			 whenever in this Act an amendment or revision is expressed in terms of an
			 amendment to, or revision of, a section or other provision, the reference shall
			 be considered to be made to a section or other provision of the Elementary and
			 Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6301">20 U.S.C. 6301 et seq.</external-xref>).</text>
		</section><section id="H560DFCB787AF4AE983E3B238C537A721"><enum>3.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following
			 findings:</text>
			<paragraph id="HF932E900085545AC91EAEC63B9232B59"><enum>(1)</enum><text>State and local
			 governments bear the majority of the cost of and responsibility for educating
			 public elementary school and secondary school students.</text>
			</paragraph><paragraph id="HBC597F7685874319000019B000D4B1A9"><enum>(2)</enum><text>State and local
			 governments often struggle to find adequate funding to provide basic
			 educational services.</text>
			</paragraph><paragraph id="H89B00F9258304E47B4004F5690C5A430"><enum>(3)</enum><text>The Federal
			 Government has not provided its full share of funding for numerous federally
			 mandated elementary and secondary education programs.</text>
			</paragraph><paragraph id="H73FBA6CF178F498296FE6CC15214BA94"><enum>(4)</enum><text>Underfunded
			 Federal education mandates increase financial pressures on States and local
			 educational agencies.</text>
			</paragraph><paragraph id="H534C976FAA23488DB59F00ABB56C26D9"><enum>(5)</enum><text>States and local
			 educational agencies are facing increased costs when implementing the annual
			 student academic assessments required under section 1111(b)(3)(C)(vii) of the
			 Elementary and Secondary Education Act of 1965 (20 U.S.C.
			 6311(b)(3)(C)(vii)).</text>
			</paragraph><paragraph id="H8E07AE1379EF488CBADD5866B9B9697D"><enum>(6)</enum><text>Multiple measures
			 of student academic achievement on various methods of assessment provide a more
			 complete picture of a student's strengths and weaknesses than does a single
			 score on a high stakes standardized test.</text>
			</paragraph><paragraph id="HE46595DFAF9F4BA38FDF16EA3CECB5C8"><enum>(7)</enum><text>The frequency of
			 using high-quality assessments as a tool to measure student achievement should
			 be decided by State educational agencies and local educational agencies.</text>
			</paragraph></section><section id="H4A38991CB69042D99F14396E4C88288C"><enum>4.</enum><header>Purposes</header><text display-inline="no-display-inline">Section 1001 (<external-xref legal-doc="usc" parsable-cite="usc/20/6301">20 U.S.C. 6301</external-xref>) is
			 amended—</text>
			<paragraph id="HB02FAE4C33724BD7BC8355A9F0C38D1D"><enum>(1)</enum><text>by redesignating
			 paragraphs (8) through (12) as paragraphs (10) through (14), respectively;
			 and</text>
			</paragraph><paragraph id="H3AE712A539CE4421BD44C144AFF8972C"><enum>(2)</enum><text>by inserting after
			 paragraph (7) the following:</text>
				<quoted-block display-inline="no-display-inline" id="H5C50CAAD37FD4A8DA63D36553B4903C3" style="OLC">
					<paragraph id="HD21C4BBAF30044B483517BC5C748143B"><enum>(8)</enum><text>encouraging State
				educational agencies and local educational agencies to design innovative State
				assessment systems that include valid and reliable high-quality assessments,
				including teacher-designed formative assessments, performance-based
				assessments, portfolio assessments, and other locally designed
				assessments;</text>
					</paragraph><paragraph id="H58E194ACB9514BB685C108A138AC4F34"><enum>(9)</enum><text>providing
				additional resources for States to encourage the use of more than high stakes
				standardized testing in making key decisions about students and schools,
				including accountability determinations, student promotion and retention
				decisions, and school funding
				decisions;</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H4BF7795B9C3F4B569F83D1B18807600"><enum>5.</enum><header>State and local
			 flexibility in assessment and accountability models</header>
			<subsection id="H286038D7DECB4B83864240F7B9673256"><enum>(a)</enum><header>Changes to
			 academic standards</header><text>Section 1111(b)(1)(D) (20 U.S.C.
			 6311(b)(1)(D)) is amended—</text>
				<paragraph id="H3A0A4D7F1FC1475A81181F01035DA275"><enum>(1)</enum><text>in clause
			 (i)(III), by inserting <quote>, including higher-order thinking and analysis
			 skills</quote> after <quote>skills</quote>; and</text>
				</paragraph><paragraph id="HB7B4CAFA46AF4CD69EAECF0092EEF100"><enum>(2)</enum><text>in clause
			 (ii)(III), by striking <quote>the lower-achieving</quote> and inserting
			 <quote>all</quote>.</text>
				</paragraph></subsection><subsection id="H83AF2AC93B6F49E796F99FB1D08DE900"><enum>(b)</enum><header>Accountability
			 definition changes</header><text>Section 1111(b)(2)(A) (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311(b)(2)(A)</external-xref>
			 is amended—</text>
				<paragraph id="HF75C0EC692E24FB6001F69A5ACC1FED"><enum>(1)</enum><text>in
			 the matter preceding clause (i)—</text>
					<subparagraph id="HFCED6BF53F78422C97ED43017FF77DC8"><enum>(A)</enum><text>by inserting
			 <quote>or adequate yearly growth</quote> after <quote>progress</quote>;
			 and</text>
					</subparagraph><subparagraph id="H35CFED61A3BC4DC98900A2C9FB783800"><enum>(B)</enum><text>by striking
			 <quote>under this paragraph</quote> and inserting <quote>in the State plan in
			 accordance with this paragraph and subject to the State's selection of an
			 assessment system described in paragraph (3)(E)</quote>; and</text>
					</subparagraph></paragraph><paragraph id="H14AC089DD02141F4935B7EB66B107500"><enum>(2)</enum><text>in clause
			 (iii)—</text>
					<subparagraph id="HBBF75C8FC53347EEB514F02FE86500EB"><enum>(A)</enum><text>by striking
			 <quote>sanctions</quote> and inserting <quote>proven interventions</quote>;
			 and</text>
					</subparagraph><subparagraph id="HC6CBE40509034A0DA5D18C9136A2B51"><enum>(B)</enum><text>by inserting
			 <quote>or adequate yearly growth</quote> after <quote>adequate yearly
			 progress</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="H7DD6671544734C50BDF9272F1CF9939C"><enum>(c)</enum><header>Adequate Yearly
			 Progress Changes</header><text>Section 1111(b)(2) (as amended by subsection
			 (b)) (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311(b)(2)</external-xref>) is further amended—</text>
				<paragraph id="HB3B1D52C89A64A23A4079E23753C8D00"><enum>(1)</enum><text>in subparagraph
			 (B), by inserting <quote>, and at the State’s selection, other academic
			 indicators,</quote> after <quote>assessments</quote>; and</text>
				</paragraph><paragraph id="H1E5A1886CB2F4E1080D6898FC86E113F"><enum>(2)</enum><text>in subparagraph
			 (D)—</text>
					<subparagraph id="H7F2270A487EA48CF8545D9D431E9118B"><enum>(A)</enum><text>in clause (i), by
			 striking <quote>and</quote> after the semicolon;</text>
					</subparagraph><subparagraph id="H76559B859FCB4F189160ABFA6CFE4D42"><enum>(B)</enum><text>by striking clause
			 (ii) and inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="HF3900AFF3DD149B58891708F24A547AE" style="OLC">
							<clause id="HF8540143ACEC48F2866BD302568D1154"><enum>(ii)</enum><text>in order to
				provide a more accurate determination of school improvement and subject to
				subparagraph (C)(iv), may elect to use other academic indicators described in
				clauses (vi) or (vii) of subparagraph (C) to determine which schools and local
				educational agencies are identified for school improvement, corrective action,
				or restructuring under section 1116;
				and</text>
							</clause><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph commented="no" id="HB6B21A6E474B4FFE88C2793448D4C1C"><enum>(C)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="HA09A2704705C42A790C3D9BF918C342E" style="OLC">
							<clause commented="no" id="HDE40266E656041BEB7D078C73672CE00"><enum>(iii)</enum><text>shall ensure
				that assessments described in paragraph (3) represent not less than 50 percent
				of the factors used to determine how academic achievement is measured for
				purposes of determining adequate yearly progress or adequate yearly
				growth.</text>
							</clause><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="HD54D41920FE841C787AB4BB20946537B"><enum>(d)</enum><header>Changes to
			 annual measurable objectives</header><text>Section 1111(b)(2)(G) (20 U.S.C.
