E2B"><enum>(2)</enum><header>Acceptance of
gifts of works of art and other related objects by other legislative branch
entities</header>
<subparagraph id="H9F5B7A58CA5840E2BF742D6C51433878"><enum>(A)</enum><header>In
general</header><text>In the case of a gift consisting of a work of art,
historical object, or exhibit for which the authority to accept the gift for
display in the Capitol is provided to an entity referred to in subparagraph
(B), the entity shall have the authority to accept the gift for display in the
Capitol Visitor Center in accordance with the authority provided under
applicable law.</text>
</subparagraph><subparagraph id="H464AAD015F834A93B072C6BB0173B238"><enum>(B)</enum><header>Entities
described</header><text>The entities referred to in this subparagraph are as
follows:</text>
<clause id="HFCFB866E65544E5DACB5E972AC96AE44"><enum>(i)</enum><text display-inline="yes-display-inline">The Joint Committee on the Library under
section 1831 of the Revised Statutes of the United States (2 U.S.C.
2133).</text>
</clause><clause id="HAD78166CAF054945A2D69CFB9F4FEA16"><enum>(ii)</enum><text display-inline="yes-display-inline">The United States Capitol Preservation
Commission under section 801 of the Arizona-Idaho Conservation Act of 1988 (2
U.S.C. 2081).</text>
</clause><clause id="H464E043A1DEA409887AC11D971B02838"><enum>(iii)</enum><text display-inline="yes-display-inline">The House of Representatives Fine Arts
Board under section 1000 of the Arizona-Idaho Conservation Act of 1988 (2
U.S.C. 2121).</text>
</clause><clause id="HF9F9D2E031604A0CB893B6727F2100AF"><enum>(iv)</enum><text>The
Senate Commission on Art under section 1 of Senate Resolution 382, Ninetieth
Congress, agreed to October 1, 1968 and enacted into law by section 901(a) of
<external-xref legal-doc="public-law" parsable-cite="pl/100/690">Public Law 100–690</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/2/2101">2 U.S.C. 2101</external-xref>).</text>
</clause></subparagraph></paragraph><paragraph id="H46FFB072B4864A08BB57892598D42387"><enum>(3)</enum><header>Annual report on
gifts accepted</header><text>Each semiannual report submitted under section
113(d) shall include a description of each accepted by the Chief Executive
Officer under this subsection during the period covered by the report.</text>
</paragraph></subsection><subsection id="HF999B2C8A044448AA29170EB9FD42BE1"><enum>(b)</enum><header>Acceptance of
volunteer services</header><text>Notwithstanding <external-xref legal-doc="usc" parsable-cite="usc/31/1342">section 1342</external-xref> of title 31,
United States Code, the Chief Executive Officer may accept and use voluntary
and uncompensated services for the Capitol Visitor Center as the Chief
Executive Officer determines necessary. No person shall be permitted to donate
his or her personal services under this section unless such person has first
agreed, in writing, to waive any and all claims against the United States
arising out of or connection with such services, other than a claim under the
provisions of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/81">chapter 81</external-xref> of title 5, United States Code. No person donating
personal services under this section shall be considered an employee of the
United States for any purpose other than for purposes of chapter 81 of such
title. In no case shall the acceptance of personal services under this
subsection result in the reduction of pay or displacement of any employee of
the Office.</text>
</subsection></section><section display-inline="no-display-inline" id="H3B8EBCA2C0BC494096697CA32DC9A2DD"><enum>115.</enum><header>Special Rules
Regarding Certain Administrative Matters</header>
<subsection id="H29E37BC3F12F4625B2511C2CC194007F"><enum>(a)</enum><header>Special Rules
Regarding Security</header>
<paragraph id="H90B55FF9366F40F9AC8813CC2FE0A49B"><enum>(1)</enum><header>Security
jurisdiction of law enforcement agencies unaffected</header><text>Nothing in
this Act granting any authority to the Chief Executive Officer shall be
construed to affect the exclusive jurisdiction of the United States Capitol
Police, the Capitol Police Board, the Sergeant at Arms and Doorkeeper of the
Senate, and the Sergeant at Arms of the House of Representatives to provide
security for the Capitol Visitor Center.</text>
</paragraph><paragraph id="HD08DC7C67D584558A8FDEA599300BEED"><enum>(2)</enum><header>Attendance of
Chief Executive Officer at certain meetings of Capitol Police
Board</header><text>At the request of the Capitol Police Board, the Chief
Executive Officer shall attend any portion of any meeting of the Capitol Police
Board during which the Board considers issues relating to the security of the
Capitol Visitor Center, including activities described in paragraph (3), or
other issues relating to services provided by employees of the Office.</text>
</paragraph><paragraph id="HEEF57672302F4D7FA186D7D3B000033"><enum>(3)</enum><header>Consultation with
Capitol Police Board on security matters</header><text display-inline="yes-display-inline">The Office shall consult with the Capitol
Police Board in carrying out any activity which affects the security of the
Capitol Visitor Center or any other part of the Capitol, including activities
relating to the hours of operation, tour routes and the number of visitors per
tour guide, and other activities relating to the entry of members of the
general public into the Capitol and the movement of members of the general
public within the Capitol.</text>
</paragraph><paragraph id="HD8989505B9994764B9685867002EC1B6"><enum>(4)</enum><header>Plan for
background checks for employees</header><text>The Chief Executive Officer, in
coordination with the Chief of the Capitol Police, shall develop plans and
