<enum>I</enum><header>Capitol Visitor Center</header>
<section id="HFCAB458F63524C528B1F4CFD135577D"><enum>101.</enum><header>Designation of facility as Capitol Visitor Center; purposes of facility; treatment of the Capitol Visitor Center</header>
<subsection id="H2E5F28EB80D6405400F9766085C1ECAA"><enum>(a)</enum><header>Designation</header><text>The facility authorized for construction under the heading <quote><header-in-text level="paragraph" style="traditional">Capitol Visitor Center</header-in-text></quote> under chapter 5 of title II of division B of the <act-name parsable-cite="OCESAA">Omnibus Consolidated and Emergency Supplemental Appropriations Act</act-name>, 1999 (<external-xref legal-doc="public-law" parsable-cite="pl/105/277">Public Law 105–277</external-xref>; 112 Stat. 2681–569) is designated as the Capitol Visitor Center and is a part of the Capitol.</text></subsection>
<subsection id="HC1CEFFB3791A4C45BAD4321F6F0078D2"><enum>(b)</enum><header>Purposes of the facility</header><text>The Capitol Visitor Center shall be used—</text>
<paragraph id="HAEC6F65FB7754F45B2418B32C9886B19"><enum>(1)</enum><text>to provide enhanced security for persons working in or visiting the United States Capitol;</text></paragraph>
<paragraph id="H78A8E3FD1A4F4E38B5F02900BB537BCF"><enum>(2)</enum><text>to improve the visitor experience by providing a structure that will afford improved visitor orientation and enhance the educational experience of those who have come to learn about the Congress and the Capitol; and</text></paragraph>
<paragraph id="H091F6BFC2F304681BEDE85DB897D66F"><enum>(3)</enum><text>for other purposes as determined by Congress or the Committee on Rules and Administration of the Senate and the Committee on House Administration of the House of Representatives.</text></paragraph></subsection>
<subsection id="H37E3BF9BF62C41F5B4B338730D548D4"><enum>(c)</enum><header>Treatment of the Capitol Visitor Center</header>
<paragraph id="H26E11C44ECDF4DFE8514F72F245E0039"><enum>(1)</enum><header>Oversight</header><text>The Committee on Rules and Administration of the Senate and the Committee on House Administration of the House of Representatives shall have oversight of the Capitol Visitor Center.</text></paragraph>
<paragraph id="H24823873D0004CB795905143C784DFEC"><enum>(2)</enum><header>Treatment of expansion space of the Senate and House of Representatives in the Capitol Visitor Center</header>
<subparagraph id="HBBA17B4EBAD44F269E29939CD0A3714F"><enum>(A)</enum><header>Senate</header><text>The expansion space of the Senate described as unassigned space under the heading <quote><header-in-text level="subsection" style="OLC">Capitol Visitor Center</header-in-text></quote> under the heading <quote><header-in-text level="subsection" style="OLC">ARCHITECT OF THE CAPITOL</header-in-text></quote> under title II of the Act entitled <quote>An Act making appropriations for the Legislative Branch for the fiscal year ending September 30, 2002, and for other purposes</quote>, approved November 12, 2001 (<external-xref legal-doc="public-law" parsable-cite="pl/107/68">Public Law 107–68</external-xref>; 115 Stat. 588) shall be part of the Senate wing of the Capitol.</text></subparagraph>
<subparagraph id="H5B67A17DA5E64EC9854292285234DB54"><enum>(B)</enum><header>House of Representatives</header><text>The expansion space of the House of Representatives described as unassigned space under the heading <quote><header-in-text level="subsection" style="OLC">Capitol Visitor Center</header-in-text></quote> under the heading <quote><header-in-text level="subsection" style="OLC">ARCHITECT OF THE CAPITOL</header-in-text></quote> under title II of the Act entitled <quote>An Act making appropriations for the Legislative Branch for the fiscal year ending September 30, 2002, and for other purposes</quote>, approved November 12, 2001 (<external-xref legal-doc="public-law" parsable-cite="pl/107/68">Public Law 107–68</external-xref>; 115 Stat. 588) shall be part of the House of Representatives wing of the Capitol.</text></subparagraph></paragraph></subsection>
<subsection id="H4DBBE29F705449A182FDAC76424494AC"><enum>(d)</enum><header>Treatment of Congressional Auditorium and Related Adjacent Areas</header>
<paragraph id="HF462D8AB7912433499B440531918F1B6"><enum>(1)</enum><header>In general</header><text>The Committee on Rules and Administration of the Senate and the Committee on House Administration of the House of Representatives shall jointly prescribe regulations for the assignment of the space in the Capitol Visitor Center known as the Congressional Auditorium and the related adjacent areas.</text></paragraph>
<paragraph id="HD2710C6778634C3987759B2446021D86"><enum>(2)</enum><header>Related Adjacent Areas</header><text>The regulations under paragraph (1) shall include a designation of the areas that are related adjacent areas to the Congressional Auditorium.</text></paragraph></subsection>
<subsection id="H6034E238337F4890881BAC92BE5EEFE6"><enum>(e)</enum><header>Visitor Center space in the Capitol</header><text>Section 301 of the National Visitor Center Facilities Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/2/2165">2 U.S.C. 2165</external-xref>) is repealed.</text></subsection>
<subsection id="H87CEAF050BCB4C94BCBFDCAC6F890109"><enum>(f)</enum><header>Exhibits for displays</header>
<paragraph id="HB3424626604640AC9C41CC955D7166B"><enum>(1)</enum><header>In general</header>
<subparagraph id="H96414034481349C8BC4FE6BB2A24EA5"><enum>(A)</enum><header>Loan agreements</header><text>Subject to subparagraph (B), the Architect of the Capitol may enter into loan agreements to place historical objects for display in the Exhibition Hall of the Capitol Visitor Center.</text></subparagraph>
<subparagraph id="H166B3750D3DC44F2A9889449EC63A84F"><enum>(B)</enum><header>Consultation and approval</header><text>The Architect of the Capitol may exercise the authority under subparagraph (A) with respect to each loan agreement—</text>
<clause id="H49DC36206AC94C88BBF8FFFBDFE7180"><enum>(i)</enum><text>after consultation with—</text>
<subclause id="H86425C8000104FDFAC390054D0CDAAEA"><enum>(I)</enum><text>the Senate Commission on Art; and</text></subclause>
<subclause commented="no" display-inline="no-display-inline" id="H8A6CF8535AA44273A9491CCABA9498E5"><enum>(II)</enum><text>the House of Representatives Fine Arts Board; and</text></subclause></clause>
<clause id="H611F0C96A8D44EAEB49197EFAC35E455"><enum>(ii)</enum><text>subject to the approval of—</text>
<subclause id="H94D16D52D97D4E6EB4428CFB9E76AF29"><enum>(I)</enum><text>the Committee on Rules and Administration of the Senate; and</text></subclause>
<subclause commented="no" display-inline="no-display-inline" id="H36795D938CE54E78886B0000097677F5"><enum>(II)</enum><text>the Committee on House Administration of the House of Representatives.</text></subclause></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H3BCCE6132062444CBE73F3B1A795003D"><enum>(C)</enum><header>Effective date</header><text>This paragraph shall take effect on December 3, 2008.</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H5F90908642B246E5BB04BDB89C57CC48"><enum>(2)</enum><header>Exhibition prohibition</header><text>Section 1815 of the Revised Statutes (<external-xref legal-doc="usc" parsable-cite="usc/2/2134">2 U.S.C. 2134</external-xref>) is amended by inserting <quote>Emancipation Hall of the Capitol Visitor Center,</quote> after <quote>Rotunda,</quote>.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H4B5A46B76A384197ABEB03B13679FB90"><enum>(3)</enum><header display-inline="yes-display-inline">Exceptions to exhibition prohibition</header><text display-inline="yes-display-inline">Section 1815 of the Revised Statutes (<external-xref legal-doc="usc" parsable-cite="usc/2/2134">2 U.S.C. 2134</external-xref>) shall not apply to any historical object placed within an exhibit in the Exhibition Hall of the Capitol Visitor Center that—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H866B550F2962489B80CA1CFB1D9B4B4"><enum>(A)</enum>
