		<section display-inline="no-display-inline" id="HDDBF6106729044FB9F3168938DBD916E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Citizen
			 Legislature and Political Freedom Act</quote>.</text>
		</section><section id="H9ACE3C7341F3431BAFCCAE3F64B6081"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds as follows:</text>
			<paragraph id="HE8806C607228422DA5CEB4412E1DAE"><enum>(1)</enum><text>The
			 proliferation of campaign finance laws (beginning with the
			 <act-name parsable-cite="FECA">Federal Election Campaign Act of
			 1971</act-name>) and the proliferation of government regulations promulgated
			 pursuant to such laws have placed strict limits on contributions by citizens to
			 the candidates of their choice, limits which have served to severely hinder the
			 ability of challengers to compete on equal terms with incumbent
			 politicians.</text>
			</paragraph><paragraph id="HC0FF938B28CE463A86666897D7BF9F64"><enum>(2)</enum><text>The contribution
			 limits imposed by the <act-name parsable-cite="FECA">Federal Election Campaign
			 Act of 1971</act-name> force candidates to raise funds in small amounts subject
			 to fixed limitations, inevitably fostering a system under which wealthy
			 candidates and long-term incumbent politicians hold an unfair financial
			 advantage, which in turn serves to discourage potential candidates from seeking
			 public office.</text>
			</paragraph><paragraph id="HB4A947C643C04AABBFB1CAC047EEB887"><enum>(3)</enum><text>The current
			 campaign finance laws have inhibited the full and fair discussion of public
			 policy issues, as challengers who are not well known to the electorate are
			 forced by government regulation to attempt to amass contributions from large
			 numbers of donors at the outset of a campaign. As a result, challengers who
			 lack the necessary resources to bring new issues into the public debate often
			 are eliminated from political campaigns before their voices are even
			 heard.</text>
			</paragraph><paragraph id="HD935E4126D3343D983678F5436168C00"><enum>(4)</enum><text>The regulation by
			 government of political speech through the regulation of campaign contributions
			 and expenditures is patently undemocratic because it favors institutionalized
			 special interests over grassroots and citizen activity by imposing burdensome
			 reporting and disclosure requirements and stringent spending limits on the
			 political parties, thereby tilting the financial and tactical advantage in
			 political campaigns to well-financed interest groups and wealthy
			 individuals.</text>
			</paragraph><paragraph id="H7CC86501E67142D18F3757C7A25EF414"><enum>(5)</enum><text>The effect of the
			 unreasonably low contribution limits has been to force more contributors and
			 political activists to operate outside the system, resulting in even less
			 accountability and even greater encouragement of irresponsible behavior.</text>
			</paragraph><paragraph id="HD5810788823E469FAEBF11191E1B262"><enum>(6)</enum><text>The only way to
			 encourage the robust discourse of public issues and candidates, promote the
			 free exchange of political speech and ideas, protect constitutional freedom,
			 and foster a more informed electorate is to lift all current restrictions on
			 political candidate and party contributions and expenditures and to provide
			 full, instantaneous disclosure of all contributions and expenditures in
			 elections for Federal office.</text>
			</paragraph></section><section id="H97ECBE0E53C84F7DABAD72E9125118F"><enum>3.</enum><header>Removal of
			 limitations on Federal election campaign contributions</header><text display-inline="no-display-inline">Section 315(a) of the
			 <act-name parsable-cite="FECA">Federal Election Campaign Act of 1971</act-name>
			 (<external-xref legal-doc="usc" parsable-cite="usc/2/441a">2 U.S.C. 441a(a)</external-xref>) is amended by adding at the end the following new
			 paragraph:</text>
