		<official-title>To provide liability protection in Federal court for
		  educators and school administrators, who are working within the scope of their
		  employment, and for other purposes.</official-title>

		<section id="H049A9F0B120B49EFA925B47CD7818BB1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Educational Immunity Act of
			 2005</short-title></quote>.</text>
		</section><section id="HC3387A0AC63048D3A29695A2DB95EDC4"><enum>2.</enum><header>Liability
			 protection in Federal court for educators and school administrators</header>
			<subsection id="H77582861CE4842DDB370EAD240DA7431"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">An educator or school
			 administrator in a pre-K–12 school is not liable, in Federal court, for damages
			 of any nature or any other legal or equitable remedy, for any act or omission
			 in the course and scope of that employment, except as provided in this
			 section.</text>
			</subsection><subsection id="H6638ED47FD4E46629FABA31E86D22798"><enum>(b)</enum><header>Exceptions</header><text>The
			 liability protection in subsection (a) does not apply to—</text>
				<paragraph id="H190DDB7ABCAF4E899DA11361C27BF5EF"><enum>(1)</enum><text>liability under a
			 contract; or</text>
				</paragraph><paragraph id="HD3D6FF5C722F4CC795A5186B113EE852"><enum>(2)</enum><text>conduct punishable
			 as a crime.</text>
				</paragraph></subsection><subsection id="HF0A9E18B26A14E1EBFD7CDECD94160E"><enum>(c)</enum><header>Attorney fees and
			 costs</header><text display-inline="yes-display-inline">If any teacher or
			 school administrator is sued and the case is dismissed or no liability found
			 against such teacher or administrator, the person immunized hereunder is
			 entitled to be reimbursed for actual attorneys fees, all court related costs,
			 fees and expenses, as well as out of pocket monies expended or lost arising out
			 of or related to the litigation.</text>
			</subsection><subsection id="H384C669732594DF9996239A15C51579F"><enum>(d)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="H09876322C9BA450B9E19332317C30075"><enum>(1)</enum><text>The term
			 <quote>pre-K–12 school</quote> means a school, whether public or private, for
			 one or more grades from pre-kindergarten through grade 12.</text>
				</paragraph><paragraph id="HD6C5DF2613E045819C00D9CFC5D4D09"><enum>(2)</enum><text>The term
			 <quote>educator</quote> includes a teacher, a teaching assistant, a guest
			 lecturer, and a librarian.</text>
				</paragraph><paragraph id="H4244BA146092485F9FBA0DD6ECD4B07"><enum>(3)</enum><text display-inline="yes-display-inline">The term <quote>school
			 administrator</quote> includes a principal, an assistant principal, a
			 Superintendent, Assistant Superintendent, or their employees.</text>
				</paragraph><paragraph id="HC9EF86268FEA4219A700B9D91CFF6409"><enum>(4)</enum><text>The term
			 <quote>employed</quote> includes work on an unpaid basis.</text>
