			 Act of 2008</short-title></quote>.</text>

			</subsection></section><section id="H28304EED15354120A3FE54784DCF124"><enum>2.</enum><header>Requirement that
			 manufacturers demonstrate sufficient means to cover, for certain products,
			 costs of potential recalls</header>
			<subsection id="H4D52D79D0D0C43C085F0397B499DC83"><enum>(a)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="H6B96CE03C3824935B917F11D117686CF"><enum>(1)</enum><header>Commerce</header><text>The
			 term <term>commerce</term> means trade, traffic, commerce, or
			 transportation—</text>
					<subparagraph id="H5AFA90B15D0541C3B6F200E26F4237E4"><enum>(A)</enum><text>between a place in
			 a State and any place outside thereof; or</text>
					</subparagraph><subparagraph id="H7D0967C8A294406DADEAA2CA3607BD"><enum>(B)</enum><text>which affects trade,
			 traffic, commerce, or transportation described in subparagraph (A).</text>
					</subparagraph></paragraph><paragraph id="HBC5160FF2EB1430D00FC5441E49F062E"><enum>(2)</enum><header>Covered
			 product</header><text>The term <term>covered product</term> means any of the
			 following:</text>
					<subparagraph id="HC88FEC65EC9C4DEB803B22FFB905DE6B"><enum>(A)</enum><text>Replacement
			 equipment, as such term is used in <external-xref legal-doc="usc" parsable-cite="usc/49/30102">section 30102</external-xref> of title 49, United States
			 Code.</text>
					</subparagraph><subparagraph id="H294F176CAD8845C488A1401DFC9FCF57"><enum>(B)</enum><text>Food, drugs,
			 devices, and cosmetics as such terms are defined in section 201 of the Federal
			 Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/321">21 U.S.C. 321</external-xref>).</text>
					</subparagraph><subparagraph id="H96AE2231F20C469B9294B249004327F2"><enum>(C)</enum><text>A biological
			 product as such term is defined in section 351(i) of the Public Health Service
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/42/262">42 U.S.C. 262(i)</external-xref>).</text>
					</subparagraph><subparagraph id="H88D4251842C54D3E839E71DB59107D8F"><enum>(D)</enum><text>A consumer
			 product, as such term is used in section 3(a) of the Consumer Product Safety
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2052">15 U.S.C. 2052</external-xref>).</text>
					</subparagraph><subparagraph id="HC27B2A1C541A4AAC86E2849DC992F8CB"><enum>(E)</enum><clause commented="no" display-inline="yes-display-inline" id="H5C6501B22B244C9B8BD3ECE58B440699"><enum>(i)</enum><text>Meat or meat food
			 product (within the meaning of the Federal Meat Inspection Act (21 U.S.C. 601
			 et seq.)).</text>
						</clause><clause id="HE75B727A895A4B56968063009926C92E" indent="up1"><enum>(ii)</enum><text>Poultry or poultry product (as
			 defined in section 4 of the Poultry Products Inspection Act (21 U.S.C.
			 453)).</text>
						</clause><clause id="HC88BFF4EDC87498C87877773CEAD2409" indent="up1"><enum>(iii)</enum><text>Egg or egg product (as defined in
			 section 4 of the Egg Products Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/1033">21 U.S.C. 1033</external-xref>)).</text>
						</clause></subparagraph></paragraph><paragraph id="H4040F01412B54A83B16513E707D138F8"><enum>(3)</enum><header>Distribute in
			 commerce</header><text>The term <term>distribute in commerce</term> means to
			 sell in commerce, to introduce or deliver for introduction into commerce, or to
			 hold for sale or distribution after introduction into commerce.</text>
				</paragraph><paragraph id="HBF4A88F3231E4A26BFE6F9E55182FE4"><enum>(4)</enum><header>Import</header><text>The
			 term <term>import</term> includes reimporting a covered product manufactured or
			 processed, in whole or in part, in the United States.</text>
				</paragraph><paragraph id="H871E55363C6A4D38A7A3BEA200E7EBFB"><enum>(5)</enum><header>Manufacturer</header><text>The
			 term <term>manufacturer</term> means any person who manufactures or imports a
			 covered product. A common carrier, contract carrier, or freight forwarder shall
			 not, for purposes of this Act, be deemed to be a manufacturer of a covered
			 product solely by reason of receiving or transporting a covered product in the
			 ordinary course of its business as such a carrier or forwarder.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H35255C61660C4BC7B5FC104CD9DE168F"><enum>(6)</enum><header>Recall</header><text>With
			 respect to a covered product, the term <term>recall</term> means the
			 following:</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H5A8462A4D05848D6A283026EAA8BA887"><enum>(A)</enum><text>In the case that
			 the Secretary of Transportation makes a determination under section 30118(b)(1)
			 of title 49, United States Code, that a covered product described in paragraph
			 (2)(A) contains a defect related to motor vehicle safety or does not comply
			 with an applicable motor vehicle safety standard prescribed under chapter 301
			 of such title, giving notification under section 30119 of such title and
			 remedying such defect or noncompliance under section 30120 of such
			 title.</text>
					</subparagraph><subparagraph id="H432FDC994EAC4DB9908212A568D72FE8"><enum>(B)</enum><text>In the case
			 of—</text>
						<clause id="H76AEBB920E59405F8D379D9411243DDF"><enum>(i)</enum><text>a
			 device, as defined in section 201 of the Federal Food, Drug, and Cosmetic Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/21/321">21 U.S.C. 321</external-xref>), an order under subsection (b)(1)(A) or (e) of section 518 of
			 such Act (21 U.S.C. 360h (b)(1)(A), (e));</text>
						</clause><clause id="H7CEB7488F4474CCDBF7C992216D80064"><enum>(ii)</enum><text>infant formula,
			 as such term is defined in section 201 of the Federal Food, Drug, and Cosmetic
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/21/321">21 U.S.C. 321</external-xref>), a recall of infant formula begun by a manufacturer of
			 infant formula that is carried out in accordance with section 412(f) of such
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/21/350a">21 U.S.C. 350a(f)</external-xref>); and</text>
						</clause><clause id="HB1362841FF534F8C9D06F2436C3CBF55"><enum>(iii)</enum><text>any other
			 covered product described in paragraph (2)(B), a recall of the covered product
			 by the manufacturer or distributor in response to an advisory or other alert
			 issued by the Commissioner of Food and Drugs that advises consumers to avoid
			 the covered product.</text>
						</clause></subparagraph><subparagraph id="H2A595FFF397E4227A300DC9B2D001144"><enum>(C)</enum><text>In the case of a
			 biological product, as defined in section 351(i) of the Public Health Service
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/42/262">42 U.S.C. 262(i)</external-xref>), an order under section 351(d) of such Act (42 U.S.C.
