		<official-title>To amend the Internal Revenue Code of 1986 to provide
		  special disposition rules for unused benefits in flexible spending arrangements
		  of individuals called to active duty.</official-title>

		<section id="HB1AFC7F039B04ADB8CF747521962C040" section-type="section-one"><enum>1.</enum><header>Special disposition rules for
			 unused benefits in flexible spending arrangements of individuals called to
			 active duty</header>
			<subsection id="HC20FA0A183BD432D9BF137BAAB00B96F"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 125 of the
			 Internal Revenue Code of 1986 (relating to cafeteria plans) is amended by
			 redesignating subsections (h) and (i) as subsection (i) and (j), respectively,
			 and by inserting after subsection (g) the following new subsection:</text>

					<subsection id="H55AE5F4AFFE14B3A979993F8DAF44449"><enum>(h)</enum><header>Special rule for
				unused benefits in flexible spending arrangements of individuals called to
				active duty</header>
						<paragraph id="HDC9062985C82489490DC32E300CC656E"><enum>(1)</enum><header>In
				general</header><text>For purposes of this title, a plan or other arrangement
				shall not fail to be treated as a flexible spending arrangement merely because
				such arrangement provides for qualified reservist distributions.</text>
						</paragraph><paragraph id="HFDB2F044A38A47B4B5D21F81159C0075"><enum>(2)</enum><header>Qualified
				reservist distribution</header><text>For purposes of this subsection, the term
				<quote>qualified reservist distribution</quote> means, any distribution to an
				individual if—</text>
							<subparagraph id="H0210B195AFC147C4A599203262C15ECA"><enum>(A)</enum><text display-inline="yes-display-inline">such individual was (by reason of being a
				member of a reserve component (as defined in <external-xref legal-doc="usc" parsable-cite="usc/37/101">section 101</external-xref> of title 37, United
				States Code)) ordered or called to active duty for a period in excess of 179
				days or for an indefinite period, and</text>
							</subparagraph><subparagraph id="HE0E1DE07F5C64F3082B816292E59376C"><enum>(B)</enum><text display-inline="yes-display-inline">such distribution is made during the period
				beginning on the date of such order or call and ending on the last date that
				distributions could otherwise be made under such arrangement for the plan year
				which includes the date of such order or
				call.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HB3AA6E66C3B64AC8BAD10092774F003C"><enum>(b)</enum><header>Effective
			 date</header><text>The amendment made by this section shall apply to
			 distributions made after the date of the enactment of this Act.</text>