procedures for conducting criminal history background checks on employees of
the Office and individuals seeking employment with the Office (including
employees of the Capitol Guide Service who are transferred to the Office under
title III).</text>
</paragraph></subsection><subsection display-inline="no-display-inline" id="H5DCCDC13ED124B1D940065B64813E401"><enum>(b)</enum><header>Special Rules
Regarding Care and Maintenance of Facilities</header>
<paragraph id="H092E828F254741A7A3D72799E5DC00D9"><enum>(1)</enum><header>Architect of the
Capitol Jurisdiction unaffected</header><text>Nothing in this Act granting any
authority to the Chief Executive Officer shall be construed to affect the
exclusive jurisdiction of the Architect of the Capitol for the care and
superintendence of the Capitol Visitor Center or any other part of the Capitol,
and all maintenance services, groundskeeping services, improvements,
alterations, additions, and repairs for the Capitol Visitor Center shall be
carried out pursuant to the direction and supervision of the Architect subject
to the oversight of Congress under applicable law.</text>
</paragraph><paragraph id="H2F01FFB726444AAE9FF2A6C38FBC2DEF"><enum>(2)</enum><header>Budget
submission</header><text display-inline="yes-display-inline">The Architect of
the Capitol shall submit with the annual budget for the Office of the Architect
of the Capitol for a fiscal year a separate, detailed statement of the costs
anticipated to be incurred during the year for the activities and services
described in paragraph (1) which are excluded from the annual budget for the
Office which is submitted by the Chief Executive Officer under section
113(a)(2).</text>
</paragraph></subsection><subsection id="HAD8FA5C9EADC44A5B02F166BF57D0000"><enum>(c)</enum><header>Special Rule
Regarding Exhibits and Tours</header><text>The Chief Executive Officer shall
consider comments and recommendations from the Clerk of the House of
Representatives and the Secretary of the Senate regarding the content of
exhibits contained in and tours operated out of the Capitol Visitor
Center.</text>
</subsection></section></subtitle><enum>II</enum><header>Related Services
Provided at Capitol Visitor Center</header>
<subtitle id="HC6D6509D0A6C4432982D4997D698BF3C"><enum>A</enum><header>Related Services
Described</header>
<section id="H10B7961E3E764616A20017C42244EC77"><enum>201.</enum><header>Gift
Shop</header>
<subsection id="H97C7207F21144A2F908700BEE5E61C1C"><enum>(a)</enum><header>Establishment</header><text>In
consultation with the supervising Committees, the Chief Executive Officer shall
establish a gift shop within the Capitol Visitor Center for the purpose of
providing for the sale of gift items.</text>
</subsection><subsection id="H78E8B383E95F476EA7C258C4B4B07D52"><enum>(b)</enum><header>Exception to
prohibition of sale or solicitation on capitol grounds</header><text>Section
5104(c) of title 40, United States Code, shall not apply to any activity
carried out under this subsection.</text>
</subsection></section><section id="HF6584167039A4EF89334671E0596902B"><enum>202.</enum><header>Food service
operations</header>
<subsection id="H808A2928A27F4DC0958200D828C793A2"><enum>(a)</enum><header>Restaurant,
catering, and vending</header><text>The Chief Executive Officer is authorized
to establish within the Capitol Visitor Center a restaurant and other food
service facilities, including catering services and vending machines.</text>
</subsection><subsection id="H5A09C79DCD34445D93ED7FF43AE39"><enum>(b)</enum><header>Use of Contract to
Carry out food service operations</header><text>The Chief Executive Officer
shall carry out all food service operations within the Capitol Visitor Center
pursuant to a contract entered into with a private vendor.</text>
</subsection><subsection id="HE248D53CD1EB4DF7A44E8B660094CCA4"><enum>(c)</enum><header>Exception to
prohibition of sale or solicitation on capitol grounds</header><text>Section
5104(c) of title 40, United States Code, shall not apply to any activity
carried out under this subsection.</text>
</subsection></section><section id="HACAD40DFB3604B7A92C5A3031E3827C6"><enum>203.</enum><header>Licenses and
Other Agreements for Operations or Other Functions</header>
<subsection id="H4DE25B34F14F4D068C4DA658CAC516D"><enum>(a)</enum><header>Authority</header><text>The
Chief Executive Officer is authorized—</text>
<paragraph id="HD1964C3D6AAB49F9B1818C70E5CD9DA8"><enum>(1)</enum><text>subject to the
approval of the supervising Committees, to enter into licenses and other
agreements to allow operations or other functions to occur within the Capitol
Visitor Center; and</text>
</paragraph><paragraph id="HA93EB273B6B445B9BB647E3900470041"><enum>(2)</enum><text>to assess and
collect charges or other fees as may be appropriate under such licenses and
agreements, including the recoupment of costs associated with the operation or
function being held.</text>
</paragraph></subsection><subsection display-inline="no-display-inline" id="H81CDB80BC0FE42B993BBF598803B907C"><enum>(b)</enum><header>Exception to
Prohibition of Sale or Solicitation on Capitol Grounds</header><text>To the
extent that a license or agreement entered into by the Chief Executive Officer
under this section permits any person to sell or solicit the sale of goods or
services within the Capitol Visitor Center, <external-xref legal-doc="usc" parsable-cite="usc/40/5104">section 5104(c)</external-xref> of title 40, United
States Code, shall not apply to the sale or solicitation of sales of such goods
or services.</text>
</subsection><subsection id="H4871171E5FFC4C7E000004B4E32363DA"><enum>(c)</enum><header>Approval of
