<official-title>To amend the Higher Education Act of 1965 to address the issues of college affordability and transparency.</official-title>

<section id="H658C47FCE58A4D7FA3D681C4F1C7FD18" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>College Affordability and Transparency Act of 2007</short-title></quote>.</text></section> 
<section id="HA9F194A2243D47369D16FEB7B744EF7B"><enum>2.</enum><header>Consumer information and public accountability in higher education</header><text display-inline="no-display-inline">Section 131 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1015">20 U.S.C. 1015</external-xref>) is amended to read as follows:</text>

<section id="HAE838EFC3CE04B519BA24874CBBD15D6"><enum>131.</enum><header>Consumer information and public accountability in higher education</header> 
<subsection id="H283B14592D254E348D951B00E15CCF69"><enum>(a)</enum><header>Purpose</header><text display-inline="yes-display-inline">It is the purpose of this section to—</text> 
<paragraph id="H05893327C49B41728674C5252B2E4009"><enum>(1)</enum><text>provide students and families with an easy-to-use, comprehensive web-based tool for researching and comparing institutions of higher education;</text></paragraph> 
<paragraph id="H61291C6A51B64C5F951B004866D6F366"><enum>(2)</enum><text>increase the transparency of college cost, price, and financial aid; and</text></paragraph> 
<paragraph id="HCCC0C92B8B5D4735A72FDC6422B30057"><enum>(3)</enum><text>raise public awareness of information available about postsecondary education, particularly among low-income families, non-traditional student populations, and first-generation college students.</text></paragraph></subsection> 
<subsection id="H3407F22A4DC34A39AA32CAA4E06C7820"><enum>(b)</enum><header>College Opportunity On-Line (COOL) Website Re-Design Process</header><text>In carrying out this section, the Commissioner of Education Statistics—</text> 
<paragraph id="H7D14DCE9EC1C48FC80CDD7E2D934298F"><enum>(1)</enum><text>shall identify the data elements that are of greatest importance to prospective students, enrolled students, and their families, paying particular attention to low-income, non-traditional student populations, and first-generation college students;</text></paragraph> 
<paragraph id="H123042D8EE8D4FC998667B4558BED143"><enum>(2)</enum><text>shall convene a group of individuals with expertise in the collection and reporting of data related to institutions of higher education to—</text> 
<subparagraph id="HA1A70F478AA94605A2C3DDBD630DA62"><enum>(A)</enum><text>determine the relevance of particular data elements to prospective students, enrolled students, and families;</text></subparagraph> 
<subparagraph id="H2114A53F6524426CAC4271A4DD2B5F2F"><enum>(B)</enum><text>assess the cost-effectiveness of various ways in which institutions of higher education might produce relevant data;</text></subparagraph> 
<subparagraph id="H95CE053E21FA441582FDF2D9495B9BFD"><enum>(C)</enum><text>determine the general comparability of the data across institutions of higher education;</text></subparagraph> 
<subparagraph id="H6A60ED24EEDF4F418D8CBF76D091005D"><enum>(D)</enum><text>make recommendations regarding the inclusion of specific data items and the most effective and least burdensome methods of collecting and reporting useful data from institutions of higher education; and</text></subparagraph></paragraph> 
<paragraph id="H05F6C337550B418FAADBA15DFAADE36B"><enum>(3)</enum><text>shall ensure that the redesigned COOL website—</text> 
<subparagraph id="HD408929A79364B75893F9BDD37A8F33F"><enum>(A)</enum><text>uses, to the extent practicable, data elements currently provided by institutions of higher education to the Secretary;</text></subparagraph> 
<subparagraph id="H809FCAC36EF04503983200F272BA79F"><enum>(B)</enum><text>includes clear and uniform information determined to be relevant to prospective students, enrolled students, and families;</text></subparagraph> 
<subparagraph id="HB41D9D8C466A4874A7AF4BD817DBB3B6"><enum>(C)</enum><text>provides comparable information, by ensuring that data are based on accepted criteria and common definitions;</text></subparagraph> 
<subparagraph id="HE9D80623095C4FE38643A11FF3C0A5DD"><enum>(D)</enum><text>includes a sorting function that permits users to customize their search for and comparison of institutions of higher education based on the information identified through the process as prescribed in <internal-xref idref="H7D14DCE9EC1C48FC80CDD7E2D934298F" legis-path="131.(b)(1)">paragraph (1)</internal-xref> as being of greatest relevance to choosing an institution of higher education.</text></subparagraph></paragraph></subsection> 
<subsection id="H27E60FA4183048C596828B274660EF30"><enum>(c)</enum><header>Data Collection</header> 
<paragraph id="H509DDBA538D44941B7B400A3AA22CD67"><enum>(1)</enum><header>Data system</header><text>The Commissioner of Education Statistics shall continue to redesign the relevant parts of the Integrated Postsecondary Education Data System to include additional data as required by this section and to continue to improve the usefulness and timeliness of data collected by such systems in order to inform consumers about institutions of higher education.</text></paragraph> 
