		<official-title>To require construction of fencing and security
		  improvements in the border area from the Pacific Ocean to the Gulf of
		  Mexico.</official-title>

		<section id="H3011B337F200452500AAFE02E4C48469" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Fence By
			 Date Certain Act</quote>.</text>
		</section><section id="H50920AA870004CEC933F9ED49CB21946"><enum>2.</enum><header>Construction of
			 fencing and security improvements in border area from pacific ocean to gulf of
			 mexico</header>
			<subsection id="H61C10C0293FF4405BF7294A5CF9F15F5"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 102(b)(1) of
			 the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (Public
			 Law 104–208; <external-xref legal-doc="usc" parsable-cite="usc/8/1103">8 U.S.C. 1103</external-xref> note) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H79AF77777E284AE48FA0FD61316281E5" style="OLC">
					<paragraph id="H4680766824264DE8922CF726A3EE6173"><enum>(1)</enum><header>Security
				features</header>
						<subparagraph id="H503B83ABC9E44EBAB19200A72E188600"><enum>(A)</enum><header>Reinforced
				fencing</header><text>In carrying out subsection (a), the Secretary of Homeland
				Security shall ensure construction of at least 2 layers of reinforced fencing,
				and the installation of additional physical barriers, roads, lighting, cameras,
				and sensors—</text>
							<clause id="HE5632AC0894A495AAB35DC1B633B9F00"><enum>(i)</enum><text>extending from 10
				miles west of the Tecate, California, port of entry to 10 miles east of the
				Tecate, California, port of entry;</text>
							</clause><clause id="HC599199138A341A885B292EBCA3E4E7F"><enum>(ii)</enum><text>extending from 10
				miles west of the Calexico, California, port of entry to 5 miles east of the
				Douglas, Arizona, port of entry;</text>
							</clause><clause id="HD5BC4774A37141DE8DDC2C4C3304DB0"><enum>(iii)</enum><text>extending from 5
				miles west of the Columbus, New Mexico, port of entry to 10 miles east of El
				Paso, Texas;</text>
							</clause><clause id="H3F57039349C4496CB3D719F03CAC2FA"><enum>(iv)</enum><text>extending from 5
				miles northwest of the Del Rio, Texas, port of entry to 5 miles southeast of
				the Eagle Pass, Texas, port of entry; and</text>
							</clause><clause id="H1FA25B86C7CD42B09C1D33A7C014AFA1"><enum>(v)</enum><text>extending 15 miles
				northwest of the Laredo, Texas, port of entry to the Brownsville, Texas, port
				of entry.</text>
							</clause></subparagraph><subparagraph id="H72DF662C3D5C483F8EF4E18B923C3EB8"><enum>(B)</enum><header>Priority
				areas</header><text>With respect to the border described—</text>
							<clause id="H2C21ED77F0474A62A78319C29446D897"><enum>(i)</enum><text>in
				subparagraph (A)(ii), the Secretary shall ensure that fence construction is
				completed by May 30, 2008; and</text>
							</clause><clause id="HDD92A5A6882B4465985C86A0F0743F51"><enum>(ii)</enum><text>in subparagraph
				(A)(v), the Secretary shall ensure that fence construction from 15 miles
				northwest of the Laredo, Texas, port of entry to 15 southeast of the Laredo,
				Texas, port of entry is completed by December 31, 2008.</text>
							</clause></subparagraph><subparagraph id="HDCA942F4F7DE4EEB960125E81152C104"><enum>(C)</enum><header>Additional
				areas</header><text display-inline="yes-display-inline">With respect to the
				duties described in subparagraph (A) that are not otherwise assigned a deadline
				under subparagraph (B), the Secretary shall ensure that such duties are
				completed by June 30, 2009.</text>
						</subparagraph><subparagraph id="H376F598D521441A6A036968892CB4FF4"><enum>(D)</enum><header>Exception</header><text>If
				the topography of a specific area has an elevation grade that exceeds 10
				percent, the Secretary may use other means to secure such area, including the
				use of surveillance and barrier
				tools.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HD1F27F4641E74CDDA762FC177D6B02D1"><enum>(b)</enum><header>Authorization of
			 appropriations</header><text>There are authorized to be appropriated such sums
			 as may be necessary to carry out the amendment made by subsection (a).</text>
			</subsection><subsection id="H33AC2DFBB2D645CC8060A6FD52413C28"><enum>(c)</enum><header>Repeals</header><text>Subsection
			 (b) of section 564 of division E of the Consolidated Appropriations Act, 2008
			 (<external-xref legal-doc="public-law" parsable-cite="pl/110/161">Public Law 110–161</external-xref>) is repealed. The amendment made by subsection (a)(2)(A) of
			 such section is repealed.</text>
