		<official-title>To amend the Internal Revenue Code of 1986 to allow
		  individuals an above-the-line deduction for contributions made to the Armed
		  Forces Relief Trust as part of filing their income tax
		  returns.</official-title>

		<section id="H012B71116DE3417A9B605F70B5BA254F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Emergency Relief Tax Check-Off for Our
			 Armed Forces Act of 2007</short-title></quote>.</text>
		</section><section id="H828E8A07DEA540EA00CC2C5B6342A7D2"><enum>2.</enum><header>Above-the-line
			 deduction for certain contributions to the armed forces relief
			 trust</header><text display-inline="no-display-inline">Section 62(a) of the
			 Internal Revenue Code of 1986 (defining adjusted gross income) is amended by
			 inserting after paragraph (21) the following new paragraph:</text>
			<quoted-block display-inline="no-display-inline" id="H2005BE62116B45F2AB86B5D0648B26E4" style="OLC">
				<paragraph id="H2C6C94000E454D00A866ADEF2235CD54"><enum>(22)</enum><header>Certain
				contributions to armed forces relief trust</header><text>In the case of an
				individual, the deduction allowed by section 170 to the extent it does not
				exceed the lesser of—</text>
					<subparagraph id="HAC78D32A293948A09E00903F24299453"><enum>(A)</enum><text>the amount
				contributed by the taxpayer pursuant to the designation procedure under section
				6097, or</text>
					</subparagraph><subparagraph id="H891123534B0B4CF3B018134C63C94F01"><enum>(B)</enum><text>$1,000 ($2,000 in
				the case of a joint
				return).</text>
					</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HF1D6D7708CB641AE8EF2F84DB6466584"><enum>3.</enum><header>Designation of
			 overpayments and contributions for the armed forces relief trust</header>
			<subsection id="HD7B7EDCF43E141118C97874C4D80EE62"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subchapter A of
			 <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/61">chapter 61</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end
			 the following new part:</text>

					<part id="HD698A6AC1D364EDF82C9B17036BF0F2"><enum>IX</enum><header>Designation of
				overpayments and contributions for the armed forces relief trust</header>
						<toc regeneration="no-regeneration">
							<toc-entry level="section">Sec. 6097. Designation.</toc-entry>
						</toc>
						<section id="H32F23942E82943EC00E9F32E937B6ED"><enum>6097.</enum><header>Designation</header>
							<subsection id="HE43CC878EF5F4942ABF18838884BD82"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">In the case of an
				individual, with respect to each taxpayer's return for the taxable year of the
				tax imposed by chapter 1, such taxpayer may designate that—</text>
								<paragraph id="H8E9043815580494FBFE596D393BF36BD"><enum>(1)</enum><text display-inline="yes-display-inline">a specified portion (but not less than $1)
				of any overpayment of tax for such taxable year, and</text>
								</paragraph><paragraph id="H5CC45D92199A4FC99519183C1424E526"><enum>(2)</enum><text display-inline="yes-display-inline">any cash contribution which the taxpayer
				includes with such return,</text>
								</paragraph><continuation-text continuation-text-level="subsection">shall be
				contributed to the Armed Forces Relief Trust.</continuation-text></subsection><subsection id="H8BACF8ED4B8045209CD8936DC563EC5"><enum>(b)</enum><header>Manner and time
				of designation</header><text display-inline="yes-display-inline">A designation
				under subsection (a) may be made with respect to any taxable year only at the
				time of filing the return of the tax imposed by chapter 1 for such taxable
				year. Such designation shall be made in such manner as the Secretary prescribes
				by regulations except that such designation shall be made either on the first
				page of the return or on the page bearing the taxpayer's signature.</text>
							</subsection><subsection id="H12A0E3B30AEA4063826914D5D9602C27"><enum>(c)</enum><header>Overpayments
				treated as refunded</header><text display-inline="yes-display-inline">For
				purposes of this title, any portion of an overpayment of tax designated under
				subsection (a) shall be treated as being refunded to the taxpayer as of the
				last date prescribed for filing the return of tax imposed by chapter 1
				(determined without regard to extensions) or, if later, the date the return is
				filed.</text>