Congress Required for Certain Events</header><text display-inline="yes-display-inline">No event intended for purposes other than
those described in section 101(b) shall be held in the central hall of the
Capitol Visitor Center unless authorized by a resolution agreed to by both
houses of the Congress.</text>
</subsection></section></subtitle><subtitle id="H95AD17FA19674039A9E6003D00CD26EA"><enum>B</enum><header>Capitol Visitor
Center Revolving Fund</header>
<section id="HF5B33535E9D149258083F831FDFD88AB"><enum>211.</enum><header>Establishment;
Accounts</header><text display-inline="no-display-inline">There is established
in the Treasury of the United States a revolving fund to be known as the
Capitol Visitor Center Revolving Fund (in this section referred to as the
<quote>Fund</quote>), consisting of the following individual accounts:</text>
<paragraph id="H36C56ECFDF0C4ADAB2CFA12FDA8896D3"><enum>(1)</enum><text>The Gift Shop
Account.</text>
</paragraph><paragraph id="H9FB5B41790634BA383BC1EE3CB8FFBF0"><enum>(2)</enum><text>The Miscellaneous
Receipts Account.</text>
</paragraph></section><section id="H65FFAC33389A49DD872BBF52549B2DB"><enum>212.</enum><header>Deposits in the
fund</header>
<subsection id="HA27A9A0BDBE34A37ACDD31BEF4F0685F"><enum>(a)</enum><header>Gift Shop
Account</header><text display-inline="yes-display-inline">There shall be
deposited in the Gift Shop Account all monies received from sales and other
services by the gift shop established under section 201, together with any
interest accrued on balances in the Account.</text>
</subsection><subsection id="H4D20DF5DB70B408E979CB0C11398B77D"><enum>(b)</enum><header>Miscellaneous
Receipts Account</header><text display-inline="yes-display-inline">There shall
be deposited in the Miscellaneous Receipts Account each of the following
(together with any interest accrued on balances in the Account):</text>
<paragraph id="H67ACE9C2752340A6860027A842AA5EB2"><enum>(1)</enum><text>Any gifts of money
accepted under section 114(a).</text>
</paragraph><paragraph id="H418CA20AC15C413788FCF5F8488B4424"><enum>(2)</enum><text display-inline="yes-display-inline">Any net profits or commissions paid to the
Capitol Visitor Center under any contract for food service operations entered
into under section 202(b).</text>
</paragraph><paragraph id="H0A0E5EAB04964E368F00F97359D3602E"><enum>(3)</enum><text>Any charges or
fees collected from the operations or other functions within the Capitol
Visitor Center under licenses or other arrangements entered into under section
203(a).</text>
</paragraph><paragraph id="H2236548AC8404582B492F4579BF0002F"><enum>(4)</enum><text>Any other receipts
received from the operation of the Capitol Visitor Center</text>
</paragraph></subsection></section><section id="HE18A8796E6F74E4B90F52C2CCCF14262"><enum>213.</enum><header>Use of
monies</header>
<subsection id="H94850A7DE0AA4D6A89CC35ACBFF8DB94"><enum>(a)</enum><header>Gift shop
account</header>
<paragraph id="HBC3798A71BF943D4923120077F56187F"><enum>(1)</enum><header>In
general</header><text>All monies in the Gift Shop Account shall be available
without fiscal year limitation for obligation by the Chief Executive Officer in
connection with the operation of the gift shops under section 201(a), including
supplies, inventories, equipment, and other expenses. In addition, such monies
may be used by the Chief Executive Officer to reimburse any applicable
appropriations account for amounts used from such appropriations account to pay
the salaries of employees of the gift shops.</text>
</paragraph><paragraph id="HA90711170A0D4339917BFD3DC19D939B"><enum>(2)</enum><header>Obligation of
funds remaining after use of funds for gift shop</header><text>To the extent
monies in the Gift Shop Account are available after disbursements and
reimbursements are made under subparagraph (A), the Chief Executive Officer may
obligate such monies for the operation of the Capitol Visitor Center, after
consultation with—</text>
<subparagraph id="HAA4A5627E31F4BA0B13FE9C8C3FB4EEE"><enum>(A)</enum><text>the supervising
Committees; and</text>
</subparagraph><subparagraph id="H7FEB21ADFCC64970B34E535BB1443EA8"><enum>(B)</enum><text>the Committees on
Appropriations of the House of Representatives and Senate.</text>
</subparagraph></paragraph></subsection><subsection id="HEA394DF442CA495785F2E33385BB926D"><enum>(b)</enum><header>Miscellaneous
receipts account</header><text>All monies in the Miscellaneous Receipts Account
shall be available without fiscal year limitation for obligation by the Chief
Executive Officer for the operations of the Capitol Visitor Center, after
consultation with—</text>
<paragraph id="HA9F833CE634B4EBB8546F82816FD53D6"><enum>(1)</enum><text>the supervising
Committees; and</text>
</paragraph><paragraph id="HBEB1646C52DF444C8935BCBA4408A1BE"><enum>(2)</enum><text>the Committees on
Appropriations of the House of Representatives and Senate.</text>
</paragraph></subsection></section><section id="HA848F0A6F47046E996EA4302077B3605"><enum>214.</enum><header>Administration
of Fund</header>
<subsection id="H3DE913309B764B519F76E6E207A0057"><enum>(a)</enum><header>Obligations</header><text>Obligations
from the Fund may be made by the Chief Executive Officer.</text>
</subsection><subsection id="H3556EA085B4746E5B523D5A9DC303A5"><enum>(b)</enum><header>Investment
Authority</header><text>The Secretary of the Treasury shall invest any portion
of the Fund that, as determined by the Chief Executive Officer, is not required
to meet current expenses. Each investment shall be made in an interest-bearing
obligation of the United States or an obligation guaranteed both as to
principal and interest by the United States that, as determined by the Chief
Executive Officer, has a maturity date suitable for the purposes of the Fund.
