		<section id="H04711B6BB4754ED0910011EE75B5F468" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Working Families Flexibility
			 Act</short-title></quote>.</text>
		</section><section id="HB103D53A79D74A11AF5210817FE4C9B"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="HF649C1E124FC4573A2B3BD5EDBDD3958"><enum>(1)</enum><header>Employee</header><text>The
			 term <term>employee</term> means an individual—</text>
				<subparagraph id="HC1FAF6704AE1402095E854166F28CF20"><enum>(A)</enum><text>who is—</text>
					<clause id="HA964CBBFAD11439FB743EEC95D1FB04E"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="H6D749DCFC22A4132BCC598D73E6F3F76"><enum>(I)</enum><text>an employee (including
			 an applicant), as defined in section 3(e) of the Fair Labor Standards Act of
			 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203(e)</external-xref>), who is not covered under any of clauses (ii) through
			 (v), including such an employee of the Library of Congress, except that a
			 reference in such section to an employer shall be considered to be a reference
			 to an employer described in clauses (i)(I) and (ii) of paragraph (2)(A);
			 or</text>
						</subclause><subclause id="H3F80043869BD458E9D56341B5FFCB956" indent="up1"><enum>(II)</enum><text>an employee (including an applicant) of
			 the Government Accountability Office;</text>
						</subclause></clause><clause id="H84CED08523634B959F9586E5E351007C"><enum>(ii)</enum><text>a
			 State employee (including an applicant) described in section 304(a) of the
			 Government Employee Rights Act of 1991 (42 U.S.C. 2000e–16c(a));</text>
					</clause><clause id="H59E5A875FF914C7D849B30A5D8EC2DB8"><enum>(iii)</enum><text>a
			 covered employee (including an applicant), as defined in section 101 of the
			 Congressional Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1301">2 U.S.C. 1301</external-xref>);</text>
					</clause><clause id="HD3C41389331C46C4BF558BDAB586C1F1"><enum>(iv)</enum><text>a
			 covered employee (including an applicant), as defined in section 411(c) of
			 title 3, United States Code; or</text>
					</clause><clause id="HD9CF81BCD45F480289EAACA8407C91E0"><enum>(v)</enum><text>a
			 Federal officer or employee (including an applicant) covered under subchapter V
			 of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/63">chapter 63</external-xref> of title 5, United States Code; and</text>
					</clause></subparagraph><subparagraph id="H050F57DA3F354F87AA5622F278270090"><enum>(B)</enum><text>who works an
			 average of at least 20 hours per week or, in the alternative, at least 1,000
			 hours per year.</text>
				</subparagraph></paragraph><paragraph id="HE73E0FBF195E48949BA2A48CC0188998"><enum>(2)</enum><header>Employer</header>
				<subparagraph id="H3BD00BC17104488E826362379BCBE17C"><enum>(A)</enum><header>In
			 general</header><text>The term <term>employer</term> means a person who
			 is—</text>
					<clause id="H5A425D331E5B463E94AC002195C27D86"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="H7E353F1A184448AE828978F476EE333C"><enum>(I)</enum><text>a covered employer, as
			 defined in subparagraph (B), who is not covered under any of subclauses (II)
			 through (V);</text>
						</subclause><subclause id="H6ADAEE8BA4144DFE8461FACA8D689DCA" indent="up1"><enum>(II)</enum><text>an entity employing a State employee
			 described in section 304(a) of the Government Employee Rights Act of
			 1991;</text>
						</subclause><subclause id="HA6F0A6F1543B413CAF9D453BC3212EC7" indent="up1"><enum>(III)</enum><text>an employing office, as defined in
			 section 101 of the Congressional Accountability Act of 1995;</text>
						</subclause><subclause id="HFCC68D27E1C64971BC643E6C6341052C" indent="up1"><enum>(IV)</enum><text>an employing office, as defined in
			 <external-xref legal-doc="usc" parsable-cite="usc/3/411">section 411(c)</external-xref> of title 3, United States Code; or</text>
						</subclause><subclause id="H32FEAC72B4A44749BF83D2EEC39D6BB9" indent="up1"><enum>(V)</enum><text>an employing agency covered under
			 subchapter V of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/63">chapter 63</external-xref> of title 5, United States Code; and</text>
						</subclause></clause><clause id="H358121B42A3F41F698B2EEC9CD87CF7"><enum>(ii)</enum><text>is
			 engaged in commerce (including government), in the production of goods for
			 commerce, or in an enterprise engaged in commerce (including government) or in
