<official-title>To authorize the Secretary of Agriculture to make grants to community-based organizations and local redevelopment agencies operating in low-income communities to promote increased access to and consumption of fresh fruits, fresh vegetables, and other healthy foods among residents of such communities, and for other purposes.</official-title>

<section display-inline="no-display-inline" id="HA3F162829C264BB3B4428052E5A94400" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Healthy Foods for Healthy Living Act</short-title></quote>.</text> </section>
<section id="HCFD83EFB4D0D41CCB3BA074E32C45EA2"><enum>2.</enum><header>Department of Agriculture grants to promote greater consumption of fresh fruits, fresh vegetables, and other healthy foods in low-income communities</header> 
<subsection id="HD270D1480790411BA7571E8449009301"><enum>(a)</enum><header>Grants authorized</header><text display-inline="yes-display-inline">The Secretary of Agriculture may make grants for the purposes specified in subsection (b) to any of the following:</text> 
<paragraph id="H2DD60225FBDA410E89F4558C42B1FD88"><enum>(1)</enum><text display-inline="yes-display-inline">A community-based organization operating in a low-income community.</text> </paragraph>
<paragraph id="HE89F5E0A73EB46EDB5001B70CB65B316"><enum>(2)</enum><text>A local redevelopment agency that is chartered, established, or otherwise sanctioned by a State or local government.</text> </paragraph></subsection>
<subsection id="H1C5BC05C0F0141B2B6BC003B11ED7220"><enum>(b)</enum><header>Use of grant amounts</header><text>The recipient of a grant under this section shall use the grant amounts for one or more of the following activities:</text> 
<paragraph id="H9C6A0719B1754440A098D8875DF1F0A0"><enum>(1)</enum><text display-inline="yes-display-inline">To assist in purchasing appropriate equipment or in hiring and training personnel to expand the inventory of fresh fruits and vegetables or other healthy food alternatives, as defined by the Department of Agriculture, such as healthier dairy and non-dairy to whole milk alternatives, 100 percent pure fruit juices, and products with 0 grams of transfat, available for residents of a low-income community.</text> </paragraph>
<paragraph id="H46442442A9074752AFB26E06426237C"><enum>(2)</enum><text display-inline="yes-display-inline">To carry out consumer education and outreach activities to encourage the purchase of products described in paragraph (1), such as by informing residents of a low-income communities about the health risks associated with high-calorie, low-exercise lifestyles and the benefits of healthy living.</text> </paragraph></subsection>
<subsection id="HD4C08246CB184BDF8547091276008B03"><enum>(c)</enum><header>Maximum grant</header><text>A grant under this section may not exceed $100,000.</text> </subsection>
<subsection id="HBDE2D000E8734D6E8EBA753CE4EC34CA"><enum>(d)</enum><header>Community-based organization defined</header><text display-inline="yes-display-inline">In this section, the term <quote>community-based organization</quote> includes schools, day-care centers, senior centers, community health centers, food banks, or emergency feeding organizations.</text> </subsection>
<subsection id="H3CAAF11ACF024254BCBEEA6BBBD814C"><enum>(e)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Secretary to carry out this section $5,000,000 for fiscal year 2008.</text> </subsection></section>
<section display-inline="no-display-inline" id="HE42874802CF6454295945755F1B603F8" section-type="subsequent-section"><enum>3.</enum><header>Coverage of additional primary care and preventive services under the Medicare and Medicaid programs</header> 
<subsection id="HD5262A5D6312420100EFAAB89CB886F"><enum>(a)</enum><header>Medicare program</header> 
<paragraph id="H1BF2414A8E4444B6A308FA8653902B78"><enum>(1)</enum><header>In general</header><text>Section 1861 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x</external-xref>) is amended—</text> 
<subparagraph id="H0F172AA3266D4D70A5660016A0F73782"><enum>(A)</enum><text>in subsection (s)(2), by adding at the end the following new subparagraph:</text> 
<quoted-block display-inline="no-display-inline" id="H99E0C4DCB525417FB0B965D07413279B" style="traditional"> 
<subparagraph id="HFC0F3820E2854CC9BFE27304D000FE51"><enum>(BB)</enum><text>additional primary and preventive services described in subsection (ccc);</text> </subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block> </subparagraph>