							</subsection><subsection id="H3204708D1E0B43B5A64200AE7343CFF"><enum>(d)</enum><header>Explanation</header><text display-inline="yes-display-inline">The Secretary shall include in the general
				instructions for filing returns by individuals of the tax imposed by chapter
				1—</text>
								<paragraph id="H65AD3A1107F24766B738DD73CC7F5F20"><enum>(1)</enum><text>a description of
				the deduction under section 62(a)(22) and the designation procedure under this
				section,</text>
								</paragraph><paragraph id="HE81587924E4746CF92D1C3926F5EA331"><enum>(2)</enum><text>an explanation
				that charitable contributions to the Armed Forces Relief Trust that are not
				described in section 62(a)(22) are still allowable as a deduction to taxpayers
				who itemize deductions, and</text>
								</paragraph><paragraph id="H690D162778164A0ABB866F8C3CB1A21"><enum>(3)</enum><text>a notice that the
				use of funds contributed to the Armed Forces Relief Trust under this section
				shall be determined by the Advisory Board established under subsection
				(e).</text>
								</paragraph></subsection><subsection id="H48086C514441490AA7F6D700F3D01612"><enum>(e)</enum><header>Advisory
				board</header>
								<paragraph display-inline="no-display-inline" id="H3CDB80628F164D94B9EA8EAE70801EB6"><enum>(1)</enum><header>Appointment</header>
									<subparagraph id="H3F3911919E0B4B2A98C9BFE33402F187"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">There is established
				an advisory board for the Armed Forces Relief Trust. The members of such board
				shall be appointed as follows:</text>
										<clause id="HB72ED5707A0D4501BDD4A049DA7E4991"><enum>(i)</enum><text display-inline="yes-display-inline">One individual appointed by the Chairman of
				the Committee on Finance of the Senate.</text>
										</clause><clause id="HB4DC8F2CA644431FB8C899553C6525D5"><enum>(ii)</enum><text display-inline="yes-display-inline">One individual appointed by the Chairman of
				the Committee on Armed Services of the Senate.</text>
										</clause><clause id="HD8ED2BF0C2F34123B9BD4D918EBF69B1"><enum>(iii)</enum><text display-inline="yes-display-inline">One individual appointed by the Chairman of
				the Committee on Veterans' Affairs of the Senate.</text>
										</clause><clause id="H58036C3A47394AD08974D53E6FE3E3B0"><enum>(iv)</enum><text display-inline="yes-display-inline">One individual appointed by the Chairman of
				the Committee on Appropriations of the Senate.</text>
										</clause><clause id="H0DAB511CC52C488A986F7E6570F13731"><enum>(v)</enum><text display-inline="yes-display-inline">One individual appointed by the Chairman of
				the Joint Committee on Taxation.</text>
										</clause><clause id="H5EC5ACBCD7A74C76B8C36EF2F5442783"><enum>(vi)</enum><text display-inline="yes-display-inline">One individual appointed by the Chairman of
				the Committee on Armed Services of the House of Representatives.</text>
										</clause><clause id="HA66DCE9AFA604118B784A1FFAFDDCDF"><enum>(vii)</enum><text display-inline="yes-display-inline">One individual appointed by the Chairman of
				the Committee on Veterans' Affairs of the House of Representatives.</text>
										</clause><clause id="HAE13843A2BD240C784DFC3FC3066DCD"><enum>(viii)</enum><text display-inline="yes-display-inline">One individual appointed by the Chairman of
				the Committee on Appropriations of the House of Representatives.</text>
										</clause><clause id="H979DC298928A41C7BED83618382BA4B9"><enum>(ix)</enum><text display-inline="yes-display-inline">One individual appointed by the President
				from each of the following: the Army Emergency Relief Society, the Navy Marine
				Corps Relief Society, the Air Force Aid Society, and the Coast Guard Mutual
				Assistance Relief Society.</text>
										</clause><clause id="H2500CC3B2CED49D0B5D596F19911B4E1"><enum>(x)</enum><text display-inline="yes-display-inline">Two individuals appointed by the President
				from 2 veterans service organizations.</text>
										</clause></subparagraph><subparagraph id="H3C793B6045B64EB789875E019749DDAE"><enum>(B)</enum><header>Term</header><text display-inline="yes-display-inline">The term of each member of the advisory
				board shall be 3 years, except that any member whose term of office has expired
				shall continue to serve until such member's successor is appointed. No member
				shall serve more than 2 3-year terms.</text>
									</subparagraph><subparagraph id="H3432BE32F3A4481C968841FD73EA5F5D"><enum>(C)</enum><header>Appointment of