			 262(d)).</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H32CB04CB0F4B4A5997F116BAC8A8BB37"><enum>(D)</enum><text>In the case of a
			 covered product described in paragraph (2)(D), an action under subsection (c)
			 and (d) of section 15 of the Consumer Product Safety Act (15 U.S.C.
			 2064).</text>
					</subparagraph><subparagraph id="H9AA004A96531443CAC8B691B9FBD6E62"><enum>(E)</enum><text>In the case of a
			 covered product described in paragraph (2)(E), a recall of the covered product
			 under—</text>
						<clause id="H2E4CC1B5E8D44F96A733F833C88B6DF"><enum>(i)</enum><text>the
			 Federal Meat Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/601">21 U.S.C. 601 et seq.</external-xref>);</text>
						</clause><clause id="H2467064923C0494B97B0A3B400DF2B2B"><enum>(ii)</enum><text>the
			 Poultry Products Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/451">21 U.S.C. 451 et seq.</external-xref>); or</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="HB1CB9CE7E9554C13009D165687F200EF"><enum>(iii)</enum><text>the Egg Products
			 Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/1031">21 U.S.C. 1031 et seq.</external-xref>).</text>
						</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H7B907AC7A99B44E1843D96509D1F3948"><enum>(b)</enum><header>Financial
			 responsibility required</header>
				<paragraph id="HC3AD1813AF1E4B39A3F8E9996946D193"><enum>(1)</enum><header>In
			 general</header><text>Beginning on the date that is 2 years after the date of
			 the enactment of this Act, a manufacturer may not distribute in commerce a
			 covered product unless the manufacturer holds a recall responsibility
			 certificate described in paragraph (2) for such covered product.</text>
				</paragraph><paragraph id="HCDC42000A9D540FAB473A67B337B0095"><enum>(2)</enum><header>Recall
			 responsibility certificate</header><text>A recall responsibility certificate
			 described in this paragraph is a certification from the U.S. Customs and Border
			 Protection that a manufacturer possess sufficient means (through insurance or
			 otherwise), for the 5-year period beginning on the date the manufacturer begins
			 to distribute in commerce a covered product, to cover—</text>
					<subparagraph id="H4FB424E5EA4948BA96B43822772B8700"><enum>(A)</enum><text>the entire cost of
			 a recall of that product, including any administrative costs associated with
			 such recall; and</text>
					</subparagraph><subparagraph id="HA9EB9E608ABA455BBFCB365D2072C865"><enum>(B)</enum><text>compensatory
			 damages and costs (including reasonable attorneys fees) of any product
			 liability or other lawsuit filed for claims arising out of, relating to, or
			 resulting from any defect in that product.</text>
					</subparagraph></paragraph></subsection><subsection id="HA82B6A89E48C447B8C50EAF8DA987097"><enum>(c)</enum><header>Annual
			 report</header>
				<paragraph id="HFC100B3952F44862A549542B48E1A12"><enum>(1)</enum><header>In
			 general</header><text>Not later than 2 years after the date of the enactment of
			 this Act and each year thereafter, the Secretary of Homeland Security shall
			 submit to Congress a report on the implementation of this Act, including an
			 assessment of the comments received from the public in accordance with
			 paragraph (3).</text>
				</paragraph><paragraph id="HF9D3A1E990C44C229CC63D5D57D37A7"><enum>(2)</enum><header>Consultation</header><text>In
			 preparing the annual report required by paragraph (1), the Secretary of
			 Homeland Security shall consult with the following:</text>
					<subparagraph id="H98DBF35D507542F0928B13D00FCADB6"><enum>(A)</enum><text>The Secretary of
			 State.</text>
					</subparagraph><subparagraph id="HCB289EF172C8413BA663303F008B4971"><enum>(B)</enum><text>The Consumer
			 Product Safety Commission.</text>
					</subparagraph><subparagraph id="H57F0768D2F70457EB4CF79C4C84FDCC"><enum>(C)</enum><text>Secretary of Health
			 and Human Services.</text>
					</subparagraph><subparagraph id="H09C8EBC984D843B4BFDD2FB15998D7D1"><enum>(D)</enum><text>The Secretary of
			 Agriculture.</text>
					</subparagraph><subparagraph id="H09D5C7ED38BF41A685969BA3005CA4DA"><enum>(E)</enum><text>The Secretary of
			 Commerce.</text>
					</subparagraph></paragraph><paragraph id="H7D438E1E48F04382B72E07779FA1CC69"><enum>(3)</enum><header>Public
			 comments</header><text>In preparing the annual report required by paragraph
			 (1), the Secretary of Homeland Security shall solicit comments from the public
			 on the implementation of this Act.</text>
				</paragraph></subsection></section><section id="HEF0F516A24544611BCE40105033784F1"><enum>3.</enum><header>Notification,
			 nondistribution, and recall of adulterated or misbranded meat and meat food
			 products</header>
			<subsection id="H50CAC4152CB347EB88A459B11E152FBF"><enum>(a)</enum><header>In
			 general</header><text>The Federal Meat Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/601">21 U.S.C. 601 et seq.</external-xref>)
			 is amended—</text>
				<paragraph id="H0F8EB3E66CC84DD6B7152739F591524C"><enum>(1)</enum><text>by redesignating
			 section 411 (<external-xref legal-doc="usc" parsable-cite="usc/21/680">21 U.S.C. 680</external-xref>) as section 412; and</text>
				</paragraph><paragraph id="H7AAE456E3DAC4D3EB61E00E8DDB67C20"><enum>(2)</enum><text>by inserting after