The Secretary of the Treasury shall credit interest earned on the obligations
to the Fund.</text>
</subsection><subsection id="H3D35778B647D41139536B636B709156B"><enum>(c)</enum><header>Audit</header><text>The
Fund shall be subject to audit by the Comptroller General at the discretion of
the Comptroller General.</text>
</subsection></section></subtitle><enum>III</enum><header>Treatment of
Capitol Guide Service</header>
<subtitle id="H8027D99BF2F047D9ABA4E73F04B8C1AA"><enum>A</enum><header>Transfer to Office
of the Capitol Visitor Center</header>
<section id="H27F426EC6DEC418F8D7DD7E6226C148"><enum>301.</enum><header>Transfer of
Capitol Guide Service</header>
<subsection id="HAF363208EF6648DE908CA191F04002D"><enum>(a)</enum><header>Transfer of
Authorities and Personnel to Office of the Capitol Visitor
Center</header><text>Except as provided in subsection (c), effective on the
transfer date—</text>
<paragraph id="HDDF816E5056E419D95273C96CA00EFAC"><enum>(1)</enum><text>the contracts,
liabilities, records, property, and other assets and interests of the Capitol
Guide Service, established pursuant to section 441 of the Legislative
Reorganization Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/2/2166">2 U.S.C. 2166</external-xref>), and the employees of the Capitol
Guide Service, are transferred to the Office, except that the transfer of any
amounts appropriated to the Capitol Guide Service that remain available as of
the transfer date shall occur only upon the approval of the Committees on
Appropriations of the House of Representatives and Senate; and</text>
</paragraph><paragraph id="H8C0DAB63B99F4D6D9F330000E29E3C00"><enum>(2)</enum><text>the Capitol Guide
Service shall be subject to the direction, supervision, and control of the
Chief Executive Officer in accordance with this subtitle.</text>
</paragraph></subsection><subsection id="H151EAB5D3CC6442F94E9FBE89AA426E"><enum>(b)</enum><header>Treatment of
Employees of Capitol Guide Service at Time of Transfer</header>
<paragraph id="HD92DC8294599428DB6581CC017082BED"><enum>(1)</enum><header>In
general</header><text>Any individual who is an employee of the Capitol Guide
Service on a permanent basis on the transfer date who is transferred to the
Office under subsection (a) shall be subject to authority of the Chief
Executive Officer under section 302(b), except that the individual shall not be
reduced in grade, compensation, rate of leave, or other benefits that apply
with respect to the individual at the time of transfer while such individual
remains continuously so employed as a Capitol Guide within the Office, other
than for cause.</text>
</paragraph><paragraph display-inline="no-display-inline" id="HB1A1E4D06833485785772B1CE332D4B9"><enum>(2)</enum><header>Eligibility for
immediate retirement on basis of involuntary separation</header><text>For
purposes of section 8336(d) and <external-xref legal-doc="usc" parsable-cite="usc/5/8414">section 8414(b)</external-xref> of title 5, United States Code,
an individual described in paragraph (1) who is separated from service with the
Office shall be considered to have separated from the service involuntarily if,
at the time the individual is separated from service—</text>
<subparagraph id="H76200232D7F8485EB8AE65625CAF6350"><enum>(A)</enum><text>the individual has
completed 25 years of service under such title; or</text>
</subparagraph><subparagraph id="H159B5F1ED6674A16AC09E799F9B6537D"><enum>(B)</enum><text>the individual has
completed 20 years of service under such title and is 50 years of age or
older.</text>
</subparagraph></paragraph><paragraph id="H27D702BC0FA54678B1B7ECB0274B1663"><enum>(3)</enum><header>Continuation of
participation in student loan repayment program</header><text>Notwithstanding
any other provision of law, if an individual described in paragraph (1) has a
written service agreement in effect under section 102 of the Legislative Branch
Appropriations Act, 2002 (<external-xref legal-doc="usc" parsable-cite="usc/2/60c-5">2 U.S.C. 60c–5</external-xref>) at the time the individual is
transferred to the Office, the agreement shall remain in effect in accordance
with the terms and conditions applicable to the agreement at the time the
individual is transferred (including the provisions of such section permitting
the individual to enter into additional service agreements for successive
1-year periods of employment), except that in applying such section to the
individual, the following shall apply:</text>
<subparagraph id="H9DE00371D5C8432F937129C800429EC2"><enum>(A)</enum><text>The Office shall
serve as the employing office, and the Chief Executive Officer shall serve as
the head of the employing office.</text>
</subparagraph><subparagraph id="HA4F78FC4DA3D43110081A44AA653673"><enum>(B)</enum><text>The Architect of
the Capitol shall carry out the responsibilities of the Secretary of the
Senate.</text>
</subparagraph><subparagraph id="H23FB5E3671BB4B6CA36041B87530CC22"><enum>(C)</enum><text>Any reference to
the Committee on Rules and Administration of the Senate and the Committee on
