<official-title>To amend the Federal Employees’ Compensation Act to cover services provided to injured Federal workers by physician assistants and nurse practitioners, and for other purposes.</official-title>

<section section-type="section-one" id="H88F3C0BFEF3E423CA33B1B642B618945" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Improving Access to Workers’ Compensation for Injured Federal Workers Act</short-title></quote>.</text></section> 
<section id="HBA7EC800ED8343C2BDFDB7606936F4F6"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> 
<paragraph id="H17DF890700E24A32A97E77669DA23B6"><enum>(1)</enum><text display-inline="yes-display-inline">Medical services and supplies provided by physician assistants (PAs), nurse practitioners (NPs), clinical nurse specialists (CNSs), certified nurse midwives (CNMs), and certified registered nurse anesthetists (CRNAs), are not included in the definition of <quote>medical, surgical, and hospital services and supplies</quote> in the Federal Employees’ Compensation Act (<external-xref legal-doc="usc" parsable-cite="usc/5/8101">5 U.S.C. 8101 et seq.</external-xref>). PAs, NPs, CNSs, CNMs, and CRNAs are not included in the definition of <quote>physician</quote> in such Act, and claims signed by PAs, NPs, CNSs, CNMs, and CRNAs have been denied by the Office of Workers’ Compensation Programs of the Department of Labor. </text></paragraph> 
<paragraph id="H4A00E52EB139411190D5DDBE0081BC03"><enum>(2)</enum><text>In some rural areas where many of these providers are the only full-time providers of care, injured Federal workers may have to travel more than 100 miles to receive care that is reimbursable. </text></paragraph> 
<paragraph id="H8A1DF107CE1045468CDA67BDA0B096F4"><enum>(3)</enum><text>In some cases, Federal workers have been advised to use hospital emergency rooms for non-emergency care, rather than receiving care after hours at local clinics where many of these providers are the only health care professionals on-site. </text></paragraph> 
<paragraph id="HB80D7904DECE4758A4001BDABD2224"><enum>(4)</enum><text>PAs, NPs, CNSs, and CNMs are covered providers within Medicare, Medicaid, Tri-Care, and most private insurance plans. </text></paragraph> 
<paragraph id="HB22DF271B8224C6CB01F2EB5D5346201"><enum>(5)</enum><text>PAs, NPs, and CNMs are legally regulated in all 50 States, the District of Columbia, and Guam.</text></paragraph> 
<paragraph id="H1AFB72CF76894012A3237BFF5BC89F12"><enum>(6)</enum><text>All 50 States, the District of Columbia, and Guam authorize physicians to delegate prescriptive privileges to the PAs they supervise, authorize NPs to prescribe medications under their own signature, and 48 States, the District of Columbia, American Samoa, and Guam provide prescriptive authority to CNMs. </text></paragraph> 
<paragraph id="HE9392079C3F046989D5D84F85F4470B0"><enum>(7)</enum><text>PAs and NPs work in virtually every area of medicine and surgery and are also employed by the Federal government to provide medical care, including by the Department of Veterans Affairs, the Department of Defense, and the Public and Indian Health Services. </text></paragraph> 
<paragraph id="H6BD939B3EFF3410FA6947268AEEC3DC9"><enum>(8)</enum><text>CNSs have clinical nursing expertise in diagnosis and provide direct care to prevent, remediate, or alleviate illness and promote health. CNSs practice in hospitals, clinics, nursing homes, and other community-based settings. </text></paragraph> 
<paragraph id="HC57CEE0FA02440E0861FD867482124A0"><enum>(9)</enum><text>CNMs provide vital care to pregnant Federal workers who are injured on the job.</text></paragraph> 
<paragraph id="HAE550DBAF7EE4E2FAFACB932B00764E"><enum>(10)</enum><text>CRNAs, the oldest of the advanced nursing specialties, administer more than 65 percent of all anesthetics given to patients each year, and are the sole providers of anesthetics in 85 percent of rural hospitals.</text></paragraph> 
<paragraph id="H7AA2893FEDC14C0E009BBB25000193F6"><enum>(11)</enum><text>CRNAs work in almost every setting in which <italic></italic>anesthesia is given, including operating rooms, dental offices, pain clinics, and ambulatory surgical settings. </text></paragraph> 