<clause commented="no" display-inline="yes-display-inline" id="H0B18B10498164340B71443929BF20091"><enum>(i)</enum><text>is directly related to the purpose of the Capitol Visitor Center under subsection (b)(2);</text></clause>
<clause id="H031099DA4E294FDF984DE11BFFA971BE" indent="up1"><enum>(ii)</enum><text>is the subject of a loan agreement entered into by the Architect of the Capitol before December 2, 2008; and</text></clause>
<clause id="HC10656AEB88D45EAA7AF232891229101" indent="up1"><enum>(iii)</enum><text>has been approved by the Capitol Preservation Commission; or</text></clause></subparagraph>
<subparagraph id="H12824D5E6C694424822058F40038C961"><enum>(B)</enum><text>is the subject of a loan agreement described under paragraph (1)(A).</text></subparagraph></paragraph>
<paragraph id="H279EA22735224828A086FB8616561FD1"><enum>(4)</enum><header>Substitution of historical object</header><text>A loan agreement described under paragraph (3)(A)(ii) may provide for the removal of an historical object from exhibition for preservation purposes and the substitution of that object with another historical object having a comparable educational purpose.</text></paragraph></subsection></section>
<section id="H6FDE4AE1541E4D6A99CB02C6C31B88D9"><enum>102.</enum><header>Designation and naming within the Capitol Visitor Center</header>
<subsection id="H61A1113626C84EEE83EB2993E091082F"><enum>(a)</enum><header>In general</header><text>Except as provided under subsection (b), no part of the Capitol Visitor Center may be designated or named without the approval of—</text>
<paragraph id="HF8732AB0E1734DC9A1CE3BDC23FC4C2C"><enum>(1)</enum><text>not less than <fraction>3/4</fraction> of all members on the Capitol Preservation Commission who are members of the Democratic party; and</text></paragraph>
<paragraph id="H39AA80C095684476B8E0D77E608B45E3"><enum>(2)</enum><text>not less than <fraction>3/4</fraction> of all members on the Capitol Preservation Commission who are members of the Republican party.</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HD8463CAA583748A5A934F03D30207DC3"><enum>(b)</enum><header>Exception</header><text>Subsection (a) shall not apply to any room or space under the jurisdiction of the Senate or the House of Representatives.</text></subsection></section>
<section commented="no" id="H835E5EE74ECE4196B9A88900D44E52DE"><enum>103.</enum><header>Use of the Emancipation Hall of the Capitol Visitor Center</header><text display-inline="no-display-inline">The Emancipation Hall of the Capitol Visitor Center may not be used for any event, except upon the passage of a resolution agreed to by both houses of Congress authorizing the use of the Emancipation Hall for that event.</text></section>
<enum>II</enum><header>Office of the Capitol Visitor Center</header>
<section id="HD84B73BB98774923ADF223A39B70FCED"><enum>201.</enum><header>Establishment</header><text display-inline="no-display-inline">There is established within the Office of the Architect of the Capitol the Office of the Capitol Visitor Center (in this Act referred to as the <quote>Office</quote>), to be headed by the Chief Executive Officer for Visitor Services (in this Act referred to as the <quote>Chief Executive Officer</quote>).</text></section>
<section id="HC6159BB755BE432C8C02F583B5BA15B"><enum>202.</enum><header>Appointment and Supervision of Chief Executive Officer for Visitor Services</header>
<subsection id="HCFEBDCD2D18D4F4989BEBBCEEFFFD1E0"><enum>(a)</enum><header>Appointment</header><text>The Chief Executive Officer shall be appointed by the Architect of the Capitol.</text></subsection>
<subsection id="HAA2674A519AA4D7E0078EBFBDBA08489"><enum>(b)</enum><header>Supervision and Oversight</header><text>The Chief Executive Officer shall report directly to the Architect of the Capitol and shall be subject to oversight by the Committee on Rules and Administration of the Senate and the Committee on House Administration of the House of Representatives.</text></subsection>
<subsection id="H31349D3920754CE3A0B418ABCDAB075F"><enum>(c)</enum><header>Removal</header><text>Upon removal of the Chief Executive Officer, the Architect of the Capitol shall immediately provide notice of the removal to the Committee on Rules and Administration of the Senate, the Committee on House Administration of the House of Representatives, and the Committees on Appropriations of the House of Representatives and Senate. The notice shall include the reasons for the removal.</text></subsection>
<subsection id="H6B1018F7F6164360ABD6008CBAB860DC"><enum>(d)</enum><header>Compensation</header><text>The Chief Executive Officer shall be paid at an annual rate of pay equal to the annual rate of pay of the Deputy Architect of the Capitol.</text></subsection>
<subsection id="HFAAD5D3DB27043F2A182283D7349E058"><enum>(e)</enum><header>Transition for Current Chief Executive Officer for Visitor Services</header>
<paragraph id="HE9A7E9AB4D7D421894BA7D35B3695E17"><enum>(1)</enum><header>Appointment</header><text display-inline="yes-display-inline">The individual who serves as the Chief Executive Officer for Visitor Services under section 6701 of the U.S. Troop Readiness, Veterans’ Care, Katrina Recovery, and Iraq Accountability Appropriation Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/2/1806">2 U.S.C. 1806</external-xref>) as of the date of the enactment of this Act shall be the first Chief Executive Officer for Visitor Services appointed by the Architect under this section.</text></paragraph>
<paragraph id="HD6ADFA7096944F5A858D7D8315C98465"><enum>(2)</enum><header>Technical and conforming amendment</header><text>Section 6701 of the U.S. Troop Readiness, Veterans’ Care, Katrina Recovery, and Iraq Accountability Appropriation Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/2/1806">2 U.S.C. 1806</external-xref>) is repealed.</text></paragraph></subsection></section>
<section id="HD79554B0098A43028EC655CACE27581B"><enum>203.</enum><header>General Duties of Chief Executive Officer</header>
<subsection display-inline="no-display-inline" id="H94A36C464CE84E0DA63D00F96DEE4F2E"><enum>(a)</enum><header>Administration of Facilities, Services, and Activities</header>
<paragraph id="HB3C98D1D04774A73B3398C50B73F4B29"><enum>(1)</enum><header>In general</header><text>Except to the extent otherwise provided in this Act, the Chief Executive Officer shall be responsible for—</text>
<subparagraph id="HD6A02D40E04F4700B1A7BE7953DAF74D"><enum>(A)</enum><text>the operation, management, and budget preparation and execution of the Capitol Visitor Center, including all long term planning and daily operational services and activities provided within the Capitol Visitor Center; and</text></subparagraph>
<subparagraph id="HF16CE913FBAF44F4B2006336234B2DFB"><enum>(B)</enum><text>in accordance with sections 401 and 402, the management of guided tours of the interior of the United States Capitol.</text></subparagraph></paragraph>
<paragraph id="HCD8C709C0863426FACDD751F5C5C2E48"><enum>(2)</enum><header>Independent budget consideration</header>
<subparagraph id="H0EEFB04835894CF7BB7FC254D634CE37"><enum>(A)</enum><header>In general</header><text>The Architect of the Capitol, upon recommendation of the Chief Executive Officer, shall submit the proposed budget for the Office for a fiscal year in the proposed budget for that year for the Office of the Architect of the Capitol (as submitted by the Architect of the Capitol to the President). The proposed budget for the Office shall be considered independently from the other components of the proposed budget for the Architect of the Capitol.</text></subparagraph>