			 the production of goods for commerce.</text>
					</clause></subparagraph><subparagraph id="H3EEE0BE540BF4B1FBF07F2115BED5B4B"><enum>(B)</enum><header>Covered
			 employer</header>
					<clause id="H8EE3549BF4CF4812B58FC2D00045E3E"><enum>(i)</enum><header>In
			 general</header><text>In subparagraph (A)(i)(I), the term <term>covered
			 employer</term>—</text>
						<subclause id="H6C180909A5B847CBB84E75B112ACEEC"><enum>(I)</enum><text>means any person
			 engaged in commerce or in any industry or activity affecting commerce who
			 employs 15 or more employees for each working day during each of 20 or more
			 calendar workweeks in the current or preceding calendar year;</text>
						</subclause><subclause id="HCA9FF32A668347FABED3DB15BF3D3DDF"><enum>(II)</enum><text>includes—</text>
							<item id="H9E2994B411784DF08C17D535D8AD815F"><enum>(aa)</enum><text>any
			 person who acts, directly or indirectly, in the interest of such an employer to
			 any of the employees of such employer; and</text>
							</item><item id="H6CE7DA41924145B1BFA9EC48BE400A9"><enum>(bb)</enum><text>any
			 successor in interest of such an employer; and</text>
							</item></subclause><subclause id="H0E100760D8364C5A8751E30C06B8930"><enum>(III)</enum><text>includes an
			 agency described in clause (iii) or (iv) of subparagraph (A) of section 101(4)
			 of the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2611">29 U.S.C. 2611(4)</external-xref>), to which
			 subparagraph (B) of such section shall apply.</text>
						</subclause></clause><clause id="HACAB44B681E74695B0A969CA1F7B9399"><enum>(ii)</enum><header>Definitions</header><text>For
			 purposes of this subparagraph:</text>
						<subclause id="H94B08C2F017845D4AF29106625D115BC"><enum>(I)</enum><header>Commerce</header><text>The
			 terms <term>commerce</term> and <term>industry or activity affecting
			 commerce</term> have the meanings given the terms in section 101 of such Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/29/2611">29 U.S.C. 2611</external-xref>).</text>
						</subclause><subclause id="H13D75DEFD7B64914BE6C1E064047AFE5"><enum>(II)</enum><header>Employee;
			 person</header><text>The terms <term>employee</term> and <term>person</term>
			 have the meanings given such terms in section 3 of the Fair Labor Standards Act
			 of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203</external-xref>).</text>
						</subclause></clause></subparagraph><subparagraph id="HAF75FD039C014744816955A319EE7969"><enum>(C)</enum><header>Predecessors</header><text>Any
			 reference in this paragraph to an employer shall include a reference to any
			 predecessor of such employer.</text>
				</subparagraph></paragraph><paragraph id="H6559CD974B9F415291DD05B27F79FEEF"><enum>(3)</enum><header>Secretary</header><text>The
			 term <quote>Secretary</quote> means the Secretary of Labor.</text>
			</paragraph></section><section id="HB7911805C1D141E587E5AAE82D81A4D8"><enum>3.</enum><header>Statutory right
			 to request flexible work terms and conditions</header>
			<subsection id="H0CBEB661296C4696BDC87B015F428854"><enum>(a)</enum><header>In
			 General</header><text>An employee may apply to the employee’s employer for a
			 change in the employee’s terms or conditions of employment if the change
			 relates to—</text>
				<paragraph id="H6FF9DD0D033249E79E848F2536DAF7E7"><enum>(1)</enum><text>the number of
			 hours the employee is required to work;</text>
				</paragraph><paragraph id="HF7814D1EF605479EB478EADF8ABB91D"><enum>(2)</enum><text>the times when the
			 employee is required to work; or</text>
				</paragraph><paragraph id="H2AC4CEE010E04703A46B85BC3DACF7E9"><enum>(3)</enum><text>where the employee
			 is required to work.</text>
				</paragraph></subsection><subsection id="HB93E78010DB543288B79A3BAC2045B7"><enum>(b)</enum><header>Contents</header><text>An
			 application submitted under this section shall—</text>
				<paragraph id="HCEAD87BAA1B84FAF80B104DEBB002C"><enum>(1)</enum><text>state that the
			 application is an application described in subsection (a);</text>
				</paragraph><paragraph id="HCAA61BF0EC444975B93EB6A415EA2CF"><enum>(2)</enum><text>specify the change
			 applied for and the date on which the employee requests that the change become
			 effective; and</text>
				</paragraph><paragraph id="H5420D3BA22DD4BD6A698F30233D54BE3"><enum>(3)</enum><text>explain what
			 effect, if any, the employee thinks the change applied for would have on the