			 section 410 (<external-xref legal-doc="usc" parsable-cite="usc/21/679a">21 U.S.C. 679a</external-xref>) the following:</text>
					<quoted-block display-inline="no-display-inline" id="HD6F69ED360B247F891D9988FBA4D7470" style="OLC">
						<section id="HEB9DE0ED09AB42AEAC328329E0D2EB00"><enum>411.</enum><header>Notification,
				nondistribution, and recall of adulterated or misbranded meat and meat food
				products</header>
							<subsection id="H368ECFD754CF499090F7323DD4855303"><enum>(a)</enum><header>Notification to
				secretary of violation</header>
								<paragraph id="H1AF8BC6B3188420E982709A6232E2046"><enum>(1)</enum><header>In
				general</header><text>A person (other than a household consumer) that has
				reason to believe that any carcass, part of a carcass, meat, or meat food
				product of cattle, sheep, swine, goats, horses, mules, or other equines
				(referred to in this section as an <quote>article</quote>) transported, stored,
				distributed, or otherwise handled by the person is adulterated or misbranded
				shall, as soon as practicable, notify the Secretary of the identity and
				location of the article.</text>
								</paragraph><paragraph id="HD4915D3AFC56452EB130B3AD866D59C7"><enum>(2)</enum><header>Manner of
				notification</header><text>Notification under paragraph (1) shall be made in
				such manner and by such means as the Secretary may require by
				regulation.</text>
								</paragraph></subsection><subsection id="H79271BE07B4E4267B4268CEB86399F9D"><enum>(b)</enum><header>Recall and
				consumer notification</header>
								<paragraph id="HDE7FEB050B244CBEBBFB1D7EE0006BA"><enum>(1)</enum><header>Voluntary
				actions</header><text>On receiving notification under subsection (a) or by
				other means, if the Secretary finds that an article is adulterated or
				misbranded and that there is a reasonable probability that human consumption of
				the article would present a threat to public health (as determined by the
				Secretary), the Secretary shall provide all appropriate persons (as determined
				by the Secretary), that transported, stored, distributed, or otherwise handled
				the article with an opportunity—</text>
									<subparagraph id="H9B6CB1FCCBBD45E1B23BF0F205A71C4C"><enum>(A)</enum><text>to cease
				distribution of the article;</text>
									</subparagraph><subparagraph id="H1675F982CEF949D68CFD8F75C2269C34"><enum>(B)</enum><text>to notify all
				persons that transport, store, distribute, or otherwise handle the article, or
				to which the article has been transported, sold, distributed, or otherwise
				handled, to cease immediately distribution of the article;</text>
									</subparagraph><subparagraph id="H1860EC90DEA6446698D5C0994B873B06"><enum>(C)</enum><text>to recall the
				article;</text>
									</subparagraph><subparagraph id="H3A533E66990B4B76938EBA38BB6D07BB"><enum>(D)</enum><text>in consultation
				with the Secretary, to provide notice of the finding of the Secretary to all
				consumers to which the article was, or may have been, distributed; or</text>
									</subparagraph><subparagraph id="H0A8C232E2FED42128595A16C9F3549F2"><enum>(E)</enum><text>to notify State
				and local public health officials.</text>
									</subparagraph></paragraph><paragraph id="H7BD467D829184EC58B2FAE79104ED83E"><enum>(2)</enum><header>Mandatory
				actions</header><text>If the appropriate person referred to in paragraph (1)
				does not carry out the actions described in that paragraph with respect to an
				article within the time period and in the manner prescribed by the Secretary,
				the Secretary—</text>
									<subparagraph id="H64E232F33E884B3987FF58003B459F66"><enum>(A)</enum><text>shall require the
				person—</text>
										<clause id="HFB03F3E097E4479AB4CA40A03512399D"><enum>(i)</enum><text>to
				immediately cease distribution of the article; and</text>
										</clause><clause id="HF6C4F93653D94CFE8E4BC161EB421341"><enum>(ii)</enum><text>to immediately
				make the notification described in paragraph (1)(B); and</text>
										</clause></subparagraph><subparagraph id="HC0D17DD4974D4BCAB5E857D127C35F81"><enum>(B)</enum><text>may take control
				or possession of the article.</text>
									</subparagraph></paragraph><paragraph id="H59EAB1FEE28943D48DC681353DAA069F"><enum>(3)</enum><header>Notice to
				consumers and health officials</header><text>The Secretary shall, as the
				Secretary determines to be necessary, provide notice of the finding of the
				Secretary under paragraph (1) to consumers to which the article was, or may
				have been, distributed and to appropriate State and local public health
				officials.</text>
								</paragraph><paragraph id="HEB1FAFF3BFAD40E6922878F97CBFE216"><enum>(4)</enum><header>Nondistribution
				by notified persons</header><text>A person that transports, stores,
				distributes, or otherwise handles the article, or to which the article has been
				transported, sold, distributed, or otherwise handled, and that is notified
				under paragraph (1)(B) or (2)(B) shall cease immediately distribution of the
				article.</text>
								</paragraph><paragraph id="H44582C61769442DA9C1DB789B8FDB381"><enum>(5)</enum><header>Availability of
				records to secretary</header><text>Each appropriate person referred to in
				paragraph (1) that transported, stored, distributed, or otherwise handled an
