		<official-title>To create a National Endowment to advance private sector
		  development of aeronautics and space technologies by way of the National
		  Advanced Space and Aeronautical Technologies Prize Award
		  Program.</official-title>

		<section id="H4C012294524944E19783E090F761B4A9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Aeronautics and Space Prize
			 Act</short-title></quote>.</text>
		</section><section id="H9611640175B74B9F9B7447554030F5CA"><enum>2.</enum><header>National
			 Endowment for Aeronautics and Space</header>
			<subsection id="HDB601C1D4CBA4712AF14348234D6E664"><enum>(a)</enum><header>Establishment</header><text>There
			 is established a National Endowment for Aeronautics and Space (referred to in
			 this Act as the <quote>Endowment</quote>).</text>
			</subsection><subsection id="HA35C09C5EFBC4A0588B191DFE0A23504"><enum>(b)</enum><header>Purposes</header><text>The
			 purposes of the Endowment are—</text>
				<paragraph id="H502D6E69AFDB41F1B404A7C5C5796666"><enum>(1)</enum><text>to execute a
			 program awarding cash prizes in recognition of outstanding private sector
			 achievements in basic, advanced, and applied research, technology development,
			 and prototype demonstration that have the potential for application to the
			 Nation’s aeronautics and space endeavors within the National Aeronautics and
			 Space Administration (referred to in this Act as <quote>NASA</quote>) and other
			 governmental agencies as well as private entities in the United States;</text>
				</paragraph><paragraph id="H5C545E3DAD004D1C802C05A9D518277"><enum>(2)</enum><text>with the advice of
			 NASA and other agencies as appropriate, to carry out a program for tasteful
			 advertising of commercial products and services in conjunction with the
			 Nation’s aeronautics and space endeavors in conjunction with NASA, other
			 agencies involved in aeronautics and space, or independently; and</text>
				</paragraph><paragraph id="HBEA181079A6A4DDCBBB5D03235B1E900"><enum>(3)</enum><text>to encourage
			 private gifts of real and personal property or any income therefrom or other
			 interest therein for the benefit of, or in connection with, the Nation’s
			 aeronautics and space endeavors in NASA as well as other governmental agencies
			 and private entities involved in aeronautics and space in the United
			 States.</text>
				</paragraph></subsection><subsection id="H5D80114C04014F8AA076E895D57757E6"><enum>(c)</enum><header>Authority of the
			 endowment</header><text>In carrying out the purposes specified in subsection
			 (b), the endowment is authorized—</text>
				<paragraph id="H5EFC1FE5CB6040500050276D77D46100"><enum>(1)</enum><text>to make,
			 promulgate, issue, rescind, and amend rules and regulations governing the
			 manner of its operations and the exercise of the powers vested in it by
			 law;</text>
				</paragraph><paragraph id="H63638701675E42A5AFE76E761F01B7D"><enum>(2)</enum><text>to
			 appoint and fix the compensation of such officers and employees as may be
			 necessary to carry out the purposes specified in subsection (b), in accordance
			 with civil service laws; and</text>
				</paragraph><paragraph id="HA40883F0667E4CEC9500BD754EB20194"><enum>(3)</enum><text>to appoint such
			 advisory committees as may be appropriate for purposes of consultation and
			 advice to the Endowment.</text>
				</paragraph></subsection><subsection id="H8F6DB86D9060485BA694F6C369A6948E"><enum>(d)</enum><header>Powers of the
			 endowment</header>
				<paragraph id="H5E819F3FD5F442858CF900E028D78D5F"><enum>(1)</enum><header>Contract</header><text>The
			 Endowment, with the advice of NASA and other agencies as appropriate, shall
			 have the power to enter into contracts or grants, to execute instruments, and
			 generally to do any and all lawful acts necessary or appropriate consistent
			 with the purposes of the Endowment specified in subsection (b).</text>
				</paragraph><paragraph id="HDB690F186D114329BD77D7F1D362567"><enum>(2)</enum><header>Payment</header><text>Neither
			 NASA, other agencies, private sector entities, nor any employee thereof, except
			 as specified in this Act, is authorized to accept funds from the
			 Endowment.</text>
				</paragraph><paragraph id="H2CED9BB3DFF64E8900031CC30017E091"><enum>(3)</enum><header>Coordination</header><text>In
			 order to carry out its functions under this Act, the Endowment may utilize the
			 services and facilities of NASA and other Federal agencies, and such services