<subparagraph id="H817E5B0EB32A4346986937DFB230A32E"><enum>(B)</enum><header>Exclusion of costs of general maintenance and repair of Visitor Center</header><text>In preparing the proposed budget for the Office under subparagraph (A), the Chief Executive Officer shall exclude costs attributable to the activities and services described under section 501(b) (relating to continuing jurisdiction of the Architect of the Capitol for the care and superintendence of the Capitol Visitor Center).</text></subparagraph></paragraph></subsection>
<subsection id="H0E4E3985376D479294C2F51E78A92D34"><enum>(b)</enum><header>Personnel, disbursements, and contracts</header><text>In carrying out this Act, the Architect of the Capitol shall have the authority to, upon recommendation of the Chief Executive Officer—</text>
<paragraph id="H87B5171DC3D34F99BDA7CDB1CED18D22"><enum>(1)</enum><text>appoint, hire, and fix the compensation of such personnel as may be necessary for operations of the Office, except that no employee may be paid at an annual rate in excess of the maximum rate payable for level 15 of the General Schedule;</text></paragraph>
<paragraph id="H11F5CF558AE440C78471B0F3657DDACD"><enum>(2)</enum><text>disburse funds as may be necessary and available for the needs of the Office (consistent with the requirements of section 303 in the case of amounts in the Capitol Visitor Center Revolving Fund); and</text></paragraph>
<paragraph id="HCA974489660A45B99890A200E1FEBFE6"><enum>(3)</enum><text>designate an employee of the Office to serve as contracting officer for the Office, subject to subsection (c).</text></paragraph></subsection>
<subsection id="HF9CF11BFB7174191A3DFEBF00033234"><enum>(c)</enum><header>Requiring Approval of Certain Contracts</header><text>The Architect of the Capitol may not enter into a contract for the operations of the Capitol Visitor Center for which the amount involved exceeds $250,000 without the prior approval of the Committee on Rules and Administration of the Senate and the Committee on House Administration of the House of Representatives.</text></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H8D89DA118B584D12A468B6EBA4B5FE57"><enum>(d)</enum><header>Semiannual Reports</header><text>The Chief Executive Officer shall submit a report to the Committee on Rules and Administration of the Senate and the Committee on House Administration of the House of Representatives not later than 45 days following the close of each semiannual period ending on March 31 or September 30 of each year on the financial and operational status during the period of each function under the jurisdiction of the Chief Executive Officer. Each such report shall include financial statements and a description or explanation of current operations, the implementation of new policies and procedures, and future plans for each function.</text></subsection></section>
<section id="HBD464FD82E1F4BDB8D584722BC48ADF5"><enum>204.</enum><header>Assistant to the Chief Executive Officer</header>
<subsection id="H38727B8A5B7A45199486004FC011B1FD"><enum>(a)</enum><header>In general</header><text>The Architect of the Capitol shall—</text>
<paragraph id="H201E9B84570C435BBFF8CDBD9E8BCBE9"><enum>(1)</enum><text>upon recommendation of the Chief Executive Officer, appoint an assistant who shall perform the responsibilities of the Chief Executive Officer during the absence or disability of the Chief Executive Officer, or during a vacancy in the position of the Chief Executive Officer; and</text></paragraph>
<paragraph id="H0CC766DC2D8E41C688C0526DE1F26CC3"><enum>(2)</enum><text>notwithstanding section 203(b)(1), fix the rate of basic pay for the position of the assistant appointed under subparagraph (A) at a rate not to exceed the highest total rate of pay for the Senior Executive Service under subchapter VIII of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/53">chapter 53</external-xref> of title 5, United States Code, for the locality involved.</text></paragraph></subsection>
<subsection id="HD5DD713C0EEC4F48B262F357B1E09B47"><enum>(b)</enum><header>Transition for Current Assistant Chief Executive Officer</header>
<paragraph id="H2B8E15A304D5421BAF16D222D567E7BD"><enum>(1)</enum><header>Appointment</header><text display-inline="yes-display-inline">The individual who serves as the assistant under section 1309 of the Legislative Branch Appropriations Act, 2008 (<external-xref legal-doc="usc" parsable-cite="usc/2/1807">2 U.S.C. 1807</external-xref>) as of the date of the enactment of this Act shall be the first Assistant Chief Executive Officer for Visitor Services appointed by the Architect under this section.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H551ABF7521C2455BB67C31BBC351001E"><enum>(2)</enum><header>Technical and conforming amendment</header><text>Section 1309 of the Legislative Branch Appropriations Act, 2008 (<external-xref legal-doc="usc" parsable-cite="usc/2/1807">2 U.S.C. 1807</external-xref>) is repealed.</text></paragraph></subsection></section>
<section commented="no" id="H4EB7A16F21C941678DD4BEB44729E139"><enum>205.</enum><header>Gift shop</header>
<subsection commented="no" id="H6C437E0F6844475B88E8B0EAA28D408"><enum>(a)</enum><header>Establishment</header><text>The Architect of the Capitol, acting through the Chief Executive Officer, shall establish a Capitol Visitor Center Gift Shop within the Capitol Visitor Center for the purpose of providing for the sale of gift items. All moneys received from sales and other services by the Capitol Visitor Center Gift Shop shall be deposited in the Capitol Visitor Center Revolving Fund established under section 301 and shall be available for purposes of this section.</text></subsection>
<subsection commented="no" id="H1615E63C6A3F48FE932F030093ACEBCC"><enum>(b)</enum><header>Exception to prohibition of sale or solicitation on Capitol grounds</header><text><external-xref legal-doc="usc" parsable-cite="usc/40/5104">Section 5104(c)</external-xref> of title 40, United States Code, shall not apply to any activity carried out under this section.</text></subsection></section>
<section id="H6B5E4357F5CD4A32B0A1BB48E85E3188"><enum>206.</enum><header>Food service operations</header>
<subsection id="H6FAC898D6EEE4E5690027B15E9FACEA"><enum>(a)</enum><header>Restaurant, catering, and vending</header><text>The Architect of the Capitol, acting through the Chief Executive Officer, shall establish within the Capitol Visitor Center a restaurant and other food service facilities, including catering services and vending machines.</text></subsection>
<subsection id="H11A30E5DE30C47E2852F716C234D6204"><enum>(b)</enum><header>Contract for food service operations</header>
<paragraph id="H9997E977ED6B4B3BB9FBD39D006F3FE0"><enum>(1)</enum><header>In general</header><text>The Architect of the Capitol, acting through the Chief Executive Officer, may enter into a contract for food service operations within the Capitol Visitor Center.</text></paragraph>
<paragraph id="H86C3C9445DAF4B07A417F59200D57B06"><enum>(2)</enum><header>Existing contract unaffected</header><text>Nothing in paragraph (1) shall be construed to affect any contract for food service operations within the Capitol Visitor Center in effect on the date of enactment of this Act.</text></paragraph></subsection>
<subsection id="HE6000D8C84354A3894653BA5369910A4"><enum>(c)</enum><header>Deposits</header><text>All net profits from the food service operations within the Capitol Visitor Center and all commissions received from the contractor for such food service operations shall be deposited in the Capitol Visitor Center Revolving Fund established under section 301.</text></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H7CB6015180A843D690EF1EBC0005C5E3"><enum>(d)</enum><header>Exception to prohibition of sale or solicitation on Capitol grounds</header><text><external-xref legal-doc="usc" parsable-cite="usc/40/5104">Section 5104(c)</external-xref> of title 40, United States Code, shall not apply to any activity carried out under this section.</text></subsection></section>
<enum>III</enum><header>Capitol Visitor Center Revolving Fund</header>