			 employer and how, in the employee’s opinion, any such effect might be dealt
			 with.</text>
				</paragraph></subsection><subsection id="HE38976F13D9C439EAC7385DFA144D846"><enum>(c)</enum><header>Submissions</header>
				<paragraph id="H206E78268BB14826B5C97581D2ACD1EE"><enum>(1)</enum><header>Period between
			 submissions</header><text>If an employee, who has submitted an application
			 under this section to an employer, submits a further application under this
			 section to the same employer before the end of the period of 12 months
			 beginning with the date on which the previous application was submitted, that
			 further application shall not be covered by section 4.</text>
				</paragraph><paragraph id="H60D184F63B1B43AEA45F8C7BB30078D"><enum>(2)</enum><header>Form and
			 timing</header><text>The Secretary shall by regulation specify—</text>
					<subparagraph id="H79ED3D3710D945518CB12548160645BF"><enum>(A)</enum><text>the form of
			 applications submitted under this section; and</text>
					</subparagraph><subparagraph id="H9C1195604BB74844A5813F259900A58C"><enum>(B)</enum><text>when such an
			 application shall be considered to be submitted.</text>
					</subparagraph></paragraph></subsection></section><section id="H25A93451E87F444EBAECACD83C993DB1"><enum>4.</enum><header>Employer’s duties
			 in relation to applications</header>
			<subsection id="H58F6368D1CBB476FBA1EA1FFCFF57506"><enum>(a)</enum><header>In
			 General</header><text>An employer to whom an employee submits an application
			 under section 3 shall consider the application in accordance with regulations
			 issued by the Secretary.</text>
			</subsection><subsection id="H550A678D5E214AF790B87FAB14E829B3"><enum>(b)</enum><header>Regulations</header><text>Regulations
			 issued under subsection (a)—</text>
				<paragraph id="H6BC045E1AA3F437C8253181C00B29D91"><enum>(1)</enum><text>shall include
			 provisions that provide—</text>
					<subparagraph id="HA87A35CE1C5F4A91AF0047849BF53085"><enum>(A)</enum><text>that the employer
			 and the employee shall hold a meeting to discuss an application submitted under
			 section 3 within 14 days after the date of submission;</text>
					</subparagraph><subparagraph id="H2AD8C0CAC35C44149E04F12CA000CA79"><enum>(B)</enum><text>that the employer
			 shall give the employee a written decision regarding the application within 14
			 days after the date of the meeting described in subparagraph (A);</text>
					</subparagraph><subparagraph id="HD4521D80A4E9416C9D9C99C2526CFB18"><enum>(C)</enum><text>that a decision
			 under subparagraph (B) to reject the application shall state the grounds for
			 the decision, including whether those grounds included—</text>
						<clause id="H3E62F1BE0E424F6893189F0074ABA1CD"><enum>(i)</enum><text>the
			 identifiable cost of the change in a term or condition of employment requested
			 in the application, including the costs of loss of productivity, of retraining
			 or hiring employees, or of transferring employees from 1 facility to another
			 facility;</text>
						</clause><clause id="H304B850BBD3245E08554A883918FE3F6"><enum>(ii)</enum><text>the
			 overall financial resources involved;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="H77C2BF8989A440D385A0AF9C2D5BD9"><enum>(iii)</enum><text>for an employer
			 with multiple facilities, the geographic separateness or administrative or
			 fiscal relationship of the facilities;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="H2157D0FD0AE74EB0926FC5B4D422E006"><enum>(iv)</enum><text>the effect of the
			 change on the employer's ability to meet customer demand; or</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="H074F9A5B3EB04CB7BADB242F7C085B07"><enum>(v)</enum><text>other factors
			 specified by the Secretary in regulation;</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H83B03B4BA7B749D9ACF8C878C5076359"><enum>(D)</enum><text>that if the
			 employer rejects the employee's application, the employer may propose in
			 writing an alternative change to the employee's hours, times, and place of
			 work;</text>
					</subparagraph><subparagraph id="H193BB947195F400DA500DEFADDA25CCC"><enum>(E)</enum><text>that if the
			 employee is dissatisfied with the employer’s decision under subparagraph (B)
			 and the alternative described in subparagraph (D), the employee has the right
			 to request reconsideration of the decision within 14 days after the later
			 of—</text>
