<section id="H03F2A8BD613D46BD81542FF62E35E8AB" section-type="section-one"><enum>1.</enum><header>Findings</header> 
<paragraph id="H5424F4BB0A3444868D4F1C07EBBF51E"><enum>(1)</enum><text>Tuna fish canning is a vital industry to the United States.</text> </paragraph>
<paragraph id="HDE76F958A0FC478B99905B622BB58BBC"><enum>(2)</enum><text>To promote United States production Congress has imposed higher tariffs on shelf-stable, retail ready tuna fish products than on raw or intermediate fish products.</text> </paragraph>
<paragraph id="H536A34156159402A0034E9FE8EEE7FD1"><enum>(3)</enum><text>According to the original intent of Congress the term <quote>in airtight containers</quote> as contained in the Harmonized Tariff Schedule of the United States subheading 1604.14 has only covered products in packages that are not permeable to air and that are presented as a finished product for consumption in shelf-stable containers (cans, glass jars, and foil pouches).</text> </paragraph>
<paragraph id="H3861814B38834E62B1613C996B4E64FE"><enum>(4)</enum><text>Congress seeks to codify the term <quote>in airtight containers</quote> as provided for in subheading 1604.14 of the Harmonized Tariff Schedule of the United States to reflect existing practice and promote public health and safety.</text> </paragraph>
<paragraph id="H3579443C87A746A19B9C8C1BD3AA32A8"><enum>(5)</enum><text>Congress seeks to codify the term <quote>in bulk or in immediate containers weighing with their contents over 6.8 kg each</quote> as provided for in subheading 1604.14 of the Harmonized Tariff Schedule of the United States to reflect existing practice and promote public health and safety.</text> </paragraph></section>
<section id="H5FCE6B73006A469E9645DAAEDE149DC0"><enum>2.</enum><header>Definitions</header> 
<subsection id="HAA1B576E41D9497A98CE298841131CB6"><enum>(a)</enum><header>Definitions</header><text>The Additional U.S. Notes to chapter 16 of the Harmonized Tariff Schedule of the United States are amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H5B81D5A719614B678B899C9C37D3DD1F" style="OLC"><list level="subsection"> <list-item>4. For purposes of subheading 1604.14, the term <quote>in airtight containers</quote> means containers that (a) are heat sealed, and none of the contents have been pinched in the seal, and (b) have an oxygen transmission rate of less than 1 ml per square meter in 24 hours in a dry state at 20° Celsius. </list-item> <list-item>5. For purposes of subheading 1604.14, the term <quote>in bulk or in immediate containers weighing with their contents over 6.8 kg each</quote> includes product that is shipped in non-airtight plastic bags, or similar intermediate containers, that are stacked in layers and placed on pallets, or similar bulk containers, as long as the entire pallet, or similar bulk container, with their contents weigh over 6.8 kg.</list-item></list> <after-quoted-block>.</after-quoted-block></quoted-block> </subsection>
<subsection id="H480D12C59B7D40FDBAB4D1C32234AC93"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) applies to goods entered, or withdrawn from warehouse for consumption, on or after the 15th day after the date of the enactment of this Act.</text> </subsection></section>