			 6311(b)(2)(G)) is amended—</text>
				<paragraph id="H80997CCB7BD840BBBEE709B6A4699DB5"><enum>(1)</enum><text>in clause (iii),
			 by inserting <quote>, or to meet a certain level of adequate yearly
			 growth,</quote> after <quote>proficient level</quote>; and</text>
				</paragraph><paragraph id="H3F7CE529CD3F493E88A137A1C935C97B"><enum>(2)</enum><text>in clause (iv), by
			 inserting <quote>, or definition of adequate yearly growth,</quote> after
			 <quote>academic achievement</quote>.</text>
				</paragraph></subsection><subsection id="H105C3AEBFD704934AA4ED8ACD1366F00"><enum>(e)</enum><header>State
			 flexibility To design growth models</header><text>Section 1111(b)(2) (20 U.S.C.
			 6311(b)(2)) is further amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HD8ABFF0C2BB94872946975690854BE00" style="OLC">
					<subparagraph id="H2222D7B44D8A436FBCB43B036D76952"><enum>(L)</enum><header>State flexibility
				To design growth models</header>
						<clause id="H4B44414AE33D4D04822C24328059D041"><enum>(i)</enum><header>In
				general</header><text>Notwithstanding any other provisions of this section, in
				carrying out this section a State may choose from among the following statewide
				accountability models:</text>
							<subclause id="H5865368E1ECD408DB63D1339B303CCD7"><enum>(I)</enum><header>Status
				model</header><text>Maintaining annual assessments under a status model, as
				described in subparagraphs (B) through (K) of this paragraph.</text>
							</subclause><subclause id="H435DEC9A78F64F5E94F43C9DFCF6896E"><enum>(II)</enum><header>Growth
				model</header><text>Implementing a growth model accountability system described
				in clause (ii).</text>
							</subclause><subclause id="H7079FC44BC4343A19D20A2790045F00"><enum>(III)</enum><header>Hybrid
				model</header><text>Implementing a hybrid accountability model, including a
				combined growth and status model, if the growth model meets the requirements
				described in clause (ii).</text>
							</subclause></clause><clause id="H96152A71422D49FC00C7FDE8E15EC3C5"><enum>(ii)</enum><header>Requirements
				for growth models</header><text>A growth model accountability system referred
				to in subclause (II) or (III) of clause (i) shall meet the following
				requirements:</text>
							<subclause id="H130BBD4D4AAA4387A8DEF19775D9F9F2"><enum>(I)</enum><header>Valid, reliable,
				and accurate measures</header><text>The growth model uses valid, reliable, and
				accurate measures.</text>
							</subclause><subclause id="H27F5F1B4C40E47B397000408F9ACD808"><enum>(II)</enum><header>Sufficient
				technical quality and capacity</header><text>The growth model has sufficient
				technical quality and technical capacity to ensure the growth model can
				function fairly and accurately for each student.</text>
							</subclause><subclause id="H8E9831BF4FB142AA8F28011F06226947"><enum>(III)</enum><header>Statewide
				privacy-protected data system</header><text>The growth model has a statewide
				privacy-protected data system capable of tracking individual students’
				growth.</text>
							</subclause><subclause id="H2059C1F30EB74766A4D991AC00D78DC"><enum>(IV)</enum><header>Annual
				assessments</header><text>The State annually assesses students in grades 3
				through 8 and once in grades 9 through 12 and such assessments produce reliable
				results in each grade and from year to year.</text>
							</subclause><subclause id="H4149E39246A441EBB2C01B99BB7BB669"><enum>(V)</enum><header>Performance
				measures or growth targets</header><text>The State may set performance measures
				or growth targets based on a student’s current academic level, but may not set
				performance measures or growth targets for students on the basis of the
				student’s membership in 1 of the groups listed in subparagraph
				(C)(v)(II).</text>
							</subclause><subclause id="H1FD78252F6C64453BB3119878EA6BF87"><enum>(VI)</enum><header>Ability to
				evaluate</header><text>The State is able to evaluate student gains or progress
				in, at a minimum, mathematics and reading or language
				arts.</text>
							</subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H104E0CC5D50445F0963735A0BA92C0F2"><enum>(f)</enum><header>State
			 flexibility To design assessment systems</header><text>Section 1111(b)(3) (20
			 U.S.C. 6311(b)(3)) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H4136482D47DE4593AA27836542009907" style="OLC">
					<subparagraph id="H5B61138AFFCE408EBA264723CDAE8E72"><enum>(E)</enum><header>State
				flexibility To design assessment systems</header>
						<clause id="H52D7923991E042EA8BBA6853C367801E"><enum>(i)</enum><header>State assessment
				systems</header>
							<subclause id="HB1F7DE0F1C6443148433A6BAEE8B3557"><enum>(I)</enum><header>In
				general</header><text>Notwithstanding any other provision of this Act, in
				carrying out this section a State may choose to design a statewide assessment
				system described in clause (ii) that is subject to peer review and approval
				under subsection (e).</text>
							</subclause><subclause id="H0035B0A514B341919CE6CD44A40723C6"><enum>(II)</enum><header>Maintaining
				current assessment system</header><text>Notwithstanding any other provision of
				this Act, a State may elect to maintain the State's statewide assessment system
				in effect on the day before the date of enactment of the Improving Student
				Testing Act of 2007.</text>
							</subclause><subclause id="HA60085F861D64C0B9D3DEF497342BD24"><enum>(III)</enum><header>Consultation</header><text>A
				State shall consult with local educational agencies, principals, teachers, and
				parents when designing an assessment system under this subparagraph.</text>
							</subclause></clause><clause id="H8893C5EDFB3C4A52ABEF5212F1F278B5"><enum>(ii)</enum><header>Statewide
				assessment system options</header><text>In carrying out this section a State
				may choose from among the following statewide assessment system options:</text>
							<subclause id="H4BB6BE3A90784E869F54AA31BB69A8CA"><enum>(I)</enum><header>Alternative
				assessment models</header>
								<item id="HFF14B2B78B394A95A84302F136004770"><enum>(aa)</enum><header>In
				general</header><text>Subject to item (bb), a State may conduct statewide
				assessments as described in paragraph (3) not less than—</text>
									<subitem id="H7734F7E40A30418AA97268BC96CD8669"><enum>(AA)</enum><text>once in grades 3
				through 5;</text>
									</subitem><subitem id="H2AFEF55E734945A4AFFB946674712819"><enum>(BB)</enum><text>once in grades 6
				through 9; and</text>
									</subitem><subitem id="HCEE971655C80499BA42809D112C3DCED"><enum>(CC)</enum><text>once in grades 10
				through 12.</text>
