		<section id="H7A19192DA739494993A5203547A2B762" section-type="section-one"><enum>1.</enum><header>Parity in application of
			 certain limits to mental health benefits</header>
			<subsection id="HCB1F83D0B4004BF7A8BDE6F714715B1"><enum>(a)</enum><header>Amendment to the
			 Internal Revenue Code of 1986</header><text>Section 9812(f)(3) of the Internal
			 Revenue Code of 1986 is amended by striking <quote>2007</quote> and inserting
			 <quote>2008</quote>.</text>
			</subsection><subsection id="H556C63E2263E4B7BB6CADAEDB406139"><enum>(b)</enum><header>Amendment to the
			 Employee Retirement Income Security Act of 1974</header><text display-inline="yes-display-inline">Section 712(f) of the Employee Retirement
			 Income Security Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/29/1185a">29 U.S.C. 1185a(f)</external-xref>) is amended by striking
			 <quote>2007</quote> and inserting <quote>2008</quote>.</text>
			</subsection><subsection id="HE5DF4B11BE4C45A1927F22F486FECC66"><enum>(c)</enum><header>Amendment to the
			 Public Health Service Act</header><text display-inline="yes-display-inline">Section 2705(f) of the Public Health
			 Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-5">42 U.S.C. 300gg–5(f)</external-xref>) is amended by striking <quote>2007</quote>
			 and inserting <quote>2008</quote>.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="H64F6CA2234CE4D92B5B2207C62A668D" section-type="subsequent-section"><enum>2.</enum><header>Inclusion of Medicare
			 Providers and Suppliers in Federal Payment Levy and Administrative Offset
			 Program</header>
			<subsection id="H849F9F43CA5449DCA9DC7FF7B3E011B"><enum>(a)</enum><header>In
			 general</header><text>Section 1874 of the Social Security Act (42 U.S.C.
			 1395kk) is amended by adding at the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H96CAD1E9E6974A77B78D45F2D659259" style="traditional">
					<subsection id="HADD0509368884F7EB588391996BDF057"><enum>(d)</enum><header>Inclusion of
				Medicare provider and supplier payments in Federal Payment Levy
				Program</header>
						<paragraph commented="no" id="H90003EC943A34072AF263DB0F75175E8"><enum>(1)</enum><header>In
				general</header><text>The Centers for Medicare &amp; Medicaid Services shall
				take all necessary steps to participate in the Federal Payment Levy Program
				under <external-xref legal-doc="usc" parsable-cite="usc/26/6331">section 6331(h)</external-xref> of the Internal Revenue Code of 1986 as soon as possible
				and shall ensure that—</text>
							<subparagraph id="H3B191977BD444397BDA1FA56BD3CCCD"><enum>(A)</enum><text>at least 50 percent
				of all payments under parts A and B are processed through such program
				beginning within 1 year after the date of the enactment of this section;</text>
							</subparagraph><subparagraph id="H0747410F61034A43968D6C21395EDF6B"><enum>(B)</enum><text>at least 75
				percent of all payments under parts A and B are processed through such program
				beginning within 2 years after such date; and</text>
							</subparagraph><subparagraph id="HC6796A5731FE4D0F8700B060F409E9B6"><enum>(C)</enum><text>all payments under
				parts A and B are processed through such program beginning not later than
				September 30, 2011.</text>
							</subparagraph></paragraph><paragraph id="H3D7C672714E14F9682E455B2F3D14544"><enum>(2)</enum><header>Assistance</header><text>The
				Financial Management Service and the Internal Revenue Service shall provide
				assistance to the Centers for Medicare &amp; Medicaid Services to ensure that
				all payments described in paragraph (1) are included in the Federal Payment
				Levy Program by the deadlines specified in that
				subsection.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H730483DA259C4193B29D687CF8D2A7E2"><enum>(b)</enum><header>Application of
			 administrative offset provisions to Medicare provider or supplier
			 payments</header><text display-inline="yes-display-inline">Section 3716 of
			 title 31, United States Code, is amended—</text>
				<paragraph id="H635DD38AEA1A45E189DAE3680020B37F"><enum>(1)</enum><text>by inserting
