<legis-type>A BILL</legis-type> 
<official-title>To amend <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/6">chapter 6</external-xref> of title 5, United States Code (commonly known as the Regulatory Flexibility Act), to ensure complete analysis of potential impacts on small entities of rules, and for other purposes.</official-title>

<section section-type="section-one" id="H1487C06A38E94A24B6AE06FF165CF05" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Small Business Regulatory Improvement Act</short-title></quote> .</text></section> 
<section id="H1CE652C23D6E42E0AF00FA945BD72CA4"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> 
<paragraph id="HD4B30E59C37344B08406F970D76C0047"><enum>(1)</enum><text display-inline="yes-display-inline">Small businesses are frequently the source of new products, methods, and innovations.</text></paragraph> 
<paragraph id="H70D48CF1AEDC40C0BEBB5DDF4FA5167B"><enum>(2)</enum><text>A vibrant and growing small business sector is critical to creating jobs in a dynamic economy.</text></paragraph> 
<paragraph id="H476D0589241540060098F7D00228606"><enum>(3)</enum><text>Regulations designed for application to large-scale entities have been applied uniformly to small businesses and other small entities.</text></paragraph> 
<paragraph id="H0CAF4E23600F441B0000739D350627DC"><enum>(4)</enum><text>Uniform Federal regulatory and reporting requirements in many instances have imposed on small businesses and other small entities disproportionately burdensome demands, including legal, accounting, and consulting costs.</text></paragraph> 
<paragraph id="HECB1F07C8D514468AC41D2821F25BAC"><enum>(5)</enum><text>Since 1980, Federal agencies have been required to recognize and take account of the differences in the scale and resources of regulated entities but have failed to do so.</text></paragraph> 
<paragraph id="HD6CA9968AC0447E9918EA2A073BFD811"><enum>(6)</enum><text>Alternative regulatory approaches that do not conflict with the stated objectives of the statutes the regulations seek to implement may be available and may minimize the significant economic impact of regulations on small businesses and other small entities.</text></paragraph> 
<paragraph id="H3B3793148C404632BB7596F97086F996"><enum>(7)</enum><text>Federal agencies have failed to analyze and uncover less costly alternative regulatory approaches, despite the fact that the <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/6">chapter 6</external-xref> of title 5, United States Code (commonly known as the Regulatory Flexibility Act), requires them to do so.</text></paragraph> 
<paragraph id="HD149BBDF727C463292951CF5D4D05C41"><enum>(8)</enum><text>Federal agencies continue to interpret <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/6">chapter 6</external-xref> of title 5, United States Code, in a manner that permits them to avoid their analytical responsibilities.</text></paragraph> 
<paragraph id="H77051E05CC8347C984FB96FCD0BCA3AD"><enum>(9)</enum><text>Significant changes are needed in the methods by which Federal agencies develop and analyze regulations, receive input from affected entities, and develop regulatory alternatives that will lessen the burden or maximize the benefits of final rules to small businesses and other small entities.</text></paragraph> 
<paragraph id="HDCB2DD5344844C8C94EFCD44F233F111"><enum>(10)</enum><text>It is the intention of the Congress to amend <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/6">chapter 6</external-xref> of title 5, United States Code, to ensure that all impacts, including foreseeable indirect effects, of proposed and final rules are considered by agencies during the rulemaking process and that the agencies assess a full range of alternatives that will limit adverse economic consequences or enhance economic benefits.</text></paragraph> 
<paragraph id="H44EB22662E5B4703A087F1A5DD1DCB00"><enum>(11)</enum><text>Federal agencies should be capable of assessing the impact of proposed and final rules without delaying the regulatory process or impinging on the ability of Federal agencies to fulfill their statutory mandates.</text></paragraph></section> 
<section id="H09D32F12D36847D5B5F59E008407B4DD"><enum>3.</enum><header>Clarification and expansion of rules covered by the Regulatory Flexibility Act</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/5/601">Section 601</external-xref> of title 5, United States Code, is amended by adding at the end the following new paragraph:</text>

<paragraph id="HA1C90C1156A046959EE83B00FD831137"><enum>(9)</enum><header>Economic impact</header><text>The term <term>economic impact</term> means, with respect to a proposed or final rule—</text> 
<subparagraph id="H8ABC14FE32F44D398D7FB9D9EE8E7BAD"><enum>(A)</enum><text>any direct economic effect on small entities of such rule; and</text></subparagraph> 
<subparagraph id="HF346FB2F9EB449A3A4D6193DFE2030E1"><enum>(B)</enum><text>any indirect economic effect on small entities which is reasonably foreseeable and results from such rule (without regard to whether small entities will be directly regulated by the rule).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H7052688A9C654A91923699A9CFB55858"><enum>4.</enum><header>Requirements providing for more detailed analyses</header> 