									</subitem></item><item commented="no" id="HDA0608D5DBA24325879985AC6737156F"><enum>(bb)</enum><header>Special
				rule</header><text>If a State chooses to assess statewide in grade-spans, then
				the State is encouraged to use more than standardized, point-in-time
				assessments to determine adequate yearly progress or adequate yearly growth,
				and decisions related to school improvement, corrective action, and
				restructuring under section 1116.</text>
								</item></subclause><subclause id="H5CE13EBB56744F08B5CF7CB50070B2EA"><enum>(II)</enum><header>Multiple
				measures of assessment</header><text>A State may choose to implement a system
				of State or locally designed or administered formative assessments, performance
				assessments, portfolio assessments, benchmark assessments, end-of-course
				examinations, and other measures of assessment, as an alternative to or in
				conjunction with statewide standardized assessments, if each such assessment in
				the system—</text>
								<item id="H0554FADE745140FB88487FCD001540E8"><enum>(aa)</enum><text>measures
				higher-order thinking skills; and</text>
								</item><item id="H8C4B5B5B0C754CB88D2E1D03AD37B681"><enum>(bb)</enum><text>meets the
				requirements of subparagraph (C)(xvi).</text>
								</item></subclause><subclause id="H567E2A31E60E477292EBD795D918E1F2"><enum>(III)</enum><header>Hybrid
				assessment model</header><text>A State may choose to create a hybrid assessment
				model composed of statewide standardized assessments and multiple measures of
				assessment described in subclause
				(II).</text>
							</subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HE66E8BB1406D4701822DF763AA91ED86"><enum>(g)</enum><header>Assessment
			 changes</header><text>Section 1111(b)(3) (as amended by subsection (e)) is
			 further amended—</text>
				<paragraph id="H5BFD4BBD01FE4D719CBC039EF83085AB"><enum>(1)</enum><text>in subparagraph
			 (A)—</text>
					<subparagraph id="H967857712D5541A3A698CB05318EBFE"><enum>(A)</enum><text>by striking
			 <quote>, yearly</quote> after <quote>high-quality</quote>; and</text>
					</subparagraph><subparagraph id="H4C8E1AD8EA8E46E7B000210990CE335"><enum>(B)</enum><text>by striking
			 <quote>that will be used as the primary</quote> and inserting <quote>, subject
			 to the State’s selection of an assessment system under subparagraph (E), that
			 will be used as 1 of the</quote>;</text>
					</subparagraph></paragraph><paragraph id="H3ACD91BCA9B3448281E64936CE18937"><enum>(2)</enum><text>in
			 subparagraph (C)—</text>
					<subparagraph id="HEEB311B3D59C46A88C133BFFBAF5CE05"><enum>(A)</enum><text>in the matter
			 preceding item (aa) of clause (v)(I), by striking <quote>except as otherwise
			 provided for grades 3 through 8 under clause vii</quote> and inserting
			 <quote>subject to a State’s selection of an assessment system under
			 subparagraph (E)</quote>;</text>
					</subparagraph><subparagraph id="H4AC702C77CC04A1683CFFD532BD361D0"><enum>(B)</enum><text>in clause (vii),
			 by striking <quote>beginning not</quote> and all that follows through
			 <quote>through 8 in</quote> and inserting <quote>measure the achievement of
			 students against the challenging State academic content and student academic
			 achievement standards in each of the grades assessed in</quote>;</text>
					</subparagraph><subparagraph id="H06ACDA7A40534C0F917086C1CAD36280"><enum>(C)</enum><text>in clause (xiv),
			 by striking <quote>and</quote> after the semicolon;</text>
					</subparagraph><subparagraph id="HACBDEB4D731C498BA92B7E69F23457E4"><enum>(D)</enum><text>in clause (xv), by
			 striking the period and inserting <quote>; and</quote>; and</text>
					</subparagraph><subparagraph id="H7956C4534C4E4E399004A5277C279733"><enum>(E)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H7A8EE1EE73764F0BAF98DC1CCAD21F63" style="OLC">
							<clause id="HDD3467768EEC411599E9DAC82912F9F"><enum>(xvi)</enum><text>if the State
				chooses, include other valid and reliable assessments, including State or
				locally designed or administered formative assessments, performance
				assessments, portfolio assessments, benchmark assessments, end-of-course
				examinations, and other local assessments, that—</text>
								<subclause id="HC8304D56F8634FC4829945D54E004CE0"><enum>(I)</enum><text>are aligned with
				the State’s academic content standards and student academic achievement
				standards;</text>
								</subclause><subclause id="HC61358AFEAD347C7A585C4F7DCCACEDD"><enum>(II)</enum><text>have been
				approved through the peer-review process described in subsection (e);</text>
								</subclause><subclause id="H1467A5F86FCE4BDFB42DE06B0002614C"><enum>(III)</enum><text>measure
				higher-order thinking skills;</text>
								</subclause><subclause id="H6F10EF59C9A549EFA85D1604841D37AB"><enum>(IV)</enum><text>produce evidence
				about student learning and achievement in a timely manner; and</text>
								</subclause><subclause id="H6A347206D9A14946B0E02EA0E3BEFC9"><enum>(V)</enum><text>provide teachers
				with meaningful feedback so that the teachers can modify, improve, and target
				instructional strategies based on individual student
				need.</text>
								</subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection commented="no" id="HA568B388D90F4821BEA17D75B5E546D8"><enum>(h)</enum><header>Special
			 rule</header><text>Section 1111(b) (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311(b)</external-xref>) is further amended by
			 striking paragraph (4).</text>
			</subsection></section><section id="HB1B6D1A00A724764BDB8A7648E9A011"><enum>6.</enum><header>Privacy
			 protections for data systems</header><text display-inline="no-display-inline">Subpart 1 of part A of title I of the
			 Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311 et seq.</external-xref>) is
			 amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="H0249E1AAFF2B4E9393B79822C3786151" style="OLC">
				<section id="H84546FB7019446C6969C19BA5FC381AA"><enum>1120C.</enum><header>Privacy
				protections for data systems</header>
					<subsection id="HDD9A0E777BA4448082A4C7FF55542164"><enum>(a)</enum><header>In
				general</header><text>Each State receiving a grant under this part shall
				implement measures to—</text>
						<paragraph id="HA3567BC545E1483B9BE0D2870060CF61"><enum>(1)</enum><text>limit the use of
				information in a statewide education data system by a State educational agency,
				a local educational agency, or an institution of higher education to the
				purposes and functions for such information set forth in Federal or State
				education law, and allow access to the information in the statewide education