				article shall make available to the Secretary information necessary to carry
				out this subsection, as determined by the Secretary, regarding—</text>
									<subparagraph id="H1E87F841268744C1A0B8182F000098E3"><enum>(A)</enum><text>persons that
				transport, store, distribute, or otherwise handle the article; and</text>
									</subparagraph><subparagraph id="H9EC412B6F69640E49121A9B73EC67FD7"><enum>(B)</enum><text>persons to which
				the article has been transported, sold, distributed, or otherwise
				handled.</text>
									</subparagraph></paragraph></subsection><subsection id="HF9964C0BE0C2448691DA144C5C0081CC"><enum>(c)</enum><header>Informal
				hearings on orders</header>
								<paragraph id="HE4F93B49AA1F4A8AB9BD8B182BEFE89B"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall provide a person subject to an order
				under subsection (b) with an opportunity for an informal hearing (in accordance
				with such rules or regulations as the Secretary shall prescribe) on—</text>
									<subparagraph id="H1DA8EA8FE0A14A288DE16D7830EEBFD7"><enum>(A)</enum><text>the actions
				required by the order; and</text>
									</subparagraph><subparagraph id="HC8A723EA94384C54A61F47362E8C7010"><enum>(B)</enum><text>any reasons why
				the article that is the subject of the order should not be recalled.</text>
									</subparagraph></paragraph><paragraph id="H71452F11672A4F8984EFCAE19BDDB3F4"><enum>(2)</enum><header>Timing of
				hearings</header><text>The Secretary shall hold a hearing under paragraph (1)
				as soon as practicable, but not later than 2 business days, after the date of
				issuance of the order.</text>

				recall orders</header>
								<paragraph id="HBF04699230EC4759BB125794C8872711"><enum>(1)</enum><header>Amendment of
				orders</header><text>If, after providing an opportunity for an informal hearing
				under subsection (c), the Secretary determines that there is a reasonable
				probability that human consumption of the article that is the subject of an
				order under subsection (b) presents a threat to public health, the Secretary
				may, as the Secretary determines to be necessary—</text>
									<subparagraph id="H62950B07690142449CA5267759147C99"><enum>(A)</enum><text>amend the order
				under subsection (b)—</text>
										<clause id="HEB347E105C3D4E0B85006398552568B1"><enum>(i)</enum><text>to
				require recall of the article or other appropriate action; and</text>
										</clause><clause id="H6B6370D0C090470DA6C6F754FCEC24E"><enum>(ii)</enum><text>to
				specify a timetable during which the recall shall occur;</text>
										</clause></subparagraph><subparagraph id="HBC23064A8DC940E1001C04832BB8ED00"><enum>(B)</enum><text>require periodic
				reports to the Secretary describing the progress of the recall;</text>
									</subparagraph><subparagraph id="H09341A32F435477A9169A26806A6AE37"><enum>(C)</enum><text>provide notice of
				the recall to consumers to which the article was, or may have been,
				distributed; or</text>
									</subparagraph><subparagraph id="HD282506C777145218367A5107FE5BF8F"><enum>(D)</enum><text>take any
				combination of actions described in subparagraphs (A) through (C).</text>
									</subparagraph></paragraph><paragraph id="H811AD4F854C246CC8EDC9CC8F4D6DB74"><enum>(2)</enum><header>Vacation of
				orders</header><text>If, after providing an opportunity for an informal hearing
				under subsection (c), the Secretary determines that adequate grounds do not
				exist to continue the actions required by the order, the Secretary shall vacate
				the order.</text>
								</paragraph></subsection><subsection id="HCE7A962790144CE8BBAA4B9BE52B5730"><enum>(e)</enum><header>Remedies not
				exclusive</header><text>The remedies authorized by this section shall be in
				addition to any other remedies that may be
				available.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HFEA7D93C67644F32A961FC46BF51383"><enum>(b)</enum><header>Conforming
			 amendments</header>
				<paragraph id="H5F0A0B9B74D64DAE8C31CCC4855FE045"><enum>(1)</enum><text>Section 1 of the
			 Federal Meat Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/601">21 U.S.C. 601</external-xref>) is amended by adding at the end the
			 following:</text>

						<subsection id="HC24D9C02EEBF49BC934297F075D900BF"><enum>(x)</enum><header>Person</header><text>The
				term <term>person</term> means any individual, partnership, corporation,

			 Products Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/451">21 U.S.C. 451 et seq.</external-xref>) is amended—</text>
			<paragraph id="H9B5D7B289B2A47DC80D6287C7F239CDC"><enum>(1)</enum><text>in the first
			 sentence of section 5(c)(1) (<external-xref legal-doc="usc" parsable-cite="usc/21/454">21 U.S.C. 454(c)(1)</external-xref>)—</text>
				<subparagraph id="H876C69C2BB33444F88A61D866B8425B5"><enum>(A)</enum><text>by striking
			 <quote>, by thirty days prior to the expiration of two years after enactment of
			 the Wholesome Poultry Products Act,</quote>; and</text>
				</subparagraph><subparagraph id="H3C40A7A69CBF493D9EF4054064004246"><enum>(B)</enum><text>by striking
			 <quote>sections 1-4, 6-10, and 12-22 of this Act</quote> and inserting

				general</header><text>A person (other than a household consumer) that has
				reason to believe that any poultry or poultry product (referred to in this
				section as an <quote>article</quote>) transported, stored, distributed, or