<paragraph id="H441CAFF77AB240F590919C8357F0E700"><enum>(2)</enum><header>College consumer profile</header><text>The Secretary shall continue to publish on the COOL website, for each academic year and in accordance with standard definitions developed by the Commissioner of Education Statistics (including definitions developed under section 131(a)(3)(A) as in effect on the day before the date of enactment of the <short-title>College Affordability and Transparency Act of 2007</short-title>), from at least all institutions of higher education participating in programs under title IV the following information:</text> 
<subparagraph id="H9BA944C7BA9648CF8F5E44F13B02695E"><enum>(A)</enum><text>The tuition and fees charged for a first-time, full-time, full-year undergraduate student.</text></subparagraph> 
<subparagraph id="HCA90797B370B471AB982F91DA984793B"><enum>(B)</enum><text>The room and board charges for a first-time, full-time, full-year undergraduate student.</text></subparagraph> 
<subparagraph id="HB55C50CF55014F019239328322C3FCC3"><enum>(C)</enum><text>The price of attendance for a first-time, full-time, full-year undergraduate student, consistent with the provisions of section 472.</text></subparagraph> 
<subparagraph id="HD27CD9C174124BAC81B17A024C5FC85"><enum>(D)</enum><text>The average amount of financial assistance received by a first-year, full-time, full-year undergraduate student, including—</text> 
<clause id="HEA6641E9633241FFA1B4541B908C77C2"><enum>(i)</enum><text>each type of assistance or benefits described in 428(a)(2)(C)(ii);</text></clause> 
<clause id="H0D9AB5D430A7467C86759400C1E7FDD"><enum>(ii)</enum><text>institutional and other assistance; and</text></clause> 
<clause id="H1D933FD5E8034AC6AD35526F73427B23"><enum>(iii)</enum><text>Federal loans under parts B, D, and E of title IV.</text></clause></subparagraph> 
<subparagraph id="H36D0172172BC45A8B008CE5900D23DBF"><enum>(E)</enum><text>The number of first-time, full-time, full-year undergraduate students receiving financial assistance described in each clause of <internal-xref idref="HD27CD9C174124BAC81B17A024C5FC85" legis-path="131.(c)(2)(D)">subparagraph (D)</internal-xref>.</text></subparagraph> 
<subparagraph id="HAAA57D5F0B0B47E784BEA9B5418B5D7F"><enum>(F)</enum><text>The institutional instructional expenditure per full-time equivalent student.</text></subparagraph> 
<subparagraph id="HAEAEF77CF31747D3A9BC962FA578AA04"><enum>(G)</enum><text>Student enrollment information, including information on the number and percentage of full-time and part-time students, the number and percentage of resident and non-resident students. </text></subparagraph> 
<subparagraph id="H81DBC843DED1477FBFDE47760031D3EC"><enum>(H)</enum><text>Faculty-to-student ratios.</text></subparagraph> 
<subparagraph id="H6E77DA9488264ED294D94CF98E6CD1DF"><enum>(I)</enum><text>Faculty information, including the total number of faculty and the percentage of faculty who are full-time employees of the institution and the percentage who are part-time.</text></subparagraph> 
<subparagraph id="HFA4A8486D2B94BE199A6DBA83EADE759"><enum>(J)</enum><text>Completion and graduation rates of undergraduate students, identifying whether the completion or graduation rates are from a 2-year or 4-year program of instruction and, in the case of a 2-year program of instruction, the percentage of students who transfer to 4-year institutions prior or subsequent to completion or graduation.</text></subparagraph> 
<subparagraph id="HFE22D71737014EF7BDF5532F5174BFC4"><enum>(K)</enum><text>A link to the institution of higher education with information of interest to students including mission, accreditation, student services (including services for students with disabilities), transfer of credit policies and, if appropriate, placement rates and other measures of success in preparing students for entry into or advancement in the workforce.</text></subparagraph> 
<subparagraph id="HE7B87E6B866444DC86F19274717C6BCB"><enum>(L)</enum><text display-inline="yes-display-inline">The college affordability information elements specified in <internal-xref idref="HAC1E020FB8624112B6817C77EAAA28A2" legis-path="131.(d)">subsection (d)</internal-xref>.</text></subparagraph> 
<subparagraph id="H127BB2A318D14CA6B31DAC67F9EF3FC0"><enum>(M)</enum><text>Any additional information that the Secretary may require.</text></subparagraph></paragraph></subsection> 
<subsection id="HAC1E020FB8624112B6817C77EAAA28A2"><enum>(d)</enum><header>College affordability information elements</header><text>The college affordability information elements required by <internal-xref idref="HE7B87E6B866444DC86F19274717C6BCB" legis-path="131.(c)(2)(L)">subsection (c)(2)(L)</internal-xref> shall include, for each institution submitting data—</text> 
<paragraph id="HF4420916E8D24CC4B426F8DF671681CC"><enum>(1)</enum><text>the sticker price of the institution for the 3 most recent academic years;</text></paragraph> 
<paragraph id="H42E7585B177F4D2DAAAB4C58EC662300"><enum>(2)</enum><text>the net tuition price of the institution for the 3 most recent academic years;</text></paragraph> 