				data system only to those State or local employees or agents, and only on such
				terms, as may be necessary to fulfill those purposes and functions;</text>
						</paragraph><paragraph id="H95E4D60B97A84544AFB3B6F2A9A78F33"><enum>(2)</enum><text>prohibit the
				disclosure of student-level information in the data system to any other person,
				agency, institution, or entity, except that States may allow the disclosures
				permitted under section 444 of the General Education Provisions Act in
				accordance with the limitations set forth in this section and any additional
				limitations set forth in State law;</text>
						</paragraph><paragraph id="H75E2AC80AF36436394B267473B9BAC9D"><enum>(3)</enum><text>require any
				person, agency, institution, or entity to whom disclosure of information in the
				data system is authorized under section 444 of the General Education Provisions
				Act to sign a data use agreement prior to disclosure, that—</text>
							<subparagraph id="H28C2FF8D1C054F5487CE7C916FB9AE00"><enum>(A)</enum><text>prohibits the
				party from further disclosing the information;</text>
							</subparagraph><subparagraph id="HC3AA756E994A40FEA5A2A69003485564"><enum>(B)</enum><text>prohibits the
				party from using the information for any purpose other than the purpose
				specified in the agreement; and</text>
							</subparagraph><subparagraph id="HA32DBB030A81475AB5888961CB00CE7B"><enum>(C)</enum><text>requires the party
				to destroy the information when the purpose for which the disclosure was made
				is accomplished;</text>
							</subparagraph></paragraph><paragraph id="H9376F9A3846E4C5797ED5E6D6DA78490"><enum>(4)</enum><text>if consistent with
				the purpose of the disclosure, remove personally identifying information and
				unique identifiers before disclosing student-level information in the data
				system;</text>
						</paragraph><paragraph id="HA0E925F41B4D48CDBEBC1FE18B5E4EB4"><enum>(5)</enum><text>in addition to the
				accounting requirements set forth under section 444 of the General Education
				Provisions Act, maintain a record of the date of each disclosure of information
				in the data system, a detailed description of the information disclosed, and
				the name and address of the person, agency, institution, or entity to whom the
				disclosure was made, which accounting shall be made available on request to
				parents of any student whose information has been disclosed, or to the student
				if the student has reached the age of 18 or is enrolled in a postsecondary
				educational institution;</text>
						</paragraph><paragraph id="H96349D47549C480C8C6603D6D07200B9"><enum>(6)</enum><text>ensure that any
				disclosure of aggregate data in the data system is in a form that does not
				permit the identification of individual students, and that any unique
				identifiers in the data system are removed prior to disclosure of aggregate
				data;</text>
						</paragraph><paragraph id="H3519CE226D854D40B94CB6044FC11328"><enum>(7)</enum><text>maintain adequate
				security measures to ensure the confidentiality and integrity of the data
				system; and</text>
						</paragraph><paragraph id="HD754416E454D4914B2C146917FD349A0"><enum>(8)</enum><text>ensure adequate
				enforcement of the requirements of this section.</text>
						</paragraph></subsection><subsection id="H47B7DB1E4C7246ED8E1BC53BF8EF77C"><enum>(b)</enum><header>Use of unique
				identifiers</header>
						<paragraph id="H29B83B7249B14C0C875C09437CAFB987"><enum>(1)</enum><header>Governmental use
				of unique identifiers</header><text>It shall be unlawful for any Federal
				agency, any employee of any Federal agency, any State or local agency in a
				State that receives funds under this Act, or any employee of a State or local
				agency in a State that receives funds under this Act, to use unique identifiers
				employed in a statewide education data system for any purpose other than as
				authorized by Federal or State education law, or to deny any individual any
				right, benefit, or privilege provided by law because of such individual’s
				refusal to disclose the individual's unique identifier.</text>
						</paragraph><paragraph id="H14D5323AF75549E49D0217F8A6FE3F54"><enum>(2)</enum><header>Regulations</header><text>Not
				later than 1 year after the date of enactment of the
				<short-title>Improving Student Testing Act of
				2007</short-title>, the Secretary shall promulgate regulations governing the
				use of unique identifiers employed in statewide education data systems, with
				the goal of safeguarding individual privacy. The regulations may require States
				seeking grants under this part to have in place measures to limit the use of
				unique identifiers by nongovernmental parties to the extent practicable,
				consistent with the uses of the information authorized in Federal or State
				education law.</text>
						</paragraph></subsection><subsection id="H558C8C810F9B475F857449A3B903033"><enum>(c)</enum><header>Formula grants
				for privacy protected data systems</header>
						<paragraph id="HDB29998562EB43D49711C51D2726367C"><enum>(1)</enum><header>Grants
				authorized</header><text>The Secretary is authorized to award a grant, from
				allotments under paragraph (2), to each State receiving funds under this part,
				for the purposes of carrying out the requirements of this section related to
				privacy protections and unique identifiers.</text>
						</paragraph><paragraph id="HD79AFBAB5DA2413EA6002025BC154236"><enum>(2)</enum><header>Allotment
				formula</header><text>The Secretary shall establish a formula for the allotment
				of grants under this subsection that ensures that no State receives less than
				$500,000 annually and that each State receives an equitable share of the amount
				allotted based upon relevant State factors, including student population
				size.</text>
						</paragraph><paragraph id="HD03903BF39404683986EEB886589CBAF"><enum>(3)</enum><header>Definition of
				State</header><text>In this subsection the term <term>State</term> means each
				of the several States of the United States, the District of Columbia, and the
				Commonwealth of Puerto Rico.</text>
						</paragraph></subsection><subsection id="H91D844C7EBD54E3D964604FBB19EE9F6"><enum>(d)</enum><header>Authorized
				amounts</header><text>There are authorized to be appropriated to carry out this
				section $35,000,000 for each of fiscal years 2008 through
				2012.</text>
					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HADC72FF8E32547A28D33DAC8542EED5B"><enum>7.</enum><header>Timeline</header><text display-inline="no-display-inline">Section 1111(b)(2)(F) (20 U.S.C.
