		<section id="H6C342F7872C345AE90B8EBEB1B5E13C5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Reforming an Entitlement through
			 Premium Adjustments based on Income Resources (REPAIR) Act of
			 2007</short-title></quote>.</text>
		</section><section id="H0DBE677579384A619CF659CAB050FAB8"><enum>2.</enum><header>Income-related
			 reduction in part D premium subsidy</header>
			<subsection id="H103DBC7F2075451BB130A7AF95D9E100"><enum>(a)</enum><header>Income-related
			 reduction in part D premium subsidy</header>
				<paragraph id="H612FFD175207460485F6E9BD2976FB4F"><enum>(1)</enum><header>In
			 general</header><text>Section 1860D–13(a) of the Social Security Act (42 U.S.C.
			 1395w–113(a)) is amended by adding at the end the following new
			 paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="HE657C1A2F0E24FF3B3B841956B58774F" style="OLC">
						<paragraph id="H1FF751A770314C0CB2332E8FBAC023F1"><enum>(7)</enum><header>Reduction in
				premium subsidy based on income</header>
							<subparagraph id="HD67B25B381DA43758182CE641AC56F5"><enum>(A)</enum><header>In
				general</header><text>In the case of an individual whose modified adjusted
				gross income exceeds the threshold amount applicable under paragraph (2) of
				section 1839(i) (including application of paragraph (5) of such section) for
				the calendar year, the monthly amount of the premium subsidy applicable to the
				premium under this section for a month after December 2008 shall be reduced
				(and the monthly beneficiary premium shall be increased) by the monthly
				adjustment amount specified in subparagraph (B).</text>
							</subparagraph><subparagraph id="H72EDF1F1E9DE44EE88CD39AE1813231B"><enum>(B)</enum><header>Monthly
				adjustment amount</header><text>The monthly adjustment amount specified in this
				subparagraph for an individual for a month in a year is equal to the product
				of—</text>
								<clause id="HF8B73245E10A49D3A7888F2B77495257"><enum>(i)</enum><text>the quotient
				obtained by dividing—</text>
									<subclause id="HA55CDF2AF14E473F8D18EFECF4FB721"><enum>(I)</enum><text>the applicable
				percentage determined under paragraph (3)(C) of section 1839(i) (including
				application of paragraph (5) of such section) for the individual for the
				calendar year reduced by 25.5 percent; by</text>
									</subclause><subclause id="HF472865328CF4567B55612E700C7ABE3"><enum>(II)</enum><text>25.5 percent;
				and</text>
									</subclause></clause><clause id="H545267306A5147C4A20033F84EA90700"><enum>(ii)</enum><text>the base
				beneficiary premium (as computed under paragraph (2)).</text>
								</clause></subparagraph><subparagraph id="H9B86EB9E13454721B410D7AC02FBCF4B"><enum>(C)</enum><header>Modified
				adjusted gross income</header><text>For purposes of this paragraph, the term
				<term>modified adjusted gross income</term> has the meaning given such term in
				subparagraph (A) of section 1839(i)(4), determined for the taxable year
				applicable under subparagraphs (B) and (C) of such section.</text>
							</subparagraph><subparagraph commented="no" id="H45BCFE299EFB446AB6D34BFD22557145"><enum>(D)</enum><header>Determination by
				commissioner of social security</header><text>The Commissioner of Social
				Security shall make any determination necessary to carry out the income-related
				reduction in premium subsidy under this paragraph.</text>
							</subparagraph><subparagraph commented="no" id="H526967DAC4BA4C989D9ED98D3595B5FA"><enum>(E)</enum><header>Procedures to
				assure correct income-related reduction in premium subsidy</header>
								<clause id="H7D673725459B41749340CE3964F89844"><enum>(i)</enum><header>Disclosure of
				base beneficiary premium</header><text>Not later than September 15 of each year
				beginning with 2008, the Secretary shall disclose to the Commissioner of Social
				Security the amount of the base beneficiary premium (as computed under
				paragraph (2)) for the purpose of carrying out the income-related reduction in
				premium subsidy under this paragraph with respect to the following year.</text>
								</clause><clause id="H29B3E755273449A8A9203E1D925DBFF8"><enum>(ii)</enum><header>Additional
				disclosure</header><text>Not later than October 15 of each year beginning with
				2008, the Secretary shall disclose to the Commissioner of Social Security the