<paragraph id="HA52C6C200E5E4195B8008FE1B0B217FD"><enum>(3)</enum><text>the percentage change in both the sticker price and the net tuition price over the 3-year time period that is being reported;</text></paragraph> 
<paragraph id="HCDB1D56872DD45B58F7BE51D861C0005"><enum>(4)</enum><text>the percentage change in the CPI over the same time period; and</text></paragraph> 
<paragraph id="HF65DF411F92B41F891D5DEA9AC3B075F"><enum>(5)</enum><text>whether the institution has been placed on affordability alert status as required by <internal-xref idref="H3C3EDAF544AB44BCB8FC5C6161E363F" legis-path="131.(e)(3)">subsection (e)(3)</internal-xref>.</text></paragraph></subsection> 
<subsection id="H632A941FE8094E2685C177FE5C83F6C"><enum>(e)</enum><header>Outcomes and Actions</header> 
<paragraph id="HC056E6E510CF466A8971E47752F32B98"><enum>(1)</enum><header>Response from institution</header><text display-inline="yes-display-inline">Effective on June 30, 2008, an institution that increases its sticker price at a percentage rate for any 3-year interval ending on or after that date that exceeds two times the rate of change in the CPI over the same time period shall provide a report to the Secretary, in such a form, at such time, and containing such information as the Secretary may require. Such report shall be published by the Secretary on the COOL website, and shall include—</text> 
<subparagraph id="HB10460C6FF2442DE851DCA4364C23750"><enum>(A)</enum><text>a description of the factors contributing to the increase in the institution’s costs and in the tuition and fees charged to students; and</text></subparagraph> 
<subparagraph id="H181EF1B6BCA44E9B963596ED3BF68B86"><enum>(B)</enum><text>if determinations of tuition and fee increases are not within the exclusive control of the institution, a description of the agency or instrumentality of State government or other entity that participates in such determinations and the authority exercised by such agency, instrumentality, or entity.</text></subparagraph></paragraph> 
<paragraph id="H8C480A32C1644F61945BC29FB0D1BDF5"><enum>(2)</enum><header>Quality-efficiency task forces</header> 
<subparagraph id="H4655B91986974BEFAE1307F74969D154"><enum>(A)</enum><header>Required</header><text>Each institution subject to <internal-xref idref="HC056E6E510CF466A8971E47752F32B98" legis-path="131.(e)(1)">paragraph (1)</internal-xref> that has a percentage change in its sticker price that is in the highest 5 percent of all institutions subject to <internal-xref idref="HC056E6E510CF466A8971E47752F32B98" legis-path="131.(e)(1)">paragraph (1)</internal-xref> shall establish a quality-efficiency task force to review the operations of such institution.</text></subparagraph> 
<subparagraph id="H683A86BD7ACB4D278002EBBB7D5C3417"><enum>(B)</enum><header>Membership</header><text>Such task force shall include administrators, business and civic leaders, and faculty, and may include students, trustees, parents of students, and alumni of such institution.</text></subparagraph> 
<subparagraph id="HE92773EC99CC4B0D9732E76368044CF6"><enum>(C)</enum><header>Functions</header><text>Such task force shall analyze institutional operating costs in comparison with such costs at other institutions within the class of institutions. Such analysis should identify areas where, in comparison with other institutions in such class, the institution operates more expensively to produce a similar result. Any identified areas should then be targeted for in-depth analysis for cost reduction opportunities.</text></subparagraph> 
<subparagraph id="HB525DF210D77461DA5C6CAF9B8B0CC63"><enum>(D)</enum><header>Report</header><text>The results of the analysis by a quality-efficiency task force under this paragraph shall be made available to the public on the COOL website.</text></subparagraph></paragraph> 
<paragraph id="H3C3EDAF544AB44BCB8FC5C6161E363F"><enum>(3)</enum><header>Consequences for 2-year continuation of failure</header><text display-inline="yes-display-inline">If the Secretary determines that an institution that is subject to <internal-xref idref="HC056E6E510CF466A8971E47752F32B98" legis-path="131.(e)(1)">paragraph (1)</internal-xref>) has failed to reduce the subsequent increase in sticker price below two times the rate of change in the CPI for 2 consecutive academic years subsequent to the 3-year interval used under <internal-xref idref="HC056E6E510CF466A8971E47752F32B98" legis-path="131.(e)(1)">paragraph (1)</internal-xref>, the Secretary shall place the institution on affordability alert status.</text></paragraph> 
<paragraph id="H31D093159144487C91942BA243861DF4"><enum>(4)</enum><header>Exemptions</header><text display-inline="yes-display-inline">Notwithstanding <internal-xref idref="H3C3EDAF544AB44BCB8FC5C6161E363F" legis-path="131.(e)(3)">paragraph (3)</internal-xref>, an institution shall not be placed on affordability alert status if, for any 3-year interval for which sticker prices are computed under <internal-xref idref="HC056E6E510CF466A8971E47752F32B98" legis-path="131.(e)(1)">paragraph (1)</internal-xref>—</text> 