			<quoted-block act-name="Federal Election Campaign Act of 1971" id="H3C8DD2C18B2B4355833DA0FA895841DF">
				<paragraph id="H3C69AC515C4B4619ACCE158CCCFB6EE7" indent="up1"><enum>(9)</enum><text>The limitations established under
				this subsection shall not apply to contributions made during calendar years
				beginning after
				2007.</text>
				</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H7C66DB32668445B8B7943EC178DCF156"><enum>4.</enum><header>Repeal of Ban on
			 Contributions and Expenditures by Corporations and Labor
			 Organizations</header><text display-inline="no-display-inline">Section 316(a)
			 of the Federal Election Campaign Act of 1971 is amended—</text>
			<paragraph id="H6BEF416190CD4A49B0EC6882A8CAB417"><enum>(1)</enum><text>by striking
			 <quote>(a) It is unlawful</quote> and inserting <quote>(a)(1) It is
			 unlawful</quote>; and</text>
			</paragraph><paragraph id="H834622EB9C524392B44B085F64B100E5"><enum>(2)</enum><text>by adding at the
			 end the following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="H10CA35FF0850487A00508FB69809609F" style="traditional">
					<paragraph id="H30D832E7C96B4CF6B1A2521349E51B4D"><enum>(2)</enum><text>Paragraph (1)
				shall not apply with respect to elections occurring after December
				2007.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="HFE67FC43643D435E96F295D6B667E46D"><enum>5.</enum><header>Termination of
			 taxpayer financing of presidential election campaigns</header>
			<subsection id="H5DA80A550D504D3890A7C617E19D46DD"><enum>(a)</enum><header>Termination of
			 designation of income tax payments</header><text>Section 6096 of the Internal
			 Revenue Code of 1986 is amended by adding at the end the following new
			 subsection:</text>

					<subsection id="H238B3FE9A25F4252A13E5EAF986C88D3"><enum>(d)</enum><header>Termination</header><text>This
				section shall not apply to taxable years beginning after December 31,
				2006.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H4DF70C2687C34FD08472146E8EA447D8"><enum>(b)</enum><header>Termination of
			 fund and account</header>
				<paragraph id="H75BB256BBCD14AE3BEF547808303FA0"><enum>(1)</enum><header>Termination of
			 presidential election campaign fund</header>
					<subparagraph id="HF628B359389343C69D096CF2C100FF66"><enum>(A)</enum><header>In
			 general</header><text>Chapter 95 of subtitle H of such Code is amended by
			 adding at the end the following new section:</text>
						<quoted-block id="HEBCB1402CA41459200FC75F735B71100">
							<section id="H77FDBC1735B44C8387CE3819FD632C60"><enum>9014.</enum><header>Termination</header><text display-inline="no-display-inline">The provisions of this chapter shall not
				apply with respect to any presidential election (or any presidential nominating
				convention) after December 31, 2007, or to any candidate in such an
				election.</text>
							</section><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="HCC62F5FA2AAF4F63982F238477A9AF7F"><enum>(B)</enum><header>Transfer of
			 excess funds to general fund</header><text>Section 9006 of such Code is amended
			 by adding at the end the following new subsection:</text>
						<quoted-block id="H8A97568908E5445785C5300C4962BD5">
							<subsection id="HBE0BEA4175F541DDBEAAF60019C1B6A3"><enum>(d)</enum><header>Transfer of
				funds remaining after 2007</header><text>The Secretary shall transfer all
				amounts in the fund after December 31, 2007, to the general fund of the
				Treasury.</text>
							</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H62D80724204C4B4E8800DF41FE9FD33"><enum>(2)</enum><header>Termination of
			 account</header><text>Chapter 96 of subtitle H of such Code is amended by
			 adding at the end the following new section:</text>

						<section id="HDC319585639D41BB921C8519D5DC00E"><enum>9043.</enum><header>Termination</header><text display-inline="no-display-inline">The provisions of this chapter shall not
				apply to any candidate with respect to any presidential election after December
				31,
				2007.</text>

