<section id="H69438B24BB5C4358A521887B635CF2A6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Debbie Smith Reauthorization Act of 2008</short-title></quote>.</text></section> 
<section id="HDE48F1D3C3824AB48648F1CB1E433BC"><enum>2.</enum><header>Reauthorization of the Debbie Smith DNA Backlog Grant Program</header> 
<subsection id="HB94A5A7B2FE84723894CC56B2D005687"><enum>(a)</enum><header>Amendments</header><text display-inline="yes-display-inline">Section 2 of the DNA Analysis Backlog Elimination Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/14135">42 U.S.C. 14135</external-xref>) is amended—</text> 
<paragraph id="H6C5900774C714D86919080F8266D4D60"><enum>(1)</enum><text>in subsection (a)—</text> 
<subparagraph id="H11CE62419635438583BEDB48580512F4"><enum>(A)</enum><text>by redesignating paragraphs (3) through (5) as paragraphs (4) through (6), respectively;</text></subparagraph> 
<subparagraph id="HC3A26C3DE8AA4D28A2C4BC1CD4249D38"><enum>(B)</enum><text>by inserting after paragraph (2) the following new paragraph:</text>

<paragraph id="HEADF7B70E6CB42BEB40002C69FE9268B"><enum>(3)</enum><text display-inline="yes-display-inline">To carry out, for inclusion in such Combined DNA Index System, DNA analyses of samples from missing or unidentified persons, including samples from the remains, personal effects, or biological relatives of such persons.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="HC53ACC2BC3B14B94AAAA199F75001109"><enum>(C)</enum><text>in paragraph (4) (as redesignated by subparagraph (A)), by striking <quote>paragraph (1) or (2)</quote> and inserting <quote>paragraph (1), (2), or (3)</quote>; and</text></subparagraph> 
<subparagraph id="H4810A0463B6A47C3BF987F5BFE2F7194" commented="no"><enum>(D)</enum><text>in paragraph (5) (as so redesignated), by striking <quote>in paragraph (1)</quote> and inserting <quote>in paragraphs (1) and (3)</quote>; </text></subparagraph></paragraph>

<paragraph id="HF6EBB04AE5044CFF970076B87D81C9C0"><enum>(8)</enum><text display-inline="yes-display-inline">provide assurances that the State or unit of local government has implemented, or will implement not later than 2 years after the date of such application, a process under which the State or unit, respectively, provides for the collection, for purposes of inclusion in the Combined DNA Index System of the Federal Bureau of Investigation, of DNA samples from all felons who are imprisoned in a prison of such State or unit, respectively, (including all felons imprisoned in such prison or unit, respectively, as of the date of the enactment of the Debbie Smith Reauthorization Act of 2008).</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph commented="no" id="HDAD89AFF91104FB58D93D22FDF425574"><enum>(3)</enum><text>in subsection (c)(3)—</text> 
<subparagraph commented="no" id="H1FD92D5161114591AD56A8E32DFC4B"><enum>(A)</enum><text>by striking subparagraphs (A) through (D);</text></subparagraph> 
<subparagraph commented="no" id="H4C468DF1535A4DCAAEF33008308DF6E"><enum>(B)</enum><text>by redesignating subparagraph (E) as subparagraph (A); and</text></subparagraph> 
<subparagraph commented="no" id="H5FAC9FE42DBB4FD6880718CD17C741E6"><enum>(C)</enum><text>by inserting after subparagraph (A) (as so redesignated) the following new subparagraph:</text>

<subparagraph commented="no" id="H6FC5CE9B74F6432A8F62CB4DA52014AE"><enum>(B)</enum><text display-inline="yes-display-inline">For each of the fiscal years 2010 through 2014, not less than 40 percent of the grant amounts shall be awarded for purposes under subsection (a)(2) of this section.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H4C3D7017ACC04865A8A621B9AD55B400"><enum>(4)</enum><text>by amending subsection (j) to read as follows:</text>

<subsection id="HC4C280A6A56A4E7EA9FF9EA3DFEB30E7"><enum>(j)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to the Attorney General for grants under subsection (a)—</text> 
<paragraph id="H57B64CDFDA034966BFFD838B33A5D3B4"><enum>(1)</enum><text>$151,000,000 for fiscal year 2009; and</text></paragraph> 
