<official-title>To amend the Controlled Substances Act and the Controlled Substances Import and Export Act to eliminate certain mandatory minimum penalties relating to crack cocaine offenses.</official-title>

<section section-type="section-one" id="H46ACA1D0ADEC4826AB19B237085F8612" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Crack-Cocaine Equitable Sentencing Act of 2007</short-title></quote>.</text></section> 
<section id="H44BBC76D12134E8E88197FF689007437"><enum>2.</enum><header>Treating crack and other forms of cocaine the same for trafficking penalties</header> 
<subsection id="HE01C24D05D9F4A4DA9A59C66C3689804"><enum>(a)</enum><header>Treating 50 grams of crack the same as 50 grams of other forms of cocaine</header><text>Section 401(b)(1)(A) of the <act-name parsable-cite="CSA">Controlled Substances Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/841">21 U.S.C. 841(b)(1)(A)</external-xref>) is amended by striking clause (iii).</text></subsection> 
<subsection id="H0D603A06C64C418794DB7207FF261334"><enum>(b)</enum><header>Treating 5 grams of crack the same as 5 grams of other forms of cocaine</header><text>Section 401(b)(1)(B) of the <act-name parsable-cite="CSA">Controlled Substances Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/841">21 U.S.C. 841(b)(1)(B)</external-xref>) is amended by striking clause (iii).</text></subsection></section> 
<section id="H74079ED45CA64D5B9182668D504CEB82"><enum>3.</enum><header>Treating the possession of crack the same as the possession of other forms of cocaine</header><text display-inline="no-display-inline">Section 404(a) of the <act-name parsable-cite="CSA">Controlled Substances Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/844">21 U.S.C. 844(a)</external-xref>) is amended by striking the sentence that begins <quote>Notwithstanding the preceding sentence</quote>.</text></section>

<subsection id="H37B2F54A4A7C4AE797CCB8EC529E59E3"><enum>(a)</enum><header>Treating 50 grams of crack the same as 50 grams of other forms of cocaine</header><text>Section 1010(b)(1) of the Controlled Substances Import and Export Act (<external-xref legal-doc="usc" parsable-cite="usc/21/960">21 U.S.C. 960(b)(1)</external-xref>) is amended by striking out subparagraph (C).</text></subsection> 
<subsection id="H203215343CB74BE285E1CC8F50DB09E4"><enum>(b)</enum><header>Treating 5 grams of crack the same as 5 grams of other forms of cocaine</header><text>Section 1010(b)(2) of the Controlled Substances Import and Export Act (<external-xref legal-doc="usc" parsable-cite="usc/21/960">21 U.S.C. 960(b)(2)</external-xref>) is amended by striking out subparagraph (C).</text></subsection></section> 
<section id="H9C81EBD7B8154BB18056A23ECDF6985"><enum>5.</enum><header>Sentencing commission to amend guidelines</header><text display-inline="no-display-inline">As soon as practicable after the date of the enactment of this Act, the United States Sentencing Commission shall promulgate such amendments to the Sentencing Guidelines as are necessary to conform those Guidelines to the amendments made by this Act.</text></section>