			 6311(b)(2)(F)) is amended by adding at the end the following: <quote>The
			 Secretary shall waive the timeline described in this subparagraph if the amount
			 appropriated to carry out this part for each of fiscal years 2008 through 2015
			 does not equal or exceed the amount authorized to be appropriated to carry out
			 this part for each such fiscal year.</quote>.</text>
		</section><section id="HCB9C722F11084A8FA449FD417B76D200"><enum>8.</enum><header>Improvements to
			 the peer review process</header><text display-inline="no-display-inline">Section 1111(e)(1) (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311(e)(1)</external-xref>) is
			 further amended—</text>
			<paragraph id="H02F8EEB972224C5186007036F41F81A7"><enum>(1)</enum><text>by striking
			 subparagraph (B) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="HB6CF1685E77246F3977F71CA6E694712" style="OLC">
					<subparagraph id="HB51AA33EA35142EAA4B991520608691"><enum>(B)</enum><text>appoint individuals
				to the peer review process who are—</text>
						<clause id="H37C54ACD7D2F4C5ABFB763270086ACDB"><enum>(i)</enum><text>representative of
				parents, teachers, State educational agencies, local educational agencies, and
				professional education associations; and</text>
						</clause><clause id="HAD141DF763144513984C6C9D88811385"><enum>(ii)</enum><text>skilled
				practitioners or education researchers with knowledge of fair, valid, and
				reliable assessment design, including individuals with expertise in 1 or more
				of the following:</text>
							<subclause id="H8F7AA855B8EE4BE89FD9E81BFDD9399B"><enum>(I)</enum><text>Developing
				educational standards.</text>
							</subclause><subclause id="HC40D219C8D954F66A44448439E3466B3"><enum>(II)</enum><text>Developing valid
				and reliable assessments for all students, including alternative assessments
				for students with disabilities and English language learners.</text>
							</subclause><subclause id="H4BD1B81A9DCF4CFCA0653685E05D1E39"><enum>(III)</enum><text>Creating valid
				accountability models.</text>
							</subclause><subclause id="HF846F0999DB84675BA90A543EB6D6D36"><enum>(IV)</enum><text>Accurately
				assessing the needs of low-performing schools.</text>
							</subclause><subclause id="HCA6E8EE964E94A6585A6463C6E8230B1"><enum>(V)</enum><text>Adequately
				measuring the other educational needs of students so that issues relating to
				the education of the whole child are
				addressed.</text>
							</subclause></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H5CBB579B192C4E4D872CC7362F00AC74"><enum>(2)</enum><text>by redesignating
			 subparagraphs (C) through (F) as subparagraphs (F) through (I),
			 respectively;</text>
			</paragraph><paragraph id="H9A33E69BB5414184AA3E3F064D05FD92"><enum>(3)</enum><text>by inserting after
			 subparagraph (B) (as amended by paragraph (1)) the following:</text>
				<quoted-block display-inline="no-display-inline" id="HEA6EED51AB514F0CBFD8F1EA722E6EE3" style="OLC">

				representative selected from among recommendations from State educational
				agencies;</text>
						</clause><clause id="H422CB38797644D0BA9BBEEB0CF74BAA"><enum>(ii)</enum><text>not less than 1
				representative selected from among recommendations from local educational
				agencies;</text>
						</clause><clause id="H7885C820E56745CE90378FF65D105CB8"><enum>(iii)</enum><text>not less than 1
				representative selected from among recommendations from professional
				educational associations;</text>
						</clause><clause id="H9CF0BB17C0434190B87C7DADC3E937B"><enum>(iv)</enum><text>not less than 1
				representative selected by the Secretary; and</text>
						</clause><clause id="H579782592CD34D178C54280063DB83E2"><enum>(v)</enum><text>not less than 1
				representative who works in a school;</text>
						</clause></subparagraph><subparagraph id="HEA07A0AEB3034B0CA921C41FB600FA7D"><enum>(D)</enum><text>ensure that there
				is consistency from State to State with respect to all decisions reached by the
				peer review panels;</text>
					</subparagraph><subparagraph id="HDAD46733688C4B14B2EAD26199F9E600"><enum>(E)</enum><text>ensure that States
				are given the opportunity to receive timely feedback from peer review teams, in
				person or via electronic communication, and directly interact with peer review
				panels on issues that need clarification during the peer review
				process;</text>
					</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H0BB7D64AB6504732A33BA1568FDF537E"><enum>(4)</enum><text>in subparagraph
			 (H)(iii) (as redesignated by paragraph (2)), by striking <quote>and</quote>
			 after the semicolon;</text>
			</paragraph><paragraph id="HDA026B0A627A4C40B587B9E555C7748C"><enum>(5)</enum><text>in subparagraph
			 (I) (as redesignated by paragraph (2)), by striking the period and inserting a
			 semicolon; and</text>
			</paragraph><paragraph id="HDC39BBAC4279437E9E9356FF437FE331"><enum>(6)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H33EDA8437CC44C69B37F507B797D136F" style="OLC">
					<subparagraph id="HF3D3212BD5EF45829EF27DCCCE006709"><enum>(J)</enum><text>post all approval
				and denial decisions regarding the State plans and final State plans, State
				plan amendments, and waiver decisions for each State plan, on a publicly
				available website in an easily identifiable location, and provide written
				notification to States of all such decisions within 3 business days of such
				decisions; and</text>
					</subparagraph><subparagraph id="HE6460A069C1F479EBCBDBCDF204FDDA"><enum>(K)</enum><text>direct the
				Inspector General of the Department to review the final determinations reached
				by the Secretary under this subsection for consistent decisionmaking through
				the peer review process across all States and report the findings to Congress
				once every 2
				years.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H5B2E46FC378A464B9EB2005500AAAE16"><enum>9.</enum><header>Disaggregation of
			 graduation rates</header>
			<subsection id="H63A58510C3674D38883F1363F5D5004B"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section
			 1111(h)(1)(C)(vi) (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311(h)(1)(C)</external-xref>) is amended by inserting before the
			 semicolon the following: <quote>, disaggregated by the student subgroups
			 described in subsection (b)(2)(C)(v)(II)</quote>.</text>

			 of grants under this subsection that ensures that no State receives less than

			 are authorized to be appropriated to carry out this subsection $70,000,000 for
			 each of fiscal years 2008 through 2012.</text>
				</paragraph></subsection></section><section id="H8F8CAA5D16594400B3E6F88277B2EBA"><enum>10.</enum><header>Competitive
			 grants for creating and implementing high-quality assessments</header>
			<subsection id="H0A56684ED0DB458999D19D7147308B14"><enum>(a)</enum><header>Purposes</header><text>The
			 purposes of this section are as follows:</text>
				<paragraph id="H0985C23C667F4564A19F437C35D5A236"><enum>(1)</enum><text>To provide