<paragraph id="H76011998429F49C08B431BA100EFE564"><enum>(2)</enum><text>$200,000,000 for each of the fiscal years 2010 through 2014.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HEB5F65B7D72348E500CD69B332ACE11E"><enum>(b)</enum><header>Effective date</header><text>The amendments made by paragraph (2) of <internal-xref idref="HB94A5A7B2FE84723894CC56B2D005687" legis-path="2.(a)">subsection (a)</internal-xref> shall apply to grants made on or after January 1, 2009.</text></subsection></section> 
<section id="H054A45DBEB814998B2A36171E3CC9375"><enum>3.</enum><header>Study to assess the DNA analysis backlog</header> 
<subsection id="H1246559B1B2B4A42B4CCEEFF9BA452C9"><enum>(a)</enum><header>Sense of Congress</header><text display-inline="yes-display-inline">It is the sense of Congress that—</text> 
<paragraph id="HF852676DC000461CAF8F040119008886"><enum>(1)</enum><text>despite the funding provided for more than 5 fiscal years by the Federal Government to assist in the reduction of the DNA analysis backlog, the backlog continues to exist in many crime laboratories around the country; </text></paragraph> 
<paragraph id="H79755B58317D482892B93002EAD00B8"><enum>(2)</enum><text>as a consequence of the continuance of the DNA analysis backlog, many violent crimes that could be solved remain unsolved, and individuals who have been wrongfully convicted who could be determined to be innocent through DNA testing remain in prison; and</text></paragraph> 
<paragraph id="HEAB3792F4B0F4CDFB1DB2F00FEF8D9DC"><enum>(3)</enum><text>the causes of the DNA analysis backlog are complex and require a thorough and detailed study.          </text></paragraph></subsection> 
<subsection id="H3C071FBE7E114C9B8904C5DBDAF6B08C"><enum>(b)</enum><header>Study required</header><text display-inline="yes-display-inline">The National Academy of Sciences shall, in consultation with no fewer than 3 forensic science practitioners from States and units of local government, conduct a study to determine the resources and other requirements necessary to eliminate the DNA analysis backlog and to prevent such a backlog from reoccurring after it has been eliminated. </text></subsection> 
<subsection id="HDC8A527AEF4A4035AC04A21E604104ED"><enum>(c)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this Act, the National Academy of Sciences shall submit to the Attorney General and to Congress a report on the results of the study conducted under <internal-xref idref="H3C071FBE7E114C9B8904C5DBDAF6B08C" legis-path="3.(b)">subsection (b)</internal-xref>. </text></subsection> 
<subsection id="HBA2CC8936A734C5CB77B00D8A97418F4"><enum>(d)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $2,000,000 for fiscal year 2009.</text></subsection></section> 
<section id="H8273516E19D84F6C9BCCD7EF57EFA35F" commented="no"><enum>4.</enum><header>Incentives for permanent State-generated DNA funding streams</header> 
<subsection id="H1CB3B50B48AA4D2D964BEA12BF60489" commented="no"><enum>(a)</enum><header>Matching funds</header><text>For each fiscal year beginning after the date of the enactment of this Act, each eligible DNA funding State, with respect to a funding mechanism described in <internal-xref idref="HDABBF04109AF412981EB3BEF8994616B" legis-path="10.(b)">subsection (b)</internal-xref> implemented by such State, shall be eligible for Federal matching funds to carry out such mechanism in an amount determined to be appropriate by the Attorney General.</text></subsection> 
<subsection id="HDABBF04109AF412981EB3BEF8994616B" commented="no"><enum>(b)</enum><header>Eligible DNA funding States described</header><text>For purposes of this section, the term <term>eligible DNA funding State</term> means a State that demonstrates to the satisfaction of the Attorney General that the State has implemented (and applies) a permanent funding mechanism that generates funds, whether by fees or penalties, that are allocated by the State only for purposes of the analysis of DNA samples for law enforcement purposes. </text></subsection> 
<subsection id="H2DFBDF3575614BE7A5EB78E54E3C6841" commented="no"><enum>(c)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section such sums as may be necessary for each of the fiscal years 2009 through 2013.</text></subsection></section> 
<section id="HA5D9145834914D17B303006D97297E8E"><enum>5.</enum><header>Evaluation of DNA integrity and security</header> 
