		<official-title>To amend the Homeland Security Act of 2002 to provide for
		  additional availability of testing facilities and equipment and to extend the
		  authority of the Secretary of Homeland Security to carry out certain research

		<section display-inline="no-display-inline" id="HBF7CCB7CC6A142678F4D420323B51064" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Homeland Security Technology
			 Advancement Act</short-title></quote>.</text>
		</section><section id="HA8262A4F31F948BD8FF610F3773C8CA7"><enum>2.</enum><header>Extension of
			 authority of Secretary of Homeland Security to carry out certain research and
			 development projects</header><text display-inline="no-display-inline">Section
			 831(a) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/391">6 U.S.C. 391(a)</external-xref>) is
			 amended—</text>
			<paragraph id="H1610C434AA144339A7D67EA1E374C804"><enum>(1)</enum><text>by striking
			 <quote>5-year</quote> and inserting <quote>10-year</quote>; and</text>
			</paragraph><paragraph id="HEDEC4FCD9A09466792681EF400B1E584"><enum>(2)</enum><text>by striking
			 <quote>the Secretary may carry out a pilot program under which</quote>.</text>
			</paragraph></section><section id="H6F85C96C8ED04F92B634F822D7A60235" section-type="subsequent-section"><enum>3.</enum><header>Availability of
			 testing facilities and equipment</header>
			<subsection id="H40023BBBE6254CC6B2F614E602027FEF"><enum>(a)</enum><header>Amendment</header><text>Title
			 III of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/181">6 U.S.C. 181 et seq.</external-xref>) is amended by
			 adding at the end the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="H8A0AEAC14B834ACAAFE83F4983E5BC6B" style="OLC">
					<section display-inline="no-display-inline" id="H54397CCCE513471B8EC481E6C44E35D0" section-type="subsequent-section"><enum>316.</enum><header>Availability of
				testing facilities and equipment</header>
						<subsection id="HE9BEE62E596F41A2A39757EC00D0F719"><enum>(a)</enum><header>Authority</header><text>The
				Under Secretary for Science and Technology or his designee may make available
				to any person or entity, for an appropriate fee, the services of any Department
				of Homeland Security owned and operated center, or other testing facility for
				the testing of materials, equipment, models, computer software, and other items
				designed to advance the homeland security mission.</text>
						</subsection><subsection id="H69204053694D4EA2B8B3FB42ECA44FAC"><enum>(b)</enum><header>Interference
				with federal programs</header><text>The Under Secretary for Science and
				Technology shall ensure that the testing of materiel and other items not owned
				by the Government shall not cause government personnel or other government
				resources to be diverted from scheduled tests of Government materiel or
				otherwise interfere with Government mission requirements.</text>
						</subsection><subsection id="H85E6985F24C243C2AA9661DE3FB1B86"><enum>(c)</enum><header>Confidentiality
				of test results</header><text>The results of tests performed with services made
				available under subsection (a) and any associated data provided by the person
				or entity for the conduct of such tests are trade secrets or commercial or
				financial information that is privileged or confidential within the meaning of
				<external-xref legal-doc="usc" parsable-cite="usc/5/552b">section 552b(4)</external-xref> of title 5, United States Code, and may not be disclosed
				outside the Federal Government without the consent of the person or entity for
				whom the tests are performed.</text>
						</subsection><subsection id="H8A03CD5FEFFA4B92B033203FB500F800"><enum>(d)</enum><header>Fees</header><text>The
				fees for exercising the authorities under subsection (a) may not exceed the
				amount necessary to recoup the direct and indirect costs involved, such as
				direct costs of utilities, contractor support, and salaries of personnel that
				are incurred by the United States to provide for the testing.</text>
						</subsection><subsection id="HDD101DDE7CB546F98D2C7B5E09982875"><enum>(e)</enum><header>Use of
				fees</header><text>The fees for exercising the authorities under subsection (a)
				shall be credited to the appropriations or other funds of the Directorate of
				Science and Technology.</text>
						</subsection><subsection id="H4AB3EE61588349889E4E43DF6C15278E"><enum>(f)</enum><header>Operational
				Plan</header><text display-inline="yes-display-inline">Not later than 3 months
				after the date of enactment of this section, the Under Secretary for Science
				and Technology shall submit to Congress a report detailing a plan for operating
				a program under the authority provided to the Under Secretary in subsection
				(a). The plan shall contain—</text>
							<paragraph id="HE75037B85BC84DD7B698A2A6C33F86A2"><enum>(1)</enum><text>a list of the
				facilities and equipment that could be made available to outside users;</text>
							</paragraph><paragraph id="H496EA5DDE53A424691E177D8ED48E4B9"><enum>(2)</enum><text>a five-year budget
				plan, including costs for facility construction, staff training, contract and
				legal fees, equipment maintenance and operation, and any incidental costs
				associated with the program;</text>
							</paragraph><paragraph id="H123792719D5141C1B4A7E46E2098A9FB"><enum>(3)</enum><text>a five-year
				estimate of the number of users and fees to be collected;</text>
							</paragraph><paragraph id="H043505A8C37A4F40A3DFD8739598BCFC"><enum>(4)</enum><text>a list of criteria
				for selecting the private sector users from the pool of applicants, including
				any special requirements for foreign applicants; and</text>
							</paragraph><paragraph id="HF45177E375BC45D6BCA11C66C839DA8"><enum>(5)</enum><text>an assessment of
				the impact this program will have on the ability of a center or testing
				facility to meet its obligations under previously existing Federal
				programs.</text>
							</paragraph></subsection><subsection id="HB0A007417EC846D8B1418CCE6BF300BB"><enum>(g)</enum><header>Report to
				Congress</header><text display-inline="yes-display-inline">The Under Secretary
				for Science and Technology shall submit to Congress annually a report
				containing a list of the centers and testing facilities that have collected
				fees under this section, the amount of fees collected, a brief description of
				each partnership formed under this section, and the purpose for which the
				testing was conducted.</text>
						</subsection><subsection id="HC7C526238FD249D79595595CA57EFAB7"><enum>(h)</enum><header>GAO
				Report</header><text display-inline="yes-display-inline">Not later than 2 years
				after the date of enactment of this section, the Comptroller General shall
				provide to Congress an assessment of the implementation of the program under
				this section.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H593B267FFD0248D2B2AEFBD4CC9856E5"><enum>(b)</enum><header>Table of
			 contents</header><text>The table of contents for the Homeland Security Act of
			 2002 is amended by inserting after the item relating to section 315 the
			 following new item:</text>