<section id="H9A1AEC017DD74DD88D273136C1D0F000"><enum>301.</enum><header>Establishment and accounts</header><text display-inline="no-display-inline">There is established in the Treasury of the United States a revolving fund to be known as the Capitol Visitor Center Revolving Fund (in this section referred to as the <quote>Fund</quote>), consisting of the following individual accounts:</text>
<paragraph id="H99E5264909CD4EFF9E42174236FF6224"><enum>(1)</enum><text>The Gift Shop Account.</text></paragraph>
<paragraph id="HDD6376B831B8472AA8769353D914A678"><enum>(2)</enum><text>The Miscellaneous Receipts Account.</text></paragraph></section>
<section id="HD1989EF5EC0842A5BEE28107269EE950"><enum>302.</enum><header>Deposits in the Fund</header>
<subsection id="H8A25CA3DF41F479DAF949000CF40FF4B"><enum>(a)</enum><header>Gift Shop Account</header><text display-inline="yes-display-inline">There shall be deposited in the Gift Shop Account all monies received from sales and other services by the gift shop established under section 205, together with any interest accrued on balances in the Account.</text></subsection>
<subsection id="H8DF64BD2F4284704AC7EB66387C16FA9"><enum>(b)</enum><header>Miscellaneous Receipts Account</header><text display-inline="yes-display-inline">There shall be deposited in the Miscellaneous Receipts Account each of the following (together with any interest accrued on balances in the Account):</text>
<paragraph id="H776A55ACBDEF45C4AB10E74C066346D6"><enum>(1)</enum><text display-inline="yes-display-inline">Any amounts deposited under section 206(c).</text></paragraph>
<paragraph id="H367CD05D0C3D4BA2A1EB6BEA72FE61DC"><enum>(2)</enum><text>Any other receipts received from the operation of the Capitol Visitor Center.</text></paragraph>
<paragraph commented="no" id="H556502B4DE7C42E8AE391B16250793C2"><enum>(3)</enum><text>Any amounts described under section 504(d).</text></paragraph></subsection></section>
<section id="H998682CB35E746B08356E75454FF567D"><enum>303.</enum><header>Use of monies</header>
<subsection id="H5F658433560B4E22AC065C942C00135D"><enum>(a)</enum><header>Gift shop account</header>
<paragraph id="HACCCCF60FB3A4DDDB332F8A28642D7AD"><enum>(1)</enum><header>In general</header><text>All monies in the Gift Shop Account shall be available without fiscal year limitation for disbursement by the Architect of the Capitol, upon recommendation of the Chief Executive Officer, in connection with the operation of the gift shop under section 205, including supplies, inventories, equipment, and other expenses. In addition, such monies may be used by the Architect of the Capitol, upon recommendation of the Chief Executive Officer, to reimburse any applicable appropriations account for amounts used from such appropriations account to pay the salaries of employees of the gift shops.</text></paragraph>
<paragraph id="H25BBB3EC78AE4F1FB69C8700F180D943"><enum>(2)</enum><header>Use of remaining funds</header><text>To the extent monies in the Gift Shop Account are available after disbursements and reimbursements are made under paragraph (1), the Architect of the Capitol, upon recommendation of the Chief Executive Officer, may disburse such monies for the operation of the Capitol Visitor Center, after consultation with—</text>
<subparagraph id="H256D8CCC09B6485DB6189E1335FA6DAF"><enum>(A)</enum><text>the Committee on Rules and Administration of the Senate and the Committee on House Administration of the House of Representatives; and</text></subparagraph>
<subparagraph id="H03CB5C84C02047469314D06EAC02226D"><enum>(B)</enum><text>the Committees on Appropriations of the House of Representatives and Senate.</text></subparagraph></paragraph></subsection>
<subsection id="HE6950D24A40245CA80F8C6924EC66677"><enum>(b)</enum><header>Miscellaneous receipts account</header><text>All monies in the Miscellaneous Receipts Account shall be available without fiscal year limitation for disbursement by the Architect of the Capitol, upon recommendation of the Chief Executive Officer, for the operations of the Capitol Visitor Center, after consultation with—</text>
<paragraph id="HC4F9CFA40A334B6FA26D56B74E1D90DB"><enum>(1)</enum><text>the Committee on Rules and Administration of the Senate and the Committee on House Administration of the House of Representatives; and</text></paragraph>
<paragraph id="HDAAD1ED7E2F9450A8ED2ADEDC84F91BF"><enum>(2)</enum><text>the Committees on Appropriations of the House of Representatives and Senate.</text></paragraph></subsection></section>
<section id="H6D0EFA259C494A4595C3B488D170495"><enum>304.</enum><header>Administration of Fund</header>
<subsection id="H2551DB9C3CE347C1A66641F1BBBC5C1B"><enum>(a)</enum><header>Disbursements</header><text>Disbursements from the Fund may be made by the Architect of the Capitol, upon recommendation of the Chief Executive Officer.</text></subsection>
<subsection id="H23ACA4F675EC44449BBB5709A7C842E7"><enum>(b)</enum><header>Investment Authority</header><text>The Secretary of the Treasury shall invest any portion of the Fund that, as determined by the Architect of the Capitol, upon recommendation of the Chief Executive Officer, is not required to meet current expenses. Each investment shall be made in an interest-bearing obligation of the United States or an obligation guaranteed both as to principal and interest by the United States that, as determined by the Architect of the Capitol, upon recommendation of the Chief Executive Officer, has a maturity date suitable for the purposes of the Fund. The Secretary of the Treasury shall credit interest earned on the obligations to the Fund.</text></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HD0060D2086F5481283E3E096909096C0"><enum>(c)</enum><header>Audit</header><text>The Fund shall be subject to audit by the Comptroller General at the discretion of the Comptroller General.</text></subsection></section>
<enum>IV</enum><header>Capitol Guide Service and Office of Congressional Accessibility Services</header>
<subtitle id="HEFB34843ACC140E6AB6E617CA2D52C5E"><enum>A</enum><header>Capitol Guide Service</header>
<section id="HF037C75B38944939AF31FE15064807BD"><enum>401.</enum><header>Transfer of Capitol Guide Service</header>
<subsection id="HCD37D09FCC4149BEB2D5DE5180A52F4E"><enum>(a)</enum><header>Transfer of Authorities and Personnel to Office of the Capitol Visitor Center</header><text>In accordance with the provisions of this title, effective on the transfer date—</text>
<paragraph commented="no" id="HB11966441ADF4F528F69FD2D00655134"><enum>(1)</enum><text>the Capitol Guide Service shall be an office within the Office;</text></paragraph>
<paragraph id="H864128CF07AC4611A1BAD94456CDE150"><enum>(2)</enum><text>the contracts, liabilities, records, property, appropriations, and other assets and interests of the Capitol Guide Service, established under section 441 of the Legislative Reorganization Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/2/2166">2 U.S.C. 2166</external-xref>), and the employees of the Capitol Guide Service, are transferred to the Office, except that the transfer of any amounts appropriated to the Capitol Guide Service that remain available as of the transfer date shall occur only upon the approval of the Committees on Appropriations of the House of Representatives and Senate; and</text></paragraph>
<paragraph id="H11F06E42BF864E31B89300C2EDEF00F2"><enum>(3)</enum><text>the Capitol Guide Service shall be subject to the direction of the Architect of the Capitol, upon recommendation of the Chief Executive Officer, in accordance with this subtitle.</text></paragraph></subsection>
<subsection id="HE10EB1E6DF4749509FFAE06713EE00D4"><enum>(b)</enum><header>Treatment of Employees of Capitol Guide Service at Time of Transfer</header>