Appropriations of the Senate shall be treated as a reference to the supervising
Committees.</text>
</subparagraph><subparagraph id="HA403BAC13C7F43EEB1BAEDF756DD60ED"><enum>(D)</enum><text>If the individual
is required to make any reimbursement under such section with respect to
payments made after the individual is transferred, the individual shall
reimburse the Office of the Architect of the Capitol.</text>
</subparagraph></paragraph><paragraph id="H4ECE2F37D59F4BE5938F78BE3E0680D7"><enum>(4)</enum><header>Prohibiting
imposition of probationary period</header><text display-inline="yes-display-inline">The Chief Executive Officer may not impose
a period of probation with respect to the transfer of any individual who is
transferred to the Office under subsection (a).</text>
</paragraph></subsection><subsection id="H4C0B555DDE4641BCBB57DEAB3D66B01"><enum>(c)</enum><header>Exception for
Congressional Special Services Office</header><text display-inline="yes-display-inline">This section does not apply with respect to
any employees, contracts, liabilities, records, property, and other assets and
interests of the Congressional Special Services Office of the Capitol Guide
Service that are transferred to the Office of Congressional Accessibility
Services under subtitle B.</text>
</subsection></section><section id="H43C9EA5E58E84D000083B1CAE7E8C9FD"><enum>302.</enum><header>Duties of
Employees of Capitol Guide Service</header>
<subsection id="HAFEC145F856C498982322C2BB165001E"><enum>(a)</enum><header>Provision of
Guided Tours</header>
<paragraph id="HEDF6E061027B422F96DFEBD1E32B34ED"><enum>(1)</enum><header>Tours</header><text>In
accordance with this section, the Capitol Guide Service shall provide guided
tours of the interior of the United States Capitol without charge, including
the Capitol Visitor Center, for the education and enlightenment of the general
public.</text>
</paragraph><paragraph id="H66E3DB4670DB4965979900AC4DB2D1D6"><enum>(2)</enum><header>Acceptance of
fees prohibited</header><text display-inline="yes-display-inline">An employee
of the Capitol Guide Service shall not charge or accept any fee, or accept any
gratuity, for or on account of his official services.</text>
</paragraph><paragraph id="HF92FC72E02E143FF84DA00A595CCF61B"><enum>(3)</enum><header>Regulations of
Chief Executive Officer</header><text>All such tours shall be conducted in
compliance with regulations approved by the Chief Executive Officer.</text>
</paragraph></subsection><subsection id="H1BED233DBF924C9FBD43DDD7AE98A26F"><enum>(b)</enum><header>Authority of
Chief Executive Officer</header><text>In providing for the direction,
supervision, and control of the Capitol Guide Service, the Chief Executive
Officer is authorized—</text>
<paragraph id="HE972171A017F420993F026941CFF74A"><enum>(1)</enum><text>subject to the
availability of appropriations, to establish and revise such number of
positions of Guide in the Capitol Guide Service as the Chief Executive Officer
considers necessary to carry out effectively the activities of the Capitol
Guide Service;</text>
</paragraph><paragraph id="H2A291D7688C548A08FBDC49E43E8D4C3"><enum>(2)</enum><text display-inline="yes-display-inline">to appoint, on a permanent basis without
regard to political affiliation and solely on the basis of fitness to perform
their duties, a Chief Guide and such deputies as the Chief Executive Officer
considers appropriate for the effective administration of the Capitol Guide
Service and, in addition, such number of Guides as may be authorized;</text>
</paragraph><paragraph id="HD059F7336E2B41C8BD8010592E5BBA24"><enum>(3)</enum><text display-inline="yes-display-inline">with the approval of the supervising
Committees, with respect to the individuals appointed pursuant to paragraph
(2)—</text>
<subparagraph id="H01DF5E80392F460CBB78C2C1774904CB"><enum>(A)</enum><text>to prescribe the
individual’s duties and responsibilities,</text>
</subparagraph><subparagraph id="H5E121354E5954282A2B35BD6E37EB83"><enum>(B)</enum><text>to fix, and adjust
from time to time, respective rates of pay at single per annum (gross) rates,
and</text>
</subparagraph><subparagraph id="H05F5B6FF97E149BCB79B37EEB91753AC"><enum>(C)</enum><text>to take
appropriate disciplinary action, including, when circumstances warrant,
suspension from duty without pay, reduction in pay, demotion, or termination of
employment with the Capitol Guide Service, against any employee who violates
any provision of this section or any regulation prescribed by the Chief
Executive Officer pursuant to paragraph (7);</text>
</subparagraph></paragraph><paragraph id="H3CE5F162C9444D78A00039263B7D2E32"><enum>(4)</enum><text>to prescribe a
uniform dress, including appropriate insignia, which shall be worn by personnel
of the Capitol Guide Service;</text>
</paragraph><paragraph id="H75A052C5F12B4290B68F8429793666FE"><enum>(5)</enum><text>from time to time
and as may be necessary, to procure and furnish such uniforms to such personnel
without charge to such personnel;</text>
