<legis-type>A BILL</legis-type> 
<official-title>To amend part A of title IV of the Social Security Act to allow funds provided under the program of block grants to States for temporary assistance for needy families to be used for alternative-to-abortion services.</official-title>

<section id="H58E4E2A70D1B4793BDB6A33FBEE8ADC5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Positive Alternatives Act</short-title></quote>. </text></section> 
<section id="HC5B29069CFBA481394C0467D83C9819"><enum>2.</enum><header>Authority to use TANF funds for alternative-to-abortion services</header> 
<subsection id="HEE65AFF1BE224857A9B2513FEAB627A8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 408(a)(6) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/608">42 U.S.C. 608(a)(6)</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="H14AF34A16182419E9B246415185146BC" display-inline="no-display-inline"> 
<subparagraph id="H88258310BB244C7C86C89F45E1DD5DE"><enum>(C)</enum><header>Exception for alternative-to-abortion services</header> 
<clause id="HDEFB94A1803E4BFB929FDCCED5FF9095"><enum>(i)</enum><header>In general</header><text>As used in subparagraph (A), the term <term>medical services</term> does not include alternative-to-abortion services.</text></clause> 
<clause id="H0070F35C6D7C48FBA0B2B28568C766FA"><enum>(ii)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subparagraph:</text> 
<subclause id="H48CEBF44AB6F40BB8D35F84BC7EC5C1"><enum>(I)</enum><header>Alternative-to-abortion services</header><text display-inline="yes-display-inline">The term <term>alternative-to-abortion services</term> means—</text> 
<item id="H08B3A54F20B04D61A68EF3219CC21E12"><enum>(aa)</enum><text>information or counseling that promotes childbirth instead of abortion, and assists pregnant women in making an informed decision regarding the alternatives of adoption or parenting with respect to her born or unborn child; and</text></item> 
<item id="HFB9BFE5AF9B34F53AD13A251FF76638D"><enum>(bb)</enum><text>any other service designed to assist a qualified individual who is a woman to carry her unborn child to term, or to support a qualified individual in a parenting or adoption decision, including the provision of self-administered pregnancy testing, baby food, maternity or baby clothing, baby furniture, or information or education (including classes), regarding prenatal care, childbirth, adoption, parenting, chastity, or abstinence.</text></item></subclause> 
<subclause id="HA5DA6E03C8384F5DA34F182858D6BFD6"><enum>(II)</enum><header>Qualified individual</header><text>The term <term>qualified individual</term> means—</text> 
<item id="H29D81D5AA6A249CCA014909F45F393B5"><enum>(aa)</enum><text display-inline="yes-display-inline">an individual who is, or has reasonable grounds to believe she may be, pregnant;</text></item> 
<item id="H4C0AF31637374266AAFB19CBDF7700E9"><enum>(bb)</enum><text>an individual who is a parent or legal guardian of a child who has not attained 12 months of age; or</text></item> 
<item id="H691C74732FFD4662B88C54B94BFB7E15"><enum>(cc)</enum><text>an individual who is the spouse or a former spouse of, is a parent of a child of, or cohabitates or has cohabitated with an individual described in item (aa) or (bb).</text></item></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H7633ACC6406840F097382CC361C2B90"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall take effect 90 days after the date of the enactment of this Act, and shall apply to grants made under part A of title IV of the Social Security Act for fiscal years ending after such 90-day period.</text> </subsection></section>