<paragraph id="HD1DB4F7ADB5A40B1877CD94729CCB7BE"><enum>(1)</enum><header>In general</header><text>Any individual who is an employee of the Capitol Guide Service on a non-temporary basis on the transfer date who is transferred to the Office under subsection (a) shall be subject to the authority of the Architect of the Capitol under section 402(b), except that the individual’s grade, compensation, rate of leave, or other benefits that apply with respect to the individual at the time of transfer shall not be reduced while such individual remains continuously so employed in the same position within the Office, other than for cause.</text></paragraph>
<paragraph display-inline="no-display-inline" id="HCB229071995F490A945DAE7DC0014700"><enum>(2)</enum><header>Eligibility for immediate retirement on basis of involuntary separation</header><text>For purposes of section 8336(d) and <external-xref legal-doc="usc" parsable-cite="usc/5/8414">section 8414(b)</external-xref> of title 5, United States Code, an individual described in paragraph (1) who is separated from service with the Office shall be considered to have separated from the service involuntarily if, at the time the individual is separated from service—</text>
<subparagraph id="HEFC4373ADEBD42F3B5F686A822536071"><enum>(A)</enum><text>the individual has completed 25 years of service under such title; or</text></subparagraph>
<subparagraph id="HC0F7A32E3BD544CC97FB315FC7F0BE26"><enum>(B)</enum><text>the individual has completed 20 years of service under such title and is 50 years of age or older.</text></subparagraph></paragraph></subsection>
<subsection id="H6E7C97EB081746F982E1E31E120F179"><enum>(c)</enum><header>Exception for Congressional Special Services Office</header><text display-inline="yes-display-inline">This section does not apply with respect to any employees, contracts, liabilities, records, property, appropriations, and other assets and interests of the Congressional Special Services Office of the Capitol Guide Service that are transferred to the Office of Congressional Accessibility Services under subtitle B.</text></subsection></section>
<section id="HE4479A470D104C8683FA5951CC1DB99E"><enum>402.</enum><header>Duties of employees of Capitol Guide Service</header>
<subsection id="H171561C38D1B4FFEB2005757E1D470C5"><enum>(a)</enum><header>Provision of Guided Tours</header>
<paragraph id="HF962A8CB7BDD40AEA354CD306EA107E4"><enum>(1)</enum><header>Tours</header><text>In accordance with this section, the Capitol Guide Service shall provide without charge guided tours of the interior of the United States Capitol, including the Capitol Visitor Center, for the education and enlightenment of the general public.</text></paragraph>
<paragraph id="H1DA98422DB9C49CC8D54367FF1B36532"><enum>(2)</enum><header>Acceptance of fees prohibited</header><text display-inline="yes-display-inline">An employee of the Capitol Guide Service shall not charge or accept any fee, or accept any gratuity, for or on account of the official services of that employee.</text></paragraph>
<paragraph id="H3152FEF0C7884DC1B219EA1B1E559343"><enum>(3)</enum><header>Regulations of the Architect of the Capitol</header><text>All such tours shall be conducted in compliance with regulations approved by the Architect of the Capitol, upon recommendation of the Chief Executive Officer.</text></paragraph></subsection>
<subsection id="H57248BE9A2674E56A9086DEAFEB72202"><enum>(b)</enum><header>Authority of the Architect of the Capitol</header><text>In providing for the direction, supervision, and control of the Capitol Guide Service, the Architect of the Capitol, upon recommendation of the Chief Executive Officer, is authorized to—</text>
<paragraph id="H70AA42B7B14448218E14DCAF79026D9B"><enum>(1)</enum><text>subject to the availability of appropriations, establish and revise such number of positions of Guide in the Capitol Guide Service as the Architect of the Capitol considers necessary to carry out effectively the activities of the Capitol Guide Service;</text></paragraph>
<paragraph id="HFD8098C124B540F6A1E000CBCE96823"><enum>(2)</enum><text display-inline="yes-display-inline">appoint, on a permanent basis without regard to political affiliation and solely on the basis of fitness to perform their duties, a Chief Guide and such deputies as the Architect of the Capitol considers appropriate for the effective administration of the Capitol Guide Service and, in addition, such number of Guides as may be authorized;</text></paragraph>
<paragraph id="H12AFD616B122464A9114F265DF510027"><enum>(3)</enum><text display-inline="yes-display-inline">with the approval of the Committee on Rules and Administration of the Senate and the Committee on House Administration of the House of Representatives, with respect to the individuals appointed under paragraph (2)—</text>
<subparagraph id="HC7067B8611624AE9ABC04B38006B7047"><enum>(A)</enum><text>prescribe the individual’s duties and responsibilities; and</text></subparagraph>
<subparagraph id="H6E3DC9A44E094B139BA8BAD52411EF37"><enum>(B)</enum><text>fix, and adjust from time to time, respective rates of pay at single per annum (gross) rates;</text></subparagraph></paragraph>
<paragraph id="H35E7332F055C47FE9EA6903945107E8C"><enum>(4)</enum><text>with respect to the individuals appointed under paragraph (2), take appropriate disciplinary action, including, when circumstances warrant, suspension from duty without pay, reduction in pay, demotion, or termination of employment with the Capitol Guide Service, against any employee who violates any provision of this section or any regulation prescribed by the Architect of the Capitol under paragraph (8);</text></paragraph>
<paragraph id="H99246CC1E161401D93EF950146093505"><enum>(5)</enum><text>prescribe a uniform dress, including appropriate insignia, which shall be worn by personnel of the Capitol Guide Service;</text></paragraph>
<paragraph id="HE6C2DC481DEB47B980937B6B00E3B95C"><enum>(6)</enum><text>from time to time and as may be necessary, procure and furnish such uniforms to such personnel without charge to such personnel;</text></paragraph>
<paragraph id="H835CCC072F684E609F6565C65FF93F73"><enum>(7)</enum><text>receive and consider advice and information from any private historical or educational organization, association, or society with respect to those operations of the Capitol Guide Service which involve the furnishing of historical and educational information to the general public; and</text></paragraph>
<paragraph id="H7EB8535936EB43CCA67D5283C227157B"><enum>(8)</enum><text>with the approval of the Committee on Rules and Administration of the Senate and the Committee on House Administration of the House of Representatives, prescribe such regulations as the Architect of the Capitol considers necessary and appropriate for the operation of the Capitol Guide Service, including regulations with respect to tour routes and hours of operation, number of visitors per guide, staff-led tours, and non-law enforcement security and special event related support.</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HED2F59DB2F384EAAA1423C5B3611CDA7"><enum>(c)</enum><header>Provision of Accessible Tours in Coordination With Office of Congressional Accessibility Services</header><text>The Chief Executive Officer shall coordinate the provision of accessible tours for individuals with disabilities with the Office of Congressional Accessibility Services established under subtitle B.</text></subsection>
<subsection id="H81ED5C5D90334EBE99F7D94FBA9648CE"><enum>(d)</enum><header>Detail of personnel</header><text>The Architect of the Capitol shall detail personnel of the Capitol Guide Service based on a request from the Capitol Police Board to assist the United States Capitol Police by providing ushering and informational services, and other services not directly involving law enforcement, in connection with—</text>
<paragraph id="H66CFCEB4F81442A1BE5ED342F41067ED"><enum>(1)</enum><text>the inauguration of the President and Vice President of the United States;</text></paragraph>