<subparagraph id="HBFFF52629E5344768C713FA34FA8265"><enum>(A)</enum><text display-inline="yes-display-inline">with respect the the class of institutions described in <internal-xref idref="H093FE9D6AD5849538FF6EC1B02318171" legis-path="131.(e)(6)">paragraph (6)</internal-xref> to which the institution belongs, the sticker price of the institution is in the lowest quartile of institutions within such class, as determined by the Secretary, during the last year of such 3-year interval; or</text></subparagraph> 
<subparagraph id="H17BD2EEFC29646FCBFDBB8FCDACEF3D4"><enum>(B)</enum><text display-inline="yes-display-inline">the institution has a percentage change in its sticker price computed under <internal-xref idref="HC056E6E510CF466A8971E47752F32B98" legis-path="131.(e)(1)">paragraph (1)</internal-xref> that exceeds two times the rate of change in the CPI over the same time period, but the dollar amount of the sticker price increase is less than $500.</text></subparagraph></paragraph> 
<paragraph id="H37F4FA04B3F345C7A2D22D4133E888CE"><enum>(5)</enum><header>Information to state agencies</header><text>Any institution that reports under <internal-xref idref="H181EF1B6BCA44E9B963596ED3BF68B86" legis-path="131.(e)(1)(B)">paragraph (1)(B)</internal-xref> that an agency or instrumentality of State government or other entity participates in the determinations of tuition and fee increases shall, prior to submitting any information to the Secretary under this subsection, submit such information to, and request the comments and input of, such agency, instrumentality, or entity. With respect to any such institution, the Secretary shall provide a copy of any communication by the Secretary with that institution to such agency, instrumentality, or entity.</text></paragraph> 
<paragraph id="H093FE9D6AD5849538FF6EC1B02318171"><enum>(6)</enum><header>Classes of institutions</header><text>For purposes of this subsection, the classes of institutions shall be those sectors used by the Integrated Postsecondary Education Data System, based on whether the institution is public, nonprofit private, or for-profit private, and whether the institution has a 4-year, 2-year, or less than 2-year program of instruction.</text></paragraph> 
<paragraph id="H438C05C493B74EFF8CF93595374F5900"><enum>(7)</enum><header>Data rejection</header><text>Nothing in this subsection shall be construed as allowing the Secretary to reject the data submitted by an individual institution of higher education.</text></paragraph></subsection> 
<subsection id="H58A72680AA1442CAB755900057496961"><enum>(f)</enum><header>Information to the Public</header><text display-inline="yes-display-inline">The Secretary shall work with public and private entities to promote broad public awareness, particularly among middle and high school students and their families, of the information made available under this section, including by distribution to students who participate in or receive benefits from means-tested federally funded education programs and other Federal programs determined by the Secretary.</text></subsection> 
<subsection id="HD868D55DECB646618DF809527E2621E8"><enum>(g)</enum><header>Fines</header><text display-inline="yes-display-inline">In addition to actions authorized in section 487(c), the Secretary may impose a fine in an amount not to exceed $25,000 on an institution of higher education for failing to provide the information required by this section in a timely and accurate manner, or for failing to otherwise cooperate with the National Center for Education Statistics regarding efforts to obtain data under subsections (c) and (j) and pursuant to the program participation agreement entered into under section 487.</text></subsection> 
<subsection id="HF4C234C0514E4553AF8E784055D8A66D"><enum>(h)</enum><header>GAO Study and Report</header> 
<paragraph id="H1FA30200A3FD4C838CB67C9BC78F1236"><enum>(1)</enum><header>GAO Study</header><text>The Comptroller General shall conduct a study of the policies and procedures implemented by institutions in increasing the affordability of postsecondary education. Such study shall include information with respect to—</text> 
<subparagraph id="H6E912850D3F44F9A9C95599D8369A9D2"><enum>(A)</enum><text>a list of those institutions that—</text> 
<clause id="H473A97EF4D47496AADC782E95C28FE21"><enum>(i)</enum><text>have reduced their sticker prices; or </text></clause> 
<clause id="H07D9695712DD499D87D69E935E2CEAE5"><enum>(ii)</enum><text>are within the least costly quartile of institutions within each class described in <internal-xref idref="H093FE9D6AD5849538FF6EC1B02318171" legis-path="131.(e)(6)">subsection (e)(6)</internal-xref>;</text></clause></subparagraph> 
<subparagraph id="H629CAEC490A8450B8EACB700507BB400"><enum>(B)</enum><text>policies implemented to stem the increase in tuition and fees and institutional costs;</text></subparagraph> 
<subparagraph id="HD400FD988C0140EB8359BA579D03D23D"><enum>(C)</enum><text>the extent to which room and board costs and prices changed;</text></subparagraph> 
<subparagraph id="HC99833D7898C40C786BC303248181F2F"><enum>(D)</enum><text>the extent to which other services were altered to affect tuition and fees;</text></subparagraph> 