						<clause id="H8D391124048C45BA874BF46CA5980018"><enum>(i)</enum><text>the
			 date on which the employer gives the employee the decision under subparagraph
			 (B); and</text>
						</clause><clause id="HD3814A031B80454C81E1442DA24C0771"><enum>(ii)</enum><text>if
			 applicable, the date on which the employer proposes the alternative described
			 in subparagraph (D);</text>
						</clause></subparagraph><subparagraph id="H0138893AFECB4F208EB15DDBBCB661B9"><enum>(F)</enum><text>for procedures for
			 exercising the right to request reconsideration described in subparagraph (E),
			 including procedures requiring the employee to set out the grounds for
			 reconsideration, including any inaccuracies or misstatements that the employee
			 contends were in the employer's decision;</text>
					</subparagraph><subparagraph id="H49B2AA95B8434FEC8CD447F1F825BDAE"><enum>(G)</enum><text>that the decision
			 under subparagraph (B) shall include such information as the regulations shall
			 specify relating to the right to request reconsideration under subparagraph
			 (E);</text>
					</subparagraph><subparagraph id="H224B1B67572C46CE8644F4F75DC4F2D"><enum>(H)</enum><text>that the employer
			 and the employee shall hold a meeting to discuss the request for
			 reconsideration described in subparagraph (E) within 14 days after the date on
			 which the employee gives notice of the request for reconsideration to the
			 employer;</text>
					</subparagraph><subparagraph id="H1F8FF89EB5A5459BB9442C511CF4F338"><enum>(I)</enum><text>that the employer
			 shall give the employee a written decision regarding the request for
			 reconsideration within 14 days after the date of the meeting described in
			 subparagraph (H);</text>
					</subparagraph><subparagraph id="HBAF73513622F46AE89B2D713ED645C7D"><enum>(J)</enum><text>that a decision
			 under subparagraph (I) to deny the request for reconsideration shall state the
			 grounds for the decision, including whether those grounds included the factors
			 described in clauses (i) through (v) of subparagraph (C);</text>
					</subparagraph><subparagraph id="H6DB15739F5474F9DA364F9AE262FF814"><enum>(K)</enum><text>that a statement
			 made under subparagraph (C) or (J) shall contain a sufficient explanation of
			 the grounds for the decision involved;</text>
					</subparagraph><subparagraph id="H424B7C7FB19E42D38034887D25E3A6FF"><enum>(L)</enum><text>that the employee
			 shall have a right to be accompanied at meetings described in subparagraph (A)
			 or (H) by a representative of the employee's choosing with such qualifications
			 as the regulations shall specify; and</text>
					</subparagraph><subparagraph id="HFF7877C704E649F3ABB1EE00D2E8F375"><enum>(M)</enum><text>that if such a
			 representative of the employee's choosing is not available to attend a meeting
			 described in subparagraph (A) or (H), the meeting shall be postponed;</text>
					</subparagraph></paragraph><paragraph id="HEAB785A7235C4CE089DA1050C5DBB66"><enum>(2)</enum><text>may include
			 provisions that provide—</text>
					<subparagraph id="H0BAF54CCEAE14833B0D8F50629F22BA"><enum>(A)</enum><text>that any
			 requirement of the regulations shall not apply in a case in which such an
			 application is disposed of by agreement or withdrawn;</text>
					</subparagraph><subparagraph id="H379004F2B2824BD794D9C9E995BFD27E"><enum>(B)</enum><text>for extension of a
			 time limit in a case in which the employer and employee agree, or in such other
			 circumstances as the regulations may specify; and</text>
					</subparagraph><subparagraph id="H40FE0E9F43FB4C3B8BFDF3EE2B8CCA90"><enum>(C)</enum><text>for applications
			 to be treated as withdrawn in specified circumstances; and</text>
					</subparagraph></paragraph><paragraph id="H87F69BE95EA743BA878F26ACE3E500C3"><enum>(3)</enum><text>may include
			 different provisions for different cases or circumstances.</text>
				</paragraph></subsection></section><section id="H39E79472C50E43130001F3BC8DE2BDFE"><enum>5.</enum><header>Prohibited
			 acts</header>
			<subsection id="H898CC588C26B466F98F6A7F67542253C"><enum>(a)</enum><header>Interference
			 With Rights</header><text>It shall be unlawful for any employer to interfere
			 with, restrain, or deny the exercise of, or the attempt to exercise, any right
			 provided under this Act.</text>
			</subsection><subsection id="HA8532A18A2B0406EAC00B3B4DE10C59F"><enum>(b)</enum><header>Interference
			 With Application, Proceedings, or Inquiries</header><text>It shall be unlawful