				following information for the purpose of carrying out the income-related
				reduction in premium subsidy under this paragraph with respect to the following
				year:</text>
									<subclause id="H1A1A5041FC8F4EC5BC88FF8DC536CCF2"><enum>(I)</enum><text>The modified
				adjusted gross income threshold applicable under paragraph (2) of section
				1839(i) (including application of paragraph (5) of such section).</text>
									</subclause><subclause id="HF88265AE9F174A019F34C442001CBB61"><enum>(II)</enum><text>The applicable
				percentage determined under paragraph (3)(C) of section 1839(i) (including
				application of paragraph (5) of such section).</text>
									</subclause><subclause id="HE35AD9E329A540B6A2BA1E4B038DE07D"><enum>(III)</enum><text>The monthly
				adjustment amount specified in subparagraph (B).</text>
									</subclause><subclause id="H1216150DA4654D7DB72C047100DE5FA"><enum>(IV)</enum><text>Any other
				information the Commissioner of Social Security determines necessary to carry
				out the income-related reduction in premium subsidy under this
				paragraph.</text>
									</subclause></clause></subparagraph><subparagraph commented="no" id="H3BF742DFAC624EF882FCFC1E2920BCB6"><enum>(F)</enum><header>Rule of
				construction</header><text>The formula used to determine the monthly adjustment
				amount specified under subparagraph (B) shall only be used for the purpose of
				determining such monthly adjustment amount under such
				subparagraph.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HC29963805F254AF38FEAD653F79361C1"><enum>(2)</enum><header>Collection of
			 monthly adjustment amount</header><text>Section 1860D–13(c) of the Social
			 Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-113">42 U.S.C. 1395w–113(c)</external-xref>) is amended—</text>
					<subparagraph id="HA227C3BA567C4684A2627C4E8830BA41"><enum>(A)</enum><text>in paragraph (1),
			 by striking <quote>(2) and (3)</quote> and inserting <quote>(2), (3), and
			 (4)</quote>; and</text>
					</subparagraph><subparagraph id="H9DAE77CC78054643ABACCA0A724E3D4"><enum>(B)</enum><text>by adding at the
			 end the following new paragraph:</text>
						<quoted-block display-inline="no-display-inline" id="H7F8C9F0711674E4791506BCEEAC3F00" style="OLC">
							<paragraph id="H895B714C96A04079A484046C658C1D1E"><enum>(4)</enum><header>Collection of
				monthly adjustment amount</header>
								<subparagraph id="HABB471D518B044CD8D861E6BE3A40344"><enum>(A)</enum><header>In
				general</header><text>Notwithstanding any other provision of this subsection or
				section 1854(d)(2), subject to subparagraph (B), the amount of the
				income-related reduction in premium subsidy for an individual for a month (as
				determined under subsection (a)(7)) shall be paid through withholding from
				benefit payments in the manner provided under section 1840.</text>
								</subparagraph><subparagraph id="HE7DBC15911AD4F2CAE6C90F600EF5DF"><enum>(B)</enum><header>Agreements</header><text>In
				the case where the monthly benefit payments of an individual that are withheld
				under subparagraph (A) are insufficient to pay the amount described in such
				subparagraph, the Commissioner of Social Security shall enter into agreements
				with the Secretary, the Director of the Office of Personnel Management, and the
				Railroad Retirement Board as necessary in order to allow other agencies to
				collect the amount described in subparagraph (A) that was not withheld under
				such
				subparagraph.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="H4E6C3FCB1596484E933E9362D01314E3"><enum>(b)</enum><header>Conforming
			 amendments</header>
				<paragraph id="H9F60B95D107B4623943E565E6474AAE"><enum>(1)</enum><header>Medicare</header><text>Part
			 D of title XVIII of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-101">42 U.S.C. 1395w–101 et seq.</external-xref>) is
			 amended—</text>
					<subparagraph id="HEE94EAA12F854481B7F22453DB9C9500"><enum>(A)</enum><text>in section
			 1860D–13(a)(1)—</text>
						<clause id="H8DF0E193F15242F393D4C0BBF74244EF"><enum>(i)</enum><text>by
			 redesignating subparagraph (F) as subparagraph (G);</text>
						</clause><clause id="H1F43368E16F14868008FCF30E05B2024"><enum>(ii)</enum><text>in
			 subparagraph (G), as redesignated by clause (i), by striking <quote>(D) and