<subsection id="HF5DE16BBB6274B278D46AE302496BA84"><enum>(a)</enum><header>Evaluation</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this Act, and annually thereafter, the Attorney General shall evaluate the integrity and security of DNA collection and storage practices and procedures at a sample of crime laboratories in the United States to determine the extent to which DNA samples are tampered with or are otherwise contaminated in crime laboratories. Such sample shall be a representative sample of crime laboratories in the United States.</text></subsection> 
<subsection id="H4E50B33A2FAA4299A6EC9D00D3B48494"><enum>(b)</enum><header>Report</header><text>The Attorney General shall annually report to Congress the findings of the evaluation conducted under <internal-xref idref="HF5DE16BBB6274B278D46AE302496BA84" legis-path="9.(a)">subsection (a)</internal-xref>.</text></subsection> 
<subsection id="HA3087DA0C52847D190525EEBCFC545CB"><enum>(c)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $10,000,000 for each of the fiscal years 2009 through 2015.</text></subsection></section> 
<section id="H63E60DBFB9A04B349BAEAB6B6C0028E3" commented="no"><enum>6.</enum><header>Incentives for States to collect DNA samples from individuals arrested for or charged with murder and sex crimes</header> 
<subsection id="H36A1AAF16D4E44A685E6001794A0CCCD" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In the case of a State that receives funds for a fiscal year under subpart 1 of part E of title I of the Omnibus Crime Control and Safe Streets Act of 1968 and that has an implemented enhanced State DNA collection process for such year, the amount of funds that would otherwise be allocated for that fiscal year to the State under such subpart shall be increased by 10 percent.</text></subsection> 
<subsection id="HEB8F0F77F0374004AEB86FD406F78CB7" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Enhanced State DNA collection process defined</header><text display-inline="yes-display-inline">For purposes of this section, the term <term>enhanced State DNA collection process</term> means, with respect to a State, a process under which the State provides for the collection, for purposes of inclusion in the Combined DNA Index System of the Federal Bureau of Investigation, of DNA samples from the following individuals who are at least 18 years of age: </text> 
<paragraph id="H4A95011722EA4F35B48CFA8C4396F93D" commented="no"><enum>(1)</enum><text>Such individuals who are arrested for or charged with a criminal offense under State law that consists of murder or voluntary manslaughter or any attempt to commit murder or voluntary manslaughter.</text></paragraph> 
<paragraph id="H732AD9AE419D410CA0635BE370C11606"><enum>(2)</enum><text display-inline="yes-display-inline">Such individuals who are arrested for or charged with a criminal offense under State law that has an element involving a sexual act or sexual contact with another and that is punishable by imprisonment for more than 1 year, or an attempt to commit such an offense.</text></paragraph> 
<paragraph id="H733FEAAD4C7B4CBDADF666A699F193E4" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">Such individuals who are arrested for or charged with a criminal offense under State law that consists of a specified offense against a minor (as defined in section 111(7) of the Sex Offender Registration and Notification Act (<external-xref legal-doc="usc" parsable-cite="usc/42/16911">42 U.S.C. 16911(7)</external-xref>)), or an attempt to commit such an offense.</text></paragraph><continuation-text continuation-text-level="subsection">The expungement requirements under section 210304(d) of the DNA Identification Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/42/14132">42 U.S.C. 14132(d)</external-xref>) shall apply to any samples collected pursuant to this section for purposes of inclusion in the Combined DNA Index System.</continuation-text></subsection> 
<subsection id="HA2CA3883FD5544A6A76E901496B04711" commented="no"><enum>(c)</enum><header>Effective date</header><text display-inline="yes-display-inline">The provisions of this section shall apply to grants made on or after the date of the enactment of this Act.</text></subsection> 