<subparagraph id="HBCDB3127A749420EA5C15F7663635840"><enum>(E)</enum><text>the extent to which the institution's policies affected student body demographics and time to completion;</text></subparagraph> 
<subparagraph id="H7B6431B9F9524B11821B70CE5D2E2D44"><enum>(F)</enum><text>what, if any, operational factors played a role in reducing tuition and fees;</text></subparagraph> 
<subparagraph id="H32B29B94200C454C99D8C96F8875B205"><enum>(G)</enum><text>the extent to which academic quality was affected, and how;</text></subparagraph> 
<subparagraph id="HD77D36288A1E4DDE93A601B423DDD19E"><enum>(H)</enum><text>if the institution is a public institution, the relationship between State and local appropriations and the institution's tuition and fees;</text></subparagraph> 
<subparagraph id="HC14F7465A9B840E9A3D5FF1E3000DC51"><enum>(I)</enum><text>the extent to which policies and practices reducing costs and prices may be replicated from one institution to another; and</text></subparagraph> 
<subparagraph id="H14C41D713A8F41EC8B010095E0CC32C5"><enum>(J)</enum><text>other information as necessary to determine best practices in increasing the affordability of postsecondary education.</text></subparagraph></paragraph> 
<paragraph id="H32C9E0FF2AFB4EAAADB25FDE48FB430"><enum>(2)</enum><header>Interim and final reports</header><text display-inline="yes-display-inline"> The Comptroller General shall submit an interim and a final report regarding the findings of the study required by <internal-xref idref="H1FA30200A3FD4C838CB67C9BC78F1236" legis-path="131.(h)(1)">paragraph (1)</internal-xref> to the appropriate authorizing committees of Congress. The interim report shall be submitted not later than July 31, 2011, and the final report shall be submitted not later than July 31, 2013.</text></paragraph></subsection> 
<subsection id="HC3617DDE791A4346ACB881FF316D3540"><enum>(i)</enum><header>Student Aid Recipient Survey</header> 
<paragraph id="H470873A0DDFF48C3898BAE8C06C0A6D2"><enum>(1)</enum><header>Survey required</header><text>The Secretary shall conduct a survey of student aid recipients under title IV on a regular cycle and State-by-State basis, but not less than once every 4 years—</text> 
<subparagraph id="H342B382B158C4AEFACAA25203010D3BF"><enum>(A)</enum><text>to identify the population of students receiving Federal student aid;</text></subparagraph> 
<subparagraph id="H69E13125C5534F7F824C7EA70809B2ED"><enum>(B)</enum><text>to describe the income distribution and other socioeconomic characteristics of federally aided students;</text></subparagraph> 
<subparagraph id="H990F586AC0244A7187E2952010C55D34"><enum>(C)</enum><text>to describe the combinations of aid from State, Federal, and private sources received by students from all income groups;</text></subparagraph> 
<subparagraph id="H1B99A690FF8342DC8CF8C3EE801207CB"><enum>(D)</enum><text>to describe the debt burden of educational loan recipients and their capacity to repay their education debts, and the impact of such debt burden on career choices;</text></subparagraph> 
<subparagraph id="HBA62A9DF9F9D4CC100FCBF9180002C06"><enum>(E)</enum><text>to describe the role played by the price of postsecondary education in the determination by students of what institution to attend; and </text></subparagraph> 
<subparagraph id="H711B1AC2654D4A038B00BC00AA476349"><enum>(F)</enum><text>to describe how the increased costs of textbooks and other instructional materials affects the costs of postsecondary education to students.</text></subparagraph></paragraph> 
<paragraph id="HC0133A50E35B49578397872EA3FA009D"><enum>(2)</enum><header>Survey design</header><text>The survey shall be representative of full-time and part-time, undergraduate, graduate, and professional and current and former students in all types of institutions, and designed and administered in consultation with the Congress and the postsecondary education community.</text></paragraph> 
<paragraph id="H15F279A0AF9B4326AABE7CB9F9D3D55"><enum>(3)</enum><header>Dissemination</header><text>The Commissioner of Education Statistics shall disseminate the information resulting from the survey in both printed and electronic form.</text></paragraph></subsection> 
<subsection id="HFC4194CCCFB44391AD1E7B2460DC24CB"><enum>(j)</enum><header>Regulations</header><text>The Secretary is authorized to issue such regulations as may be necessary to carry out the provisions of this section.</text></subsection> 
<subsection id="HC3B29C3A2E9F4A95A02F51654E4FE505"><enum>(k)</enum><header>Definitions</header><text>For the purposes of this section:</text> 
<paragraph id="H64F112FD5C34481D8F08A174CC6E6FA9"><enum>(1)</enum><header>Net tuition price</header><text>The term <term>net tuition price</term> means the average tuition and fees charged to a first-time, full-time, full-year undergraduate student, minus the average grants provided to such students, for any academic year.</text></paragraph> 