			 (E)</quote> and inserting <quote>(D), (E), and (F)</quote>; and</text>
						</clause><clause id="H7ADB40084EAB4362804642853C4300C7"><enum>(iii)</enum><text>by
			 inserting after subparagraph (E) the following new subparagraph:</text>
							<quoted-block display-inline="no-display-inline" id="H4AAAB67B6ADA4062A2025BF4342E89EA" style="OLC">
								<subparagraph id="H752B03870B344D48BD242687EE10005D"><enum>(F)</enum><header>Increase based
				on income</header><text>The monthly beneficiary premium shall be increased
				pursuant to paragraph (7).</text>
								</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</clause></subparagraph><subparagraph id="HB41446FB6D174CA0BDE9BC60CF426E00"><enum>(B)</enum><text>in section
			 1860D–15(a)(1)(B), by striking <quote>paragraph (1)(B)</quote> and inserting
			 <quote>paragraphs (1)(B) and (1)(F)</quote>.</text>
					</subparagraph></paragraph><paragraph id="H79AA8E141BBB48A5A5523C627EBCC8DD"><enum>(2)</enum><header>Internal Revenue
			 Code</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/6103">Section 6103(l)(20)</external-xref> of the Internal Revenue Code of 1986
			 (relating to disclosure of return information to carry out Medicare part B
			 premium subsidy adjustment) is amended—</text>
					<subparagraph id="H0862A6B9E6214AFCBBEEA6D76DDAED8B"><enum>(A)</enum><text>in the heading, by
			 striking <quote><header-in-text level="paragraph" style="OLC">part B premium
			 subsidy adjustment</header-in-text></quote> and inserting
			 <quote><header-in-text level="paragraph" style="OLC">parts B and D premium
			 subsidy adjustments</header-in-text></quote>;</text>
					</subparagraph><subparagraph id="HC7AAF6E38E81452E83E4D9566752B31D"><enum>(B)</enum><text>in subparagraph
			 (A)—</text>
						<clause id="H864B2B46AE974CCFABBF956C0003A0F"><enum>(i)</enum><text>in
			 the matter preceding clause (i), by inserting <quote>or 1860D–13(a)(7)</quote>
			 after <quote>1839(i)</quote>; and</text>
						</clause><clause id="H336EB525D06B436FA5D7A96EBC41B3EC"><enum>(ii)</enum><text>in
			 clause (vii), by inserting after <quote>subsection (i) of such section</quote>
			 the following: <quote>or under section 1860D–13(a)(7) of such
			 Act</quote>;</text>
						</clause></subparagraph><subparagraph id="H2B428DA1628745BE8277D1AD8B5108C1"><enum>(C)</enum><text>in subparagraph
			 (B)—</text>
						<clause id="H2A44C1AE0E3647ACBEA2AC54F0224BB6"><enum>(i)</enum><text>by
			 inserting <quote>or such section 1860D–13(a)(7)</quote> before the period at
			 the end;</text>
						</clause><clause id="H923F0872F3354E58880000DA009964F"><enum>(ii)</enum><text>as
			 amended by clause (i), by inserting <quote>or for the purpose of resolving tax
			 payer appeals with respect to any such premium adjustment</quote> before the
			 period at the end; and</text>
						</clause><clause id="H729904E2BED940F68602FE8511FC2595"><enum>(iii)</enum><text>by
			 adding at the end the following new sentence: <quote>Officers, employees, and
			 contractors of the Social Security Administration may disclose such return
			 information to officers, employees, and contractors of the Department of Health
			 and Human Services, the Office of Personnel Management, the Railroad Retirement
			 Board, the Department of Justice, and the courts of the United States to the
			 extent necessary to carry out the purposes described in the preceding
			 sentence.</quote>; and</text>
						</clause></subparagraph><subparagraph id="HDA748AA0B2004C1EB850428000C52CC8"><enum>(D)</enum><text>by adding at the
			 end the following new subparagraph:</text>
						<quoted-block display-inline="no-display-inline" id="HA65DFC8BD5A54507AE4B7F5F831E3BCA" style="OLC">
							<subparagraph id="H25FE07EB01E142DBBE664C2BBFFB1F02"><enum>(C)</enum><header>Timing of
				disclosure</header><text>Return information shall be disclosed to officers,
				employees, and contractors of the Social Security Administration under
				subparagraph (A) not later than the date that is 90 days prior to the date on
				which the taxpayer first becomes entitled to benefits under part A of title
				XVIII of the Social Security Act or eligible to enroll for benefits under part
				B of such
				title.</text>
							</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection></section></legis-body>