			 and facilities may be made available on request to the extent practicable
			 without reimbursement therefor.</text>
				</paragraph></subsection><subsection id="H8D075A07D50547059FBE6C175CE005A7"><enum>(e)</enum><header>Gifts; devises;
			 bequests</header>
				<paragraph id="H03245A95336642EF8850BE8091F7EEC9"><enum>(1)</enum><header>In
			 general</header><text>Except as provided in paragraph (2), the Endowment may
			 accept, receive, solicit, hold, administer, and use any gifts, devises, or
			 bequests, either absolutely or in trust, of real or personal property or any
			 income therefrom or other interest therein for the benefit of or in connection
			 with the Nation’s aeronautics and space endeavors within NASA as well as other
			 governmental agencies within the United States, including a gift, devise, or
			 bequest that is encumbered, restricted, or subject to beneficial interests of
			 private persons if any current or future interest therein is for the benefit of
			 the Nation’s aeronautics and space endeavors within NASA as well as other
			 governmental agencies involved in aeronautics and space within the United
			 States. For purposes of this paragraph, an interest in real property includes
			 easements or other rights for preservation, conservation, protection, or
			 enhancement by and for the public of natural, scenic, historic, scientific,
			 educational, inspirational, or recreational resources.</text>
				</paragraph><paragraph id="H26D287A7FD7F47999FE690C7F4B52365"><enum>(2)</enum><header>Limitation</header><text>The
			 Endowment may not accept a gift, devise, or bequest which entails any
			 expenditure other than from the resources of the Endowment.</text>
				</paragraph><paragraph id="H1A4848D80FC44FA685900020C35700FC"><enum>(3)</enum><header>Property of the
			 united states</header><text>Gifts and other transfers made to or for the use of
			 the Endowment shall be regarded as contributions, gifts, or transfers to or for
			 the use of the United States.</text>
				</paragraph></subsection><subsection id="H65BF4DB6533449419967DE14087100A4"><enum>(f)</enum><header>Reporting</header><text>Promptly
			 at the end of each fiscal year, the Endowment shall transmit to Congress an
			 annual report of its proceedings and activities, including a full and complete
			 statement of its receipts, expenditures, and investments.</text>
			</subsection><subsection id="HA640A9D721374776AD3D51F37DA97838"><enum>(g)</enum><header>Chairperson of
			 the endowment</header>
				<paragraph id="H69E47D6D4FE047D9B877009967CAE9FF"><enum>(1)</enum><header>In
			 general</header><text>The Endowment shall be headed by a Chairperson, who shall
			 be appointed by the President, by and with the advice and consent of the
			 Senate.</text>
				</paragraph><paragraph id="HAD6677CC670647D6B2CAFD351F8306A4"><enum>(2)</enum><header>Responsibilities</header><text>Under
			 the supervision and direction of the President, the Chairperson shall be
			 responsible for the exercise of all powers and the discharge of all duties of
			 the Endowment, and shall have authority and control over all personnel and
			 activities thereof. The Chairperson shall not engage in any other business,
			 vocation, or employment while serving as such.</text>
				</paragraph><paragraph id="HDD77937F39F044A89080D8B40375FA32"><enum>(3)</enum><header>Terms</header><text>The
			 Chairperson shall serve for a term of 4 years and shall be eligible for
			 reappointment. Upon expiration of the Chairperson’s term of office the
			 Chairperson shall serve until the Chairperson’s successor shall be
			 appointed.</text>
				</paragraph><paragraph id="H7C5FF7B177BF4660800294CD1D94925D"><enum>(4)</enum><header>Duties</header><text>The
			 Chairperson shall correlate the programs of the Endowment, insofar as
			 practicable, with existing programs of Federal, State, regional, or private
			 groups, and shall develop the programs of the Endowment with due regard to the
			 contribution to the objectives of this Act which can be made by other Federal
			 agencies under existing programs. The Chairperson may enter into interagency
			 agreements to promote or assist the aeronautics and space activities of other
			 Federal agencies on a reimbursable or nonreimbursable basis, and may use funds
			 authorized to be appropriated for the purposes of subsection (b) for the costs
			 of such activities.</text>
				</paragraph></subsection></section><section id="H97CDA94ED2984C21AB06A6F591A03001"><enum>3.</enum><header>National advanced
