		<official-title>To amend title 38, United States Code, to provide for the
		  payment of a monthly stipend to the surviving parents (known as <quote>Gold
		  Star parents</quote>) of members of the Armed Forces who die during a period of
		  war.</official-title>

		<section id="HF67D3BADE2B048DC8FDE31994DF73D1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Gold Star Parents Annuity Act of
			 2007</short-title></quote>.</text>
		</section><section id="HDE928A51D2D54A3CAF0655DB821088C9"><enum>2.</enum><header>Special pension
			 for Gold Star parents</header>
			<subsection id="HF2C7B26C77474D4AB239E5DD9D388CA8"><enum>(a)</enum><header>Special
			 Pension</header>
				<paragraph id="H59E46A1760C74FF2A45C459919177486"><enum>(1)</enum><header>In
			 general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/15">Chapter 15</external-xref> of title 38, United States Code, is amended by
			 adding at the end the following new subchapter:</text>
					<quoted-block id="HCDFBDA88460D4136A5742269B7F06B92" style="USC">
						<subchapter id="H40D95BA04ED242C0B8B4A24F2726BA01"><enum>V</enum><header>Special pension
				for Gold Star parents</header>
							<section id="H54E709ECCE9B490E886E2C27DB00ED48"><enum>1571.</enum><header>Gold Star
				parents</header>
								<subsection id="HD0448DF3FD4549BC860079F230FC3282"><enum>(a)</enum><header>Monthly
				payment</header><text>The Secretary shall pay monthly to each person who has
				received a gold star lapel button under <external-xref legal-doc="usc" parsable-cite="usc/10/1126">section 1126</external-xref> of title 10 as a parent of
				a person who died in a manner described in subsection (a) of that section a
				special pension in an amount determined under subsection (b).</text>
								</subsection><subsection id="H66615517DB44454B86EEC913F0080AB"><enum>(b)</enum><header>Amount</header><text>The
				amount of special pension payable under this section with respect to the death
				of any person shall be $125 per month. In any case in which there is more than
				one parent eligible for special pension under this section with respect to the
				death of a person, the Secretary shall divide the payment equally among those
				eligible parents.</text>
								</subsection><subsection id="H9A0B52A4890046ACA331D769E72BFBE9"><enum>(c)</enum><header>Relationship to
				other laws</header><text>The receipt of special pension under this section
				shall not deprive any person of any other pension or other benefit, right, or
				privilege to which such person is or may hereafter be entitled under any
				existing or subsequent law. Special pension under this section shall be paid in
				addition to all other payments under laws of the United States.</text>
								</subsection><subsection id="H8FC73AC6C926453AAE3200AE9BDAA85F"><enum>(d)</enum><header>Treatment of
				special pension</header><text>Special pension under this section shall not be
				subject to any attachment, execution, levy, tax lien, or detention under any
				process whatsoever.</text>
								</subsection><subsection id="H4ADED981A3F949069140ED19D30E79"><enum>(e)</enum><header>Definition of
				parent</header><text>For purposes of this section, the term <term>parent</term>
				has the meaning provided in section 1126(d)(2) of title
				10.</text>
								</subsection></section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H2471A622EAFD4F83895EC041523081AD"><enum>(2)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of chapter 15 of
			 such title is amended by adding at the end the following:</text>

						</toc>
						<after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H98BB62AE531348DB93FAB2F68383D040"><enum>(b)</enum><header>Effective
			 date</header>
				<paragraph id="H935E25CA95D04816A1F032871DC7E347"><enum>(1)</enum><header>In
			 general</header><text><external-xref legal-doc="usc" parsable-cite="usc/38/1571">Section 1571</external-xref> of title 38, United States Code, as added by
			 subsection (a), shall take effect on October 1, 2007, and apply with respect to
			 deaths occurring on or after that date.</text>
				</paragraph><paragraph id="H37FAD1C7533E4DD79B76C05900ED8F04"><enum>(2)</enum><header>Retroactive
			 payments</header><text>Not later than 90 days after the date of the enactment
			 of this Act, the Secretary of Veterans Affairs shall pay to any person who is
			 entitled to a pension under that section by reason of the death of an
			 individual during the period beginning October 1, 2007, and ending on the date
			 of the enactment of this Act, an amount equal to the total amount of pension to
			 which that person is entitled under that section for that period.</text>