<paragraph id="H41E4746718544869B4685221A5C14FB"><enum>(2)</enum><header>Sticker price</header><text>The term <term>sticker price</term> means the average tuition and fees charged to a first-time, full-time, full-year undergraduate student by an institution of higher education for any academic year.</text></paragraph> 
<paragraph id="H1A014C8F4EB3427981C17002A3F61B65"><enum>(3)</enum><header>CPI</header><text display-inline="yes-display-inline">The term <term>CPI</term> means the Consumer Price Index-All Urban Consumers (Current Series).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HBD0DCF6F92E44D7C86AE4EE6EB1B63DC"><enum>3.</enum><header>College Affordability Demonstration Project</header><text display-inline="no-display-inline">Part G of title IV is amended by inserting after section 486 (<external-xref legal-doc="usc" parsable-cite="usc/20/1093">20 U.S.C. 1093</external-xref>) the following new section:</text>

<section id="H6DF8D13C2DB64AB895AA30460003416C"><enum>486A.</enum><header>College Affordability Demonstration Project</header> 
<subsection id="H1463A6E099D8415CBD106037F041A172"><enum>(a)</enum><header>Purpose</header><text display-inline="yes-display-inline">It is the purpose of this section—</text> 
<paragraph id="H18BDDF272560436F95B0F3E744F2E729"><enum>(1)</enum><text>to provide, through a college affordability demonstration project, for increased innovation in the delivery of higher education and student financial aid in a manner resulting in reduced costs for students as well as the institution by employing one or more strategies including accelerating degree or program completion, increasing availability of, and access to, distance components of education delivery, engaging in collaborative arrangements with other institutions and organizations, and other alternative methodologies; and</text></paragraph> 
<paragraph id="HA6AAF00AE592435BAE8CA1A2DE75F393"><enum>(2)</enum><text>to help determine—</text> 
<subparagraph id="H1A97AAB789DF4FF6B5C2B77100817087"><enum>(A)</enum><text>the most effective means of delivering student financial aid as well as quality education;</text></subparagraph> 
<subparagraph id="H40C172DDB7E6466E001148B1451D4D63"><enum>(B)</enum><text>the specific statutory and regulatory requirements that should be altered to provide for more efficient and effective delivery of student financial aid, as well as access to high quality distance education programs, resulting in a student more efficiently completing postsecondary education; and</text></subparagraph> 
<subparagraph id="H32448947EB8949928C8F578C09C1D625"><enum>(C)</enum><text>the most effective methods of obtaining and managing institutional resources.</text></subparagraph></paragraph></subsection> 
<subsection id="H7C4DF316459A4579A686E2E81FB25FB"><enum>(b)</enum><header>Demonstration Project Authorized</header> 
<paragraph id="H53CCEB1A6DF24C09BAD099A7EB3C909F"><enum>(1)</enum><header>In general</header><text>In accordance with the purposes described in subsection (a) and the provisions of subsection (d), the Secretary is authorized to select not more than 100 institutions of higher education, including those applying as part of systems or consortia of such institutions, for voluntary participation in the College Affordability Demonstration Project in order to enable participating institutions to carry out such purposes by providing programs of postsecondary education, and making available student financial assistance under this title to students enrolled in those programs, in a manner that would not otherwise meet the requirements of this title.</text></paragraph> 
<paragraph id="HF0F17871702042738E5E481E77E5F6AF"><enum>(2)</enum><header>Waivers</header><text>The Secretary is authorized to waive for any institutions of higher education, or any system or consortia of institutions of higher education, selected for participation in the College Affordability Demonstration Project, any requirements of this Act or the regulations thereunder as deemed necessary by the Secretary to meet the purpose described in subsection (a)(1), and shall make a determination that the waiver can reasonably be expected to result in reduced costs to students or institutions without an increase in Federal program costs. The Secretary may not waive under this paragraph the maximum award amounts for an academic year or loan period.</text></paragraph> 
<paragraph id="H9E2DB992657F4A678EA3005FE800978E"><enum>(3)</enum><header>Eligible applicants</header> 
<subparagraph id="H513CA075450E446E9D7677C85241D13"><enum>(A)</enum><header>Eligible institutions</header><text>Except as provided in subparagraph (B), only an institution of higher education that is eligible to participate in programs under this title shall be eligible to participate in the demonstration project authorized under this section.</text></subparagraph> 
<subparagraph id="H88D1A4C180D24DC1963C6B3B4F4000FD"><enum>(B)</enum><header>Prohibition</header><text>An institution of higher education described in section 102(a)(1)(C) shall not be eligible to participate in the demonstration project authorized under this section.</text></subparagraph></paragraph></subsection> 
<subsection id="HC3812C810D3049B694D3458B33CBABA3"><enum>(c)</enum><header>Application</header> 