			 space and aeronautical technologies prize award program</header>
			<subsection id="H716BC8B09C164D948DD6ED8B7C9D8CAC"><enum>(a)</enum><header>In
			 general</header><text>The Endowment shall carry out the program described in
			 section 2(b)(1).</text>
			</subsection><subsection id="H183B75EADA8C4F7992919448302F993B"><enum>(b)</enum><header>Competition
			 requirements</header><text>The Endowment shall—</text>
				<paragraph id="HD83EDCA41CDF4BAB851081D456DEA5B6"><enum>(1)</enum><text>widely advertise
			 prize competitions and use a competitive process for the selection of
			 recipients of prizes under this section; and</text>
				</paragraph><paragraph id="H902ECC1F0D444DEABBED3DC8C51206C2"><enum>(2)</enum><text>make a
			 determination, with the advice of NASA and other governmental agencies as
			 appropriate, prior to the advertisement required under paragraph (1) if an
			 individual prize might have benefits for the Nation’s aeronautics and space
			 endeavors within NASA as well as other governmental agencies and private
			 entities involved in aeronautics and space in the United States.</text>
				</paragraph></subsection><subsection id="H2CFB0C6BF92849EA9583706BDAE5F5F7"><enum>(c)</enum><header>Registration</header>
				<paragraph id="HE78C023678314E528893653170624800"><enum>(1)</enum><header>In
			 general</header><text>The Endowment shall require potential recipients of
			 prizes to register for any prize competition under the program established
			 under this section, and, as part of the registration process, to assume any and
			 all risks and waive claims against the United States Government and its related
			 entities for any injury, death, damage, or loss of property or revenue or
			 profits, whether direct, indirect, or consequential, arising from their
			 participation in a competition, whether such injury, death, damage, or loss
			 arises through negligence or otherwise, except in the case of willful
			 misconduct.</text>
				</paragraph><paragraph id="H2E7702447FB94D388D18E8C0332984BB"><enum>(2)</enum><header>Related
			 entity</header><text>For purposes of this subsection, the term <term>related
			 entity</term> includes a contractor or subcontractor at any tier, and a
			 supplier, user, customer, cooperating party, grantee, investigator, or
			 detailee.</text>
				</paragraph></subsection><subsection id="H39E10D79ECDB440BB8072E4DEDA7725"><enum>(d)</enum><header>Limitations</header><text>The
			 following limitations apply:</text>
				<paragraph id="HC24CD42C4354413EA0EFEC6F6E6565"><enum>(1)</enum><text>The
			 total amount of cash prizes budgeted in a fiscal year shall not exceed
			 $150,000,000.</text>
				</paragraph><paragraph id="HA76C3BECFE094AEA9B6C88491DBF67C"><enum>(2)</enum><text>No
			 prize competition shall result in the award of more than $50,000 in cash prizes
			 without the approval of the Chairperson or the Chairperson’s designee.</text>
				</paragraph></subsection><subsection id="HE9E8E048435F4DD5A51DFB1B7428BAF7"><enum>(e)</enum><header>Availability of
			 funds</header><text>Funds appropriated for the program authorized by this
			 section shall remain available until expended for a maximum of 4 years.</text>
			</subsection><subsection id="H795E9BC81F9847818E4FE2800414AB1D"><enum>(f)</enum><header>Report</header><text>The
			 Endowment shall transmit to the Committee on Appropriations and the Committee
			 on Commerce, Science, and Transportation of the Senate, and to the Committee on
			 Appropriations and the Committee on Science and Technology of the House of
			 Representatives, a report on the administration of the program under this
			 section for each fiscal year. The report shall include—</text>
				<paragraph id="H96F72AF6461F4F48B31D731FE7B48BE0"><enum>(1)</enum><text>the aeronautics
			 and space applications for which cash prizes were awarded;</text>
				</paragraph><paragraph id="H9B108ADBB146472CBEF102714500062B"><enum>(2)</enum><text>the total amount
			 of the cash prizes awarded; and</text>
				</paragraph><paragraph id="H59B60036F03A49D3BC3CA5BBFAD7854"><enum>(3)</enum><text>the methods used
			 for solicitation and evaluation of submissions, together with an assessment of
			 the effectiveness of those methods.</text>
				</paragraph></subsection></section><section id="H1AB1D09073DF447E8EB00E2C7D554F9"><enum>4.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated such sums as may be necessary to carry out this
			 Act.</text>