<subsection id="H3222AA96DC804E659CD8081D6CCBA9CD"><enum>(a)</enum><header>Initial regulatory flexibility analysis</header><text display-inline="yes-display-inline">Subsection (b) of <external-xref legal-doc="usc" parsable-cite="usc/5/603">section 603</external-xref> of title 5, United States Code, is amended to read as follows:</text> 
<quoted-block style="OLC" id="HD103CCF52EE240559FEF83FFAAEA1C3C" display-inline="no-display-inline"> 
<subsection id="H2DB8FE2ADC134D95A2C93C4CFFAA48BF"><enum>(b)</enum><text display-inline="yes-display-inline">Each initial regulatory flexibility analysis required under this section shall contain a detailed statement describing—</text> 
<paragraph id="H8D484F30D07C4FC79EB324D2D7C16842"><enum>(1)</enum><text>the reasons why the action by the agency is being considered; </text></paragraph> 
<paragraph id="H3BC2C3044355470DA8FD4D142177C95B"><enum>(2)</enum><text>the objectives of, and legal basis for, the proposed rule; </text></paragraph> 
<paragraph id="H61E3E26D4E7741389CCDC9966B795434"><enum>(3)</enum><text>the type of small entities to which the proposed rule will apply;</text></paragraph> 
<paragraph id="HBA9EDD788F8840DC921BB1894EF0C439"><enum>(4)</enum><text>the number of small entities to which the proposed rule will apply or why such estimate is not available; </text></paragraph> 
<paragraph id="HC00A79D5DB0C447C8E32E6EF34291E83"><enum>(5)</enum><text>the projected reporting, recordkeeping, and other compliance requirements of the proposed rule, including an estimate of the classes of small entities which will be subject to the requirement, the costs, and the type of professional skills necessary to comply with the rule; and</text></paragraph> 
<paragraph id="H9C0CD9FF25A542E69544C22B897C4FCB"><enum>(6)</enum><text>all relevant Federal rules which may duplicate, overlap, or conflict with the proposed rule, or the reasons why such a description could not be provided.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HA939D53DA2E64F7096688D4B03CA35A"><enum>(b)</enum><header>Final regulatory flexibility analysis</header> 
<paragraph id="H72DB831E120948F781A2413FEB17BA7D"><enum>(1)</enum><text>Paragraph (1) of <external-xref legal-doc="usc" parsable-cite="usc/5/604">section 604(a)</external-xref> of title 5, United States Code, is amended by striking <quote>succinct</quote>.</text></paragraph> 
<paragraph id="H21A56D6D519749F39E015FC2F2DE5C"><enum>(2)</enum><text>Paragraph (3) of such section is amended by striking <quote>an explanation</quote> and inserting <quote>a detailed explanation</quote>.</text></paragraph> 
<paragraph id="HB39634F220E145B7A4C005CD30BEBA9D"><enum>(3)</enum><text>Paragraph (4) of such section is amended to read as follows:</text>

<paragraph id="H8F4C4183B14348F28D6ED500E5C15B5E"><enum>(4)</enum><text display-inline="yes-display-inline">a description of the projected reporting, recordkeeping, and other compliance requirements of the rule, including an estimate of the classes of small entities which will be subject to the requirement, the costs, and the type of professional skills necessary to comply with the rule; and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H3260286F74B34A3BADB23FAD33674B58"><enum>(c)</enum><header>Certification of no impact</header><text>Subsection (b) of <external-xref legal-doc="usc" parsable-cite="usc/5/605">section 605</external-xref> of title 5, United States Code, is amended by inserting <quote>detailed</quote> before <quote>statement</quote> both places such term appears.</text></subsection></section> 
<section id="HD658D56F178A4D2DBAFEBCB4A3BA48E6"><enum>5.</enum><header>Periodic review of rules</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/5/610">Section 610</external-xref> of title 5, United States Code, is amended to read as follows:</text>

<section id="HE071F9F5D4454EAD92FBAB19782FBAD2"><enum>610.</enum><header>Periodic review of rules</header> 
<subsection id="H83669DF236DF412FACA9FA669257FE48"><enum>(a)</enum><text>Not later than 180 days after the enactment of the <short-title>Small Business Regulatory Improvement Act</short-title>, each agency shall publish in the Federal Register and place on its website a plan for the periodic review of rules issued by the agency which the head of the agency determines have a significant economic impact on a substantial number of small entities. Such determination shall be made without regard to whether the agency performed an analysis under section 604. The purpose of the review shall be to determine whether such rules should be continued without change, or should be amended or rescinded, consistent with the stated objectives of applicable statutes, to minimize significant economic impacts on a substantial number of small entities. Such plan may be amended by the agency at any time by publishing the revision in the Federal Register and subsequently placing the amended plan on the agency’s website.</text></subsection> 
<subsection id="H0715D8FF1D5B4C249DCDC4CBAAD0D205"><enum>(b)</enum><text>The plan shall provide for the review of all such agency rules existing on the date of the enactment of the <short-title>Small Business Regulatory Improvement Act</short-title> within 10 years of the date of publication of the plan in the Federal Register and for review of rules adopted after the date of enactment of the <short-title>Small Business Regulatory Improvement Act</short-title> within 10 years after the publication of the final rule in the Federal Register. If the head of the agency determines that completion of the review of existing rules is not feasible by the established date, the head of the agency shall so certify in a statement published in the Federal Register and may extend the review for not longer than 2 years after publication of notice of extension in the Federal Register. Such certification and notice shall be sent to the Chief Counsel for Advocacy and the Congress.</text></subsection> 