			 <quote>the Department of Health and Human Services,</quote> after <quote>United
			 States Postal Service,</quote> in subsection (c)(1)(A); and</text>
				</paragraph><paragraph id="H15F40A7DEE5C4E9C97354021F0A651D5"><enum>(2)</enum><text>by adding at the
			 end of subsection (c)(3) the following new subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="H26BD3F8578364F0280A35E906149D2E9" style="OLC">
						<subparagraph id="H0AE9A4B803EA4BE9BBC8BA80455BFB8F"><enum>(D)</enum><text>This section shall
				apply to payments made after the date which is 90 days after the enactment of
				this subparagraph (or such earlier date as designated by the Secretary of
				Health and Human Services) with respect to claims or debts, and to amounts
				payable, under title XVIII of the Social Security
				Act.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H8D9E3C0C98354758AF22AD6FED544FBD"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall take effect on the
			 date of the enactment of this Act.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="H8AECB0806D814B028C0095AF6FD1E080"><enum>3.</enum><header>Deposit of excess
			 savings in PAQI Fund</header>
			<subsection id="H425F83B89AFB4A8C8604DC2D2100F095"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">In addition to any
			 amounts otherwise made available to the Physician Assistance and Quality
			 Initiative Fund under section 1848(l)(2) of the Social Security Act (42 U.S.C.
			 1395w–4(l)(2)), there shall be made available to such Fund—</text>
				<paragraph id="HCDC6E5BBB3CA4F45A52530F006C84825"><enum>(1)</enum><text>$93,000,000 for
			 expenditures during or after 2009;</text>
				</paragraph><paragraph id="H1773EBFAE0FE41698FC521E9FB892010"><enum>(2)</enum><text>$212,000,000 for
			 expenditures during or after 2014; and</text>
				</paragraph><paragraph id="HF80B29C6A7D54224B5BA0D341A338FC"><enum>(3)</enum><text>$44,000,000 for
			 expenditures during or after 2018.</text>
				</paragraph></subsection><subsection id="HEF7A123025254EB6B0916D702C41B837"><enum>(b)</enum><header>Obligation</header><text>The
			 Secretary of Health and Human Services shall provide for expenditures from the
			 Fund specified in subsection (a) in a manner designed to provide (to the
			 maximum extent feasible) for the obligation of the entire amount specified
			 in—</text>
				<paragraph id="HC46CF70C24234ABFBCC2527DB834A0"><enum>(1)</enum><text display-inline="yes-display-inline">subsection (a)(1) for payment with respect
			 to physicians’ services furnished during or after January 1, 2009;</text>
				</paragraph><paragraph id="HEBA623BCF40845BEB3EF3E803F3300F4"><enum>(2)</enum><text display-inline="yes-display-inline">subsection (a)(2) for payment with respect
			 to physicians’ services furnished on or after January 1, 2014; and</text>
				</paragraph><paragraph id="HF341332FD3364438A34DEF5E73E6671C"><enum>(3)</enum><text>subsection (a)(3)
			 for payment with respect to physicians’ services furnished on or after January
			 1, 2018.</text>
				</paragraph></subsection></section><section id="H91A7E099F3934E6896C9183D9D78ED35"><enum>4.</enum><header>Protection of
			 Social Security</header><text display-inline="no-display-inline">To ensure
			 that the assets of the trust funds established under section 201 of the Social
			 Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/401">42 U.S.C. 401</external-xref>) are not reduced as a result of the enactment of
			 this Act, the Secretary of the Treasury shall transfer from the general
			 revenues of the Federal Government to those trust funds the following
			 amounts:</text>
			<paragraph id="HBD69D2278E9449DBAF1684362C60756D"><enum>(1)</enum><text>For fiscal year
			 2008, $1,000,000.<pagebreak></pagebreak></text>
			</paragraph><paragraph id="HA19D77464CD14639852220B7DA2EB9E"><enum>(2)</enum><text>For fiscal year
			 2009, $5,000,000.</text>
			</paragraph><paragraph id="HB8A3A8E1A69C43D2A5D0D0C9607F2BDA"><enum>(3)</enum><text>For fiscal year
			 2010, $1,000,000.</text>