<paragraph id="HC42F434EF4A54E638596F585CAC2DBE"><enum>(2)</enum><text>the official reception of representatives of foreign nations and other persons by the Senate or House of Representatives; or</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HA31151F28002400C87FE933CEA519FA"><enum>(3)</enum><text display-inline="yes-display-inline">other special or ceremonial occasions in the United States Capitol or on the United States Capitol Grounds that—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H5BDF84ED94C943C9927912EA8B9926AF"><enum>(A)</enum><text display-inline="yes-display-inline">require the presence of additional Government personnel; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H6D964F354A8B4F5DABD2FC55B60629E"><enum>(B)</enum><text display-inline="yes-display-inline">cause the temporary suspension of the performance of regular duties.</text></subparagraph></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H6317AD51714E48D194A18607E4158BDD"><enum>(e)</enum><header>Effective date</header><text>This section shall take effect on the transfer date.</text></subsection></section></subtitle>
<subtitle id="HA9B030ED5E23408BB3514CD112FCA1B"><enum>B</enum><header>Office of Congressional Accessibility Services</header>

<subsection commented="no" id="HE46E2CB4F285400ABEEF9D975D18DDD2"><enum>(a)</enum><header>In General</header><text display-inline="yes-display-inline">Section 310 of the Legislative Branch Appropriations Act, 1990 (<external-xref legal-doc="usc" parsable-cite="usc/2/130e">2 U.S.C. 130e</external-xref>) is amended to read as follows:</text>

<paragraph id="H250505F8CF174588913BB92128951E5F"><enum>(1)</enum><header>Establishment</header><text>There is established in the legislative branch the Office of Congressional Accessibility Services, to be headed by the Director of Accessibility Services.</text></paragraph>
<paragraph id="H198B0139F2A3412A89C4F5EADA2DE"><enum>(2)</enum><header>Congressional Accessibility Services Board</header>
<subparagraph id="H5F6F0126BD7047578CCAEA82E2474FD9"><enum>(A)</enum><header>Establishment</header><text>There is established the Congressional Accessibility Services Board, which shall be composed of—</text>
<clause id="HD492AC252DEF4403BBC68F913C911E2B"><enum>(i)</enum><text>the Sergeant at Arms and Doorkeeper of the Senate;</text></clause>
<clause id="HB8BAEB37BC9B464F9796AAB8D8CF88D1"><enum>(ii)</enum><text>the Secretary of the Senate;</text></clause>
<clause id="HC92140BE3FEF4D509C000759AFDFD764"><enum>(iii)</enum><text>the Sergeant at Arms of the House of Representatives;</text></clause>
<clause id="H1049A3C639574E00BE5C88F000884FBE"><enum>(iv)</enum><text>the Clerk of the House of Representatives; and</text></clause>
<clause id="H77600563A1E14904BBECE2F0066A6E"><enum>(v)</enum><text>the Architect of the Capitol.</text></clause></subparagraph>
<subparagraph id="H5D1EB620087D46B6ACB236F9B7649BCA"><enum>(B)</enum><header>Direction of Board</header><text>The Office of Congressional Accessibility Services shall be subject to the direction of the Congressional Accessibility Services Board.</text></subparagraph></paragraph>
<paragraph id="HA8F96F3456A84D87A47800EA041FE4FE"><enum>(3)</enum><header>Mission and Functions</header>
<subparagraph id="H97C2C39C403C440D94BE4C68DD76DD10"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Office of Congressional Accessibility Services shall—</text>
<clause id="H5522A60FDC444DF3A3272F35D129F1D0"><enum>(i)</enum><text display-inline="yes-display-inline">provide and coordinate accessibility services for individuals with disabilities, including Members of Congress, officers and employees of the House of Representatives and the Senate, and visitors, in the United States Capitol Complex; and</text></clause>
<clause id="HB77AC3618B594AE38B409D4064552D57"><enum>(ii)</enum><text display-inline="yes-display-inline">provide information regarding accessibility for individuals with disabilities, as well as related training and staff development, to Members of Congress and employees of the Senate and the House of Representatives.</text></clause></subparagraph>
<subparagraph id="HFB07A0E2614D4F6887E82C871329398F"><enum>(B)</enum><header>United States Capitol Complex defined</header><text>In this paragraph, the term <term>United States Capitol Complex</term> means the Capitol buildings (as defined in <external-xref legal-doc="usc" parsable-cite="usc/40/5101">section 5101</external-xref> of title 40, United States Code) and the United States Capitol Grounds (as described in section 5102 of such title).</text></subparagraph></paragraph></subsection>
<subsection id="H3C5519C631744F77896B93EE49F647A6"><enum>(b)</enum><header>Director of Accessibility Services</header>
<paragraph display-inline="no-display-inline" id="HBCC9414449994AABB7CB6BC17CB0349C"><enum>(1)</enum><header>Appointment, pay, and removal</header>
<subparagraph id="H33C792ACB1F44633B42907CC02880160"><enum>(A)</enum><header>Appointment and pay</header><text>The Director of Accessibility Services shall be appointed by the Congressional Accessibility Services Board and shall be paid at a rate of pay determined by the Congressional Accessibility Services Board.</text></subparagraph>
<subparagraph id="H1280D21E1BE74DC289DEA33EC490C014"><enum>(B)</enum><header>Removal</header><text>Upon removal of the Director of Accessibility Services, the Congressional Accessibility Services Board shall immediately provide notice of the removal to the Committee on Rules and Administration of the Senate, the Committee on House Administration of the House of Representatives, and the Committees on Appropriations of the House of Representatives and Senate. The notice shall include the reasons for the removal.</text></subparagraph></paragraph>
<paragraph id="HD98FB79979E84B7BBD5E74BC7B35E6E"><enum>(2)</enum><header>Personnel and Other Administrative Functions</header>
<subparagraph id="HC35AF1CE0A634566A9A2EF7A109612"><enum>(A)</enum><header>Personnel, disbursements, and contracts</header><text>In carrying out the functions of the Office of Congressional Accessibility Services under subsection (a), the Director of Accessibility Services shall have the authority to—</text>
<clause id="HB2EF67C575BC4F34866781B077E23243"><enum>(i)</enum><text>appoint, hire, and fix the compensation of such personnel as may be necessary for operations of the Office of Congressional Accessibility Services, except that no employee may be paid at an annual rate in excess of the annual rate of pay for the Director of Accessibility Services;</text></clause>
<clause id="H2D2685437AB74920A000F7AFD35D0449"><enum>(ii)</enum><text>take appropriate disciplinary action, including, when circumstances warrant, suspension from duty without pay, reduction in pay, demotion, or termination of employment with the Office of Congressional Accessibility Services, against any employee;</text></clause>
<clause id="HC3CF38CA3BC14FD0B1D1751EBB20983"><enum>(iii)</enum><text>disburse funds as may be necessary and available for the needs of the Office of Congressional Accessibility Services; and</text></clause>
<clause id="HA6D37AB9C1C446328B9455B9E73920C1"><enum>(iv)</enum><text>serve as contracting officer for the Office of Congressional Accessibility Services.</text></clause></subparagraph>