			 for any employer to discharge or in any other manner discriminate against
			 (including retaliating against) any individual because such individual—</text>
				<paragraph id="H1CFF4215607C46D5B8E4CFAC96005117"><enum>(1)</enum><text>has submitted (or
			 attempted to submit) an application under section 3;</text>
				</paragraph><paragraph id="H370BBF59EE014063914DC0FD05089710"><enum>(2)</enum><text>has filed an
			 action, or has instituted or caused to be instituted any proceeding, under or
			 related to this Act;</text>
				</paragraph><paragraph id="HC4802749A59D405BBB66E1F5F8CC5080"><enum>(3)</enum><text>has given, or is
			 about to give, any information in connection with any inquiry or proceeding
			 relating to any right provided under this Act;</text>
				</paragraph><paragraph id="H8BF9184803C2400FAEA5ABFECCFFFE1"><enum>(4)</enum><text>has testified, or
			 is about to testify, in any inquiry or proceeding relating to any right
			 provided under this Act;</text>
				</paragraph><paragraph id="H687C5A8BE99E4EFB932B62822E40995C"><enum>(5)</enum><text>has opposed any
			 practice made unlawful by this Act; or</text>
				</paragraph><paragraph id="HA10F7286F95E44D3BD532CDCF95FD7F"><enum>(6)</enum><text>has in any other
			 way exercised or attempted to exercise any right provided under this
			 Act.</text>
				</paragraph></subsection></section><section id="H8C6A7587B5B747E4BECFFC459E4F1619"><enum>6.</enum><header>Enforcement</header>
			<subsection id="H0D9E18E0D97449A78DDF0390104096BE"><enum>(a)</enum><header>Definitions</header><text>Except
			 as provided in subsection (d), in this section:</text>
				<paragraph id="HA51A9598942D46EC9BC1C643AD44B3C"><enum>(1)</enum><header>Employee</header><text>The
			 term <term>employee</term> means an employee described in clause (i) or (ii) of
			 section 2(1)(A).</text>
				</paragraph><paragraph id="H2219C338FF164801B8C2747EEB4CA336"><enum>(2)</enum><header>Employer</header><text>The
			 term <term>employer</term> means an employer described in subclause (I) or (II)
			 of section 2(2)(A)(i).</text>
				</paragraph></subsection><subsection id="H6A2233693DE440179250A6C925DAE7B9"><enum>(b)</enum><header>General
			 Authority</header><text>The provisions of this Act may be enforced pursuant to
			 the following provisions:</text>
				<paragraph id="HB1E16F61BECC4C37866C051F35627542"><enum>(1)</enum><header>Investigation
			 and assessment</header><text>An employee who is affected by a violation of a
			 right in section 5 (including a violation relating to a right provided under
			 section 3 or 4) may make a complaint to the Administrator of the Wage and Hour
			 Division of the Employment Standards Administration of the Department of Labor,
			 alleging that the employer involved has violated section 5. The Administrator
			 shall investigate, and may issue an order making determinations, and assessing
			 a civil penalty described in section 7(a)(1) or awarding relief described in
			 section 7(a)(2), as appropriate, with respect to the alleged violation.</text>
				</paragraph><paragraph id="HE707396A7DA94B16BD4FB1AC2F013524"><enum>(2)</enum><header>Administrative
			 hearing</header><text>An affected person who takes exception to an order issued
			 under paragraph (1) may request an administrative hearing concerning the order
			 under procedures established by the Secretary that comply with the requirements
			 of sections 554, 556, and 557 of title 5, United States Code, and regulations
			 promulgated by the Secretary. Such hearing shall be conducted expeditiously. If
			 no affected person requests the hearing within 60 days after the order is
			 issued under paragraph (1), the order shall be deemed to be a final order that
			 is not subject to judicial review.</text>
				</paragraph><paragraph id="H235DDF51AA9345F281EE14722FE83C89"><enum>(3)</enum><header>Enforcement</header><text>The
			 amount of any penalty assessed against an employer under this subsection, when
			 finally determined, may be—</text>
					<subparagraph id="H038825F69E234ED4AF8D6CE61E50EFBD"><enum>(A)</enum><text>deducted from any
			 sums owed by the United States to the employer; or</text>
					</subparagraph><subparagraph id="H6EC55103FB45482990B2D0CA00740124"><enum>(B)</enum><text>recovered in a
			 civil action brought against the employer by the Secretary in any court of
			 competent jurisdiction, in which action the Secretary shall be represented by