				otherwise handled by the person is adulterated or misbranded shall, as soon as
				practicable, notify the Secretary of the identity and location of the
				article.</text>
							</paragraph><paragraph id="H977840BD32064574BA60039F46843919"><enum>(2)</enum><header>Manner of
				notification</header><text>Notification under paragraph (1) shall be made in
				such manner and by such means as the Secretary may require by
				regulation.</text>
							</paragraph></subsection><subsection id="H328D15EE4F044CD39EC27CA1D1C6A0D8"><enum>(b)</enum><header>Recall and
				consumer notification</header>
							<paragraph id="HC322795B7F3D48208845AD1033DB3C10"><enum>(1)</enum><header>Voluntary
				actions</header><text>On receiving notification under subsection (a) or by
				other means, if the Secretary finds that an article is adulterated or
				misbranded and that there is a reasonable probability that human consumption of
				the article would present a threat to public health (as determined by the
				Secretary), the Secretary shall provide all appropriate persons (as determined
				by the Secretary), that transported, stored, distributed, or otherwise handled
				the article with an opportunity—</text>
								<subparagraph id="H629A8F54A0AC4C79AE3802A9985BB743"><enum>(A)</enum><text>to cease
				distribution of the article;</text>
								</subparagraph><subparagraph id="H6EC01B28C8EE43E695A7D640D37601C4"><enum>(B)</enum><text>to notify all
				persons that transport, store, distribute, or otherwise handle the article, or
				to which the article has been transported, sold, distributed, or otherwise
				handled, to cease immediately distribution of the article;</text>
								</subparagraph><subparagraph id="H97F6D48338414E0BAD12C517F2DB4000"><enum>(C)</enum><text>to recall the
				article;</text>
								</subparagraph><subparagraph id="H60C2601602FF44D9817FA6AD5D726CA"><enum>(D)</enum><text>in consultation
				with the Secretary, to provide notice of the finding of the Secretary to all
				consumers to which the article was, or may have been, distributed; or</text>
								</subparagraph><subparagraph id="HD657A96C921C41D1B5C96687C0AD0026"><enum>(E)</enum><text>to notify State
				and local public health officials.</text>
								</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H278B6E16BFAA4BA5A0D0A3D7FE8081B6"><enum>(2)</enum><header>Mandatory
				actions</header><text>If the appropriate person referred to in paragraph (1)
				does not carry out the actions described in that paragraph with respect to an
				article within the time period and in the manner prescribed by the Secretary,
				the Secretary—</text>
								<subparagraph id="HC29076BD19D34E35BC4DBCDDEC64ED33"><enum>(A)</enum><text>shall require the
				person—</text>
									<clause id="HE60352B0A20C4EBC92F10068CB41FC36"><enum>(i)</enum><text>to
				immediately cease distribution of the article; and</text>
									</clause><clause id="H89FE6D2DDB5C451DA12039F779CB89F0"><enum>(ii)</enum><text>to immediately
				make the notification described in paragraph (1)(B); and</text>
									</clause></subparagraph><subparagraph id="H84A9D2507C754A569576A6FA697EAA08"><enum>(B)</enum><text>may take control
				or possession of the article.</text>
								</subparagraph></paragraph><paragraph id="HEBB9957042E74E0B9103617121D7CBD6"><enum>(3)</enum><header>Notice to
				consumers and health officials</header><text display-inline="yes-display-inline">The Secretary shall, as the Secretary
				determines to be necessary, provide notice of the finding of the Secretary
				under paragraph (1) to consumers to which the article was, or may have been,
				distributed and to appropriate State and local health officials.</text>
							</paragraph><paragraph id="HB706C1301A274A4E8DBDD3120031B7B1"><enum>(4)</enum><header>Nondistribution
				by notified persons</header><text>A person that transports, stores,
				distributes, or otherwise handles the article, or to which the article has been
				transported, sold, distributed, or otherwise handled, and that is notified
				under paragraph (1)(B) or (2)(B) shall cease immediately distribution of the
				article.</text>
							</paragraph><paragraph id="H5F4F47AD350D4C3996FE84E9DD3DF61"><enum>(5)</enum><header>Availability of
				records to secretary</header><text>Each appropriate person referred to in
				paragraph (1) that transported, stored, distributed, or otherwise handled an
				article shall make available to the Secretary information necessary to carry
				out this subsection, as determined by the Secretary, regarding—</text>
								<subparagraph id="HE7F89773213046368FFC81004F009C23"><enum>(A)</enum><text>persons that
				transport, store, distribute, or otherwise handle the article; and</text>
								</subparagraph><subparagraph id="HD236A1343D514D0286AC32EA4646A8F4"><enum>(B)</enum><text>persons to which
				the article has been transported, sold, distributed, or otherwise
				handled.</text>
								</subparagraph></paragraph></subsection><subsection id="HD9C9CB0515DE4E538C63001DCE38F5DE"><enum>(c)</enum><header>Informal
				hearings on orders</header>
							<paragraph id="H2EAD25B865EF4CDDBF92992D7C582240"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall provide a person subject to an order
				under subsection (b) with an opportunity for an informal hearing (in accordance
