<official-title>To amend the Housing and Community Development Act of 1974 to provide financial assistance for the development and reuse of brownfields.</official-title>

<section id="H72AD28D060F9411B998CFA4EC5E0D6E6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Brownfields Housing and Community Renewal Development Act</short-title></quote>.</text></section> 
<section id="H3E0FA8C899E747BC886EAF2577C4BEB0"><enum>2.</enum><header>Findings and purpose</header> 
<subsection id="H09CE9183AD424154A2949F3D7CC4C620"><enum>(a)</enum><header>Congressional findings</header><text display-inline="yes-display-inline">The Congress finds the following:</text> 
<paragraph id="H6F8ECAD0B04A4049869864B7D8E2E3E9"><enum>(1)</enum><text>Addressing the problem of contaminated abandoned industrial or commercial properties by funding programs that encourage the reuse of such properties must continue to be a priority of this country.</text></paragraph> 
<paragraph id="HDDEF8346ECCA48D197AAEBEDF853C31C"><enum>(2)</enum><text>Brownfields grant programs funded through the Environmental Protection Agency (EPA) are utilized for environmental assessment, planning, job training, and cleanup.</text></paragraph> 
<paragraph id="H37A98E1FF1864E21A6A4A9C1BFC0679B"><enum>(3)</enum><text>EPA brownfields programs are not adequate to rehabilitate, demolish, or redevelop structures.</text></paragraph> 
<paragraph id="HA6AF6C332C4146929775E93F2B1FDA57"><enum>(4)</enum><text>The Department of Housing and Urban Development is an appropriate agency to provide grants to redevelop contaminated, abandoned or underutilized buildings, which pose not only a possible health risk but also impact a community’s quality of life.</text></paragraph> 
<paragraph id="H0A5571B23F8843BAB9F59025E931E718"><enum>(5)</enum><text>Local communities need additional redevelopment programs that provide new flexibility to organizations to be part of community development efforts.</text></paragraph> 
<paragraph id="HA07DAB4054B447D38D234D55E864BE6D"><enum>(6)</enum><text>The Congress should fund appropriate Federal programs that allow communities to redevelop their neighborhoods and improve the quality of life in the surrounding areas.</text></paragraph></subsection> 
<subsection id="HA9B16DA65C1B4354B2F5DB41974D89B3"><enum>(b)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purpose of this Act is to empower local communities and their partners to clean and redevelop brownfields in their communities by providing—</text> 
<paragraph id="HF3137EF1ADF7488B0013EDCF4CAADDF1"><enum>(1)</enum><text>flexibility for the development of local plans to address brownfields problems; and</text></paragraph> 
<paragraph id="H4A8BEA41A248400DA852E8DBB5AD3F76"><enum>(2)</enum><text>access to economic development grant funds.</text></paragraph></subsection></section> 
<section id="HA2F101F6304C4A38AA00ED352BFE1FA1"><enum>3.</enum><header>Grant program to promote community renewal through brownfield redevelopment</header><text display-inline="no-display-inline">Section 108 of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5308">42 U.S.C. 5308</external-xref>) is amended—</text> 
<paragraph id="H735B6A020644499F9D1092DA97E7076C"><enum>(1)</enum><text>by redesignating subsection (r) as subsection (s); and</text></paragraph> 
<paragraph id="HC2624850C2FD4E198B4572CC393F6EEA"><enum>(2)</enum><text>by inserting after subsection (q) the following new subsection:</text>

<subsection id="HA976A4F445544ECE842D00329F950652"><enum>(r)</enum><header>Grant program to promote community renewal through brownfield redevelopment</header> 
<paragraph id="H7F39F1BBCC5E4C48B625FA5D1BA4298B"><enum>(1)</enum><header>Establishment of program</header><text display-inline="yes-display-inline">The Secretary shall establish a program under this subsection to make grants to assist in carrying out redevelopment activities for brownfield sites and abandoned, idled, and underused industrial, commercial or housing structures located in brownfield sites.</text> </paragraph> 