</paragraph><paragraph id="HBAAED1F397D2496D8F76C3DA46FBB169"><enum>(6)</enum><text>to receive and
consider advice and information from any private historical or educational
organization, association, or society with respect to those operations of the
Capitol Guide Service which involve the furnishing of historical and
educational information to the general public; and</text>
</paragraph><paragraph id="HF01F0E36B74E477BAF67077024BBF827"><enum>(7)</enum><text>with the approval
of the supervising Committees, to prescribe such regulations as the Chief
Executive Officer considers necessary and appropriate for the operation of the
Capitol Guide Service, including regulations with respect to tour routes and
hours of operation, number of visitors per guide, staff-led tours, and non-law
enforcement security and special event related support.</text>
</paragraph></subsection><subsection id="H9DF41360C84E4EEEA637D8BCE3BA009B"><enum>(c)</enum><header>Provision of
Accessible Tours in Coordination With Office of Congressional Accessibility
Services</header><text>The Chief Executive Officer shall coordinate the
provision of accessible tours for individuals with disabilities with the Office
of Congressional Accessibility Services established under subtitle B.</text>
</subsection></section></subtitle><subtitle id="H06EBD2F4492C4B8DAA01BCCE2888955D"><enum>B</enum><header>Office of
Congressional Accessibility Services</header>
<section id="HF146C65B58F9484C008BAF747594137C"><enum>311.</enum><header>Establishment
of Office of Congressional Accessibility Services</header>
<subsection id="HD9357215EF014A7D99CFC60506D5A678"><enum>(a)</enum><header>Establishment</header><text>There
is established in the legislative branch the Office of Congressional
Accessibility Services, to be headed by the Director of Accessibility
Services.</text>
</subsection><subsection id="HB8B8A343F7EF421E909F1DB9B6035F12"><enum>(b)</enum><header>Supervision and
Control</header><text>The Office of Congressional Accessibility Services shall
be subject to the direction, supervision, and control of the Capitol Police
Board.</text>
</subsection><subsection id="H742C8684F01E47ACB8E23EB96CBF948F"><enum>(c)</enum><header>Mission and
Functions</header>
<paragraph id="H9C823B9A7BF44C3BA3F4492DFB888D5D"><enum>(1)</enum><header>In
general</header><text display-inline="yes-display-inline">The Office of
Congressional Accessibility Services shall—</text>
<subparagraph id="HBA7E5277363942D19464094958474FC1"><enum>(A)</enum><text display-inline="yes-display-inline">in consultation with the Office of House
Employment Counsel and the Senate Chief Counsel for Employment, provide and
coordinate accessibility services for individuals with disabilities, including
Members of Congress, employees of the House of Representatives and the Senate,
and visitors, in the United States Capitol Complex; and</text>
</subparagraph><subparagraph id="H24785860A9C34C3CB24BF58BE645026F"><enum>(B)</enum><text>provide
information regarding accessibility for individuals with disabilities, as well
as related training and staff development, to Members of Congress and employees
of the House of Representatives and Senate.</text>
</subparagraph></paragraph><paragraph id="H806480A14BE34CE0B225C78E33F9A302"><enum>(2)</enum><header>Specific
functions</header><text>The Director of Accessibility Services shall submit to
the supervising Committees a list of the specific functions that the Office of
Congressional Accessibility Services will perform in carrying out this subtitle
with the approval of the supervising committees. The Director of Accessibility
Services shall submit the list not later than 30 days after the transfer
date.</text>
</paragraph><paragraph id="HA08DCD342CFD4E6590A8EF3036003BFB"><enum>(3)</enum><header>No effect on
authority of employment counsels</header><text>Nothing in this subtitle shall
be construed to limit any authority or function of the Office of House
Employment Counsel or the Senate Chief Counsel for Employment that such Office
or Counsel carries out prior to the transfer date.</text>
</paragraph><paragraph id="HFBD63571F3C84F1886D6C914941BD912"><enum>(4)</enum><header>United States
Capitol Complex defined</header><text>In this subsection, the term <term>United
States Capitol Complex</term> means the Capitol buildings (as defined in
<external-xref legal-doc="usc" parsable-cite="usc/40/5101">section 5101</external-xref> of title 40, United States Code) and the United States Capitol
Grounds (as described in section 5102 of such title).</text>
</paragraph></subsection><subsection id="HB09816B573FC41398BC82B1EFFE41300"><enum>(d)</enum><header>Conforming
Amendment</header><text>Section 310 of the Legislative Branch Appropriations
Act, 1990 (<external-xref legal-doc="usc" parsable-cite="usc/2/130e">2 U.S.C. 130e</external-xref>) is repealed.</text>
</subsection></section><section id="HC1037464FA334EFA97D3A5E0DE52FFB4"><enum>312.</enum><header>Director of
Accessibility Services</header>
<subsection display-inline="no-display-inline" id="HAB2B53EBDAA643B3A40098B00804B821"><enum>(a)</enum><header>Appointment and