<subsection id="HC12DD5771BAC470799ABF66431E56E39"><enum>(d)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated, in addition to funds made available under section 508 of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3758">42 U.S.C. 3758</external-xref>), such sums as may be necessary to carry out this section for each of the fiscal years 2009 through 2013.</text></subsection></section> 
<section id="H8F862AE98B1F4D34A8061BC886E46BD4"><enum>7.</enum><header>Additional study and report on investigations and prosecutions related to CODIS <quote>hits</quote></header> 
<subsection id="H253DE31B1D43448BAE84534C234BC55C"><enum>(a)</enum><header>Study</header><text>The Inspector General of the Department of Justice shall carry out a study on—</text> 
<paragraph id="H3AB7599578F94F3898EC1E6D2DDFC115"><enum>(1)</enum><text display-inline="yes-display-inline">the number of instances in which DNA samples that are matched with samples included in the Combined DNA Index System database of the Federal Bureau of Investigation that are followed up on by appropriate law enforcement entities;</text></paragraph> 
<paragraph id="H810D267BCD1F4FDCBC115C949C910610"><enum>(2)</enum><text>the number of such matches described in <internal-xref idref="H3AB7599578F94F3898EC1E6D2DDFC115" legis-path="7.(a)(1)">paragraph (1)</internal-xref> that are brought to the attention of a prosecutor; </text></paragraph> 
<paragraph id="HA35851C1F84147A8BB2E7BB1A0953F6C"><enum>(3)</enum><text>the number of the investigations described in <internal-xref idref="H810D267BCD1F4FDCBC115C949C910610" legis-path="7.(a)(2)">paragraph (2)</internal-xref> that result in a trial; and</text></paragraph> 
<paragraph id="H369E28A48EDB4CD1A44EA9366D7E762C"><enum>(4)</enum><text>in the case of matches described in <internal-xref idref="H3AB7599578F94F3898EC1E6D2DDFC115" legis-path="7.(a)(1)">paragraph (1)</internal-xref> that were not followed up on by appropriate law enforcement entities, were not brought to the attention of a prosecutor, or did not result in a trial—</text> 
<subparagraph id="HE507AB28F8204B7DAD045C9B25214513"><enum>(A)</enum><text>the reasons why such matches were not pursued accordingly; and</text></subparagraph> 
<subparagraph id="H642932EC3965441192D44163C0AB228"><enum>(B)</enum><text>the resulting impact on the criminal justice system, including whether other crimes were committed that could have been prevented if such matches had been pursued accordingly.</text></subparagraph></paragraph></subsection> 
<subsection id="H651054C50F2E4C2A9500465D6D19E3B"><enum>(b)</enum><header>Report</header><text>Not later than one year after the date of the enactment of this Act, the Inspector General shall submit to Congress a report on the study under <internal-xref idref="H253DE31B1D43448BAE84534C234BC55C" legis-path="7.(a)">subsection (a)</internal-xref>.</text></subsection></section> 
<section id="HD9CF05E2324645AAA02258EEC3B500FB" commented="no"><enum>8.</enum><header>National DNA Index System Advisory Board</header><text display-inline="yes-display-inline"></text> 
<subsection id="H5AACEE0960D44A04A5A5E4038E11C1E1" commented="no"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Attorney General shall establish the National DNA Index System Advisory Board (in this section referred to as the <quote>NDIS Advisory Board</quote> to develop and, if appropriate, periodically revise standards and requirements for the use of and access to the index described in section 210304(a) of the DNA Identification Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/42/14132">42 U.S.C. 14132(a)</external-xref>).</text></subsection> 
<subsection id="H0C7257762E80498D97C25D8289B76DB6" commented="no"><enum>(b)</enum><header>Membership</header><text>Not later than 30 days after the date of the enactment of this Act, the Director of the Federal Bureau of Investigation shall appoint members to the NDIS Advisory Board as follows:</text> 
<paragraph id="HA1161C86B7274AFDB8A370117E3B179E" commented="no"><enum>(1)</enum><text>At least 4 directors of State or local forensic laboratories.</text></paragraph> 
<paragraph id="H89EBD6AB5AF5429CA0E139509C45B318" commented="no"><enum>(2)</enum><text>One representative from the Federal Bureau of Investigation.</text></paragraph> 
<paragraph id="H834CC5A5D860480F82A4EF892FB95B4B" commented="no"><enum>(3)</enum><text>One representative from the Scientific Working Group on DNA Analysis Methods.</text></paragraph> 