				</paragraph></subsection><subsection id="H74EB4C23CD374B919F8EE916FA754B73"><enum>(c)</enum><header>Clerical
			 amendments</header>
				<paragraph id="H96A3EEE9864446B393CC2C6C398F9B48"><enum>(1)</enum><text>The table of
			 sections for chapter 95 of subtitle H of such Code is amended by adding at the
			 end the following new item:</text>

			 State and local political parties of information reported under State
			 law</header>
			<subsection id="HED6D22E588AA486F9585ADE19FB4988B"><enum>(a)</enum><header>In
			 general</header><text>Section 304 of the <act-name parsable-cite="FECA">Federal
			 Election Campaign Act of 1971</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/2/434">2 U.S.C. 434</external-xref>) is amended by adding at
			 the end the following new subsection:</text>
				<quoted-block act-name="Federal Election Campaign Act of 1971" id="H7EEA1AD5BBD1436BA5531814DE483B17">
					<subsection id="H88EDDFFED4824F389EAB97C610CF751D"><enum>(i)</enum><text>If a political
				committee of a State or local political party is required under a State or
				local law, rule, or regulation to submit a report on its disbursements to an
				entity of the State or local government, the committee shall file a copy of the
				report with the Commission at the time it submits the report to such an
				entity.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HEA3C1015CCDD4209977B37D5E6AE0500"><enum>(b)</enum><header>Effective
			 date</header><text>The amendment made by subsection (a) shall apply with
			 respect to elections occurring after December 2007.</text>
			</subsection></section><section id="H36D40E805C26406BBD21C3B695529BDE"><enum>7.</enum><header>Promoting
			 expedited availability of FEC reports</header>
			<subsection id="H647A2E6C7C504AE7A1CF010536C76CE5"><enum>(a)</enum><header>Mandatory
			 electronic filing for all reports</header>
				<paragraph id="H40D186B140B44799935002FA287D90D4"><enum>(1)</enum><header>In
			 general</header><text>Section 304(a)(11) of the <act-name parsable-cite="FECA">Federal Election Campaign Act of 1971</act-name> (2 U.S.C.
			 434(a)(11)) is amended—</text>
					<subparagraph id="HEDC85C1FBCFE4CBDB3E33B47E373A3FA"><enum>(A)</enum><text>in subparagraph
			 (A), by striking <quote>a person required to file—</quote> and all that follows
			 and inserting the following: <quote>each person required to file a report under
			 this Act shall be required to maintain and file such report in electronic form
			 accessible by computers.</quote>;</text>
					</subparagraph><subparagraph id="H6779BF6C11B045760048EFF2038700D7"><enum>(B)</enum><text>in subparagraph
			 (C), by striking <quote>designations, statements, and reports</quote> and
			 inserting <quote>documents</quote>; and</text>
					</subparagraph><subparagraph id="H948D0516CF0B4666BC2F60F5246DF79"><enum>(C)</enum><text>in subparagraph
			 (D), by striking <quote>means, with respect to</quote> and all that follows and
			 inserting the following: <quote>means any report, designation, statement, or
			 notification required by this Act to be filed with the Commission or the
			 Secretary of the Senate.</quote>.</text>
					</subparagraph></paragraph><paragraph id="HADC63ABFAF304EB58CE2009777FABAC2"><enum>(2)</enum><header>Placement of all
			 reports on internet</header><text>Section 304(a)(11)(B) of such Act (2 U.S.C.
			 434(a)(11)(B)) is amended—</text>
					<subparagraph id="H6EF7911F5B4B45AF9F043F56B511D062"><enum>(A)</enum><text>by striking
			 <quote>a designation, statement, report, or notification</quote> and inserting
			 <quote>each report</quote>; and</text>
					</subparagraph><subparagraph id="HE2B9144AA13D400FB160E1820828A187"><enum>(B)</enum><text>by striking
			 <quote>the designation, statement, report, or notification</quote> and
			 inserting <quote>the report</quote>.</text>
					</subparagraph></paragraph><paragraph id="HE9D429DCE3E84677996968ECD875E102"><enum>(3)</enum><header>Software for
			 filing of all reports</header><text>Section 304(a)(12) of such Act (2 U.S.C.