			 additional resources to State educational agencies, local educational agencies,
			 and schools so that accountability decisions about students and schools are
			 based on well-designed multiple measures of assessment rather than 1 high
			 stakes standardized test.</text>
				</paragraph><paragraph id="H591D034F460A4A948FFA2100E55BCB69"><enum>(2)</enum><text>To assist State
			 educational agencies, local educational agencies, and schools in the design and
			 implementation of high-quality assessments, including State or locally designed
			 school district assessments, formative assessments, performance assessments,
			 portfolio assessments, alternative assessments for students with disabilities
			 and English Language Learners, and other assessments that measure higher-order
			 thinking skills and are aligned with State student academic achievement and
			 academic content standards in order to create multiple measures of assessment
			 that—</text>
					<subparagraph id="HB6D6CDB5B69D4C9684E0CF035324CAFD"><enum>(A)</enum><text>improve classroom
			 instruction; or</text>
					</subparagraph><subparagraph id="HE9AC0C473F844A38AE66ABCD13446301"><enum>(B)</enum><text>are used in
			 accountability systems.</text>
					</subparagraph></paragraph></subsection><subsection id="H693E467514814638BD1DBBBCDA58BDEC"><enum>(b)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="HAA792270E0144B480076F000622E50A3"><enum>(1)</enum><header>ESEA
			 definitions</header><text>The terms used in this section have the meanings
			 given the terms in section 9101 of the Elementary and Secondary Education Act
			 of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text>
				</paragraph><paragraph id="H8ED26A36ABDD4463B32B3EB3A6C6DE8"><enum>(2)</enum><header>Formative
			 assessment</header><text>The term <term>formative assessment</term> means an
			 assessment that—</text>
					<subparagraph id="H7DFEEE086F01428D0061AB5C5CD98C09"><enum>(A)</enum><text>produces evidence
			 about student learning and achievement in a timely manner; and</text>
					</subparagraph><subparagraph id="H0CF19BBBB31A411CBBA2B302EC28C21"><enum>(B)</enum><text>provides students
			 and teachers with meaningful feedback so that teachers can modify, improve, and
			 target instructional strategies based on individual student need, and students
			 can assess the students' own academic progress.</text>
					</subparagraph></paragraph><paragraph id="HE796E3DFA8484ABCB1DA4566FB5FCB3C"><enum>(3)</enum><header>Multiple
			 measures of assessment</header><text>The term <term>multiple measures of
			 assessment</term> means different forms of assessment that offer all students
			 various ways to show academic achievement and progress.</text>
				</paragraph><paragraph id="HD0C07CB66AC04A89B0FB528FF3E8631B"><enum>(4)</enum><header>Performance
			 assessment</header><text>The term <term>performance assessment</term> means an
			 assessment that measures the ability of students to apply knowledge and
			 demonstrate achievement through performance-based tasks.</text>
				</paragraph><paragraph id="H4FB0012700874652B81F29A285121E01"><enum>(5)</enum><header>Portfolio
			 assessment</header><text>The term <term>portfolio assessment</term> means an
			 assessment that accumulates student work to use as formative or summative
			 evidence of student academic progress.</text>
				</paragraph></subsection><subsection id="H16695DC1E4AF41E69768181EEFB93100"><enum>(c)</enum><header>Grants
			 authorized</header><text>The Secretary of Education is authorized to award
			 grants to State educational agencies to enable the State educational agencies
			 to carry out the authorized activities described in subsection (d).</text>
			</subsection><subsection id="H8D9AE21F87C34ADCAE9FCADFB31C7272"><enum>(d)</enum><header>Authorized
			 activities</header>
				<paragraph id="HE33996AC450A4B558DE25CD5C38FDCF3"><enum>(1)</enum><header>In
			 general</header><text>A State educational agency that receives a grant under
			 this section shall use the funds made available through the grant for the
			 design or implementation of high-quality assessments in local classrooms,
			 including—</text>
					<subparagraph id="HF2187BC7211D4BF9A79861E414B54F48"><enum>(A)</enum><text>partnering with
			 institutions of higher education to train teachers in how to develop and
			 utilize the assessments described in subsection (a)(2) and how to teach
			 students to assess their own learning;</text>
					</subparagraph><subparagraph id="HB04122723AB148BBBC84B5E60053DFF1"><enum>(B)</enum><text>creating the
			 assessments described in subsection (a)(2) and aligning the assessments with
			 State student academic achievement and academic content standards;</text>
					</subparagraph><subparagraph id="HDE77CC547EB94A33BAC42672E65C3FB"><enum>(C)</enum><text>aligning local
			 assessments across the State to develop a system of common assessments;</text>
					</subparagraph><subparagraph id="HC9338C54B63A4218ACB34097B876F85C"><enum>(D)</enum><text>designing student
			 reports that detail assessment results and that can be used to inform classroom
			 instruction and provide parents with timely information on student progress;
			 and</text>
					</subparagraph><subparagraph id="H815DB480774945D6AFF2744EFEBE1C5F"><enum>(E)</enum><text>collaborating with
			 other State educational agencies to share information about assessment
			 development and implementation across the States.</text>
					</subparagraph></paragraph><paragraph id="HCB54398F7BDF4A8699087E34859FD185"><enum>(2)</enum><header>Restrictions</header><text>Grant
			 funds received under this section shall—</text>
					<subparagraph id="H4CC85F51CA234E61BA9C82C9FD13EBC"><enum>(A)</enum><text>be used only for
			 the development, implementation, and measurement of the assessments described
			 in subsection (a)(2); and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H12EBD489C1104DFBB04067195B2580C5"><enum>(B)</enum><text>not be used for
			 the purchase or development of high stakes, large scale assessments or for test
			 preparation materials for high stakes testing.</text>
					</subparagraph></paragraph></subsection><subsection id="H29F346A263CE4DA783E1363EBD36D9E6"><enum>(e)</enum><header>Eligible partner
			 entities</header>
				<paragraph id="H711FD311886F47B0BAD3D9F1E452005F"><enum>(1)</enum><header>In
			 general</header><text>Each State educational agency that receives a grant under
			 this section, upon receipt of the grant funds, may partner with an entity
			 described in paragraph (2), in order to carry out the activities assisted under
			 the grant.</text>
				</paragraph><paragraph id="H22A045B0727A4A4DA5A6993DB17FAF0"><enum>(2)</enum><header>Entities</header><text>An
			 entity referred to in paragraph (1) is—</text>
					<subparagraph id="H88CE21833C6F4934B0E770DE1FEEBB9"><enum>(A)</enum><text>an institution of
			 higher education that has a teacher training program;</text>