				with such rules or regulations as the Secretary shall prescribe) on—</text>
								<subparagraph id="HB17062ECF901430C88DDDFE448BF8497"><enum>(A)</enum><text>the actions
				required by the order; and</text>
								</subparagraph><subparagraph id="H1E61B894D38F4625A686D8F5B7BCC52"><enum>(B)</enum><text>any reasons why the
				article that is the subject of the order should not be recalled.</text>
								</subparagraph></paragraph><paragraph id="H5FA6F2FD824B431BB8020023DDB72A0"><enum>(2)</enum><header>Timing of
				hearings</header><text>The Secretary shall hold a hearing under paragraph (1)
				as soon as practicable, but not later than 2 business days, after the date of
				issuance of the order.</text>
							</paragraph></subsection><subsection id="H4D8D74A3B8024779979664E79D5F84E3"><enum>(d)</enum><header>Post-hearing
				recall orders</header>
							<paragraph id="HA8EC2FC5A1E34835BAF2DA8DF1EF9601"><enum>(1)</enum><header>Amendment of

				specify a timetable during which the recall shall occur;</text>
									</clause></subparagraph><subparagraph id="H0C90CA1429074ECCB599C2AA0045C7F6"><enum>(B)</enum><text>require periodic
				reports to the Secretary describing the progress of the recall; or</text>
								</subparagraph><subparagraph id="H26FB009DD3E54C41BC20BFAD2BADE2F6"><enum>(C)</enum><text>provide notice of
				the recall to consumers to which the article was, or may have been,
				distributed.</text>
								</subparagraph></paragraph><paragraph id="H9877DB1622334627AF5694B6F8425B3D"><enum>(2)</enum><header>Vacation of
				orders</header><text>If, after providing an opportunity for an informal hearing
				under subsection (c), the Secretary determines that adequate grounds do not

			 Inspection Act is amended by inserting after section 20 (<external-xref legal-doc="usc" parsable-cite="usc/21/1049">21 U.S.C. 1049</external-xref>) the
			 following:</text>

				reason to believe that any egg or egg product (referred to in this section as
				an <quote>article</quote>) transported, stored, distributed, or otherwise
				handled by the person is adulterated or misbranded shall, as soon as
				practicable, notify the Secretary of the identity and location of the
				article.</text>
						</paragraph><paragraph id="H64AB70F55C254282B30000DD5BD63E68"><enum>(2)</enum><header>Manner of
				notification</header><text>Notification under paragraph (1) shall be made in
				such manner and by such means as the Secretary may require by
				regulation.</text>
						</paragraph></subsection><subsection id="H8110C880F4594F23B21D545BCDFE99F4"><enum>(b)</enum><header>Recall and
				consumer notification</header>
						<paragraph id="H5CCBF5478AC54C7A83F131F24DEB7417"><enum>(1)</enum><header>Voluntary
				actions</header><text>On receiving notification under subsection (a) or by
				other means, if the Secretary finds that an article is adulterated or
				misbranded and that there is a reasonable probability that human consumption of
				the article would present a threat to public health (as determined by the
				Secretary), the Secretary shall provide all appropriate persons (as determined
				by the Secretary), that transported, stored, distributed, or otherwise handled
				the article with an opportunity—</text>
							<subparagraph id="HDCDF986FCFE942CDA21D06C253D63927"><enum>(A)</enum><text>to cease
				distribution of the article;</text>
							</subparagraph><subparagraph id="H1F88635804CB4A4C9D5325A68E962028"><enum>(B)</enum><text>to notify all
				persons that transport, store, distribute, or otherwise handle the article, or
				to which the article has been transported, sold, distributed, or otherwise
				handled, to cease immediately distribution of the article;</text>
							</subparagraph><subparagraph id="H026E8BE957594BFC9B815BE763329621"><enum>(C)</enum><text>to recall the
				article;</text>
							</subparagraph><subparagraph id="HF0EFC57EDAA24E6788522D66C55696BA"><enum>(D)</enum><text>in consultation
				with the Secretary, to provide notice of the finding of the Secretary to all
				consumers to which the article was, or may have been, distributed; or</text>
							</subparagraph><subparagraph id="H471EEC0F2F7F4B1EA15DC921D60021A6"><enum>(E)</enum><text>to notify State
				and local public health officials.</text>
							</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H88E8A46121A148AA9DE59C0001411744"><enum>(2)</enum><header>Mandatory
				actions</header><text>If the appropriate person referred to in paragraph (1)
				does not carry out the actions described in that paragraph with respect to an
				article within the time period and in the manner prescribed by the Secretary,
				the Secretary—</text>
							<subparagraph id="H2547B84C8B024DE1A46472DBB4385C78"><enum>(A)</enum><text>shall require the
				person—</text>
								<clause id="H5824F6BEF3A6409AB42C35EFD5F39E12"><enum>(i)</enum><text>to
				immediately cease distribution of the article; and</text>
								</clause><clause id="H24B62F8DD85E4E6E8E38AB23BAAC007B"><enum>(ii)</enum><text>to immediately
				make the notification described in paragraph (1)(B); and</text>
								</clause></subparagraph><subparagraph id="H0B2D6201892F400C912689A2A8220071"><enum>(B)</enum><text>may take control
				or possession of the article.</text>
							</subparagraph></paragraph><paragraph id="H1D16068DAB394C069F7FA84C6E84ED34"><enum>(3)</enum><header>Notice to