<paragraph id="H85AEAF5184384CB08DCE85DA9DCA646" commented="no"><enum>(4)</enum><text>One representative from the Office of Legal Policy of the Department of Justice.</text></paragraph> 
<paragraph id="H5B6D28D8E20445ED00BDEEF3AC1DC672" commented="no"><enum>(5)</enum><text display-inline="yes-display-inline">One representative from the National Institute of Justice.</text></paragraph> 
<paragraph id="H64B9106164FD41C29FE5C44896C90035"><enum>(6)</enum><text>One representative from the National Academies of Science.</text></paragraph> 
<paragraph id="HAEC7695A6ABE41A49229E5FA58A7C612"><enum>(7)</enum><text>One State or local prosecutor.</text></paragraph> 
<paragraph id="H0520CFEED2A948EFAB06BB0004ACEA29" commented="no"><enum>(8)</enum><text>One criminal defense attorney.</text></paragraph> 
<paragraph id="H5140AAE30EA64B52826EA3D21887530"><enum>(9)</enum><text>One representative from the National Institute of Standards and Technology.</text></paragraph> 
<paragraph id="H57D9E1B5F9A34D3591F2966D3CBA57C8"><enum>(10)</enum><text>One member of the academic community who specializes in DNA privacy issues.</text></paragraph> 
<paragraph id="H605576B185EE4C32A2C958B1D5445FA"><enum>(11)</enum><text>One crime victim or crime victim advocate.</text></paragraph> 
<paragraph id="HA79C240019704111916C9FC8BA239496"><enum>(12)</enum><text>One representative of a State police agency.</text></paragraph> 
<paragraph id="HE0BAD5739D0146098E8D00FF88A2D416"><enum>(13)</enum><text>One representative of a local police agency.</text></paragraph></subsection> 
<subsection id="H75AD388ED01A4811A3F19FC64B19EFDA" display-inline="no-display-inline"><enum>(c)</enum><header>Application of FACA</header><text display-inline="yes-display-inline">The <act-name parsable-cite="FACA">Federal Advisory Committee Act</act-name> (5 U.S.C. App.), other than section 14 of such Act, shall apply to the NDIS Advisory Board.</text></subsection> 
<subsection id="H42EDF48A93FF4139922F549E8B7F97F" display-inline="no-display-inline"><enum>(d)</enum><header>Notice, comment, and publication</header><text display-inline="yes-display-inline">The Attorney General shall provide for public notice and comment for each standard developed under this section and for publication of each such standard.</text></subsection> 
<subsection id="H9E5E16F694084C40992594CD7E2195DE"><enum>(e)</enum><header>Pay and reimbursement</header> 
<paragraph id="HF6869E25E68649A8BAD748C81905BF4E"><enum>(1)</enum><header>No compensation for members of NDIS Advisory Board</header><text>Except as provided in <internal-xref idref="H5D5CED96737E4BDA94D9DE7C91BB5FC6" legis-path="6.(e)(2)">paragraph (2)</internal-xref>, a member of the NDIS Advisory Board may not receive pay, allowances, or benefits by reason of their service on the Board.</text></paragraph> 
<paragraph id="H5D5CED96737E4BDA94D9DE7C91BB5FC6" commented="no"><enum>(2)</enum><header>Travel expenses</header><text>Each member shall receive travel expenses, including per diem in lieu of subsistence under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code.</text></paragraph></subsection> 
<subsection id="HA8033EE205C541EE8800A8093069F5EA" commented="no"><enum>(f)</enum><header>Quality assurance standards</header> 
<paragraph id="H99476333C02C421A8D76EC982F95D06E" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the NDIS Advisory Board shall develop (and provide recommendations to the Director of the Federal Bureau of Investigation on) standards governing the use of and access to the index described in subsection (a). The NDIS Advisory Board shall periodically update such standards as appropriate. The standards shall provide for the expedited uploading into such index by State and local forensic laboratories of DNA analyses of samples obtained from persons convicted of crimes, including such analyses processed by private forensic laboratories. </text></paragraph> 
<paragraph id="H32996D8A5B8B4190800690DE03FA7837" commented="no"><enum>(2)</enum><header>Consideration of additional proposals to expedite processing and uploading of DNA samples</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this Act, the NDIS Advisory Board shall also provide recommendations to the Director of the Federal Bureau of Investigation on the following:</text> 