					</subparagraph><subparagraph id="H765A516FFB244AC99F9E15B0B72CAD01"><enum>(B)</enum><text>a local
			 educational agency; and</text>
					</subparagraph><subparagraph id="H4A3B13BF8B4D413EA44816006800F8DE"><enum>(C)</enum><text>a research
			 institution with experience in designing high-quality assessments.</text>
					</subparagraph></paragraph></subsection><subsection id="HF909294105CF4F1BB89F0040A3435256"><enum>(f)</enum><header>Application</header><text>To
			 be eligible to receive a grant under this section, a State educational agency
			 shall submit an application to the Secretary at such time, in such manner, and
			 containing such information as the Secretary may require, including, at a
			 minimum—</text>
				<paragraph id="H745918DC54C944EA8B008218BD2CF068"><enum>(1)</enum><text>a
			 proposal to use the grant funds to design or implement the assessments
			 described in subsection (a)(2);</text>
				</paragraph><paragraph id="H92F6B756BA614BFF9526DD242E5CDC94"><enum>(2)</enum><text>a
			 method for establishing an application process whereby local educational
			 agencies and individual schools can apply to receive funds provided under this
			 section from the State educational agency;</text>
				</paragraph><paragraph id="HE91D1141CDB1451A88F7015D76456E53"><enum>(3)</enum><text>a
			 description of how the State educational agency plans to assess the
			 effectiveness of the assessments in raising student achievement and narrowing
			 the achievement gap among the State’s student population; and</text>
				</paragraph><paragraph id="H6437E68C17544EEDA2EDF5DD21E116E4"><enum>(4)</enum><text>a
			 description of how the State educational agency plans to ensure that the
			 assessments will be used to improve teaching and provide detailed and timely
			 feedback to students and parents.</text>
				</paragraph></subsection><subsection id="HB2FBA881A5CC41AC854E0091E8DCF882"><enum>(g)</enum><header>Duration</header><text>A
			 grant under this section shall be awarded for a period of not more than 5
			 fiscal years.</text>
			</subsection><subsection id="H04C375B949804FD20044D32C4EB35E8F"><enum>(h)</enum><header>Award
			 considerations</header><text>In awarding grants under this section, the
			 Secretary shall select State educational agencies that demonstrate the greatest
			 need for the grants and the greatest potential benefit from receipt of the
			 grants.</text>
			</subsection><subsection id="H5AFDC6CEA4304F968DF0606FD2F40561"><enum>(i)</enum><header>Report and
			 evaluation</header>
				<paragraph id="H8411A1B7110440F9879D684C4087DFED"><enum>(1)</enum><header>State
			 reports</header><text>Each State educational agency that receives a grant under
			 this section shall submit—</text>
					<subparagraph id="H965F120A55884AEC99CCA8918174C8E"><enum>(A)</enum><text>an annual report to
			 the Secretary detailing how the State educational agency is using the grant
			 funds and detailing ongoing evaluation of the design of the assessments
			 assisted under this section, the training of educators in using the
			 assessments, and the effectiveness of the assessments as measured by student
			 achievement and growth based on multiple measures of assessment; and</text>
					</subparagraph><subparagraph id="HD2921E82B9A240EDBDC7DEE35370FF5D"><enum>(B)</enum><text>a comprehensive
			 5-year report at the end of the 5-year grant period including a detailed
			 analysis of—</text>
						<clause id="HE34747750C66447A9F6C024F17F734FD"><enum>(i)</enum><text>how
			 the grant funds were used; and</text>
						</clause><clause id="H9BDD7748393D4848B9011000004931C2"><enum>(ii)</enum><text>the
			 impact of the grant on student achievement, narrowing the achievement gap, and
			 the quality of teaching, based on multiple measures of assessment.</text>
						</clause></subparagraph></paragraph><paragraph id="HB04A77F194FC423E90BC3EDD84FA2737"><enum>(2)</enum><header>Federal
			 evaluation and report</header><text>Not later than 5 years after the date of
			 enactment of this Act, the Secretary shall—</text>
					<subparagraph id="HF489C3A0BCCF480FB09F00FCE3BC176B"><enum>(A)</enum><text>develop and
			 execute a plan for evaluating the assessments assisted under this section and
			 the strategies financed under this section; and</text>
					</subparagraph><subparagraph id="HA8F7E1335C0A404A9731D8CF09F98E6B"><enum>(B)</enum><text>submit a report to
			 Congress detailing how State educational agencies used the grant funds provided
			 under this section, the impact of the grants on student achievement and
			 teaching in the States, and any recommendations for improvements that can be
			 made to the grant program under this section.</text>
					</subparagraph></paragraph></subsection><subsection id="H2CA4F0EA9A684A05B957FECDA3F2C200"><enum>(j)</enum><header>Authorized
			 amounts</header><text>There are authorized to be appropriated to carry out this
			 section $150,000,000 for each of fiscal years 2008 through 2012.</text>
			</subsection></section><section id="H847A2F504E274C82A8209DED2CD0204F"><enum>11.</enum><header>Competitive
			 grants for increasing capacity at the State and local level</header>
			<subsection id="HBF40BB78C2AF4AB8A23E000056F7E72C"><enum>(a)</enum><header>Purposes</header><text>The
			 purpose of this section is to assist State educational agencies and local
			 educational agencies with—</text>
				<paragraph id="HA482F92DF19D4333914853E0FD2CEE86"><enum>(1)</enum><text>building State
			 educational agency and local educational agency technical capacity; and</text>
				</paragraph><paragraph id="HB54BD398892B4131B00566C0E40161E0"><enum>(2)</enum><text>improving
			 technical assistance.</text>
				</paragraph></subsection><subsection id="H5892C36686EF4D78B4D1B57098616919"><enum>(b)</enum><header>Grants
			 authorized</header><text>The Secretary of Education is authorized to award
			 grants to State educational agencies and local educational agencies to enable
			 the agencies to carry out the authorized activities described in subsection
			 (c).</text>
			</subsection><subsection id="HCDAD37B362CA481FBD752833A37D4834"><enum>(c)</enum><header>Authorized
			 activities</header><text>A State educational agency or local educational agency
			 that receives a grant under this section shall use the funds made available
			 under the grant to carry out 1 or more of the following activities:</text>
				<paragraph id="H34BB6F796E8A4D6DA83C26CE02A573D0"><enum>(1)</enum><text>Creating,
			 maintaining, and improving State or local education databases that can track
			 adequate yearly growth in individual students.</text>
				</paragraph><paragraph id="HAB075F7278744ABFBEDAF7DC6329EF82"><enum>(2)</enum><text>Implementing
			 adequate privacy protections in State or local education databases.</text>
				</paragraph><paragraph id="H8FCDFFC711C946E08F3CF9AAC358ECB8"><enum>(3)</enum><text>Complying with the
			 requirement to disaggregate and report data under sections 1111(b)(2)(C),
			 1111(b)(3)(C)(xiii), and 1111(h) of the Elementary and Secondary Education Act
