		<section id="H7675748472E448DD00BF540329ACEE00" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Renewable and Hydroelectric Energy for
			 Alaska’s Tomorrow Act (the Renewable HEAT Act)</short-title></quote> .</text>
		</section><section id="HB8C7D41E26784693A6271DEF5640E659"><enum>2.</enum><header>Renewable energy
			 construction grants</header>
			<subsection id="HA7CC36C9E2EA41F5875000917F96CF66"><enum>(a)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="HE19AD35E791648EA970029D42B2EFE60"><enum>(1)</enum><header>Alaska small
			 hydroelectric power</header><text>The term <term>Alaska small hydroelectric
			 power</term> means power that—</text>
					<subparagraph id="HD0363474F50041AC9C78E48829CC3563"><enum>(A)</enum><text>is
			 generated—</text>
						<clause id="HD1C9B709BC4C43AA00BB45AC1011C7AB"><enum>(i)</enum><text>in
			 the State of Alaska;</text>
						</clause><clause id="H29AD31358D964D16928D944BC77C163D"><enum>(ii)</enum><text>through the use
			 of—</text>
							<subclause id="HD2C3AEC753094E5200F9E004207BF92"><enum>(I)</enum><text>a
			 lake tap (but not a perched alpine lake);</text>
							</subclause><subclause id="H327D0F2117C547898F7025184E8B88AA"><enum>(II)</enum><text>a run-of-river
			 screened at the point of diversion; or</text>
							</subclause><subclause id="HE28298B4AA5D44069D62EC2D74FC5587"><enum>(III)</enum><text>a dam or
			 impoundment of water; and</text>
							</subclause></clause></subparagraph><subparagraph id="H75138C3A7ABE4D9AAF957C626596497C"><enum>(B)</enum><text>has a nameplate
			 capacity rating of a wattage that is not more than 15 megawatts.</text>
					</subparagraph></paragraph><paragraph id="H5825A8D8C6D546CD82AEA3DA5C5EADB"><enum>(2)</enum><header>Eligible
			 applicant</header><text>The term <term>eligible applicant</term> means
			 any—</text>
					<subparagraph id="H4800372895B340A7805E1BC5AEFF8012"><enum>(A)</enum><text>governmental
			 entity;</text>
					</subparagraph><subparagraph id="HEAFF3778B5A94679A5015CED4E6DDCE9"><enum>(B)</enum><text>private
			 utility;</text>
					</subparagraph><subparagraph id="H27E9DB7A79464FA49617D778338E3DE2"><enum>(C)</enum><text>public
			 utility;</text>
					</subparagraph><subparagraph id="HD9E3D92E5437413D83E0E8AC13759614"><enum>(D)</enum><text>municipal
			 utility;</text>
					</subparagraph><subparagraph id="HAA9D74F0EBD04908BFF94BB3016F5800"><enum>(E)</enum><text>cooperative
			 utility;</text>
					</subparagraph><subparagraph id="H9CAAFA6B1FA8454790608F77582691DD"><enum>(F)</enum><text>Indian tribe;
			 or</text>
					</subparagraph><subparagraph id="H59B48FCC9B5B4D40806E1DFD2B3100A0"><enum>(G)</enum><text>Regional
			 Corporation (as defined in section 3 of the Alaska Native Claims Settlement Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/43/1602">43 U.S.C. 1602</external-xref>)).</text>
					</subparagraph></paragraph><paragraph id="HB0171F7682CD4F1DBC7248EB0198F436"><enum>(3)</enum><header>Ocean
			 energy</header>
					<subparagraph id="H71EF9D33FD014A3380C808E1F7C2F3CC"><enum>(A)</enum><header>Inclusions</header><text>The
			 term <term>ocean energy</term> includes current, wave, and tidal energy.</text>
					</subparagraph><subparagraph id="H700E4003E3D1458D80F38F382041A800"><enum>(B)</enum><header>Exclusion</header><text>The
			 term <term>ocean energy</term> excludes thermal energy.</text>
					</subparagraph></paragraph><paragraph id="HFE856CBC88B94538AD5E9E05FB44263C"><enum>(4)</enum><header>Renewable energy
			 project</header><text>The term <term>renewable energy project</term> means a
			 project—</text>
					<subparagraph id="H0CCF4687FB4C493AA1250900983791FF"><enum>(A)</enum><text>for the commercial
			 generation of electricity; and</text>
					</subparagraph><subparagraph id="H81EE1711CB264E81AFF648F33E40482"><enum>(B)</enum><text>that generates
			 electricity from—</text>
						<clause id="H21B29280BB8041DFAB1C5DAF1665FB"><enum>(i)</enum><text>solar,
			 wind, or geothermal energy or ocean energy;</text>
						</clause><clause id="H5AA34928DF5E4958AC1F501300AF3002"><enum>(ii)</enum><text>biomass (as
			 defined in section 203(b) of the Energy Policy Act of 2005 (42 U.S.C.