			 434a(a)(12)) is amended—</text>
					<subparagraph id="HC91AABBBD38C4903AC3114604CE630C7"><enum>(A)</enum><text>in subparagraph
			 (A)(ii), by striking <quote>each person required to file a designation,
			 statement, or report in electronic form</quote> and inserting <quote>each
			 person required to file a report (as defined in paragraph (11)(D))</quote>;
			 and</text>
					</subparagraph><subparagraph id="HC5760BC4DB5D4345BE03E216A8C06BA6"><enum>(B)</enum><text>in subparagraph
			 (B), by striking <quote>any designation, statement, or report</quote> and
			 inserting <quote>any report (as defined in paragraph (11)(D))</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="HF3DC10BD625848FC006838F4F3052BA2"><enum>(b)</enum><header>Requiring
			 reports for all contributions made to any political committee within 90 days of
			 election; requiring reports to be made within 24 hours</header><text>Section
			 304(a)(6)(A) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/2/434">2 U.S.C. 434(a)(6)(A)</external-xref>) is amended to read as
			 follows:</text>
				<quoted-block id="H9DC803256D3B410696F8FECED800F2CD">
					<subparagraph id="HAC47CDB5D7854C41986BC7FE00311CF1" indent="up2"><enum>(A)</enum><text>Each political committee shall notify
				the Secretary or the Commission, and the Secretary of State, as appropriate, in
				writing, of any contribution received by the committee during the period which
				begins on the 90th day before an election and ends at the time the polls close
				for such election. This notification shall be made within 24 hours (or, if
				earlier, by midnight of the day on which the contribution is deposited) after
				the receipt of such contribution and shall include the name of the candidate
				involved (as appropriate) and the office sought by the candidate, the
				identification of the contributor, and the date of receipt and amount of the
				contribution.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H38CFD265F07A49E2A2B5CC1DDD4340A4"><enum>(c)</enum><header>Effective
			 date</header><text>The amendment made by this section shall apply with respect
			 to reports for periods beginning on or after January 1, 2008.</text>
			</subsection></section><section id="HF59198F25DBC4491A9000054D3D67911"><enum>8.</enum><header>Waiver of
			 <quote>best efforts</quote> exception for information on identification of
			 contributors</header>
			<subsection id="HC3888E3613DC4593B2B11D80964598D8"><enum>(a)</enum><header>In
			 general</header><text>Section 302(i) of the <act-name parsable-cite="FECA">Federal Election Campaign Act of 1971</act-name> (2 U.S.C.
			 432(i)) is amended—</text>
				<paragraph id="H49422967DB6D4EB19EBBB39D968030AD"><enum>(1)</enum><text>by striking
			 <quote>(i) When the treasurer</quote> and inserting <quote>(i)(1) Except as
			 provided in paragraph (2), when the treasurer</quote>; and</text>
				</paragraph><paragraph id="H1251E6D8D26D4350AEBAA633C52679AC"><enum>(2)</enum><text>by adding at the
			 end the following new paragraph:</text>
					<quoted-block id="H38847363C6C8493600EB6810C9A9376B">
						<paragraph id="H4F842747E45E47B49E1D88F8C23A0D" indent="up1"><enum>(2)</enum><text>Paragraph (1) shall not apply with
				respect to information regarding the identification of any person who makes a
				contribution or contributions aggregating more than $200 during a calendar year
				(as required to be provided under subsection
				(c)(3)).</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H9BBBCB2120D4445C89441059EA0065D7"><enum>(b)</enum><header>Effective
			 date</header><text>The amendment made by subsection (a) shall apply with
			 respect to persons making contributions for elections occurring after December
			 2007.</text>
