		<section id="H1A977A1E16B54056A4C476000506FA22" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>The Invest in USA Act of
			 2007</short-title></quote>.</text>
		</section><section id="HB75EA9B9B1E14CEA884BD2F6C026025"><enum>2.</enum><header>Permanent EB–5
			 Regional Center Program</header><text display-inline="no-display-inline">Section 610(b) of the Departments of
			 Commerce, Justice, and State, the Judiciary, and Related Agencies
			 Appropriations Act, 1993 (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153</external-xref> note) is amended by striking <quote>for
			 15 years</quote>.</text>
		</section><section id="HDCA46608D4674C9A979BF9065C374D2F"><enum>3.</enum><header>Premium
			 Processing Fee for EB–5 Immigrant Investor Cases</header>
			<subsection id="HBCABC0A0744C43BDB0BEA31399DB5E9D"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 286(u) of the
			 Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1356">8 U.S.C. 1356</external-xref>) is amended by adding
			 <quote>except that the fee for petitions filed under section 203(b)(5) shall be
			 $2,000. The fee</quote> after <quote>$1,000,</quote>.</text>
			</subsection><subsection id="HF05F2746BA6F42AE934D2EB6CBE68417"><enum>(b)</enum><header>Use of
			 fees</header><text display-inline="yes-display-inline">Fees collected pursuant
			 to the amendment made by subsection (a) shall be available to the Secretary of
			 Homeland Security solely for the purpose of administration and operation of the
			 EB–5 immigrant investor program.</text>
			</subsection><subsection id="HE6A9BC7020184AA688C3E1EA0B29208"><enum>(c)</enum><header>Regulations</header><text display-inline="yes-display-inline">The Department of Homeland Security shall
			 promulgate regulations to implement this amendment not later than 120 days
			 after the date of the enactment of this Act.</text>
			</subsection></section><section id="H1A43B39E53E44ED0BC50B7DAC875487E"><enum>4.</enum><header>Allow concurrent
			 filing for EB–5 petitions and adjustment of status applications</header><text display-inline="no-display-inline">Section 245 of the Immigration and
			 Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1255">8 U.S.C. 1255</external-xref>) is amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="H3308D40396A24E1EB548D1195B6D4876" style="OLC">
				<subsection id="H69C5CD72EACA4D169DD69663AC8136E4"><enum>(n)</enum><header>Concurrent
				Processing for Employment Creation Immigrants</header><text display-inline="yes-display-inline">If, at the time an alien files a petition
				for classification through a regional center under section 203(b)(5), approval
				of the petition would make a visa immediately available to the alien
				beneficiary, the alien beneficiary’s application for adjustment of status shall
				be considered properly filed whether submitted concurrently with, or subsequent
				to, such
				petition.</text>
				</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H2F6009FF90AA46E183001102010811C0"><enum>5.</enum><header>Regional Center
			 Designation Fees</header>
			<subsection id="HAAD8C37AB54848108FBCC45DCAD492DD"><enum>(a)</enum><header>Establishment of
			 fee</header><text display-inline="yes-display-inline">Section 610 of the
			 Departments of Commerce, Justice, and State, the Judiciary, and Related
			 Agencies Appropriations Act, 1993 (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153</external-xref> note) is amended by adding at
			 the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HC7F2A4ED3ABD4293A2E0EF452DAF1250" style="OLC">
					<subsection id="HD1D8C92C02D6445EAB780067D59C7EBB"><enum>(e)</enum><text display-inline="yes-display-inline">In addition to any other fees authorized by
				law, the Secretary of Homeland Security shall impose a $2,500 fee to apply for
				designation as a regional center under this section. Fees collected under this
				subsection shall be deposited in the Treasury in accordance with section 286(w)
				of the Immigration and Nationality Act (8 U.S.C.
				1356(w)).</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HBA4562F296114E4D9700D683FD7305EF"><enum>(b)</enum><header>Establishment of
			 Account &amp; Use of Fees</header><text display-inline="yes-display-inline">Section 286 of the Immigration and
			 Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1356">8 U.S.C. 1356</external-xref>) is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H9C7CACF7A0FF40EFA5B49B615C02FEA8" style="OLC">
					<subsection id="HA2A232F8CB544521838D1D3EF7C03125"><enum>(w)</enum><header>Immigrant
				Entrepreneur Regional Center Account</header>
						<paragraph id="H88632E7F52A942A0BB3C927588EEAB44"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">There is established
				in the general fund of the Treasury a separate account, which shall be known as
				the <quote>Immigrant Entrepreneur Regional Center Account</quote>.
				Notwithstanding any other provision of law, there shall be deposited as
				offsetting receipts into the account all fees collected under subsections (b)
				and (e) of section 610 of the Departments of Commerce, Justice, and State, the
				Judiciary, and Related Agencies Appropriations Act, 1993 (8 U.S.C. 1153
				note).</text>
						</paragraph><paragraph id="HD1848777EC5E43FCA479BACF1FF51078"><enum>(2)</enum><header>Use of
				fees</header><text display-inline="yes-display-inline">Fees collected under
				this section shall be available to the Secretary of Homeland Security solely
				for the purpose of administration and operation of the EB–5 immigrant investor
				program.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H21D66F053A674D7DAD616E88A6EF6F8B"><enum>(c)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendment made by
			 this section—</text>
				<paragraph id="HD153C292EB014B5D982403156F00D374"><enum>(1)</enum><text>shall take effect
			 on the date on which regulations are published to carry out this section and
			 the amendments made by this section; and</text>
				</paragraph><paragraph id="HF32A8DC61B7B4CDDAB8EBA4BAB2FB8D8"><enum>(2)</enum><text>shall apply to
			 regional center applications filed on or after such date.</text>