<paragraph id="HD6237E3E4FAF4D3690B4D8B36A7067"><enum>(12)</enum><text>Amending the Federal Employees’ Compensation Act to recognize PAs and NPs as covered providers will bring this Act in line with the overwhelming majority of State workers’ compensation programs, which recognize PAs and NPs as covered providers. </text></paragraph> 
<paragraph id="H1EA138FC83F74F72A1F0A183E12D272C"><enum>(13)</enum><text>The exclusion of PAs, NPs, CNSs, CNMs, and CRNAs from the category of covered providers under the Federal Employees’ Compensation Act limits patients’ access to medical care, services, and supplies, disrupts continuity of care, and creates unnecessary costs for the Office of Workers’ Compensation Programs.</text> </paragraph></section> 
<section id="HAE67091E8F3B448F8C48AC57F71FD0A7"><enum>3.</enum><header>Inclusion of physician assistants and advanced practice registered nurses in Federal employees’ compensation Act</header> 
<subsection id="HFA087274BBA14827B22C81028D02166C"><enum>(a)</enum><header>Inclusion</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/8101">Section 8101</external-xref> of title 5, United States Code, is amended—</text> 
<paragraph id="H9039BFDB892B4099B44F42E6933B4B92"><enum>(1)</enum><text>in paragraph (3), by inserting <quote>other eligible providers,</quote> after <quote>chiropractors,</quote>;</text></paragraph> 
<paragraph id="H2E50D601425E4A00BCE000525DD50039"><enum>(2)</enum><text>by striking <quote>and</quote> at the end of paragraphs (18) and (19);</text></paragraph> 
<paragraph id="HC813433835364BB9868BFD441CAEF2DD"><enum>(3)</enum><text>by striking the period at the end of paragraph (20) and inserting <quote>; and</quote>; and </text></paragraph> 
<paragraph id="HEF094DB9E123455AAD32C3DF30D7FDC"><enum>(4)</enum><text>by adding at the end the following:</text>

<paragraph id="HB0769FDD97924F55A3622C32E68F5C30"><enum>(21)</enum><text display-inline="yes-display-inline"><quote>other eligible provider</quote> means a physician assistant, nurse practitioner, clinical nurse specialist, certified nurse midwife, or certified registered nurse anesthetist, within the scope of their practice as defined by State law, or as credentialed by the Federal government.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HEE87687EFFE242E39B451B002F6524D9"><enum>(b)</enum><header>Conforming amendments</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/81">Chapter 81</external-xref> of title 5, United States Code, is amended—</text> 
<paragraph id="HAF58FCBA7D2D4A59A69DEFC661B25F00"><enum>(1)</enum><text>in section 8103(a)—</text> 
<subparagraph id="H14229030222846939C4E7431447D63C7"><enum>(A)</enum><text>in the matter preceding paragraph (1), by inserting <quote>or other eligible provider</quote> after <quote>physician</quote>;</text></subparagraph> 
<subparagraph id="H1ED4F46888084E24938D34012D446C7E"><enum>(B)</enum><text>in paragraph (3), by inserting <quote>or other eligible providers</quote> after <quote>physicians</quote>; and</text></subparagraph> 
<subparagraph id="HD4DA9516EBF7428E85F2228EA669E18F"><enum>(C)</enum><text display-inline="yes-display-inline">in the matter following paragraph (3), by inserting <quote>or other eligible provider</quote> after <quote>physician</quote>;</text></subparagraph></paragraph> 
<paragraph id="H3C18465696CD4C74985443D1FF5045B0"><enum>(2)</enum><text display-inline="yes-display-inline">in section 8121(6), by inserting <quote>or other eligible provider</quote> after <quote>physician</quote>; and</text></paragraph> 
<paragraph id="HA049052539134DF387A65592ACAC4F6F"><enum>(3)</enum><text display-inline="yes-display-inline">in section 8123(a)—</text> 
<subparagraph id="H1A4535A701A24479879D83869B725B00"><enum>(A)</enum><text>in the second sentence, by inserting <quote>or other eligible provider</quote> after <quote>physician</quote>; and</text></subparagraph> 
<subparagraph id="H7959B92624DC457F00572E2E336FB67D"><enum>(B)</enum><text>in the third sentence, by striking <quote>of the employee</quote> and inserting <quote>or other eligible provider of the employee</quote>.</text></subparagraph></paragraph></subsection></section> 
<section id="H629F93890437481FB3F66F18E9243209"><enum>4.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by this section shall apply beginning on the first day of the second Federal fiscal year quarter that begins on or after the date of the enactment of this Act.</text></section>