<subparagraph id="H869CF9AB4BE345A7ABAE473E12167BAF"><enum>(A)</enum><text>The feasibility and desirability of entering into agreements with private forensic laboratories to enable direct access to the Combined DNA Index System of the Federal Bureau of Investigation for the purpose of uploading DNA analyses of samples obtained from persons convicted of crimes.</text></subparagraph> 
<subparagraph id="HA820541FD77944528C3500E975BBBCA9" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">The feasibility and desirability of providing for more limited technical review audits of DNA analyses of samples prior to uploading such data into the Combined DNA Index System.</text></subparagraph> 
<subparagraph id="H5C46C4F4CCA7406C00F4E1DBE908002D" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">The feasibility and desirability of permitting greater participation in the technical review of DNA analyses of samples by contractor personnel.</text></subparagraph> 
<subparagraph id="H3E9A2D20EE354F32A48539A584BD42D"><enum>(D)</enum><text>The feasibility and desirability of allowing immediate upload of DNA profiles obtained from crime scene samples and rape kits. </text></subparagraph></paragraph> 
<paragraph id="HC72CB8707FB5414DABE3A8DE6E8F1FED"><enum>(3)</enum><header>Issuance of policies, procedures, and standards</header><text>The Director of the Federal Bureau of Investigation, with the approval of the Attorney General, after taking into consideration the recommended policies, procedures, and standards recommended by the NDIS Advisory Board under this section shall issue (and revise from time to time) policies, procedures, and standards relating to the administration of the National DNA Index System including, standards for quality assurance, testing the proficiency of forensic laboratories, and forensic analysts, in conducting analyses of DNA. </text></paragraph></subsection> 
<subsection id="HA125231CC23F467B006657AE0458C53D"><enum>(g)</enum><header>Exclusivity of policies, procedures, and standards</header><text>The policies, procedures, and standards issued under <internal-xref idref="HC72CB8707FB5414DABE3A8DE6E8F1FED" legis-path="6.(f)(3)">subsection (f)(3)</internal-xref> shall be the exclusive policies, procedures, and standards issued with respect to State, local, and private laboratories that participate in the National DNA Index System. Polices, procedures, laboratory audit requirements, standards, and any other manner of regulation or control (other than any condition imposed pursuant to a grant awarded through the Department of Justice) may not be inconsistent with, or expand upon provisions contained in such approved policies, procedures, or standards.</text></subsection></section> 
<section id="H5EBEDCFDEFFC447289C0F2EE6F6B236C"><enum>9.</enum><header>DNA technology enhancement grants</header> 
<subsection id="H79B0F319B702485300002467BEDE7768"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Attorney General shall establish a grant program under which the Attorney General may make grants to States and units of local government to purchase forensic DNA technology or to improve such technology.</text></subsection> 
<subsection id="H0B52DAEED058400D94EECAA73CB6F03D"><enum>(b)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated $50,000,000 for each of the fiscal years 2009 through 2013 to carry out <internal-xref idref="H79B0F319B702485300002467BEDE7768" legis-path="5.(a)">subsection (a)</internal-xref>.</text></subsection></section>

<subsection id="H63EA2F8510944BF78F3038DD8E2561E5"><enum>(a)</enum><header>DNA training and education for law enforcement, correctional personnel, and court officers</header><text display-inline="yes-display-inline">Section 303(b) of the Justice For All Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/42/14136">42 U.S.C. 14136(b)</external-xref>) is amended by striking <quote>2009</quote> and inserting <quote>2014</quote>.</text></subsection> 
<subsection id="HFE47A199A01B4E6D80B5FB98B0C8B500"><enum>(b)</enum><header>Sexual assault forensic exam program grants</header><text>Section 304(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/14136a">42 U.S.C. 14136a(c)</external-xref>) is amended by striking <quote>2009</quote> and inserting <quote>2014</quote>.</text></subsection>