<subparagraph id="H40F2A350D9854DD18BD9D14EE1DBF9AF"><enum>(B)</enum><text>by adding at the end the following new subsection:</text> 
<quoted-block display-inline="no-display-inline" id="H6D48E3466C3149BAB7DBA99378F33523" other-style="archaic" style="other"> 
<subsection id="HB1F415EBD2C84887BA6625A0DFA14C31"><enum>(ccc)</enum><header>Additional primary and preventive services</header><text>The term <quote>additional primary and preventive services</quote> means such primary and preventive services that are not otherwise covered under this title as the Secretary shall specify when provided by qualified providers, as specified by the Secretary. Such term includes the following:</text> 
<paragraph id="H473102A10C484DB1A55800BCB6EF721"><enum>(1)</enum><text>Services for the prevention and treatment of obesity and obesity-related disease.</text> </paragraph>
<paragraph id="HDF512D95BFF346E98451406027F707E0"><enum>(2)</enum><text>Supervised exercise sessions.</text> </paragraph>
<paragraph id="HDA25CF3F768C4ECCACAC8C6DC81EEE86"><enum>(3)</enum><text>Exercise stress testing for the purpose of exercise prescriptions.</text> </paragraph>
<paragraph id="HD7C678B1A43E444F81C91E935CCC93DB"><enum>(4)</enum><text>Lifestyle health improvement education.</text> </paragraph>
<paragraph id="HDC58B1ADB82F45E98B301796CDDEE995"><enum>(5)</enum><text>Culinary arts education for the purpose of promoting proper nutrition.</text> </paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subparagraph></paragraph>
<paragraph id="HD68C3DB8405E4EE38B9246DBD6736123"><enum>(2)</enum><header>Conforming amendments</header>
<subparagraph commented="no" display-inline="yes-display-inline" id="HCD00F67AD9444AA2A26169B9CD6B4FEB"><enum>(A)</enum><text>Section 1862(a)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395y">42 U.S.C. 1395y(a)(1)</external-xref>) is amended—</text> 
<clause id="H7ADDDB1ECE3841BB9607BF13346261F4" indent="up1"><enum>(i)</enum><text>by striking <quote>and</quote> at the end of subparagraph (M);</text> </clause>
<clause id="H671410308B1947AB8B3C48FBFA7C2342" indent="up1"><enum>(ii)</enum><text>by adding <quote>and</quote> at the end of subparagraph (N); and</text> </clause>
<clause id="H809C86D65D104058A33F7D10FF46D81D" indent="up1"><enum>(iii)</enum><text>by adding at the end the following new subparagraph:</text>

<subparagraph id="HDE36F1CE062B4A899F8FEF6863F66D17"><enum>(O)</enum><text>in the case of additional primary care and preventive services, which are performed more frequently than the Secretary may specify;</text> </subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </clause></subparagraph>
<subparagraph id="H7D5C2E93538F43249D29D7379C862959" indent="up1"><enum>(B)</enum><text>Section 1833(b)(5) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395l">42 U.S.C. 1395l(b)(5)</external-xref>) is amended by inserting <quote>or additional primary care or preventive services (as defined in section 1861(ccc))</quote> after <quote>(jj))</quote>.</text> </subparagraph></paragraph></subsection>
<subsection id="H8ECE9CC5322E445E0006F8982C8FD900"><enum>(b)</enum><header>Medicaid program</header><text>Section 1905(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(a)</external-xref>) is amended—</text> 
<paragraph id="H0028668A1200454995CB8CEC11332EF5"><enum>(1)</enum><text>by striking <quote>and</quote> at the end of paragraph (27);</text> </paragraph>
<paragraph id="HD3CD72886DB24014A6D248A5E1E9F399"><enum>(2)</enum><text>by redesignating paragraph (28) as paragraph (29); and</text> </paragraph>
<paragraph id="H0E846B343DB245CAB2D2A25B67A76505"><enum>(3)</enum><text>by inserting after paragraph (27) the following new paragraph:</text> 
<quoted-block display-inline="no-display-inline" id="H96E34CC3C73D4E2884457FD200A212BC" style="traditional"> 
<paragraph id="H6F831A269E854097A200076FEF2FF4A8"><enum>(28)</enum><text>additional primary care and preventive services (as defined in section 1861(ccc)) which are not otherwise covered under this subsection; and</text> </paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection>
<subsection id="H655E3744FB76485295EAE14F317D83C2"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on the first day of the first calendar quarter beginning after the date of the enactment of this Act, regardless of whether regulations to implement the amendments are in effect as of such date.</text> </subsection></section>