<subparagraph display-inline="no-display-inline" id="H46E31733D1E3471EA412ACD493AA533B"><enum>(B)</enum><header>Agreements with the office of the architect of the capitol, with other legislative branch agencies, and with offices of the senate and house of representatives</header><text>Subject to the approval of the Committee on Rules and Administration of the Senate and the Committee on House Administration of the House of Representatives, the Director of Accessibility Services may place orders and enter into agreements with the Office of the Architect of the Capitol, with other legislative branch agencies, and with any office or other entity of the Senate or House of Representatives for procuring goods and providing financial and administrative services on behalf of the Office of Congressional Accessibility Services, or to otherwise assist the Director in the administration and management of the Office of Congressional Accessibility Services.</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HFB4BCFB5F80E48D68C3FE7E9B242355"><enum>(3)</enum><header>Semiannual reports</header><text>The Director of Accessibility Services shall submit a report to the Committee on Rules and Administration of the Senate and the Committee on House Administration of the House of Representatives not later than 45 days following the close of each semiannual period ending on March 31 or September 30 of each year on the financial and operational status during the period of each function under the jurisdiction of the Director. Each such report shall include financial statements and a description or explanation of current operations, the implementation of new policies and procedures, and future plans for each function.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="H0A6B30993CF24475B802402B256CDE65"><enum>(b)</enum><header>Specific functions</header><text>The Director of Accessibility Services shall submit to the Committee on Rules and Administration of the Senate and the Committee on House Administration of the House of Representatives a list of the specific functions that the Office of Congressional Accessibility Services will perform in carrying out this subtitle with the approval of the Committee on Rules and Administration of the Senate and the Committee on House Administration of the House of Representatives. The Director of Accessibility Services shall submit the list not later than 30 days after the transfer date.</text></subsection>
<subsection id="H3918EFE2FE104813B9452B42B7555BDD"><enum>(c)</enum><header>Transition for Current Director</header><text display-inline="yes-display-inline">The individual who serves as the head of the Congressional Special Services Office as of the date of the enactment of this Act shall be the first Director of Accessibility Services appointed by the Congressional Accessibility Services Board under section 310 of the Legislative Branch Appropriations Act, 1990 (<external-xref legal-doc="usc" parsable-cite="usc/2/130e">2 U.S.C. 130e</external-xref>) (as amended by this section).</text></subsection></section>
<section id="HE302E4BDF0EA4E9084CAC3BA2811C3AB"><enum>412.</enum><header>Transfer From Capitol Guide Service</header>
<subsection id="H6D0BC7AE380849FCAE0072134E8BE610"><enum>(a)</enum><header>Transfer of Authorities and Personnel of Congressional Special Services Office of Capitol Guide Service</header><text display-inline="yes-display-inline">In accordance with the provisions of this title, effective on the transfer date—</text>
<paragraph id="H33A3D76F75EB463A9BB8742D873DFAF"><enum>(1)</enum><text display-inline="yes-display-inline">the contracts, liabilities, records, property, appropriations, and other assets and interests of the Congressional Special Services Office of the Capitol Guide Service, and the employees of such Office, are transferred to the Office of Congressional Accessibility Services established under section 310(a) of the Legislative Branch Appropriations Act, 1990 (<external-xref legal-doc="usc" parsable-cite="usc/2/130e">2 U.S.C. 130e</external-xref>) (as amended by section 411 of this Act), except that the transfer of any amounts appropriated to the Congressional Special Services Office that remain available as of the transfer date shall occur only upon the approval of the Committees on Appropriations of the House of Representatives and Senate; and</text></paragraph>
<paragraph id="HE8EA4A87932E4AC197C0C00D0A51DD"><enum>(2)</enum><text>the employees of such Office shall be subject to the direction, supervision, and control of the Director of Accessibility Services.</text></paragraph></subsection>
<subsection display-inline="no-display-inline" id="H264C26BCE5044F428296DB5BFDD210ED"><enum>(b)</enum><header>Treatment of Employees at Time of Transfer</header>
<paragraph id="HC749504987F04D69B54DC98ECAF9BAAE"><enum>(1)</enum><header>In general</header><text>Any individual who is an employee of the Congressional Special Services Office of the Capitol Guide Service on a non-temporary basis on the transfer date who is transferred under subsection (a) shall be subject to the authority of the Director of Accessibility Services under section 310(b) of the Legislative Branch Appropriations Act, 1990 (<external-xref legal-doc="usc" parsable-cite="usc/2/130e">2 U.S.C. 130e</external-xref>) (as amended by section 411 of this Act), except that the individual’s grade, compensation, rate of leave, or other benefits that apply with respect to the individual at the time of transfer shall not be reduced while such individual remains continuously so employed in the same position within the Office of Congressional Accessibility Services established under section 310(a) of the Legislative Branch Appropriations Act, 1990 (<external-xref legal-doc="usc" parsable-cite="usc/2/130e">2 U.S.C. 130e</external-xref>) (as amended by section 411 of this Act), other than for cause.</text></paragraph>
<paragraph id="HF74B6658DB844AC7825D76E75BE433D0"><enum>(2)</enum><header>Eligibility for immediate retirement on basis of involuntary separation</header><text>For purposes of section 8336(d) and <external-xref legal-doc="usc" parsable-cite="usc/5/8414">section 8414(b)</external-xref> of title 5, United States Code, an individual described in paragraph (1) who is separated from service with the Office of Congressional Accessibility Services shall be considered to have separated from the service involuntarily if, at the time the individual is separated from service—</text>
<subparagraph id="H12842E67F63E4DA4B087B51DFEB44422"><enum>(A)</enum><text>the individual has completed 25 years of service under such title; or</text></subparagraph>
<subparagraph id="HE9E0B729AE16413EA3F6A4A9AF802654"><enum>(B)</enum><text>the individual has completed 20 years of service under such title and is 50 years of age or older.</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H6F8D1E977DE8432DB9F62CF4BE792316"><enum>(3)</enum><header>Prohibiting imposition of probationary period</header><text display-inline="yes-display-inline">The Director of Accessibility Services may not impose a period of probation with respect to the transfer of any individual who is transferred to the Office of Congressional Accessibility Services under subsection (a).</text></paragraph></subsection></section></subtitle>
<subtitle id="H6B0DEC1F68834B4C81A076FA95B37BA9"><enum>C</enum><header>Transfer date and technical and conforming amendments</header>
<section commented="no" display-inline="no-display-inline" id="H8C475A13D2CE4CBF89F9376914387030" section-type="subsequent-section"><enum>421.</enum><header>Transfer date</header><text display-inline="no-display-inline">In this title, the term <quote>transfer date</quote> means the date occurring on the first day of the first pay period (applicable to employees transferred under section 401) occurring on or after 30 days after the date of enactment of this Act.</text></section>
<section id="HDE3F1C26F4B84FA493E182199D75BE26"><enum>422.</enum><header>Technical and conforming amendments</header>
<subsection id="H44E6517B98B344469658DF3EDD20C14C"><enum>(a)</enum><header>Existing Authority of Capitol Guide Service</header><text>Section 441 of the Legislative Reorganization Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/2/2166">2 U.S.C. 2166</external-xref>) is repealed.</text></subsection>
<subsection id="HBC6CDC5D0AFF4D98BB95DBD8F57E2B98"><enum>(b)</enum><header>Coverage Under Congressional Accountability Act of 1995</header>
<paragraph id="HF81ED1D9701546328C85004D19009BA7"><enum>(1)</enum><header>Treatment of employees as covered employees</header><text>Section 101(3)(C) of the Congressional Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1301">2 U.S.C. 1301(3)(C)</external-xref>) is amended to read as follows:</text>

<enum>V</enum><header>Miscellaneous provisions</header>