				consumers and health officials</header><text display-inline="yes-display-inline">The Secretary shall, as the Secretary
				determines to be necessary, provide notice of the finding of the Secretary
				under paragraph (1) to consumers to which the article was, or may have been,
				distributed and to appropriate State and local health officials.</text>
						</paragraph><paragraph id="H35968AFC9B3244C891302CC471F6818"><enum>(4)</enum><header>Nondistribution
				by notified persons</header><text>A person that transports, stores,
				distributes, or otherwise handles the article, or to which the article has been
				transported, sold, distributed, or otherwise handled, and that is notified
				under paragraph (1)(B) or (2)(B) shall cease immediately distribution of the
				article.</text>
						</paragraph><paragraph id="H33B96E119A0C4BAE850662F123320476"><enum>(5)</enum><header>Availability of
				records to secretary</header><text>Each appropriate person referred to in
				paragraph (1) that transported, stored, distributed, or otherwise handled an
				article shall make available to the Secretary information necessary to carry
				out this subsection, as determined by the Secretary, regarding—</text>
							<subparagraph id="HA690B2A295CE4429A274982EBA31C754"><enum>(A)</enum><text>persons that
				transport, store, distribute, or otherwise handle the article; and</text>
							</subparagraph><subparagraph id="H93B9D108D3BE4630A5FB9926F51C4E2B"><enum>(B)</enum><text>persons to which
				the article has been transported, sold, distributed, or otherwise
				handled.</text>
							</subparagraph></paragraph></subsection><subsection id="HDD668288A9B04B65A26F9541C8AE6188"><enum>(c)</enum><header>Informal
				hearings on orders</header>
						<paragraph id="H6341DF75853D47F9AE411438C42E4188"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall provide a person subject to an order
				under subsection (b) with an opportunity for an informal hearing (in accordance
				with such rules or regulations as the Secretary shall prescribe) on—</text>
							<subparagraph id="H6F80F1AED01A4F4EB01DDF4E19E3275E"><enum>(A)</enum><text>the actions
				required by the order; and</text>
							</subparagraph><subparagraph id="H95853439E37145CCB74EEF37B4C58414"><enum>(B)</enum><text>any reasons why
				the article that is the subject of the order should not be recalled.</text>
							</subparagraph></paragraph><paragraph id="H3D428FA7D399440D8FFCF200C4D82600"><enum>(2)</enum><header>Timing of
				hearings</header><text>The Secretary shall hold a hearing under paragraph (1)
				as soon as practicable, but not later than 2 business days, after the date of

				notify the Secretary of the identity and location of the article.</text>
						</paragraph><paragraph id="H3A36532614E94723AA9F35E70545BFE7"><enum>(2)</enum><header>Manner of
				notification</header><text>Notification under paragraph (1) shall be made in
				such manner and by such means as the Secretary may require by
				regulation.</text>
						</paragraph></subsection><subsection id="HEB8F7191A9E64B1098D0CF438DA0C1B9"><enum>(b)</enum><header>Recall and
				consumer notification</header>
						<paragraph id="HED06F19598F34D1C81AC43423FF54641"><enum>(1)</enum><header>Voluntary
				actions</header><text>On receiving notification under subsection (a) or by
				other means, if the Secretary finds that an article is adulterated or
				misbranded and that there is a reasonable probability that human consumption of
				the article would present a threat to public health (as determined by the
				Secretary), the Secretary shall provide all appropriate persons (as determined
				by the Secretary), that transported, stored, distributed, or otherwise handled
				the article with an opportunity—</text>
							<subparagraph id="HF292ED08390A4EF694D6AE7D156C9038"><enum>(A)</enum><text>to cease
				distribution of the article;</text>
							</subparagraph><subparagraph id="H98E3B7BC6D3549E0BE11B43B57B13086"><enum>(B)</enum><text>to notify all
				persons that transport, store, distribute, or otherwise handle the article, or
				to which the article has been transported, sold, distributed, or otherwise
				handled, to cease immediately distribution of the article;</text>
							</subparagraph><subparagraph id="H52160ADE9B4449ABAD89A9D1A463F1DA"><enum>(C)</enum><text>to recall the
				article;</text>
							</subparagraph><subparagraph id="H47603685859E4C1C84BD13A1B1FF66CF"><enum>(D)</enum><text>in consultation
				with the Secretary, to provide notice of the finding of the Secretary to all
				consumers to which the article was, or may have been, distributed; or</text>
							</subparagraph><subparagraph id="H46310D5553164A10B353236DD7786643"><enum>(E)</enum><text>to notify State
				and local public health officials.</text>
							</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H5AE6658159164A12B6B049EDAE323486"><enum>(2)</enum><header>Mandatory
				actions</header><text>If the appropriate person referred to in paragraph (1)
				does not carry out the actions described in that paragraph with respect to an
				article within the time period and in the manner prescribed by the Secretary,
				the Secretary—</text>
							<subparagraph id="HEEAAD222AF2D4A739E1DDA6B7FB09594"><enum>(A)</enum><text>shall require the
				person—</text>