				successors</header><text display-inline="yes-display-inline">The appointment of
				any successor member shall be made in the same manner as the original
				appointment. If a member dies or resigns before the expiration of the member's
				term, a successor shall be appointed for the unexpired portion of the term in
				the same manner as the original appointment.</text>
									</subparagraph><subparagraph id="H62194BBC3A324F65A66D169DBCCBACD8"><enum>(D)</enum><header>Prohibition</header><text display-inline="yes-display-inline">No member of the advisory board may be an
				employee of the Federal Government.</text>
									</subparagraph></paragraph><paragraph id="HE130AB7D7E944C1E8BE75EA4CC6EC0A4"><enum>(2)</enum><header>Chairman; vice
				chairman</header>
									<subparagraph id="H75890647A6C6466E8E0067A0ECF3169F"><enum>(A)</enum><header>Designation</header><text display-inline="yes-display-inline">The President shall designate a chairman
				for the advisory board. The advisory board shall not later than its second
				meeting, by majority vote, designate a vice chairman, who shall perform the
				duties of the chairman in the absence of the chairman.</text>
									</subparagraph><subparagraph id="H3040219D2A674798BE7F68A9412E82CC"><enum>(B)</enum><header>Duties of
				chairman</header><text display-inline="yes-display-inline">The chairman shall
				call the meetings of the advisory board, propose meeting agendas, chair the
				meetings, and establish, with the approval of a majority of the members, the
				rules and procedures for such meetings.</text>
									</subparagraph></paragraph><paragraph id="HAD2DFC3DBD37478284E05BF240659F20"><enum>(3)</enum><header>Operations of
				board</header><text display-inline="yes-display-inline">The advisory board
				shall meet semi-annually, for the purpose of providing ongoing advice to the
				Armed Forces Relief Trust regarding the distribution of contributed funds,
				policies governing said distribution, and the administrative costs and
				operations of the Armed Forces Relief Trust. A majority of the members shall
				constitute a quorum. Advisory board members shall serve without compensation.
				While performing duties as a member of the advisory board, each member shall be
				reimbursed under Federal Government travel regulations for travel expenses.
				Such reimbursements and any other reasonable expenses of the advisory board
				shall be provided by the budget of the Executive Office of the
				President.</text>
								</paragraph><paragraph id="HD7A919E940504405A34E55A03CD26170"><enum>(4)</enum><header>Control over
				designated funds</header><text>Amounts contributed to the Armed Forces Relief
				Trust pursuant to this section may be used by such Trust only as provided by
				the advisory board.</text>
								</paragraph><paragraph id="H4636C80897B04D20969023C917154600"><enum>(5)</enum><header>Audit</header><text display-inline="yes-display-inline">The General Accountability Office shall
				audit the distribution and management of funds of the Armed Forces Relief Trust
				on an annual basis to ensure compliance with statutory and administrative
				directives. The Comptroller General of the United States shall report to the
				advisory board and Congress on the results of such audit.</text>
								</paragraph><paragraph id="H8B8AE206020545208428A0B091430A1"><enum>(6)</enum><header>Reports</header><text>Within
				60 days after its semi-annual meeting, the advisory board shall submit a
				written report to the President of its action, and of its views and
				recommendations. Any report other than the semi-annual report, shall, if
				approved by a majority of the members of the advisory board, be submitted to
				the President within 60 days after such
				approval.</text>
								</paragraph></subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H98F9138263D34886B8F5BC1E48610000"><enum>(b)</enum><header>Clerical
			 amendment</header><text display-inline="yes-display-inline">The table of parts
			 for subchapter A of chapter 61 of such Code is amended by adding at the end the
			 following new item:</text>

					<toc-entry level="part"><quote>Part IX. Designation of overpayments
				and contributions for the Armed Forces Relief Trust.</quote>.</toc-entry>
				</toc>
			</subsection></section><section id="HC3DC74F49AD94F79B4D2A890E6C8054C"><enum>4.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">The amendments made by
			 this Act shall apply to taxable years beginning after December 31, 2006.</text>
