		<legis-type>A BILL</legis-type>
		<official-title>To amend the Controlled Substances Act and the Controlled
		  Substances Import and Export Act to eliminate increased penalties for cocaine
		  offenses where the cocaine involved is cocaine base, to eliminate minimum
		  mandatory penalties for offenses involving cocaine, to use the resulting
		  savings to provide drug treatment and diversion programs for cocaine users, and
		  for other purposes.</official-title>

		<section id="H6CA5F998E6964D4B98D60049B7747F54" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Fairness in Cocaine Sentencing Act of
			 2008</short-title></quote>.</text>
		</section><section id="H82CB03CF32C14C828DF055AE69CDE750"><enum>2.</enum><header>Elimination of
			 increased penalties for cocaine offenses where the cocaine involved is cocaine
			 base</header>
			<subsection id="HAA8A412AE4B3457BB09EBB28BF60954C"><enum>(a)</enum><header>Controlled
			 Substances Act</header><text display-inline="yes-display-inline">The following
			 provisions of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/801">21 U.S.C. 801 et seq.</external-xref>) are
			 repealed:</text>
				<paragraph id="H2E1798DDC129432E8510D701795D68E7"><enum>(1)</enum><text>Clause (iii) of
			 section 401(b)(1)(A).</text>
				</paragraph><paragraph id="H9566445184394AFE99EBDBF04D132CB8"><enum>(2)</enum><text>Clause (iii) of
			 section 401(b)(1)(B).</text>
				</paragraph><paragraph id="HD90F4AF958AF476BB8A127746F1CAD2"><enum>(3)</enum><text display-inline="yes-display-inline">The sentence beginning
			 <quote>Notwithstanding the preceding sentence</quote> in section 404(a).</text>
				</paragraph></subsection><subsection id="HB3C6EFBC216140030083B5F35C453885"><enum>(b)</enum><header>Controlled
			 Substances Import and Export Act</header><text display-inline="yes-display-inline">The following provisions of the Controlled
			 Substances Import and Export Act (<external-xref legal-doc="usc" parsable-cite="usc/21/951">21 U.S.C. 951 et seq.</external-xref>) are repealed:</text>
				<paragraph id="H46BAB9BA7C17490D9ED732F5FCCA88A4"><enum>(1)</enum><text>Subparagraph (C)
			 of section 1010(b)(1).</text>
				</paragraph><paragraph id="H9B6CF5991D16466EB6646C19D9B79478"><enum>(2)</enum><text>Subparagraph (C)
			 of section 1010(b)(2).</text>
				</paragraph></subsection></section><section id="HFCF835E96B06433FB170036CC4EF6598"><enum>3.</enum><header>Reestablishment
			 of possibility of probationary sentence</header>
			<subsection id="HC1B106DC3AAE4B31A1E5965213275827"><enum>(a)</enum><header>Controlled
			 Substances Act</header><text display-inline="yes-display-inline">Section 401(b)
			 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/841">21 U.S.C. 841(b)(1)</external-xref>) is amended—</text>
				<paragraph id="H372FD949505E4F5FB9115CA56484B9D2"><enum>(1)</enum><text>in the penultimate
			 sentence of subparagraph (A), by inserting <quote>, other than under clause
			 (ii)</quote> after <quote>any person sentenced under this subparagraph</quote>;
			 and</text>
				</paragraph><paragraph id="H632433B1FB004A82B2D6496F88D49579"><enum>(2)</enum><text display-inline="yes-display-inline">in the final sentence of subparagraph (B),
			 by inserting <quote>, other than under clause (ii)</quote> after <quote>any
			 person sentenced under this subparagraph</quote>.</text>
				</paragraph></subsection><subsection id="HAD4A0B342B7246638330FD54106296CF"><enum>(b)</enum><header>Controlled
			 Substances Import and Export Act</header><text>Section 1010(b) of the
			 Controlled Substances Import and Export Act (<external-xref legal-doc="usc" parsable-cite="usc/21/960">21 U.S.C. 960(b)</external-xref>) is amended in
			 the penultimate sentence of each of paragraphs (1) and (2), by inserting