			 15852(b)));</text>
						</clause><clause id="H42D1A6374498463387003BB7EEFDDA70"><enum>(iii)</enum><text>landfill gas;
			 or</text>
						</clause><clause id="H95DE25389CF04F7199F4D801D8A1E902"><enum>(iv)</enum><text>Alaska small
			 hydroelectric power.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="HCA03429EDB01431FB594DB01D583E8E6"><enum>(b)</enum><header>Renewable Energy
			 Construction Grants</header>
				<paragraph id="HDFF8125FB510482A85FEA28121EFD7F"><enum>(1)</enum><header>In
			 general</header><text>The Secretary of Energy shall use amounts appropriated
			 under this Act to make grants for use in carrying out renewable energy
			 projects.</text>
				</paragraph><paragraph id="HD7F464427119422690F13C4E016819BF"><enum>(2)</enum><header>Criteria</header><text>Not
			 later than 180 days after the date of enactment of this Act, the Secretary of
			 Energy shall set forth criteria for use in awarding grants under this
			 section.</text>
				</paragraph><paragraph id="H9BF0342F9538405698CC587889F19D19"><enum>(3)</enum><header>Application</header><text>To
			 receive a grant from the Secretary of Energy under paragraph (1), an eligible
			 applicant shall submit to the Secretary an application at such time, in such
			 manner, and containing such information as the Secretary may require, including
			 a written assurance that—</text>
					<subparagraph id="HE8DC384945F146BDB8A725F2922F83E"><enum>(A)</enum><text>all laborers and
			 mechanics employed by contractors or subcontractors during construction,
			 alteration, or repair that is financed, in whole or in part, by a grant under
			 this section shall be paid wages at rates not less than those prevailing on
			 similar construction in the locality, as determined by the Secretary of Labor
			 in accordance with sections 3141–3144, 3146, and 3147 of title 40, United
			 States Code; and</text>
					</subparagraph><subparagraph id="HAA2D0D249C694C3D9BA396D6D8BB96C4"><enum>(B)</enum><text>the Secretary of
			 Labor shall, with respect to the labor standards described in this paragraph,
			 have the authority and functions set forth in Reorganization Plan Numbered 14
			 of 1950 (5 U.S.C. App.) and <external-xref legal-doc="usc" parsable-cite="usc/40/3145">section 3145</external-xref> of title 40, United States
			 Code.</text>
					</subparagraph></paragraph><paragraph id="H51E72D9A0F104164B2E00F2E266BE3D"><enum>(4)</enum><header>Non-federal
			 share</header><text>Each eligible applicant that receives a grant under this
			 subsection shall contribute to the total cost of the renewable energy project
			 constructed by the eligible applicant an amount not less than 50 percent of the
			 total cost of the project.</text>
				</paragraph></subsection><subsection id="HAADC9D7466FF485FBCDC83E1DE84D76"><enum>(c)</enum><header>Authorization of
			 Appropriations</header><text>There are authorized to be appropriated to the
			 Fund such sums as are necessary to carry out this Act.</text>