								<clause id="HC2FDF2104D33475F9448D75C7DC89C99"><enum>(i)</enum><text>to
				immediately cease distribution of the article; and</text>
								</clause><clause id="HEBF018FED6FF496DABEEA941800575C"><enum>(ii)</enum><text>to
				immediately make the notification described in paragraph (1)(B); and</text>
								</clause></subparagraph><subparagraph id="H20B036E2234D4CE3B7E3FA5B289E3171"><enum>(B)</enum><text>may take control
				or possession of the article.</text>
							</subparagraph></paragraph><paragraph id="HE587461C8E444AD89B332007B9F020E"><enum>(3)</enum><header>Notice to
				consumers and health officials</header><text display-inline="yes-display-inline">The Secretary shall, as the Secretary
				determines to be necessary, provide notice of the finding of the Secretary
				under paragraph (1) to consumers to which the article was, or may have been,
				distributed and to appropriate State and local health officials.</text>
						</paragraph><paragraph id="H8EA3C1E9246F472989465EA771D32E14"><enum>(4)</enum><header>Nondistribution
				by notified persons</header><text>A person that transports, stores,
				distributes, or otherwise handles the article, or to which the article has been
				transported, sold, distributed, or otherwise handled, and that is notified
				under paragraph (1)(B) or (2)(A)(ii) shall cease immediately distribution of
				the article.</text>
						</paragraph><paragraph id="HA6FC4253F21448500014449711105CBC"><enum>(5)</enum><header>Availability of
				records to secretary</header><text>Each appropriate person referred to in
				paragraph (1) that transported, stored, distributed, or otherwise handled an
				article shall make available to the Secretary information necessary to carry
				out this subsection, as determined by the Secretary, regarding—</text>
							<subparagraph id="H3EA8DE90F67B4D6E9E4EC200004713A9"><enum>(A)</enum><text>persons that
				transport, store, distribute, or otherwise handle the article; and</text>
							</subparagraph><subparagraph id="HF7B85AB712134A8893B6F2B15FB4155"><enum>(B)</enum><text>persons to which
				the article has been transported, sold, distributed, or otherwise
				handled.</text>
							</subparagraph></paragraph></subsection><subsection id="H6B33B3E4478E4413AEFD5F636050E367"><enum>(c)</enum><header>Informal
				hearings on orders</header>
						<paragraph id="H35DFA46083984FEDAC82045BB7D597FA"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall provide a person subject to an order
				under subsection (b) with an opportunity for an informal hearing (in accordance
				with such rules or regulations as the Secretary shall prescribe) on—</text>
							<subparagraph id="H656F23137B4845DD8838D549067B7E17"><enum>(A)</enum><text>the actions
				required by the order; and</text>
							</subparagraph><subparagraph id="H240ECE724B384777942FE41C50C03E3E"><enum>(B)</enum><text>any reasons why
				the article that is the subject of the order should not be recalled.</text>
							</subparagraph></paragraph><paragraph id="H1E1C47871612475584C8E062F85BF3C"><enum>(2)</enum><header>Timing of
				hearings</header><text>The Secretary shall hold a hearing under paragraph (1)
				as soon as practicable, but not later than 2 business days, after the date of
				issuance of the order.</text>
						</paragraph></subsection><subsection id="H07900AFCAFC045248713CAABB9F28B"><enum>(d)</enum><header>Post-hearing
				recall orders</header>
						<paragraph id="H5D73FC0862C145FB8056E0126EB2C6C2"><enum>(1)</enum><header>Amendment of
				orders</header><text>If, after providing an opportunity for an informal hearing
				under subsection (c), the Secretary determines that there is a reasonable
				probability that human consumption of the article that is the subject of an
				order under subsection (b) presents a threat to public health, the Secretary
				may, as the Secretary determines to be necessary—</text>
							<subparagraph id="HFE39C592A78F46A1916100D6D5BC2AD"><enum>(A)</enum><text>amend the order
				under subsection (b)—</text>
								<clause id="HA7E3474A3E564FB0AD26BBC3748708C8"><enum>(i)</enum><text>to
				require recall of the article or other appropriate action; and</text>
								</clause><clause id="HA9CD7E6B9A5A4B15BCEFCE50E003D5DF"><enum>(ii)</enum><text>to specify a
				timetable during which the recall shall occur;</text>
								</clause></subparagraph><subparagraph id="H09C88D04669E44B8ACBF98E3D4FA9D02"><enum>(B)</enum><text>require periodic
				reports to the Secretary describing the progress of the recall; or</text>
							</subparagraph><subparagraph id="H7C9C728A31B342D192313F00009D91DD"><enum>(C)</enum><text>provide notice of
				the recall to consumers to which the article was, or may have been,
				distributed.</text>
							</subparagraph></paragraph><paragraph id="HFAD1CCBEFCBA4D1484B52685E5C9D18"><enum>(2)</enum><header>Vacation of
				orders</header><text>If, after providing an opportunity for an informal hearing
				under subsection (c), the Secretary determines that adequate grounds do not
				exist to continue the actions required by the order, the Secretary shall vacate
				the order.</text>
						</paragraph></subsection><subsection id="HD711471BDE2645E4A9EADB3C7C56BA44"><enum>(e)</enum><header>Remedies not
				exclusive</header><text>The remedies authorized by this section shall be in
				addition to any other remedies that may be
				available.</text>