			 <quote>, other than under subparagraph (B)</quote> after <quote>any person
			 sentenced under this paragraph</quote>.</text>
			</subsection></section><section id="H0E6B14E93F33413AA7BE5F00FF969D3F"><enum>4.</enum><header>Elimination of
			 minimum mandatory imprisonment penalties for cocaine offenses</header>
			<subsection id="H403DC06F1E3148FCA789BF1811BFE480"><enum>(a)</enum><header>Controlled
			 Substances Act</header>
				<paragraph id="H0C40F428E9A14E8983C769EA92D0FC61"><enum>(1)</enum><text>Section
			 401(b)(1)(A) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/841">21 U.S.C. 841(b)(1)(A)</external-xref>) is
			 amended by adding at the end the following: <quote>However, any minimum term of
			 imprisonment otherwise required under this subparagraph shall not apply to an
			 offense under clause (ii).</quote>.</text>
				</paragraph><paragraph id="H58EFA7A9DFAF40BB877ED6C28510A7E"><enum>(2)</enum><text display-inline="yes-display-inline">Section 401(b)(1)(B) of the Controlled
			 Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/841">21 U.S.C. 841(b)(1)(B)</external-xref>) is amended by adding at the end the
			 following: <quote>However, any minimum term of imprisonment otherwise required
			 under this subparagraph shall not apply to an offense under clause
			 (ii).</quote>.</text>
				</paragraph></subsection><subsection id="HDA6609519473476880B551376D654EF3"><enum>(b)</enum><header>Controlled
			 Substances Import and Export Act</header>
				<paragraph id="H814009AF3DC14AC3B8D9B05C362C6E48"><enum>(1)</enum><text display-inline="yes-display-inline">Section 1010(b)(1) of the Controlled
			 Substances Import and Export Act (<external-xref legal-doc="usc" parsable-cite="usc/21/960">21 U.S.C. 960(b)(1)</external-xref>) is amended by adding at
			 the end the following: <quote>However, any minimum term of imprisonment
			 otherwise required under this paragraph shall not apply to an offense under
			 subparagraph (B). </quote>.</text>
				</paragraph><paragraph id="HC3C757B7BBCF4989B85298F100A3633"><enum>(2)</enum><text>Section 1010(b)(2)
			 of the Controlled Substances Import and Export Act (<external-xref legal-doc="usc" parsable-cite="usc/21/960">21 U.S.C. 960(b)(2)</external-xref>) is
			 amended by adding at the end the following: <quote>However, any minimum term of
			 imprisonment otherwise required under this paragraph shall not apply to an
			 offense under subparagraph (B). </quote>.</text>
				</paragraph></subsection></section><section id="H11D95F49BF974C0F93A600D0B4446DF4"><enum>5.</enum><header>Authorization for
			 Federal drug court program</header><text display-inline="no-display-inline">There is authorized to be appropriated to
			 the Administrative Office of the United States Courts $10,000,000 for each of
			 fiscal years 2009 through 2013 to provide pretrial diversion and post
			 conviction drug courts at the Federal level for people charged with illegal use
			 of controlled substances.</text>
		</section><section id="HFE3B6EA39C7142C6916D8FAEF7211200" section-type="subsequent-section"><enum>6.</enum><header>Reauthorization of
			 drug courts grant program</header><text display-inline="no-display-inline">Section 1001(a)(25)(A) of the Omnibus Crime
			 Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3793">42 U.S.C. 3793(a)(25)(A)</external-xref>) is amended to
			 read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="HC717C3E55759450794095D1F55EACAE3" style="OLC">
				<subparagraph id="H2408A210710F4C3688BF17903405914D" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">Except as provided in subparagraph (C),
				there are authorized to be appropriated to carry out part EE $50,000,000 for
				each of the fiscal years 2009 through
				2013.</text>