<subsection id="HBC48146E3D894E51AF617211FAB7E4BC"><enum>(c)</enum><text>Each agency shall annually submit a report regarding the results of its review pursuant to such plan to the Congress and, in the case of agencies other than independent regulatory agencies (as defined in <external-xref legal-doc="usc" parsable-cite="usc/44/3502">section 3502(5)</external-xref> of title 44, United States Code) to the Administrator of the Office of Information and Regulatory Affairs of the Office of Management and Budget. Such report shall include the identification of any rule with respect to which the head of the agency made a determination described in paragraph (5) or (6) of subsection (d) and a detailed explanation of the reasons for such determination.</text></subsection> 
<subsection id="H20A94473C8D44C42BA85A5C6ED7FCDD"><enum>(d)</enum><text>In reviewing rules under such plan, the agency shall consider the following factors:</text> 
<paragraph id="HC542DCA47AC84376ADCC32B22035B79E"><enum>(1)</enum><text>The continued need for the rule.</text></paragraph> 
<paragraph id="HF7AB76621452478DA4EFE1AA16315E00"><enum>(2)</enum><text>The nature of complaints received by the agency from small entities concerning the rule.</text></paragraph> 
<paragraph id="HB892082484C4407FA995C542F748D8B8"><enum>(3)</enum><text>Comments by the Regulatory Enforcement Ombudsman and the Chief Counsel for Advocacy.</text></paragraph> 
<paragraph id="HD7B16874D321439E8D5CC1863500BFC0"><enum>(4)</enum><text>The complexity of the rule.</text></paragraph> 
<paragraph id="HA409362534BB4AF6A6CD376B004D82F8"><enum>(5)</enum><text>The extent to which the rule overlaps, duplicates, or conflicts with other Federal rules and, unless the head of the agency determines it to be infeasible, State and local rules.</text></paragraph> 
<paragraph id="HDF3B5D23B79B4E15BED3335EAC87C0A1"><enum>(6)</enum><text>The length of time since the rule has been evaluated or the degree to which technology, economic conditions, or other factors have changed in the area affected by the rule.</text></paragraph></subsection> 
<subsection id="H351609F950F84B91A42BD942BD15F01C"><enum>(e)</enum><text>The agency shall publish in the Federal Register and on its website a list of rules to be reviewed pursuant to such plan. Such publication shall include a brief description of the rule, the reason why the agency determined that it has a significant economic impact on a substantial number of small entities (without regard to whether it had prepared a final regulatory flexibility analysis for the rule), and request comments from the public, the Chief Counsel for Advocacy, and the Regulatory Enforcement Ombudsman concerning the enforcement of the rule.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HB1597B12A5014321BFC4893CE2792B63"><enum>6.</enum><header>Changes to the Regulatory Flexibility Act to Comport with Executive Order 13272</header> 
<subsection id="H0EC0694B18C1486582C0DCE49E8C4C11"><enum>(a)</enum><header>Initial regulatory flexibility analysis</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/5/603">Section 603</external-xref> of title 5, United States Code, is amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="H706229C92A6E47DCADF071CB0025C300" display-inline="no-display-inline"> 
<subsection id="H091C1B80C11B4540BD1539CC00CABF84"><enum>(d)</enum><text display-inline="yes-display-inline">An agency shall notify the Chief Counsel for Advocacy of the Small Business Administration of any draft rules that may have a significant economic impact on a substantial number of small entities either—</text> 
<paragraph id="HC701AA37B02247109711F231AFCF1F"><enum>(1)</enum><text>when the agency submits a draft rule to the Office of Information and Regulatory Affairs at the Office of Management and Budget, if submission is required; or</text></paragraph> 
<paragraph id="H46898C6CA23B4FBDA02943039371FFE2"><enum>(2)</enum><text>if no submission to the Office of Information and Regulatory Affairs is so required, at a reasonable time prior to publication of the rule by the agency.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H49F1531A0BA543F9B574F51483A0248C"><enum>(b)</enum><header>Final regulatory flexibility analysis</header> 
<paragraph id="H42CFEB5D3FB24160B4F0FEF3CA64C180"><enum>(1)</enum><header>Inclusion of response to comments on certification of proposed rule</header><text>Paragraph (2) of <external-xref legal-doc="usc" parsable-cite="usc/5/604">section 604(a)</external-xref> of title 5, United States Code, is amended by inserting after <quote>initial regulatory flexibility analysis</quote> the following: <quote>(or certification of the proposed rule under section 605(b))</quote>.</text></paragraph> 
<paragraph id="H7AEB091E6533436ABF946679BC3B7774"><enum>(2)</enum><header>Inclusion of response to comments filed by Chief Counsel for Advocacy</header><text>Subsection (a) of <external-xref legal-doc="usc" parsable-cite="usc/5/604">section 604</external-xref> of title 5, United States Code, is amended by redesignating paragraphs (3) through (5) as (4) through (6), respectively, and by inserting after paragraph (2) the following:</text>
