		<official-title>To amend part B of title XVIII of the Social Security Act
		  to repeal limiting charges under the Medicare Program for non-participating
		  physicians and to preempt State laws that prohibit balance
		  billing.</official-title>

		<section id="HD016D509F5934ADEB88554F110C0DC35" section-type="section-one"><enum>1.</enum><header>Removal of limiting charges
			 for physicians services under Medicare</header>
			<subsection id="HDA01274C0A454F92ABAF9473D003416D"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Sections 1848(g) of
			 the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-4">42 U.S.C. 1395w–4(g)</external-xref>) is amended—</text>
				<paragraph id="H876C2CB474304869BE5D2851FB322697"><enum>(1)</enum><text>in subsection (g),
			 by striking paragraphs (1) and (2); and</text>
				</paragraph><paragraph id="HB4FEFA9B917C45C089FB81CC3EFA14F1"><enum>(2)</enum><text>in subsection (h),
			 by striking <quote>and the maximum amount that may be charged consistent with
			 subsection (g)(2)</quote>.</text>
				</paragraph></subsection><subsection id="H697D6C9034094FFFB1364500105900FD"><enum>(b)</enum><header>Conforming
			 amendments</header>
				<paragraph id="HB8F1B0541BDD4D3AA70032D6D9123E2C"><enum>(1)</enum><text display-inline="yes-display-inline">Section 1842(b)(3) of such Act (42 U.S.C.
			 1395u(b)(3)) is amended by striking subparagraph (G).</text>
				</paragraph><paragraph id="HA917DF0567654969B52F0337D2E97EDE"><enum>(2)</enum><text>Section 1842(h)(7)
			 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395u">42 U.S.C. 1395u(h)(7)</external-xref>) is amended—</text>
					<subparagraph id="H3160DF57F9DD49CFA967E143E223672E"><enum>(A)</enum><text>by adding
			 <quote>and</quote> at the end of subparagraph (B);</text>
					</subparagraph><subparagraph id="H87E5EE08F8B6489A8D8CC068BD5CA7F1"><enum>(B)</enum><text>by striking
			 <quote>, and</quote> at the end of subparagraph (C) and inserting a period;
			 and</text>
					</subparagraph><subparagraph id="H67DB97BAF85A4C65B11B6C8D1124B833"><enum>(C)</enum><text>by striking
			 subparagraph (D).</text>
					</subparagraph></paragraph><paragraph id="H628087FDCA5C46C0A3B1901E7EEDBDB"><enum>(3)</enum><text>Section
			 1852(k)(2)(A) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-22">42 U.S.C. 1395w–22(k)(2)(A)</external-xref>) is amended by striking
			 clause (ii).</text>
				</paragraph></subsection><subsection id="H127E5A7C9BC5470388D58B48A9A1C171"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to services
			 furnished on or after the date of the enactment of this Act.</text>
			</subsection></section><section id="H2B776568068948D49BDA12B6D700B040"><enum>2.</enum><header>Preemption of
			 State laws limiting charges for physicians’ services</header>
			<subsection id="HFF3BD792EF5A41CA8E6877B73CE41406"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">No State may impose a
			 limit on the amount of charges, in relation to recognized payment amounts under
			 any health plan or otherwise, a physician (as defined in section 1861(r)(1) of
			 the Social Security Act) may impose for services furnished by the physician and
			 any such limit is hereby preempted.</text>
			</subsection><subsection id="HE9F18B25F2BD46CE9B3DD7426677AD00"><enum>(b)</enum><header>State</header><text>In
			 this section, the term <term>State</term> includes the District of Columbia,
			 Puerto Rico, the Virgin Islands, Guam, and American Samoa.</text>