			 of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311(b)(2)(C)</external-xref>, 6311(b)(3)(C)(xiii), 6311(h)).</text>
				</paragraph><paragraph id="HA34327D5B0234196B0A4C1004C663D54"><enum>(4)</enum><text>Developing State
			 educational agency or local educational agency capacity to create
			 accountability or assessment systems that contain multiple measures of student
			 achievement, including statewide, local, formative, and performance-based
			 assessments.</text>
				</paragraph><paragraph id="HA03CBD18D12E47C0B6E3C25385FF5135"><enum>(5)</enum><text>Conducting
			 research on proven strategies for improving schools and local school districts
			 or implementing research-proven, valid, and reliable improvement strategies in
			 schools or local school districts.</text>
				</paragraph><paragraph id="H2A7F1E0030D84198B4675E19EBE8310"><enum>(6)</enum><text>Training State
			 educational agency staff, local educational agencies, administrators, and
			 schools in making data-driven decisions.</text>
				</paragraph><paragraph id="H661341ECAAC54179B0BACFF2D67662BE"><enum>(7)</enum><text>Developing State
			 educational agency or local educational agency capacity to provide technical
			 assistance to schools in need of improvement.</text>
				</paragraph></subsection><subsection id="H6B88E43601CC4055AEA56DEAD3B90996"><enum>(d)</enum><header>Application</header><text>To
			 be eligible to receive a grant under this subsection, a State educational
			 agency or local educational agency shall submit an application to the Secretary
			 at such time, in such manner, and containing such information as the Secretary
			 may require, including, at a minimum—</text>
				<paragraph id="H53C7CF26470C4962B3AE94AD01AE5400"><enum>(1)</enum><text>a
			 description of the privacy protections that the State educational agency or
			 local educational agency has implemented or will implement pursuant to section
			 1120C of the Elementary and Secondary Education Act of 1965, and assurances
			 that the protections will be in place when the grant funds are made available
			 to the State educational agency or local educational agency, if applying for
			 grant funding to create, maintain, or improve a State or local education
			 database;</text>
				</paragraph><paragraph id="H0DB2C64311DB4D04B700E51556A6511D"><enum>(2)</enum><text>a
			 description of the school improvement techniques the State educational agency
			 or local educational agency will implement, and a description of how the
			 techniques will meet the needs of the schools or local educational agencies in
			 the State that are identified for school improvement, corrective action, or
			 restructuring under section 1116 of the Elementary and Secondary Act of 1965
			 (<external-xref legal-doc="usc" parsable-cite="usc/20/6316">20 U.S.C. 6316</external-xref>), if applying for grant funding to develop capacity to provide
			 school improvement technical assistance;</text>
				</paragraph><paragraph id="HB3829E2B37FC4C3E96A27566A3FF3C69"><enum>(3)</enum><text>a
			 description of the multiple measures of student achievement that a State
			 educational agency or local educational agency will include in its assessment
			 systems, if applying for grant funding to develop assessment system
			 capacity;</text>
				</paragraph><paragraph id="H50F8425EF71E430C851C67A611B88C00"><enum>(4)</enum><text>a
			 description of the training programs that will be offered to staff of State
			 educational agencies and local educational agencies to boost data-driven
			 decisionmaking skills, if applying for grant funding to develop such training
			 programs;</text>
				</paragraph><paragraph id="H56FD5A4F5A764470A3593E263500D40"><enum>(5)</enum><text>a
			 method for establishing an application process whereby local educational
			 agencies can apply to receive funds provided under this section from the State
			 educational agency;</text>
				</paragraph><paragraph id="HEED72D1ABBD448C785006E5766F68FEF"><enum>(6)</enum><text>a
			 description of how the State educational agency plans to assess the
			 effectiveness of the State educational agency's capacity building efforts under
			 this section; and</text>
				</paragraph><paragraph id="H5AC74FF4AA9F42C1AE52283C8B570035"><enum>(7)</enum><text>a
			 description of how the State educational agency plans to account for funds
			 expended under this section.</text>
				</paragraph></subsection><subsection id="H42AC803D67224817B3B02300BDEADB4"><enum>(e)</enum><header>Duration</header><text>A
			 grant under this section shall be awarded for not less than 2 fiscal years and
			 not more than 5 fiscal years.</text>
			</subsection><subsection id="H321E695780634C4D9FA77F004D8E7DB6"><enum>(f)</enum><header>Priority</header><text>In
			 awarding grants under this section, the Secretary shall give priority to State
			 educational agencies and local educational agencies that demonstrate in the
			 application submitted under subsection (c) the greatest need for the grant and
			 the greatest potential benefit from receipt of the grant.</text>
			</subsection><subsection id="H6B247929B6B34FF4A8C59F268C4BBA28"><enum>(g)</enum><header>Evaluation</header>
				<paragraph id="H9936FAEBDE264883A60080963E8E8F4F"><enum>(1)</enum><header>State
			 evaluations</header><text>Each State educational agency receiving a grant under
			 this section shall submit a report at the end of the last year of the grant
			 that provides a detailed analysis of how the grant funds were used and the
			 effectiveness of the grant funds in improving State educational agency and
			 local educational agency capacity to meet the requirements under part A of
			 title I of the Elementary and Secondary Education Act of 1965 (20 U.S.C. 6311
			 et seq.).</text>
				</paragraph><paragraph id="HAC46E65F6AB54BDA92E5819082D15D1"><enum>(2)</enum><header>Federal
			 evaluation</header><text>Not later than 5 years after the date of enactment of
			 this Act, the Secretary shall—</text>
					<subparagraph id="H0CCEAB22852F4AA8B0FF5593741EB5B8"><enum>(A)</enum><text>develop and
			 execute a plan for evaluating the State educational agency and local
			 educational agency’s capacity-building programs funded under this
			 section;</text>
					</subparagraph><subparagraph id="HE02E5F09B969487DB8ABFD77941F5623"><enum>(B)</enum><text>submit a detailed
			 report to Congress on the use of the funds provided under this section in
			 improving State and local education capacity; and</text>
					</subparagraph><subparagraph id="H99FC4B57C59940329595D71F54E311DC"><enum>(C)</enum><text>provide to
			 Congress any recommendations for improvements that can be made to the grant
			 program funded under this section.</text>
					</subparagraph></paragraph></subsection><subsection id="HB6E004C93C224C959D38653F97099E00"><enum>(h)</enum><header>Authorized
			 amounts</header><text>There are authorized to be appropriated to carry out this
			 section $100,000,000 for each of fiscal years 2008 through 2012.</text>
