		<section id="H92BC40AA779F490488A9721FB95F0879" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Performance Rights
			 Act</short-title></quote>.</text>
		</section><section id="HD6A7CA243F18466E8F00D57E82FFD537" section-type="subsequent-section"><enum>2.</enum><header>Equitable treatment
			 for terrestrial broadcasts</header>
			<subsection id="H6628353760A047148C84EBB16B00883F"><enum>(a)</enum><header>Performance
			 right applicable to radio transmissions generally</header><text>Section 106(6)
			 of title 17, United States Code, is amended to read as follows:</text>
				<quoted-block id="HC64E38CEABBC4357005684C044A06BBF" style="OLC">
					<paragraph id="HEE0360477F48473DAE7E4BD87346CF9"><enum>(6)</enum><text>in the case of
				sound recordings, to perform the copyrighted work publicly by means of an audio
				transmission.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H2970DB55816F4C8DA72072B11BFCE835"><enum>(b)</enum><header>Inclusion of
			 terrestrial broadcasts in existing performance right</header><text>Section
			 114(d)(1) of title 17, United States Code, is amended—</text>
				<paragraph id="HDE739248F8B748C194C1D7D48E740786"><enum>(1)</enum><text>in the matter
			 preceding subparagraph (A), by striking <quote>a digital</quote> and inserting
			 <quote>an</quote>; and</text>
				</paragraph><paragraph id="H35FDF676DC8443E7009ECF7D272F279D"><enum>(2)</enum><text>by striking
			 subparagraph (A).</text>
				</paragraph></subsection><subsection id="HA5EFB75F2D4C459488C4584D00A6A1F3"><enum>(c)</enum><header>Inclusion of
			 terrestrial broadcasts in existing statutory license
			 system</header><text><external-xref legal-doc="usc" parsable-cite="usc/17/114">Section 114(j)(6)</external-xref> of title 17, United States Code, is
			 amended by striking <quote>digital</quote>.</text>
			</subsection></section><section id="HEE3728247A3C4F14B34BD6500B3040"><enum>3.</enum><header>Special treatment
			 for small, noncommercial, educational, and religious stations and certain
			 uses</header>
			<subsection id="HE4B9688197C748A195283C2BE55194A4"><enum>(a)</enum><header>Small,
			 noncommercial, educational, and religious radio stations</header>
				<paragraph id="H3E131A80AE044AB4B662DD31950290F7"><enum>(1)</enum><header>In
			 general</header><text><external-xref legal-doc="usc" parsable-cite="usc/17/114">Section 114(f)(2)</external-xref> of title 17, United States Code, is
			 amended by adding at the end the following:</text>
					<quoted-block id="HD7E0D3F0C295430C8F32E5FCA112D615" style="OLC">
						<subparagraph id="H306FB663D1E441F5955416849EE6BE55" indent="up1"><enum>(D)</enum><text>Notwithstanding the provisions of
				subparagraphs (A) through (C), each individual terrestrial broadcast station
				that has gross revenues in any calendar year of less than $1,250,000 may elect
				to pay for its over-the-air nonsubscription broadcast transmissions a royalty
				fee of $5,000 per year, in lieu of the amount such station would otherwise be
				required to pay under this paragraph. Such royalty fee shall not be taken into
				account in determining royalty rates in a proceeding under chapter 8, or in any
				other administrative, judicial, or other Federal Government proceeding.</text>
						</subparagraph><subparagraph id="H9CB6C6B922804FAAB4F95BD008E00FE" indent="up1"><enum>(E)</enum><text>Notwithstanding the provisions of
				subparagraphs (A) through (C), each individual terrestrial broadcast station
				that is a public broadcasting entity as defined in section 118(f) may elect to
				pay for its over-the-air nonsubscription broadcast transmissions a royalty fee
				of $1,000 per year, in lieu of the amount such station would otherwise be
				required to pay under this paragraph. Such royalty fee shall not be taken into
				account in determining royalty rates in a proceeding under chapter 8, or in any
				other administrative, judicial, or other Federal Government
				proceeding.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" id="HAFE98D6A3E034187B7B34D40833B6FE9"><enum>(2)</enum><header>Payment
			 date</header><text display-inline="yes-display-inline">A payment under
			 subparagraph (D) or (E) of <external-xref legal-doc="usc" parsable-cite="usc/17/114">section 114(f)(2)</external-xref> of title 17, United States Code,
			 as added by paragraph (1), shall not be due until the due date of the first
			 royalty payments for nonsubscription broadcast transmissions that are
			 determined, after the date of the enactment of this Act, under such section
			 114(f)(2) by reason of the amendment made by section 2(b)(2) of this
			 Act.</text>
				</paragraph></subsection><subsection id="H08AB54C3931740BAAC19F7741946A400"><enum>(b)</enum><header>Transmission of
			 religious services; incidental uses of music</header><text>Section 114(d)(1) of
			 title 17, United States Code, as amended by section 2(b), is further amended by
			 inserting the following before subparagraph (B):</text>
				<quoted-block id="HF843023F4B024D3AA91C2B4C739F8300" style="OLC">
					<subparagraph id="H7A54B85178114D1589BC3ED2444E6EE0"><enum>(A)</enum><text>an eligible
				nonsubscription transmission of—</text>
						<clause id="H6F84B11535E747B393AD0200E26200F9"><enum>(i)</enum><text>services at a
				place of worship or other religious assembly; and</text>
						</clause><clause id="HEC2A58EF1BE74243B6C177509808048C"><enum>(ii)</enum><text>an incidental use
				of a musical sound
				recording;</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="H59AEA32CC9794BC5A38F16D600C2B7A6"><enum>4.</enum><header>Availability of
			 per program license</header><text display-inline="no-display-inline">Section
			 114(f)(2)(B) of title 17, United States Code, is amended by inserting after the
			 second sentence the following new sentence: <quote>Such rates and terms shall
			 include a per program license option for terrestrial broadcast stations that
			 make limited feature uses of sound recordings.</quote></text>
		</section><section id="HA16BEA87FA9A4FA5B6F4FDEBE91BD739"><enum>5.</enum><header>No
			 harmful effects on songwriters</header>
			<subsection id="H0B8FEB6BF8BC48A89B638DE41B1337F6"><enum>(a)</enum><header>Preservation of
			 royalties on underlying works</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/17/114">Section 114(i)</external-xref> of title 17, United States
			 Code, is amended in the second sentence by striking <quote>It is the intent of
			 Congress that royalties</quote> and inserting <quote>Royalties</quote>.</text>
			</subsection><subsection id="H7B8D65C7E61D4C13A0ED6D49CCD2B29"><enum>(b)</enum><header>Public
			 performance rights and royalties</header><text>Nothing in this Act shall
			 adversely affect in any respect the public performance rights of or royalties
			 payable to songwriters or copyright owners of musical works.</text>