			 the Secretary of Labor.</text>
					</subparagraph></paragraph><paragraph id="H522952F31E95419600D5DF95C18BFF2E"><enum>(4)</enum><header>Civil
			 action</header><text>An affected person desiring review of an order issued
			 under paragraph (2) (other than a nonreviewable order) may file a petition for
			 review in an appropriate Federal court of appeals.</text>
				</paragraph><paragraph id="H74995EEC06E346978C8DD7DA9C379D8C"><enum>(5)</enum><header>Civil action by
			 the Secretary for injunctive relief</header><text>The Secretary may bring an
			 action for a violation described in paragraph (1) in a district court of the
			 United States to obtain the injunctive relief described in section 7(b).</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HF71AB7F307654720BEF924C4A64D5B98"><enum>(c)</enum><header>Government
			 Accountability Office and Library of Congress</header><text>Notwithstanding any
			 other provision of this section, the Secretary is authorized to enter into
			 agreements with the Librarian of Congress and the Comptroller General of the
			 United States with respect to individuals employed in the Library of Congress
			 and the Government Accountability Office, respectively, to provide for the
			 carrying out of functions of the Secretary under subsection (b) with respect to
			 such individuals.</text>
			</subsection><subsection id="H9F482AA2E68242DABA14578D917F03FF"><enum>(d)</enum><header>Other
			 Employees</header>
				<paragraph id="H00DE4F264FEE4D5EA7CE8BCC5FC800A4"><enum>(1)</enum><header>Employees
			 covered by congressional accountability act of
			 1995</header><text>Notwithstanding any other provision of this section or
			 section 7, the powers, remedies, and procedures provided in the Congressional
			 Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1301">2 U.S.C. 1301 et seq.</external-xref>) to the Board (as defined in
			 section 101 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/2/1301">2 U.S.C. 1301</external-xref>)), or any person, alleging a violation
			 of section 202(a)(1) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/2/1312">2 U.S.C. 1312(a)(1)</external-xref>) shall be the powers,
			 remedies, and procedures this Act provides to that Board, or any person,
			 alleging an unlawful employment practice in violation of this Act against an
			 employee described in section 2(1)(A)(iii).</text>
				</paragraph><paragraph id="H8165600475764DA496D180D6755701E9"><enum>(2)</enum><header>Employees
			 covered by chapter <enum-in-header>5</enum-in-header> of title
			 <enum-in-header>3</enum-in-header>, united states
			 code</header><text>Notwithstanding any other provision of this section or
			 section 7, the powers, remedies, and procedures provided in chapter 5 of title
			 3, United States Code, to the President, the Merit Systems Protection Board, or
			 any person, alleging a violation of section 412(a)(1) of that title, shall be
			 the powers, remedies, and procedures this Act provides to the President, that
			 Board, or any person, respectively, alleging an unlawful employment practice in
			 violation of this Act against an employee described in section
			 2(1)(A)(iv).</text>
				</paragraph><paragraph id="HD0B3B41896D141DB9F50E6B862D0E9CB"><enum>(3)</enum><header>Employees
			 covered by chapter <enum-in-header>63</enum-in-header> of title
			 <enum-in-header>5</enum-in-header>, united states
			 code</header><text>Notwithstanding any other provision of this section or
			 section 7, the powers, remedies, and procedures provided in title 5, United
			 States Code, to an employing agency, provided in chapter 12 of that title to
			 the Merit Systems Protection Board, or provided in that title to any person,
			 alleging a violation of chapter 63 of that title, shall be the powers,
			 remedies, and procedures this Act provides to that agency, that Board, or any
			 person, respectively, alleging an unlawful employment practice in violation of
			 this Act against an employee described in section 2(1)(A)(v).</text>
				</paragraph></subsection></section><section id="H6BA6B6B990CD436A9E477CDD37DDE50"><enum>7.</enum><header>Remedies</header>
			<subsection id="HA2F6EA6184244E23AEB6389D007298"><enum>(a)</enum><header>Administrative
			 Proceedings and Actions for Review</header>
				<paragraph id="H29A413FE5D954478B2124DA0F400CECA"><enum>(1)</enum><header>Interference
			 with exercise of rights</header><text>In an action brought under paragraph (1),
