<legis-type>AN ACT</legis-type> 
<official-title display="yes">To require the issuance of medals to recognize the dedication and valor of Native American code talkers.</official-title> 
</form> 
<legis-body id="H8B2C252C86EE45BCB9A39926DA024FF" style="OLC"> 
<section id="HC3F6618EE37C4B97B346554308CA1822" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Code Talkers Recognition Act of 2008</short-title></quote>.</text></section> 
<section id="HE0725DB3D74F4605A103A6D7A4B900F1"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to require the issuance of medals to express the sense of the Congress that—</text> 
<paragraph id="HC3A4C582658A412CACAF6DA0FC4E3DC"><enum>(1)</enum><text>the service of Native American code talkers to the United States deserves immediate recognition for dedication and valor; and</text></paragraph> 
<paragraph id="HFA4B87C4C0AB4E9EBE46764FB2305FDB"><enum>(2)</enum><text>honoring Native American code talkers is long overdue.</text></paragraph></section> 
<section id="HC9BC302843BE455B88AA13D9C6EF59A7"><enum>3.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds the following:</text> 
<paragraph id="H6066E59E997848EBA1FDD13FDA9BFD12"><enum>(1)</enum><text>When the United States entered World War I, Native Americans were not accorded the status of citizens of the United States.</text></paragraph> 
<paragraph id="HF29610DA62764D288D9CFCC48B438516"><enum>(2)</enum><text>Without regard to that lack of citizenship, members of Indian tribes and nations enlisted in the Armed Forces to fight on behalf of the United States.</text></paragraph> 
<paragraph id="HC6DE97A7300B4F81A2CDBE04DFC31CB4"><enum>(3)</enum><text>The first reported use of Native American code talkers was on October 17, 1918.</text></paragraph> 
<paragraph id="H9EDFCBD180A545F8AC96648CA8D63F70"><enum>(4)</enum><text display-inline="yes-display-inline">Because the language used by the Choctaw code talkers in the transmission of information was not based on a European language or on a mathematical progression, the Germans were unable to understand any of the transmissions.</text></paragraph> 
<paragraph id="H5103802D74DE4F02B5281723E8DCA6FC"><enum>(5)</enum><text display-inline="yes-display-inline">This use of Native American code talkers was the first time in modern warfare that such a transmission of messages in a native language was used for the purpose of confusing an enemy.</text> </paragraph> 
<paragraph id="HFDE92F24C51C41A0BEA6297B74E76853"><enum>(6)</enum><text>On December 7, 1941, Japan attacked Pearl Harbor, Hawaii, and the Congress declared war the following day.</text></paragraph> 
<paragraph id="HA6D77B1B2CF241FEA200D87600018521"><enum>(7)</enum><text display-inline="yes-display-inline">The Federal Government called on the Comanche Nation to support the military effort during World War II by recruiting and enlisting Comanche men to serve in the Army to develop a secret code based on the Comanche language.</text></paragraph> 
<paragraph id="H137D5EAE8E074528BF91D600C306C048"><enum>(8)</enum><text display-inline="yes-display-inline">The United States Army recruited approximately 50 Native Americans for special native language communication assignments.</text></paragraph> 
<paragraph id="H5F3FE7A88DE547D981CD8FBAB9E52BE0"><enum>(9)</enum><text display-inline="yes-display-inline">The United States Marine Corps recruited several hundred Navajos for duty in the Pacific region.</text> </paragraph> 
<paragraph id="HAED52E86842E4758BD177245650501D6"><enum>(10)</enum><text display-inline="yes-display-inline">During World War II, the United States employed Native American code talkers who developed secret means of communication based on native languages and were critical to winning the war.</text></paragraph> 
<paragraph id="H5CA5CA33DE904CD3A6895872B46753C4"><enum>(11)</enum><text display-inline="yes-display-inline">To the frustration of the enemies of the United States, the code developed by the Native American code talkers proved to be unbreakable and was used extensively throughout the European theater.</text> </paragraph> 
<paragraph id="H7F79F5EA64824E8DAF7E16C4A11DC1F7"><enum>(12)</enum><text>In 2001, the Congress and President Bush honored Navajo code talkers with congressional gold medals for the contributions of the code talkers to the United States Armed Forces as radio operators during World War II.</text></paragraph> 
<paragraph id="HEA2EEAE444364C87AF2353B66D6EE17E"><enum>(13)</enum><text>The heroic and dramatic contributions of Native American code talkers were instrumental in driving back Axis forces across the Pacific during World War II.</text></paragraph> 
<paragraph id="H5783ADB86F5C46A096A100228CA167FE"><enum>(14)</enum><text>The Congress should provide to all Native American code talkers the recognition the code talkers deserve for the contributions of the code talkers to United States victories in World War I and World War II.</text></paragraph></section> 