<paragraph id="HE64A5A07E37949E8B3D1EF3C1E20ED6"><enum>(1)</enum><header>In general</header><text>Each institution or system of institutions desiring to participate in the demonstration project under this section shall submit an application to the Secretary at such time and in such manner as the Secretary may require.</text></paragraph> 
<paragraph id="HC0E403E121E749D6834C1ED5EB525D7D"><enum>(2)</enum><header>Contents of applications</header><text>Each application for the college affordability demonstration project shall include at least the following:</text> 
<subparagraph id="H840BBC7BE44742B48FB4B27878427F23"><enum>(A)</enum><text>a description of the institution or system or consortium of institutions and what quality assurance mechanisms are in place to ensure the integrity of the Federal financial aid programs;</text></subparagraph> 
<subparagraph id="H8E72F5C4F1654758B7B9BBADF738A593"><enum>(B)</enum><text>a description of the innovation or innovations being proposed and the affected programs and students, including—</text> 
<clause id="HACAD740DC3D647F19B196870D5FA07B8"><enum>(i)</enum><text>a description of any collaborative arrangements with other institutions or organizations to reduce costs;</text></clause> 
<clause id="HD090439E09AF4BD69C1CBE8528188E45"><enum>(ii)</enum><text>a description of any expected economic impact of participation in the project within the community in which the institution is located; and</text></clause> 
<clause id="HF237EDF42DE04F1CB490CF4BC580000"><enum>(iii)</enum><text>a description of any means the institution will employ to reduce the costs of instructional materials, such as textbooks;</text></clause></subparagraph> 
<subparagraph id="H086A65DF36E54C5FA1B52415DF319FC8"><enum>(C)</enum><text>a description of each regulatory or statutory requirement for which waivers are sought, with a reason for each waiver;</text></subparagraph> 
<subparagraph id="H3801D5B068C84D82A9A32C6F69DEF00"><enum>(D)</enum><text>a description of the expected outcomes of the program changes proposed, including the estimated reductions in costs both for the institution and for students;</text></subparagraph> 
<subparagraph id="H0AAA456D58364588B0D2EE3DBBF4EF07"><enum>(E)</enum><text>an assurance from each institution in a system or consortium of a commitment to fulfill its role as described in the application;</text></subparagraph> 
<subparagraph id="H3254229561434A089D871D621380F19"><enum>(F)</enum><text>an assurance that the participating institution or system of institutions will offer full cooperation with the ongoing evaluations of the demonstration project provided for in this section; and</text></subparagraph> 
<subparagraph id="HA399DEDD88F344378B00B8115FB1A6B8"><enum>(G)</enum><text>any other information or assurances the Secretary may require.</text></subparagraph></paragraph></subsection> 
<subsection id="H092DD3330A264DB9ABBEF5EEC4DA374D"><enum>(d)</enum><header>Selection</header><text display-inline="yes-display-inline">In selecting institutions to participate in the demonstration project under this section, the Secretary shall take into account—</text> 
<paragraph id="HE6DA8350469249D4A43608D026B5523C"><enum>(1)</enum><text>the number and quality of applications received, determined on the basis of the contents required by subsection (c)(2);</text></paragraph> 
<paragraph id="H31AFB1FE316A4B328949E1FBE1001967"><enum>(2)</enum><text>the Department's capacity to oversee and monitor each institution's participation;</text></paragraph> 
<paragraph id="H70C959D7E2524602AE9DC7295E28D500"><enum>(3)</enum><text>an institution's—</text> 
<subparagraph id="HB08508A38FF84584A4230000FBC94CD3"><enum>(A)</enum><text>financial responsibility;</text></subparagraph> 
<subparagraph id="H953A7CC5B3E9416F96F6175781FE1F7D"><enum>(B)</enum><text>administrative capability;</text></subparagraph> 
<subparagraph id="H2683F5F472324819811598B32F8EDA33"><enum>(C)</enum><text>program or programs being offered via distance education, if applicable;</text></subparagraph> 
<subparagraph id="H4B58F920F8A34FDF998BC09033E3D24C"><enum>(D)</enum><text>student completion rates; and</text></subparagraph> 
<subparagraph id="HB5570F8CF89348A5AE85FB57061F6FC5"><enum>(E)</enum><text>student loan default rates; and</text></subparagraph></paragraph> 
<paragraph id="H4DDDAB5AC09645A3BD41ADC9C63E1A9"><enum>(4)</enum><text>the participation of a diverse group of institutions with respect to size, mission, and geographic distribution.</text></paragraph></subsection> 
<subsection id="H2636471C46BF4BAD98ACC9D693CB2C53"><enum>(e)</enum><header>Notification</header><text display-inline="yes-display-inline">The Secretary shall make available to the public and to the authorizing committees a list of institutions selected to participate in the demonstration project authorized by this section. Such notice shall include a listing of the specific statutory and regulatory requirements being waived for each institution and a description of the innovations being demonstrated.</text></subsection> 
<subsection id="HAA7D2F7EE2544AAF9FBFAED56144ED8"><enum>(f)</enum><header>Evaluations and Reports</header> 