<paragraph id="HF6B6A6A9CDDD4BBAA45870AAB0B22446"><enum>(2)</enum><header>Grantees and grant conditions</header><text display-inline="yes-display-inline">A grant may be made under this subsection to a unit of general local government, including an agency of such a unit, an entity affiliated with such a unit, a nonprofit organization, or a community development corporation, but only pursuant to a grant proposal for redevelopment of a brownfield site or sites, which is submitted to and approved by the Secretary and ensures that the grant will be used for at least one of the following purposes:</text> 
<subparagraph id="HFFB48E39776341E1004F41E08835A4D1"><enum>(A)</enum><text>To benefit low and moderate income communities.</text></subparagraph> 
<subparagraph id="H744B32EC42574F4AB7B5D541A7384F45"><enum>(B)</enum><text>To increase affordable housing opportunities.</text></subparagraph> 
<subparagraph id="H0D91D3697FA746ABBC65E600115DB9D2"><enum>(C)</enum><text>To address imminent threats or urgent community needs.</text></subparagraph> 
<subparagraph id="HF6979F0D8CDD4F6887DEE5A039EA2CA5"><enum>(D)</enum><text>To provide open spaces or parks.</text></subparagraph></paragraph> 
<paragraph id="HFCABD932E9AB4A9A9FCC9568F5F8C68F"><enum>(3)</enum><header>Priority</header><text>In awarding grants under this subsection, the Secretary shall give priority to grant proposals that ensure that the grant will be used for two or more of the objectives specified in subparagraphs (A) through (D) of paragraph (2).</text></paragraph> 
<paragraph id="HA118B12C2DF14186B5EEF3516BBA8591"><enum>(4)</enum><header>Availability of assistance</header><text>The Secretary shall not require, for eligibility to a grant under this section, that such grant amounts be used only in connection or conjunction with projects and activities assisted with a loan guaranteed under this section.</text></paragraph> 
<paragraph id="HDED34CB06C6E4F75B6EB67E5E8F6DD3"><enum>(5)</enum><header>Grant amount</header><text>Each grant award made under this subsection shall be of sufficient size to carry out the goals of this subsection, but shall not exceed $1,000,000.</text></paragraph> 
<paragraph id="H03C360F77A78419E9DA723CE5CBF25F2"><enum>(6)</enum><header>Administrative costs</header><text>A recipient of a grant under this subsection may use not more than 10 percent of the amount of the grant for reasonable administrative costs necessary in carrying out the brownfields project for which the grant is made.</text></paragraph> 
<paragraph id="H1ED70C34E27D495F90F07691D1C3D785"><enum>(7)</enum><header>Audits</header><text>The Secretary shall establish and carry out procedures for auditing or reviewing grants made under this subsection.</text></paragraph> 
<paragraph id="HB8430601FBFA48A0BAEBFA2339CAFFD5"><enum>(8)</enum><header>Violations</header><text>The Secretary shall establish and implement appropriate measures to sanction grantees who are found to have violated the requirements under this subsection or any grant conditions.</text></paragraph> 
<paragraph id="HCF80CAA51B124AE8A1E3BFC396EE2F9D"><enum>(9)</enum><header>Definition</header><text>For purposes of this subsection, the term <term>brownfield site</term> has the meaning given such term in section 101 of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601</external-xref>).</text></paragraph> 
<paragraph id="H76517D5163B04A39ACF7D76D1B2818E1"><enum>(10)</enum><header>Authorization of appropriations</header> 
<subparagraph id="HFC646A696B6D4883B1F60529A5D08ED0"><enum>(A)</enum><header>In general</header><text>There is authorized to be appropriated for grants under this subsection $25,000,000 for fiscal year 2008, $50,000,000 for fiscal year 2009, and $75,000,000 for fiscal year 2010.</text></subparagraph> 
<subparagraph id="H50B24D8E59A141C883E816A3E082A316"><enum>(B)</enum><header>Availability</header><text>Any amounts appropriated pursuant to this paragraph shall remain available until expended.</text></subparagraph></paragraph> 
<paragraph id="H9B61163252AA4B20A3AC66DD9666504B"><enum>(11)</enum><header>Report to Congress</header><text>The Secretary shall submit a report to the Congress, not later than 30 months after the date of the enactment of the <short-title>Brownfields Housing and Community Renewal Development Act</short-title>, on the use and impact of the grant program under this subsection.</text></paragraph> </subsection><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section>