			 (2), or (4) of section 6(b), an employer who violates the provisions of section
			 5(a) (including a violation relating to a right provided under section 3 or 4)
			 shall be subject to a civil penalty of not less than $1000 and not more than
			 $5,000 for each employee who was the subject of such a violation.</text>
				</paragraph><paragraph id="H866FF7AC5AD749328159A3FE5CEB0001"><enum>(2)</enum><header>Retaliation</header><text>In
			 an action brought under paragraph (1), (2), or (4) of section 6(b), if an
			 employer violates section 5(b), the employee who is affected by the violation
			 or the Secretary, as appropriate, may obtain an order awarding such equitable
			 relief as may be appropriate, including employment, reinstatement, promotion,
			 back pay, and a change in the terms or conditions of employment.</text>
				</paragraph></subsection><subsection id="H3194F419AAAC4BC7864FA7AF80E736C9"><enum>(b)</enum><header>Civil action by
			 the Secretary for injunctive relief</header><text>In an action brought under
			 section 6(b)(5), the Secretary may obtain an order—</text>
				<paragraph id="HC74200397C464A6CABBCBE15E50058D6"><enum>(1)</enum><text>restraining
			 violations of section 5 (including a violation relating to a right provided
			 under section 3 or 4); or</text>
				</paragraph><paragraph id="HE9E70CCD78C842D1AA3B2254D86DAE03"><enum>(2)</enum><text>awarding such
			 other equitable relief as may be appropriate, including employment,
			 reinstatement, promotion, back pay, and a change in the terms or conditions of
			 employment.</text>
				</paragraph></subsection></section><section id="H433FACB47C8D4416AE9FE2ED62890D4"><enum>8.</enum><header>Notice</header>
			<subsection id="H12A69A3EA4F64F40A0B2BD008B00D28F"><enum>(a)</enum><header>In
			 general</header><text>Each employer shall post and keep posted, in conspicuous
			 places on the premises of the employer where notices to employees and
			 applicants for employment are customarily posted, a notice, to be prepared or
			 approved by the Secretary (or the appropriate officer specified in section
			 12(a), as applicable), setting forth excerpts from, or summaries of, the
			 pertinent provisions of this Act and information pertaining to the filing of a
			 complaint under section 6(b).</text>
			</subsection><subsection id="H15D0B834591A41269359153BA7C3002B"><enum>(b)</enum><header>Penalty</header><text>Any
			 employer that willfully violates this section may be assessed a civil money
			 penalty not to exceed $500 for each separate offense.</text>
			</subsection></section><section id="H46295F4889A14C2CAC997E9B5229791D"><enum>9.</enum><header>Recordkeeping</header><text display-inline="no-display-inline">Any employer shall make, keep, and preserve
			 records pertaining to compliance with this Act in accordance with regulations
			 issued under section 12.</text>
		</section><section id="H409D0738671D4E50B45D04F1BA05552F"><enum>10.</enum><header>Research,
			 education, and technical assistance program</header>
			<subsection id="H80EEA11FF0564C959BA26E625654215F"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary (and
			 each officer specified in section 12(a), as applicable) shall provide
			 information and technical assistance to employers, labor organizations, and the
			 general public concerning compliance with this Act.</text>
			</subsection><subsection id="HBD872355D1A1451F00D0A609F1C71920"><enum>(b)</enum><header>Program</header><text display-inline="yes-display-inline">In order to achieve the objectives of this
			 Act, the Secretary (and each officer specified in section 12(a), as applicable)
			 shall carry on a continuing program of research, education, and technical
			 assistance, including—</text>
				<paragraph id="HE6521B46B4744248984BDB82A447D452"><enum>(1)</enum><text>conducting and
			 promoting research with the intent of encouraging flexibility in work terms and
			 conditions;</text>
				</paragraph><paragraph id="HAC0D6BECE25F45F0833367003796F922"><enum>(2)</enum><text>publishing and
			 otherwise making available to employers, labor organizations, professional
			 associations, educational institutions, the various communication media, and
			 the general public the findings of studies and other materials for promoting
			 compliance with this Act;</text>
				</paragraph><paragraph id="H3E9BB40D918645EFB2BAC53509D9E95B"><enum>(3)</enum><text>sponsoring and