<section id="H7883D6F7AD9D4832A5426F99EDA521F1"><enum>501.</enum><header>Jurisdictions unaffected</header>
<subsection id="H6FDB10D8F81E4F1EA0C15B00F720FF36"><enum>(a)</enum><header>Security jurisdiction unaffected</header><text display-inline="yes-display-inline">Nothing in this Act granting any authority to the Architect of the Capitol or Chief Executive Officer shall be construed to affect the exclusive jurisdiction of the Capitol Police, the Capitol Police Board, the Sergeant at Arms and Doorkeeper of the Senate, and the Sergeant at Arms of the House of Representatives to provide security for the Capitol, including the Capitol Visitor Center.</text></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H5EE68D6DB15E4DE2AEEA256222A4766C"><enum>(b)</enum><header>Architect of the Capitol jurisdiction unaffected</header>
<paragraph commented="no" display-inline="no-display-inline" id="HB6103AA79A9F4DC5A2D6E4D91E12E020"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Nothing in this Act granting any authority to the Chief Executive Officer shall be construed to affect the exclusive jurisdiction of the Architect of the Capitol for the care and superintendence of the Capitol Visitor Center. All maintenance services, groundskeeping services, improvements, alterations, additions, and repairs for the Capitol Visitor Center shall be made under the direction and supervision of the Architect, subject to the approval of the Committee on Rules and Administration of the Senate and the House Office Building Commission as to matters of general policy.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H26704D1DC10A4497ABC11CF662002472"><enum>(2)</enum><header>Technical and conforming amendment</header><text>Section 1305 of the Legislative Branch Appropriations Act, 2008 (<external-xref legal-doc="usc" parsable-cite="usc/2/1825">2 U.S.C. 1825</external-xref>) is repealed.</text></paragraph></subsection></section>
<section id="HFB019E40587141A0BD7FD499CD3613F5"><enum>502.</enum><header>Student loan repayment authority</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/5/5379">Section 5379(a)(1)(A)</external-xref> of title 5, United States Code, is amended by inserting <quote>, the Architect of the Capitol, the Botanic Garden, and the Office of Congressional Accessibility Services </quote> after <quote>title</quote>.</text></section>
<section commented="no" display-inline="no-display-inline" id="H1EE4C9A4E7774B2BA8E69924CF9B9197" section-type="subsequent-section"><enum>503.</enum><header>Acceptance of volunteer services</header><text display-inline="no-display-inline">Notwithstanding <external-xref legal-doc="usc" parsable-cite="usc/31/1342">section 1342</external-xref> of title 31, United States Code, the Architect of the Capitol, upon the recommendation of the Chief Executive Officer, may accept and use voluntary and uncompensated services for the Capitol Visitor Center as the Architect of the Capitol determines necessary. No person shall be permitted to donate personal services under this section unless such person has first agreed, in writing, to waive any and all claims against the United States arising out of or connection with such services, other than a claim under the provisions of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/81">chapter 81</external-xref> of title 5, United States Code. No person donating personal services under this section shall be considered an employee of the United States for any purpose other than for purposes of chapter 81 of such title. In no case shall the acceptance of personal services under this subsection result in the reduction of pay or displacement of any employee of the Office of the Architect of the Capitol.</text></section>
<section id="H5087D758B9E6465DA2F8682531FFFEF0"><enum>504.</enum><header>Coins treated as gifts</header>
<subsection id="H90594327DF23415784E05D4655C3F3DC"><enum>(a)</enum><header>Definition</header><text>In this section, the term <term>covered grounds</term> means—</text>
<paragraph id="H640C0A77830B472EA4EE376A44FD570"><enum>(1)</enum><text>the grounds described under <external-xref legal-doc="usc" parsable-cite="usc/40/5102">section 5102</external-xref> of title 40, United States Code;</text></paragraph>
<paragraph id="H5E62FDB5B4DC42C39944A2FF8E53DD99"><enum>(2)</enum><text>the Capitol Buildings defined under <external-xref legal-doc="usc" parsable-cite="usc/40/5101">section 5101</external-xref> of title 40, United States Code, including the Capitol Visitor Center; and</text></paragraph>
<paragraph id="H1244564B16744D56ACA00D4A47C2303"><enum>(3)</enum><text>the Library of Congress buildings and grounds described under section 11 of the Act entitled <quote>An Act relating to the policing of the buildings and grounds of the Library of Congress</quote>, approved August 4, 1950 (<external-xref legal-doc="usc" parsable-cite="usc/2/167j">2 U.S.C. 167j</external-xref>).</text></paragraph></subsection>
<subsection id="H892384C9EEBB4F55AAD1EB27BB85E114"><enum>(b)</enum><header>Treatment of coins</header><text>In the case of any coins in any fountains on covered grounds—</text>
<paragraph id="H983829A2008B42D7A0FD94048BCF38F4"><enum>(1)</enum><text>such coins shall be treated as gifts to the United States; and</text></paragraph>
<paragraph id="H7DF679767044438FA88069EE44A62070"><enum>(2)</enum><text>the Architect of the Capitol shall—</text>
<subparagraph id="HDBFE76DDD3D34521BF048755FEDDB1B1"><enum>(A)</enum><text>collect such coins at such times and in such manner as the Architect determines appropriate; and</text></subparagraph>
<subparagraph id="HF35526A6C91945CFB9456497B760231C"><enum>(B)</enum><text>except as provided under subsection (c), deposit the collected coins in accordance with subsection (d).</text></subparagraph></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HF073192F324E440E9C0053172D1BE4AC"><enum>(c)</enum><header display-inline="yes-display-inline">Cost reimbursement</header><text display-inline="yes-display-inline">Any amount collected under this section shall first be used to reimburse the Architect of the Capitol for any costs incurred in the collection and processing of the coins. The amount of any such reimbursement is appropriated to the account from which such costs were paid and may be used for any authorized purpose of that account.</text></subsection>
<subsection id="H6A01D4749B3940D3A74D113FEF6B14CA"><enum>(d)</enum><header>Deposit of coins</header><text>The Architect of the Capitol shall deposit coins collected under this section in the Miscellaneous Receipts Account of the Capitol Visitor Center Revolving Fund established under section 301.</text></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H62E517E83A9F4FBFAC5962A73FE98CCE"><enum>(e)</enum><header>Authorized use and availability</header><text>Amounts deposited in the Miscellaneous Receipts Account of the Capitol Visitor Center Revolving Fund under this section shall be available as provided under section 303(b).</text></subsection></section>
<section id="H2BF5FB26510C4E399424321B5F6F8B08"><enum>505.</enum><header>Flexible work schedule pilot program</header>
<subsection id="HE24590E846D842B9A792E0CC73ED6D00"><enum>(a)</enum><header>In general</header><text>Section 1302 of the Legislative Branch Appropriations Act, 2008 (<external-xref legal-doc="usc" parsable-cite="usc/2/1831">2 U.S.C. 1831</external-xref> note; 121 Stat. 2242) is amended in the third sentence by striking <quote>September 30, 2008</quote> and inserting <quote>September 30, 2010</quote>.</text></subsection>
<subsection id="HB645D68E619C4A24A645E208BFF4F52"><enum>(b)</enum><header>Effective date</header><text>The amendment made under subsection (a) shall take effect as though enacted as part of the Legislative Branch Appropriations Act, 2008 (<external-xref legal-doc="public-law" parsable-cite="pl/110/161">Public Law 110–161</external-xref>; 121 Stat. 2218 et seq.).</text></subsection></section>
<enum>VI</enum><header>Authorization of appropriations</header>