<paragraph id="HEF3EC4AD5DFD4E5FA4231C8F145932C"><enum>(1)</enum><header>Evaluation</header><text>The Secretary shall evaluate the demonstration project authorized under this section on a biennial basis. Such evaluations specifically shall review—</text> 
<subparagraph id="HABD77810D0A34AB88E8383582136FAC"><enum>(A)</enum><text>the extent to which expected outcomes, including the estimated reductions in cost, were achieved;</text></subparagraph> 
<subparagraph id="H7E2B0DF1E7684D7F8F9955DCAEAF81F"><enum>(B)</enum><text>the number and types of students participating in the programs offered, including the progress of participating students toward recognized certificates or degrees and the extent to which participation in such programs increased;</text></subparagraph> 
<subparagraph id="H2145CE91B2DD4F6C9BF6D03E4BE157DA"><enum>(C)</enum><text>issues related to student financial assistance associated with the innovations undertaken;</text></subparagraph> 
<subparagraph id="H58AD5425B9224380B6812BC3F2ECE246"><enum>(D)</enum><text>effective technologies and alternative methodologies for delivering student financial assistance;</text></subparagraph> 
<subparagraph id="HA08C3381122D405DBDB54D04A5AD853C"><enum>(E)</enum><text>the extent of the cost savings to the institution, the student, and the Federal Government resulting from the waivers provided, and an estimate as to future cost savings for the duration of the demonstration project;</text></subparagraph> 
<subparagraph id="H932DF38308E0469FA6FA225D953E97DE"><enum>(F)</enum><text>the extent to which students saved money by completing their postsecondary education sooner;</text></subparagraph> 
<subparagraph id="HDC472C64A4CB45DB939DE190AB67AD7F"><enum>(G)</enum><text>the extent to which the institution reduced its tuition and fees and its costs by participating in the demonstration project</text></subparagraph> 
<subparagraph id="HF9480AC0A1D3404B95CB5581F704D106"><enum>(H)</enum><text>the extent to which any collaborative arrangements with other institutions or organizations have reduced the participating institution's costs; and</text></subparagraph> 
<subparagraph id="H8022D0A4EB014D2AA939A9DA9221FC0"><enum>(I)</enum><text>the extent to which statutory or regulatory requirements not waived under the demonstration project present difficulties for students or institutions.</text></subparagraph></paragraph> 
<paragraph id="H385B2CD44E984D8EAD8B005E4FEAE500"><enum>(2)</enum><header>Policy analysis</header><text>The Secretary shall review current policies and identify those policies that present impediments to the implementation of innovations that result in cost savings and in expanding access to education.</text></paragraph> 
<paragraph id="HD21C661CB37F42A5B200003942AC21AB"><enum>(3)</enum><header>Reports</header><text>The Secretary shall provide a report to the authorizing committees on a biennial basis regarding—</text> 
<subparagraph id="H759952C9B86640CE912150B71391A4D2"><enum>(A)</enum><text>the demonstration project authorized under this section;</text></subparagraph> 
<subparagraph id="H72A1768004B34F24AA88F7659DF0C958"><enum>(B)</enum><text>the results of the evaluations conducted under paragraph (1);</text></subparagraph> 
<subparagraph id="H2578124CAA0C4363A38D0226BA6F6834"><enum>(C)</enum><text>the cost savings to the Federal Government by the demonstration project authorized by this section; and</text></subparagraph> 
<subparagraph id="HEA523C4EDF2B427600B102FCEDB89B5F"><enum>(D)</enum><text>recommendations for changes to increase the efficiency and effective delivery of financial aid.</text></subparagraph></paragraph></subsection> 
<subsection id="H57DCFC3E854440EBADD8C47423E42B90"><enum>(g)</enum><header>Oversight</header><text>In conducting the demonstration project authorized under this section, the Secretary shall, on a continuing basis—</text> 
<paragraph id="H9383F48363A54FE4A5A7E8D86ED4924"><enum>(1)</enum><text>ensure compliance of institutions or systems of institutions with the requirements of this title (other than the sections and regulations that are waived under subsection (b)(2));</text></paragraph> 
<paragraph id="HEA0150A747D8412B8C9C32709B7EE279"><enum>(2)</enum><text>provide technical assistance to institutions in their application to and participation in the demonstration project;</text></paragraph> 
<paragraph id="HD4E8ADE603E74D8C8F4E2D4B08F03850"><enum>(3)</enum><text>monitor fluctuations in the student population enrolled in the participating institutions or systems of institutions;</text></paragraph> 
<paragraph id="H71FC9848726541B7992ED33CD9691E0"><enum>(4)</enum><text>monitor changes in financial assistance provided at the institution; and</text></paragraph> 
<paragraph id="H7B2AD63E23554BD5BFF75B4622F9D88F"><enum>(5)</enum><text>consult with appropriate accrediting agencies or associations and appropriate State regulatory authorities.</text></paragraph></subsection> 
<subsection id="HFD7084BA61E0454D9307D549E746A065"><enum>(h)</enum><header>Termination of Authority</header><text>The authority of the Secretary under this section shall cease to be effective on October 1, 2012.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