Removal; Compensation</header>
<paragraph id="H4CCDD5CEE92A45E797177D73AE00B5A8"><enum>(1)</enum><header>Appointment</header><text>The
Director of Accessibility Services shall be appointed by the Capitol Police
Board.</text>
</paragraph><paragraph id="H28D791F1F5124BC88387AA991F899D5"><enum>(2)</enum><header>Removal</header><text>The
Director of Accessibility Services may be removed by the Capitol Police Board,
upon notification to the supervising Committees.</text>
</paragraph><paragraph id="HDBEB66C040FC4AB9A2D522134507DC64"><enum>(3)</enum><header>Compensation</header><text display-inline="yes-display-inline">The Director of Accessibility Services
shall be paid at an annual rate of pay determined by the Capitol Police Board,
except that such rate may not exceed the maximum rate payable for level 15 of
the General Schedule.</text>
</paragraph><paragraph id="HD5D126A070554CCBBA94869EF844EC03"><enum>(4)</enum><header>Transition for
current head of Congressional Special Services Office of Capitol Guide
Service</header><text>The individual serving as the head of the Congressional
Special Services Office of the Capitol Guide Service as of the transfer date
shall be appointed by the Capitol Police Board as the first Director of
Accessibility Services under this subtitle.</text>
</paragraph></subsection><subsection id="HF21D5755B43B4A6E89C9A6DA45A9ACBE"><enum>(b)</enum><header>Personnel and
Other Administrative Functions</header>
<paragraph id="HF55796F70D2E413DA8E4EE622C91B570"><enum>(1)</enum><header>Personnel,
disbursements, and contracts</header><text>In carrying out the functions of the
Office of Congressional Accessibility Services under section 311, the Director
of Accessibility Services shall have the authority—</text>
<subparagraph id="H8DA9CA78ABED40D286D45F6F1396974"><enum>(A)</enum><text>to appoint, hire,
and fix the compensation of such personnel as may be necessary for operations
of the Office of Congressional Accessibility Services, except that no employee
may be paid at an annual rate in excess of the annual rate of pay for the
Director of Accessibility Services;</text>
</subparagraph><subparagraph id="H7B54A8939C5C47BD8D064B33294FFF3D"><enum>(B)</enum><text>to disburse funds
as may be necessary and available for the needs of the Office of Congressional
Accessibility Services; and</text>
</subparagraph><subparagraph id="HCF4732ADFA73402E86838EBB800A905"><enum>(C)</enum><text>to serve as
contracting officer for the Office of Congressional Accessibility
Services.</text>
</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="HFECE567717FA4A15AACD7EEBBE3CD94C"><enum>(2)</enum><header>Agreements with
the office of the architect of the capitol, with other legislative branch
agencies, and with offices of the senate and house of
representatives</header><text>Subject to the approval of the supervising
Committees, the Director of Accessibility Services may place orders and enter
into agreements with the Office of the Architect of the Capitol, with other
legislative branch agencies, and with any office or other entity of the Senate
or House of Representatives for procuring goods and providing financial and
administrative services on behalf of the Office of Accessibility Services, or
to otherwise assist the Director in the administration and management of the
Office of Accessibility Services.</text>
</paragraph></subsection><subsection display-inline="no-display-inline" id="HFC85815BACDC4441AD641600A0C5E653"><enum>(c)</enum><header>Semiannual
Reports</header><text>The Director of Accessibility Services shall submit a
report to the supervising Committees not later than 45 days following the close
of each semiannual period ending on June 30 or December 31 of each year on the
financial and operational status during the period of each function under the
jurisdiction of the Director. Each such report shall include financial
statements and a description or explanation of current operations, the
implementation of new policies and procedures, and future plans for each
function.</text>
</subsection></section><section id="H4356CBF6383041A8851D108D25FC13C0"><enum>313.</enum><header>Transfer From
Capitol Guide Service</header>
<subsection id="H8B010CB6F5904EA2A400B923DA69FD3F"><enum>(a)</enum><header>Transfer of
Authorities and Personnel of Congressional Special Services Office of Capitol
Guide Service</header><text display-inline="yes-display-inline">In accordance
with the provisions of this subtitle, effective on the transfer date—</text>
<paragraph id="HC322B2BC34CA487595D2F92131C76FAF"><enum>(1)</enum><text display-inline="yes-display-inline">the contracts, liabilities, records,
property, and other assets and interests of the Congressional Special Services
Office of the Capitol Guide Service, and the employees of such Office, are
transferred to the Office of Congressional Accessibility Services established
under section 311(a), except that the transfer of any amounts appropriated to
the Congressional Special Services Office that remain available as of the
transfer date shall occur only upon the approval of the Committees on