			 assisting State and community informational and educational programs;
			 and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA8AF89FF866849BEAC1ED31365CF9718"><enum>(4)</enum><text>providing
			 technical assistance to employers, labor organizations, professional
			 associations, and other interested persons on means of achieving and
			 maintaining compliance with the provisions of this Act.</text>
				</paragraph></subsection></section><section id="H92F8BBD9C4E84B88B47B001000BF9D24"><enum>11.</enum><header>Rights retained
			 by employees</header><text display-inline="no-display-inline">Nothing in this
			 Act shall be considered to diminish the rights, privileges, or remedies of any
			 employee under any Federal or State law, or under a collective bargaining
			 agreement.</text>
		</section><section id="HC8011BBFC7F44310A88BB33800118853"><enum>12.</enum><header>Application of
			 provisions</header>
			<subsection commented="no" id="HFC7FBE3BEBA443358D25E787139CD307"><enum>(a)</enum><header>Application to
			 classes of employees</header><text>Not later than 120 days after the date of
			 enactment of this Act—</text>
				<paragraph id="H0B4D2DE6071344F49D1CCE985E3FC530"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HEF329A6D0195468F944942511D00F7C9"><enum>(A)</enum><text>except as provided in
			 subparagraph (B), the Secretary shall issue such regulations as are necessary
			 to carry out this Act with respect to employees described in clause (i) or (ii)
			 of section 2(1)(A); and</text>
					</subparagraph><subparagraph id="HFA103FA4901849C3B156C34E31ED60CC" indent="up1"><enum>(B)</enum><text>the Comptroller General of the United
			 States and the Librarian of Congress shall issue such regulations as are
			 necessary to carry out this Act with respect to employees of the Government
			 Accountability Office and the Library of Congress, respectively;</text>
					</subparagraph></paragraph><paragraph id="HDD690DC8D424479F9128C31B82C1E7B9"><enum>(2)</enum><text>the Board of
			 Directors of the Office of Compliance shall issue (in accordance with section
			 304 of the Congressional Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1384">2 U.S.C. 1384</external-xref>)) such
			 regulations as are necessary to carry out this Act with respect to employees
			 described in section 2(1)(A)(iii);</text>
				</paragraph><paragraph id="H3042AE84450943DCB2DD421148BEDE76"><enum>(3)</enum><text>the President (or
			 the designee of the President) shall issue such regulations as are necessary to
			 carry out this Act with respect to employees described in section 2(1)(A)(iv);
			 and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF2B83BD949644BA9A373B6BF6C79A1C3"><enum>(4)</enum><text>the Director of
			 the Office of Personnel Management shall issue such regulations as are
			 necessary to carry out this Act with respect to employees described in section
			 2(1)(A)(v).</text>
				</paragraph></subsection><subsection id="H32AE21F2ED2F4196839785C53CE0B668"><enum>(b)</enum><header>Transitional
			 Provisions</header><text>A regulation issued under subsection (a) may contain
			 such transitional provisions as the Secretary determines to be appropriate in
			 connection with the application of any of the provisions of this Act.</text>
			</subsection></section><section id="H3195805D74D84BF8B3D5476136AFA89D"><enum>13.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated to carry out this Act such sums as may be
			 necessary for fiscal year 2008 and each subsequent fiscal year.</text>
		</section><section id="H9A948C6D9E96495CB08FE6B698F70019"><enum>14.</enum><header>Effective
			 date</header>
			<subsection id="H79699442664D41DAAF1FFFB32D55F1A7"><enum>(a)</enum><header>In
			 general</header><text>This Act takes effect 6 months after the date of
			 enactment of this Act, except as provided in subsection (b).</text>
			</subsection><subsection id="H2F5FFA58D1FE466E8D1D70A2C674215D"><enum>(b)</enum><header>Collective
			 bargaining agreements</header><text>In the case of a collective bargaining
			 agreement in effect on the effective date prescribed by subsection (a), this
			 Act shall apply on the earlier of—</text>
				<paragraph id="H01B3354B8505489A832E447CFD5ED0CC"><enum>(1)</enum><text>the date of the
			 termination of such agreement; or</text>
				</paragraph><paragraph id="H3F471B0C85034DFEA77EAB17577C8944"><enum>(2)</enum><text>the date that
			 occurs 12 months after the date of enactment of this Act.</text>
