<section id="H325DF193E5C045F5AAE9A83FE3AF1C09" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Congressional Disclosures Protections Act of 2007</short-title></quote>. </text></section> 
<section id="HED53652D8C9040788E87EFE7C8CAAFB" section-type="subsequent-section"><enum>2.</enum><header>Alternative remedy for retaliation against whistleblowers making disclosures to Congress</header> 
<subsection id="H83E57A48E041422082F54401E997E709"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/72">chapter 72</external-xref> of title 5, United States Code, is amended by adding at the end the following:</text> 
<quoted-block style="USC" id="HBF7571DE0FB84B86AC704CC4F36E9D7E" display-inline="no-display-inline"> 
<section id="HB2434DED07D245E3870826785EC2BCA"><enum>7212.</enum><header>Alternative remedy</header> 
<subsection id="HCB8FC299176B4B84B6B303E7BFEB87EF"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this section—</text> 
<paragraph id="HFD6A9A9D639B4233A1629710353B8E74"><enum>(1)</enum><text>the term <term>compensatory damages</term> means damages awarded to a complaining party for each <quote>action</quote>, which shall be synonymous with <quote>cause of action</quote> or <quote>claim</quote>, as prescribed by title VII of the Civil Rights Act of 1991; </text></paragraph> 
<paragraph id="H9B7FB41EA3EA4A66A03FFBB700DC5FF6" display-inline="no-display-inline"><enum>(2)</enum><text>the term <term>covered disclosure</term> means a disclosure of information—</text> 
<subparagraph id="HD2AA196FFCBD49DF9CB1A9B71C74B1AC"><enum>(A)</enum><text>made by an employee to either House of Congress or to a committee or Member or staff thereof; and</text></subparagraph> 
<subparagraph id="H677FEA4A4EC84CC3BDCA1955CB62A962"><enum>(B)</enum><text>which the employee reasonably believes evidences—</text> 
<clause id="H9A51C547A99F45399D308BA49F6EFC05"><enum>(i)</enum><text>a violation of any law (including title VII of the Civil Rights Act of 1964), rule, or regulation; or</text></clause> 
<clause id="H58756A781E3A4CA7A43DC11885ADBACB"><enum>(ii)</enum><text>gross mismanagement, a gross waste of funds, an abuse of authority, or a substantial and specific danger to public health or safety;</text></clause></subparagraph></paragraph> 
<paragraph id="H8AC2E041945144DBB4D1B472C5B01B8"><enum>(3)</enum><text>the term <term>employee</term> means an individual as defined by section 2105 and any other individual, including permanent, temporary, full or part time employees or applicants, independent contractors, medical or other staff, professionals with institutional privileges, individuals paid by temporary services, or individuals performing services for an organization that in whole or in part is a contractor, grantee or other recipient if the United States government provides any portions of the money or property which is requested or demanded; and</text></paragraph> 
<paragraph id="H90ABACDDAAA747F98B1F433BFED00C6"><enum>(4)</enum><text display-inline="yes-display-inline">the term <term>interfered with or denied</term> includes any personnel action in section 2302(a)(2)(A); implementation or enforcement of any nondisclosure policy, form or agreement in violation of this section; and investigation or prosecution of any alleged violation of title 18 provisions other than those prohibiting crimes of violence, moral turpitude or espionage.</text></paragraph></subsection> 
<subsection id="HF2E6A3F81E524F4681656D2CDD59341F"><enum>(b)</enum><header>Alternative remedy</header><text display-inline="yes-display-inline">An employee aggrieved by a violation of section 7211 with respect to a covered disclosure may within a year of the alleged violation bring an action at law and equity in the appropriate district court of the United States—</text> 
<paragraph id="H6D12CF4F8D0845A68EB05B05482D0587"><enum>(1)</enum><text display-inline="yes-display-inline">which shall have jurisdiction over such an action without regard to the amount in controversy and which action shall, at the request of any party to such action, be tried by the court with a jury; and</text></paragraph> 
<paragraph id="HA56D3B86404C4CE4A42B57DBEA86C16F"><enum>(2)</enum><text display-inline="yes-display-inline">in any proceeding under this subsection, a court—</text> 
<subparagraph id="HDB0F5A9615C54ABEA9D2DB357B2BD3C"><enum>(A)</enum><text display-inline="yes-display-inline">shall apply the standards set forth in section 1221(e); and</text></subparagraph> 
<subparagraph id="HAEDB84CBDC2B4B0BBC3E48B0871B3418"><enum>(B)</enum><text display-inline="yes-display-inline">shall award triple lost wages, benefits, reinstatement, costs including reasonable expert witness fees, triple attorney fees, triple compensatory damages including emotional distress and lost reputation, and equitable, injunctive, and any other relief that the court considers appropriate.</text></subparagraph></paragraph></subsection> 
<subsection id="HE728263882D04FD78F6D1E6471078926" display-inline="no-display-inline"><enum>(c)</enum><header>Choice of remedies</header><text>Except in the circumstance described in subsection (b)(1)(B), the commencement of an action under this subsection bars the employee from pursuing (or further pursuing) any remedy otherwise available under section 1221 or 7701 with respect to the personnel action involved.</text></subsection> </section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H3BDE4B67DEEA463BB62CCED29028EA9B" display-inline="no-display-inline"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/72">chapter 72</external-xref> of title 5, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/5/7211">section 7211</external-xref> the following:</text>