Appropriations of the House of Representatives and Senate; and</text>
</paragraph><paragraph id="HE6A1E50BF92F49138631F107023E9978"><enum>(2)</enum><text>the employees of
such Office shall be subject to the direction, supervision, and control of the
Director of Accessibility Services.</text>
</paragraph></subsection><subsection display-inline="no-display-inline" id="HF83F3CCF6E8C4B5D9D4C1094006BDC8E"><enum>(b)</enum><header>Treatment of
Employees at Time of Transfer</header>
<paragraph id="H14268ACD15FF441D924BA6D696B36402"><enum>(1)</enum><header>In
general</header><text>Any individual who is an employee of the Congressional
Special Services Office of the Capitol Guide Service on a permanent basis on
the transfer date who is transferred under subsection (a) shall be subject to
authority of the Director of Accessibility Services under section 312, except
that the individual shall not be reduced in grade, compensation, rate of leave,
or other benefits that apply with respect to the individual at the time of
transfer while such individual remains continuously so employed within the
Office of Congressional Accessibility Services established under section
311(a), other than for cause.</text>
</paragraph><paragraph id="HF92FD61ABBE74B589BAB00D1DD00F30"><enum>(2)</enum><header>Eligibility for
immediate retirement on basis of involuntary separation</header><text>For
purposes of section 8336(d) and <external-xref legal-doc="usc" parsable-cite="usc/5/8414">section 8414(b)</external-xref> of title 5, United States Code,
an individual described in paragraph (1) who is separated from service with the
Office of Congressional Accessibility Services shall be considered to have
separated from the service involuntarily if, at the time the individual is
separated from service—</text>
<subparagraph id="H64D57F54981D4BF5AF84C457E22D1089"><enum>(A)</enum><text>the individual has
completed 25 years of service under such title; or</text>
</subparagraph><subparagraph id="H8F42A445B1974697A850BDA5438F883F"><enum>(B)</enum><text>the individual has
completed 20 years of service under such title and is 50 years of age or
older.</text>
</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H736EE347B1044F8A8BDF1049D53491BF"><enum>(3)</enum><header>Prohibiting
imposition of probationary period</header><text display-inline="yes-display-inline">The Director of Accessibility Services may
not impose a period of probation with respect to the transfer of any individual
who is transferred to the Office of Congressional Accessibility Services under
subsection (a).</text>
</paragraph></subsection></section></subtitle><subtitle id="H7B50050B472B471693009326E1B73314"><enum>C</enum><header>Technical and
Conforming Amendments</header>
<section id="H58986AA62FA7431C83665DA19E5DE8E2"><enum>321.</enum><header>Technical and
Conforming Amendments</header>
<subsection id="HDC0305A77B244F8681ACA96F24EBC023"><enum>(a)</enum><header>Existing
Authority of Capitol Guide Service</header><text>Section 441 of the Legislative
Reorganization Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/2/2166">2 U.S.C. 2166</external-xref>) is repealed.</text>
</subsection><subsection id="H5463A8B3C63A496983DB62E2624CC67"><enum>(b)</enum><header>Coverage Under
Congressional Accountability Act of 1995</header>
<paragraph id="H25CD238E27C54507B44B274DFCBED967"><enum>(1)</enum><header>Treatment of
employees as covered employees</header><text>Section 101(3)(C) of the
Congressional Accountability of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1301">2 U.S.C. 1301(3)(C)</external-xref>) is amended to read
as follows:</text>

protections relating to public services and
accommodations</header><text>Section 210(a)(4) of such Act (2 U.S.C.
1331(a)(4)) is amended to read as follows:</text>

Accessibility Services,</quote>.</text>
</paragraph></subsection><subsection id="H2A3C4CD3BDD64587804B697074D60079"><enum>(c)</enum><header>Treatment as
Congressional Employees for Retirement Purposes</header><text>Section 2107(9)
of title 5, United States Code, is amended to read as follows:</text>

Date</header><text>The amendments made by this section shall take effect on the
transfer date.</text>
</subsection></section></subtitle><subtitle id="H97334671AB0E4983BB74D7489D0005A8"><enum>D</enum><header>Transfer
Date</header>
<section id="H445083A3EE9E4167B6A1CB1C5D877099"><enum>331.</enum><header>Transfer
Date</header><text display-inline="no-display-inline">In this title, the
<quote>transfer date</quote> means the date on which the Chief Executive
Officer, in consultation with the Architect of the Capitol, certifies that a
certificate of occupancy for the Capitol Visitor Center has been issued by the
appropriate authorities.</text>
</section></subtitle><enum>IV</enum><header>General
Provisions</header>
<section id="HCDBA1DD6C3934E089FD6D4E142003E77"><enum>401.</enum><header>Authorization
of Appropriations</header><text display-inline="no-display-inline">There are
authorized to be appropriated such sums as are necessary to carry out this
Act.</text>