<section id="H8D44D8DD27C64DF28FF84E57771D86B2"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act, the following definitions shall apply:</text> 
<paragraph id="H284FF28BD390414998D72A890CAD895"><enum>(1)</enum><header>Code talker</header><text>The term <quote>code talker</quote> means a Native American who—</text> 
<subparagraph id="HDE20B78E4973416D85C5A600DBCC4FCC"><enum>(A)</enum><text>served in the Armed Forces during a foreign conflict in which the United States was involved; and</text></subparagraph> 
<subparagraph id="HBDB6C3803AF84B38B4091532D2245162"><enum>(B)</enum><text>transmitted (encoded and translated) secret coded messages for tactical military operations during World War I and World War II using their native tribal language (non-spontaneous communications)</text></subparagraph></paragraph> 
<paragraph id="H3E2730F5969C4DEE9F12984C35E0D1CB"><enum>(2)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of the Treasury.</text></paragraph></section> 
<section id="HE7784303CF7E4BCB9F43008020ECDB94"><enum>5.</enum><header>Congressional gold medals</header> 
<subsection id="H71002EC2B8034E14A009F55CB9FDD073"><enum>(a)</enum><header>Award authorization</header><text>The Speaker of the House of Representatives and the President pro tempore of the Senate shall make appropriate arrangements for the award, on behalf of the Congress, of gold medals of appropriate design in recognition of the service of Native American code talkers during World War I and World War II.</text></subsection> 
<subsection id="HBCDAD8E8DDCA4769B3DCED7381909B6"><enum>(b)</enum><header>Identification of recipients</header><text>The Secretary, in consultation with the Secretary of Defense and the tribes, shall—</text> 
<paragraph id="H57CCF4266E454517A6B7345C6007943"><enum>(1)</enum><text display-inline="yes-display-inline">determine the identity, to the maximum extent practicable, of each Native American tribe that had a member of that tribe serve as a Native American code talker, with the exception of the Navajo Nation;</text></paragraph> 
<paragraph id="H646C3673DBF04DF29BA799B17B059938"><enum>(2)</enum><text>include the name of each Native American tribe identified under subparagraph (A) on a list; and</text></paragraph> 
<paragraph id="H3A951D4130D346298D30C1872D658224"><enum>(3)</enum><text>provide the list, and any updates to the list, to the Smithsonian Institution for maintenance under section 5(c)(2).</text></paragraph></subsection> 
<subsection id="H5F23EE3746464D7AB03EB883B6FA8BE2"><enum>(c)</enum><header>Design and striking of medals</header> 
<paragraph id="H84257C26089546328B2D49974549A8F2"><enum>(1)</enum><header>In general</header><text>The Secretary shall strike the gold medals awarded under subsection (a) with appropriate emblems, devices, and inscriptions, as determined by the Secretary.</text></paragraph> 
<paragraph id="HEC00D49BAC2740CAA25C460043A0E775"><enum>(2)</enum><header>Designs of medals emblematic of tribal affiliation and participation</header><text>The design of a gold medal under paragraph (1) shall be emblematic of the participation of the code talkers of each recognized tribe.</text></paragraph> 
<paragraph id="H76568EB8EDFB4C90B681A52DCFBB61B"><enum>(3)</enum><header>Treatment</header><text>Each medal struck pursuant to this subsection shall be considered to be a national medal for purposes of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/51">chapter 51</external-xref> of title 31, United States Code.</text></paragraph></subsection> 
<subsection id="H9E467360254048339D00639B988F682E"><enum>(d)</enum><header>Action by Smithsonian Institution</header><text>The Smithsonian Institution—</text> 
<paragraph id="HF88232958024400BAF00D7189B6F0006"><enum>(1)</enum><text>shall accept and maintain such gold medals, and such silver duplicates of those medals, as recognized tribes elect to send to the Smithsonian Institution;</text></paragraph> 
<paragraph id="HDE8BF9FAEBA643BAB105CFA8B122A2D6"><enum>(2)</enum><text>shall maintain the list developed under section 6(1) of the names of Native American code talkers of each recognized tribe; and</text></paragraph> 
<paragraph id="H85E592858BC74087B61B1BD79289CB7D"><enum>(3)</enum><text>is encouraged to create a standing exhibit for Native American code talkers or Native American veterans.</text></paragraph></subsection></section> 
<section id="H7E7D9E6DB79B4416BF00AA08E7D2F4D6"><enum>6.</enum><header>Native American code talkers</header><text display-inline="no-display-inline">The Secretary, in consultation with the Secretary of Defense and the tribes, shall—</text> 