<subsection id="H509994D5A52D411F8BBE6B5945F05AA" display-inline="no-display-inline"><enum>(c)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this Act shall take effect on the date of enactment of this Act and shall apply with respect to any personnel action (as defined by <external-xref legal-doc="usc" parsable-cite="usc/5/2302">section 2302(a)(2)(A)</external-xref> of title 5, United States Code) occurring on or after such date of enactment. </text>

<toc-entry level="section">7212. Alternative remedy.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection> </section> 
<section id="HFC63EC30774B45579B884F3FC47E5DA" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header>Right of representation</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/5/1212">Section 1212(a)</external-xref> of title 5, United States Code, is amended—</text> 
<paragraph id="H3A19AF0BC09A40708D61A8118CEC12CC"><enum>(1)</enum><text>by striking <quote>and</quote> at the end of paragraph (5);</text></paragraph> 
<paragraph id="HCAA30E9D46C04514BB7DB6A0326B1CE8"><enum>(2)</enum><text>by striking the period at the end of paragraph (6) and inserting <quote>; and</quote>; and</text></paragraph> 
<paragraph id="H32CDEE2AEB0141539005387368006F3E"><enum>(3)</enum><text>by adding at the end the following:</text>

<paragraph id="HCDC7441E373946EA8F76D553C42E7FC6"><enum>(6)</enum><text display-inline="yes-display-inline">upon request, furnish such legal representation as an employee may require in a proceeding in which such employee seeks relief under <external-xref legal-doc="usc" parsable-cite="usc/5/7212">section 7212</external-xref> of title 5.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HF7BC1B7A8C394E1FA1A03497015DA168"><enum>4.</enum><header>Amendment to No FEAR Act</header> <text display-inline="no-display-inline">Paragraph (3) of section 203(a) of the Notification and Federal Employee Antidiscrimination and Retaliation Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/5/2301">5 U.S.C. 2301</external-xref> note) is amended to read as follows:</text>

<paragraph id="H51D0A5C98C284C19AE9BAE446F24A000"><enum>(3)</enum><text display-inline="yes-display-inline">the amount of money required to be reimbursed by such agency under section 201 in connection with each of such cases, including for salaries or pay, travel costs, and any other expenses, separately identifying the aggregate amount of such reimbursements attributable to the payment of attorney’s fees, if any, and separately identifying the total dollar amount by fiscal year of any reimbursement for which an agency remains liable under section 201;</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </section>