<paragraph id="H594D3314F0624F7B98BBBCC30587EBE0"><enum>(1)</enum><text display-inline="yes-display-inline">with respect to tribes recognized as of the date of the enactment of this Act —</text> 
<subparagraph id="H4F1ED1DC448A42E185986996E8ACC66F"><enum>(A)</enum><text>determine the identity, to the maximum extent practicable, of each Native American code talker of each recognized tribe with the exception of the Navajo Nation;</text></subparagraph> 
<subparagraph id="HC39105C3B6E94FB8BEE9192B005B0735"><enum>(B)</enum><text>include the name of each Native American code talker identified under subparagraph (A) on a list, to be organized by recognized tribe; and</text></subparagraph> 
<subparagraph id="HB181F44CA286480F9838304911C5DD19"><enum>(C)</enum><text display-inline="yes-display-inline">provide the list, and any updates to the list, to the Smithsonian Institution for maintenance under section 5(d)(2);</text> </subparagraph> </paragraph> 
<paragraph id="H2107F036EBB4406893FF392D2B388C1"><enum>(2)</enum><text>in the future, determine whether any Indian tribe that is not a recognized as of the date of the enactment of this Act, should be eligible to receive a gold medal under this Act; and</text></paragraph> 
<paragraph id="HE8E8C8B448E14A29974492158B10F058"><enum>(3)</enum><text>with consultation from the tribes listed in following subsection, examine the following specific tribes to determine the existence of Code Talkers:</text> 
<subparagraph id="H604047A2BB6B432CA9B2348217600316"><enum>(A)</enum><text>Assiniboine.</text></subparagraph> 
<subparagraph id="HE0770A9198B34F1DAE1FAA3D41C23E5"><enum>(B)</enum><text>Chippewa and Oneida.</text></subparagraph> 
<subparagraph id="H877ECC746A34497899F7015E2EC891B8"><enum>(C)</enum><text>Choctaw.</text></subparagraph> 
<subparagraph id="H0264291738984535BE431EFDAE243F00"><enum>(D)</enum><text>Comanche.</text></subparagraph>

<section id="H07FD8576301B4AAAA2AD68E2064C5BDD"><enum>7.</enum><header>Duplicate medals</header> 
<subsection id="H60B1D8E2F1D142F5ACBF09C42457806F"><enum>(a)</enum><header>Silver duplicate medals</header> 
<paragraph id="H1AD6F8AD50EC49EFA911E3D3D5CA3C35"><enum>(1)</enum><header>In general</header><text>The Secretary shall strike duplicates in silver of the gold medals struck under section 5(b), to be awarded in accordance with paragraph (2).</text></paragraph> 
<paragraph id="H6A644A2E3ECA4CBBAEDB93793E5D3400"><enum>(2)</enum><header>Eligibility for award</header> 
<subparagraph id="H5B8AB83CAC4E45919C67D602901FAF"><enum>(A)</enum><header>In general</header><text>A Native American shall be eligible to be awarded a silver duplicate medal struck under paragraph (1) in recognition of the service of Native American code talkers of the recognized tribe of the Native American, if the Native American served in the Armed Forces as a code talker in any foreign conflict in which the United States was involved during the 20th century.</text></subparagraph> 
<subparagraph id="H6871BBFDC4164A33A562F6F6F1AE5298"><enum>(B)</enum><header>Death of code talker</header><text>In the event of the death of a Native American code talker who had not been awarded a silver duplicate medal under this subsection, the Secretary may award a silver duplicate medal to the next of kin or other personal representative of the Native American code talker.</text></subparagraph> 
<subparagraph id="H74532D8BAB0D41FCBB4289506BF6D4F"><enum>(C)</enum><header>Determination</header><text>Eligibility for an award under this subsection shall be determined by the Secretary in accordance with section 6.</text></subparagraph></paragraph></subsection> 
<subsection id="HEEE8B061894147D49179708F1C1B23F8"><enum>(b)</enum><header>Bronze duplicate medals</header><text>The Secretary may strike and sell duplicates in bronze of the gold medal struck pursuant to section 4 under such regulations as the Secretary may prescribe, at a price sufficient to cover the cost thereof, including labor, materials, dies, use of machinery, and overhead expenses, and the cost of the gold and silver medals.</text></subsection></section> 
<section id="H4CF1BE674AB44007AC51672540C528F5"><enum>8.</enum><header>Authority to use fund amounts; proceeds of sale</header> 
<subsection id="H35EA2B240AF44273B3C60793FA85302"><enum>(a)</enum><header>Authority to use fund amounts</header><text>There are authorized to be charged against the United States Mint Public Enterprise Fund such amounts as may be necessary to pay for the cost of the medals struck pursuant to this Act.</text></subsection> 
<subsection id="HEA09A2D14CB44DB4B752BE7914DEE96E"><enum>(b)</enum><header>Proceeds of sale</header><text>Amounts received from the sale of duplicate bronze medals authorized under section 7(b) shall be deposited into the United States Mint Public Enterprise Fund.</text></subsection></section>
